Former Rep Scott Mcinnis has joined the Hasan Family Foundation as a senior

fellow it was announced Wednesday

McInnis a Colorado Republican retired from the 3rd Congressional District and

will work on natural resource issues for the Pueblo-based foundation which wasestablished by Dr Malik and Seeme Hasan

When Rep Mcinnis retired we were concerned that Colorado would lose a strong

voice on water and natural resource issues so we asked him to serve as a senior

fellow with the foundation said Mrs Hasan who is chairwoman of the foundation

Because the foundation is committed to promoting education we want Mr

McInnis to be available to any group wanting to hear his expertise on these issues

As a senior fellow Mcinnis will make speaking appearances around the state as wellas write about water and natural resource issues

Mcinnis said he was honored to be named to the two-year position of being a senior

fellow 1 have great respect for the Hasan Family Foundation and its mission to

educate the public on the importance ofbalanced natural resources utilization in

Colorado and the West he said

McInnis is the former chairman of the House Subcommittee on Forests and Forest

Health and wrote the Healthy Forest Restoration Act which President Bush signed

last year He also played a leading role in the establishment of the Great Sand Dunes

National Park

He currently is a partner in the law firm ofHogan and Hartson and serves on several

corporate boards including KSL Resorts and ING

In addition there were never discussions nor any knowledge by the Foundation that Mr ~ l c I n n i s was working with aresearch advisor If ndeed Mr McInnis was working with a research advisor it was never brought to our attentionnor a U ~ l o r i z e d The work that the Foundation hired Mr McInnis to do was to be done solely by ~ l r Mcinnis and oot inconcert with anyone else

The Hasan Family Foundation takes the issue of plagiarism extremely seriOUSly At no time was it brought to ouraltention that Mr McInnis used information not Cited or unethically lIsed work that was not his own All work wasrepresented to be o11glnal and final We will conduct an independent internal investigation and if the allegations areproven to be true we will demand Mr McInnis retum all monies paid to him by the Foundation

Although GOP gubernatorial candidate Scott Mcinnis presented his

Musings on Water for publication as original works portions are

identical and nearly identical to an essay on water written 20 years

earlier by now-Colorado Supreme Court Justice Gregory J Hobbs

A Clemson University expert who reviewed Mcinnis work next to

Hobbs essay called it a clear case of plagiarism of both words and

ideas

Mcinnis water articles were a required part of his two-year fellowship

at the Hasan Family Foundation In 2005 and 2006 The former

congressman Who left office in 2004 was paid $300000 to do speaking engagements and research and

write a monthly article on water issues that can be distributed to media and organizations as

well as be available on the Internet

EXTRAS Totaling 150 pages over 23 installments the articles discussing

stale water policy are devoid of footnotes endnotes or other forms

pages that are nearly reprinted verbatim from Hobbs earlier work

The justice reviewed examples of his work and Mcinnis essays provided by The Denver Post and

released a statement through court spokesman Rob McCallum

There are definite similarities Hobbs said I would expect there would be some attribution

Mcinnis a lawyer and partner at Hogan Lovells refused to comment

His spokesman Sean Duffy said Mcinnis acknowledged the similarities but blamed a researcher

Rolly Fischer a Glenwood Springs engineer who worked at the Colorado River Water Conservation

District Duffy said was the one who handled the portions that used Hobbs work without attribution

It shouldve been attributed properly and it was not Duffy said (Mcinnis) relied on the research and

expertise of Fischer

Fischer did not ratum calls late Monday His name appears nowhere on the work Mcinnis submitted as his

Copies of his work provided to The Post by the Mcinnis campaign were stamped DRAFT by a campaign

lawyer but the campaign acknowledged that the newspapers copies were the final versions Mcinnis

submitted to the Hasan Family Foundation as part of his fellowship

Deeply disappointed

In a phone interview Monday night Dr Malik Hasan said he hired MCinnis as a fellow because of his work

on the House Natural Resources Commillee and his expertise on water issues

He said he expected it would be a full- or substantlal-tlme job because the project included educating the

public on Colorado water uses and how the state could be more diligent in protecting fts rivers

But soon after he started his fellowship Mcinnis took a Job at Hogan amp Hartson (now Hogan Lovells)

leaving lillie time for the project Hasan said

Speaking only for h i m s e ~ and not for the foundation board of which he is a member Hasan said he was

deeply disappOinted by the quantity and quality of Mcinnis work

I am doubly disapPOinted since learning of the plagiarism he said Im going to suggest (Mcinnis) return

a substantial amount of the money to the foundation

The chairwoman of the foundation released a statement late Monday night

In light of he accusations against Scott Mcinnis regarding plagiarism of articles to the Hasan Family

Foundation I am shocked angry and disappointed the statement from Seeme Hasan said Any work

related to the fellowship that Mr Mcinnis submitted was always represented as final At no time

whatsoever did Mr MCinnis communicate that any of the work were rough drafts Any representation that

they were submitted to the Foundation as rough drafts is absolutely incorrect

In addition there were never discussions nor any knowledge by the Foundation that Mr Mcinnis was

working with a research advisor The work that the Foundation hired Mr Mcinnis to do was to be done

solely by Mr Mcinnis and not in concert with anyone else

The Hasan Family Foundation takes the issue of plagiarism extremely seriously At no time was it brought

to our attention that Mr Mcinnis used Information not cHed or unethically used work thai was not his own

All work was represented 10 be original and final We will conduct an independent internal investigation

and nthe allegations are proven to be true we will demand Mr Mcinnis return all monies paid to him by

the Foundation

Mcinnis articles were not posted to the foundations website until he began his run for governor and

media inquired about what he did to earn $300000

Duffy said thai when he submllled each installment of his musings Mcinnis did not intend the articles to be

published as submitted by him He expected to edit them when the foundation decided to publish

In 2005 Mcinnis wrote a memo to Seeme Hasan the chairwoman of the foundation updating her on his

fellowship program Noting his series of articles Mcinnis said All the articles are original and not reprinted

from any other source

At the end of his fellowship he wrote Seeme Hasan a memo dated Feb 102007 saying the foundation

had in its custody the final form of the series

I am very pleased with the articles and am confident thai they will service the public Interesl for some time

as well-researched easy-read and on-point articles

Hobbs essay on Ihe Green Mountain reservoir addressed the intricaCies of a proposed water exchange

project that involved the reservOir the ColoradoBig Thompson Project and Denver MCinnis makes

reference to the years of history surrounding the reservoir in a number of articles

At times he uses identical complex phrases also employed by HObbs such as constant vigilance and

key 10 a complex interlOCk And entire sentences - even paragraphs - are identical but for a synonym

or two and tense change

Same words Ideas

Teresa Fishman director of Ihe Center for Academic Integrity at Clemson University said plagiarism

comes in two forms ideas and words

In this case It looks like plagiarism of bolh - words and ideas lifted from an original source said

Fishman who compared Hobbs work with that of Mcinnis at the request of The Post She said that if

Mcinnis were her student she would give him an F and report him to the academic dishonesty council

For instance at the end of Hobbs 3D-page essay he writes It is said that Wayne Aspinall shortly before

his death cautioned western Colorado water leaders against giving up Green Mountain Reservoir the key

to the Colorado River which the Western Slope Protective ASSOCiation fashioned forty-six years ago

Hasan said his wife in her capacity as the foundations chairwoman wrote hirn a very nice

letter saying tilis Is what the foundation expected to 111m to do and baslcally telling Ilim tllat l1e

needed to do more

in 2006 when it carne time to consider renewing Mcinnis fellowship Hasan said th e former

congressman job performance made the foundations deCISion an ellsy one

Earlier this year when press inquiries raised questions about the work r-1cInnls did for the

foundation Hasan said his wife approachecl tlesse and suggested It was up to Mcinnis not the

foundation to set the record straight

She said to bim that there are problems here Hasan said Rather than tile foundation comlnfl

in and clarifying It would be better if Scott Jut out a statement Indicating what l1e was

supposed to do and what he did and what he couldn1 do because he was too busy Hasan

said no one heard back from McInnis or his representatives which is why he wanted to go

public with his concerns on ~ l o n d a y

Foundation responds harshly to questionable essay by

GLENWOOD SPRINGS - Long-time local resident Rolly Fischer on Tuesday declined to say much about hisinvolvement in a research paper that gubernatorial candidate and former Congressman Scott Mcinnis wrote to

meet a fellowship deadline

Scotts responsible for stated Fisher an engineer who worked for the Colorado River Water Conservationfor when asked whether he was responsible fo r articles attributed to Mcinnis

Beyond that Fisher said flatly I have nothing to say

Mcinnis a Glenwood Springs native who is seeking the Republican nomination to become Colorados nextgovernor was awarded a fellowship in 2005 and 2006 by the Hasan Family Foundation a Pueblo-basedorganization shortly after he retired from Congress

The fellowship included a payment of $300000 for speaking engagements and to research and write a monthlyarticle on state water issues according to a story in the July 13 Denver Post

But shortly after getting the fellowship according to the Post Mcinnis got a job with the Denver law firm ofHogan amp Hartson leaving him pressed for time to finish the fellowship articles

At some pOint according to the Post Fisher got involved although his name does not appear anywhere in thedocuments

Numerous passages in the articles which reportedly totaled more than 150 pages in 23 installments appearedto either exactly replicate or closely mirror passages from a 1984 a essay by now-Colorado Supreme CourtJustice Gregory J Hobbs

The Denver Post reported that a Mcinnis aide Sean Duffy told a reporter that Fischer was the one whohandled the portions that used Hobbs work without attribution

Duffy who could not be reached for comment also is quoted as saying the articles were not intended forpublication without editing

Mcinnis was quoted by 9NEWS as calling the charges a nonissue

The Mcinnis campaign late Tuesday issued a statement about the furor in which the candidate acknowledgedhiring Fischer to help with the articles and admitting that it has now become clear that much of the researchwas in fact taken from other source material without proper attribution While I do not believe that this was adeliberate act i t was a serious mistake I should have been more vigilant in my review of research materialRolly submitted

In a statement from the Hasan Family Foundation chairwoman Seeme Hasan said of the accusations againstMcinnis I am shocked angry and disappointed Any work related to the fellowship that Mr Mcinnis submittedwas always represented as final At no time whatsoever did Mr Mcinnis communicate that any of the workwere rough drafts Any representation that they were submitted to the Foundation as rough drafts isabsolutely incorrect

Hasan also declared that the foundation was not told Mcinnis was relying on research other than his own

GLENWOOD SPRINGS - Long-time local resident Rolly Fischer on Tuesday declined to say much about hisinvolvement in a research paper that gubernatorial candidate and former Congressman Scott Mcinnis wrote to

meet a fellowship deadline

Scotts responsible for stated Fisher an engineer who worked for the Colorado River Water Conservationfor when asked whether he was responsible fo r articles attributed to Mcinnis

Beyond that Fisher said flatly I have nothing to say

Mcinnis a Glenwood Springs native who is seeking the Republican nomination to become Colorados nextgovernor was awarded a fellowship in 2005 and 2006 by the Hasan Family Foundation a Pueblo-basedorganization shortly after he retired from Congress

The fellowship included a payment of $300000 for speaking engagements and to research and write a monthlyarticle on state water issues according to a story in the July 13 Denver Post

But shortly after getting the fellowship according to the Post Mcinnis got a job with the Denver law firm ofHogan amp Hartson leaving him pressed for time to finish the fellowship articles

At some pOint according to the Post Fisher got involved although his name does not appear anywhere in thedocuments

Numerous passages in the articles which reportedly totaled more than 150 pages in 23 installments appearedto either exactly replicate or closely mirror passages from a 1984 a essay by now-Colorado Supreme CourtJustice Gregory J Hobbs

The Denver Post reported that a Mcinnis aide Sean Duffy told a reporter that Fischer was the one whohandled the portions that used Hobbs work without attribution

Duffy who could not be reached for comment also is quoted as saying the articles were not intended forpublication without editing

Mcinnis was quoted by 9NEWS as calling the charges a nonissue

The Mcinnis campaign late Tuesday issued a statement about the furor in which the candidate acknowledgedhiring Fischer to help with the articles and admitting that it has now become clear that much of the researchwas in fact taken from other source material without proper attribution While I do not believe that this was adeliberate act i t was a serious mistake I should have been more vigilant in my review of research materialRolly submitted

In a statement from the Hasan Family Foundation chairwoman Seeme Hasan said of the accusations againstMcinnis I am shocked angry and disappointed Any work related to the fellowship that Mr Mcinnis submittedwas always represented as final At no time whatsoever did Mr Mcinnis communicate that any of the workwere rough drafts Any representation that they were submitted to the Foundation as rough drafts isabsolutely incorrect

Hasan also declared that the foundation was not told Mcinnis was relying on research other than his own

The Hasan Family Foundation takes the issue of plagiarism extremely seriously the statement concludes All

[Mcinnis] work was represented to be original and final We will conduct an independent internal investigationand i f the allegations are proven to be true we will demand Mr Mcinnis return al l monies paid to him by theFoundation

A spokesperson for the Colorado Bar Association said there are no rules that address accusations of plagiarism

against attorneys although i f an attorney were convicted of the crime of plagiarism the Bar might take some

disciplinary action

But Luis Toro director of Colorado Ethics Watch said that if true the charges could threaten Mcinnis license to

practice law in the state

According to an article in the Colorado Statesman a non-partisan political organ Toro said that such a finding would raise serious questions about Mcinnis compliance with the ethics rules that apply to al l Colorado lawyers

On Tuesday Colorado House Speaker Terrance Carrol l called for Mcinnis a former six-term congressman to

withdraw from the gubernatorial race

Mcinnis will face fellow Republican Dan Maes in the August 10 primary to see who will face Hickenlooper in November
