    Declaration of Representative Amanda Reeve

    I, Amanda Reeve, hereby declare:

    1. I am a Republican member of the Arizona House of Representatives (the"House"), I have been a member of the House since 2010, I represent Legislative District 6.

    2. Unless otherwise stated herein, I make this Declaration based on my personalknowledge and/or observations.

    3. I am presently a member of the Energy and Natural Resources Committee andHigher Education. Innovation and Reform Committee. and serve as the Chairman of theEnvironment Committee.

    4. I have had many interactions with Representative Daniel Patterson and observedhim interact with constituents, other legislators. and staff members.

    5. I have personally observed Representative Daniel Patterson display a pattern ofdisorderly, aggressive, unprofessional, counterproductive, and disrespectful conduct that isinconsistent with the professional atmosphere at the Legislature.

    6. On March 17, 20 I0, I witnessed Representative Patterson impugn Senator Pearceduring a presentation on legislation proposed by former Senator Pearce in a Military Affairs andPublic Safety ("MAPS") Committee hearing during which Representative Patterson wasaggressive, red faced, and extremely worked up. Representative Patterson refused to calmdown despite Chairman Weiers' several warnings, Representative Patterson eventually stormedout of the Committee hearing and was subsequently removed from the Committee.

    7. On February 6, 2012, during a meeting of the ENR Committee, RepresentativePatterson and I had a discussionconcerning some legislation he was supporting before theCommittee.

    8. Following adjournment of the hearing, as I gathered my materials to leave thecommittee hearing room. Representative Patterson stepped in front of me, blocking me from

    exiting the hearing room, He drew uncomfortably close to me and asked whether Iwould hearhis bill. When he continued to block my path, I walked directly for the exit door, Only whenhe saw that I was determined to move past him, and I explained for the second time that I WJ!llate for another appointment, did he step slightly aside to let me pass,

    9. The next day, on the floor Representative Patterson approached me and asked meagain if I would hear his bill, During this conversation Representative Patterson wasuncomfortably close to me and when I attempted to leave the conversation he obstructed mypath.

    J O . The following week, Representative Patterson approached me on the I-louse floorto again ask if I was going to hear his bill. "When I declined to do so he became agitated andstated that I "had no integrity."

    11. I regard Representative Patterson's behavior toward me after the cornmittee :hearing and on the two occasions on the House floor-which is detailed in paragraphs 8throughlO-as unprof essional and discourteous. I believe that in each of these instances I gave

    . Representative Patterson a fair opportunity to explain his position and only sought to end theconversations after they became unproductive, or I had to leave for another appointment.

    Declaration of Representative David Gowan

    I, David Gowan, hereby declare:

    1. I am a member of the Arizona House of Representatives (the "House"). 1 havebeen a member of the House since 2009. I represent Legislative District 30.

    2. Unless otherwise stated herein, I make this Declaration based on my personalknowledge and/or observations.

    J. I am presently a member of the Government Committee and Military Affairs andPublic Safety ("MAPS") Committee.

    4. On March 17, 2010, at a MAPS hearing, I witnessed Representative Pattersonimpugn former Senator Pearce in connection with SB1027. Representative Patterson disagreedwith the bill and became increasingly angry and inappropriately aggressive toward formerSenator Pearce as he testified about SBI027. Even though Chairman Weiers attempted to gaveldown Representative Patterson in attempt to stop his inappropriate behavior, RepresentativePatterson refused to heed Chairman Weiers' warnings. As a result of this incident and others,Representative Patterson was removed from the MAPS Committee.

    S. In another incident around February 20, 2010. Representative Patterson came tomy office to see if 1 would hear a certain bill he sponsored regarding bicycles. I toldRepresentative Patterson that I was not inclined to have the Committee heal' it. My decisionupset Representative Patterson so he proceeded to badger me for several minutes to try tochange my mind. He became louder and tried to intimidate mc. Whcn he found out he couldn'tintimidate me he backed down. After the disagreement, Representative Patterson approachedm e at lunch and apologized.

    6. On another occasion in early March 2012, as I exited the Caucus hearing room 1overheard part of a heated exchange between Representative Patterson and Representative Jerry

    7 . Based on my observations and interactions with Representative Patterson, I find :. tha t sometimes Representative Patterson ha s failed to observe the most basic standards ofmember etiquette and decorum. On occasion, he has behaved aggressively and unprofessionallytoward other members.

    Declaration of Representative Ruben Gallego

    I, Ruben Gallego, hereby declare:L I am a Democratic member of the Arizona House of Representatives (the

    "House"). I have been a member of the House since 2011. I represent Legislative District 16.2. Unless otherwise stated herein, I make this Declaration based on my personal

    knowledge andlor observations.3. I am presently a member of the Agriculture and Water Committee, Military

    Affairs and Public Safety Committee, and Ways and Means Committee.4. I have had many personal interactions with Representative Patterson and observedhim interact with constituents, other legislators, and staff members.5; . I have personally observed Representative Patterson display a pattern of

    disorderly, mean-spirited, aggressive, unprofessional, counterproductive, intimidating, anddisrespectful conduct that, at minimum, violated the House's Code of Conduct.

    6. Most recently for example, I witnessed, on two separate occasions,Representative Patterson act in an inappropriate and aggressive manner toward RepresentativeReeve on the House floor. The first occasion I witnessed from a distance. RepresentativePatterson approached Representative Reeve and appeared to intentionally bump into her in anaggressive and otherwise intimidating manner. Representative Patterson appeared tointentionally invade Representative Reeve's personal space. On a separate occasion, whilesitting at .rny desk on the House floor, I overheard Representative Patterson get verballyaggressive with Representative Reeve and angrily tell her she had "no integrity." Thisexchange caused me to stop what I was otherwise doing to ask Representative Reeve what thatwas about and apologize for Representative Patterson's actions. In my opinion his acts againstRepresentative Reeve were intentional and confrontational.

    7. I witnessed Representative Patterson get angry with Representative Pancrazi andturn red in a closed Democratic Caucus meeting.

    8. Inmy opinion Representative Patterson has an inability to let issues gowhen he isworked up or otherwise angry.

    9. Following the latest allegations against Representative Patterson and seeing whatIelieve to be a pattern of intimidating actions against female Representatives, r asked female.Representatives who sit next to Representative Patterson on the House floor if they wanted tochange seats with me.

    10. I have concerns for the safety of others and have requested additional security be.enforced and have sometime brought m y weapon to work.

    I, Anna Tovar, hereby declare:1, I am a Democratic member of the Arizona House of Representatives (the

    "House") and serve as Minority Whip, I have been a member of the House since 2009, Irepresent Legislative District 13.

    2. Unless otherwise stated herein, I make this Declaration based on my personalknowledge and/or observations.

    3. I am presently a member of the House Appropriations Committee, EducationCommittee, Judiciary Committee, and Sub Appropriations on Multi Year BudgetingCommittee,

    4. When I first began my tenure at the Legislature others cautioned me aboutRepresentative Daniel Patterson, stating "watch out for Daniel" and describing RepresentativePatterson as one who is known to "fly off the handle."

    5. I have had many personal interactions with Representative Patterson and observedhim interact with constituents, other legislators, and staff members.

    6. I have personally observed Representative Patterson display a pattern ofdisorderly, mean-spirited, aggressive, unprofessional, counterproductive, intimidating, anddisrespectful conduct that, at minimum, violated the House's Code of Conduct

    7. For example, on March 29, 2011, after a closed caucus meeting adjourned, Iwitnessed Representative Patterson in a heated discussion with Representative Steve Farley, Irecall that Representative Bruce Wheeler was also present during this heated discussion. I wasstanding about 4-5 feet away from the heated discussion and recall that Representative Wheelerwas trying to pull Representative Patterson away from Representative Farley. Eventually,Representative Wheeler walked away, but Representative Patterson continued to exchangewords with Representative Farley, At that time, I was trying to get through the aisle, I was

    about 3 feet behind Representative Farley, and I heard Representative Patterson state toRepresentative Farley that he should stop spreading lies about Representative Patterson.Representative Patterson continued that, if Representative Farley did not stop spreading liesabout Representative Patterson, Representative Farley would regret his actions. This commentappeared to cause Representative Farley concern. Representative Patterson's tone anddemeanor (finger pointing) was intimidating, quite shocking to witness and, in my opinion,scary. Based on my observation of this incident, I took Representative Patterson's comments toRepresentative Farley as a verbal threat. In fact, I was so alarmed by Representative Patterson'sconduct that, after I witnessed this incident, I made notes of what I had observed. A true andcorrect copy of my Incident Notes is attached at Exhibit A.

    8. On another occasion, in April, 2011, during a floor debate, there was a veryheated discussion between Representative Patterson and Representative Eddie Farnsworth. Iobserved the two of them go toward the back of the House chambers to have this heateddiscussion. This discussion quickly deteriorated and, as the only member of the HouseDemocratic leadership on the floor at the time, I had to address Representative Patterson'sconduct. During this same debate, Representative Patterson also acted combatively and veryunprofessionally toward Representative Lynne Pnacrazi by raising his voice at, and.pointing hisfinger toward, her. Speaker of the House, Representative Kirk Adams, informed me thatRepresentative Patterson had become out of control and he was considering removingRepresentative Patterson from the House floor. Because the custom,. with regard toRepresentative Patterson, is to always speak with him with at least one other witness present, Ihad the Chief of Staff locate Representative Patterson so we could speak with him about hismisconduct. Typical of Representative Patterson when confronted with his behavioraloutbursts, he denied doing anything inappropriate and appeared not to understand why hismisconduct was inappropriate. We convinced Representative Patterson to leave thefloor.

    the House floor following a meeting of the Environment Committee. Afterwards,9. Approximately two and a half weeks ago, Representative Amanda Reeve wason

    Representative Patterson walked up to Representative Reeve, very upset, confronted her aboutallegedly holding up his bill, and then stormed off. I consider Representative Patterson'sconduct in this regard disorderly, unprofessional,and nothing short of a verbal assault onRepresentative Reeve. Having witnessed the interaction, on behalf of the Democratic Caucus, Iapologized to Representative Reeve for Representative Patterson's misconduct.

    10. Others have expressed to me fears for their personal safety with regard toRepresentative Patterson and have told. me they consider Representative Patterson out ofcontrol.

    11. On February 27, 2012, at approximately 7:02 p.m., Representative Patterson leftme a voice mail wherein he apologized for "all this BS going on" and stated that he has "beenfearful" for his "safety." I consider this voice mail a part of Representative Patterson's patternof refusing to take responsibility for his actions.

    12. As a member of House Democratic leadership, I can say that the DemocraticHouse members are routinely having to apologize for Representative Patterson's actions anddisorderly conduct In fact, Democratic leadership has had many meetings to discuss how toaddress and handle Representative Patterson's misconduct toward his fellow House membersand constituents.

    IJ. My personal observations of Representative Patterson have led me to conclude..that Representative Patterson has engaged in a long pattern of disorderly and unprofessional.misconduct that reflects poorly on himself, his party, the House, the State of Arizona, and worstof all, those who elected Representative Patterson to office.

    I, Bruce Wheeler, hereby declare:1. I am a Democratic member of the Arizona House of Representatives (the

    "House"). I have been a member of the House since 2011. I represent Legislative District 28. Ihave also previously served in the House from 1975 through 1977.

    2. Unless otherwise stated herein, I make this Declaration based on my personalknowledge and/or observations.

    3. I am presently a member of the Energy and Natural Resources ("ENR")Committee and Technology and Infrastructure Committee.

    4. I have had many personal interactions with Representative Daniel Patterson andobserved him interact with constituents, other legislators, and staff members.

    5. I have personally observed Representative Patterson display a pattern ofdisorderly, mean-spirited, aggressive, unprofessional, counterproductive, and disrespectfulconduct that, I believe, violated the House's Code of Conduct.

    6. For example, during an ENR hearing on February 14, 201 I, RepresentativePatterson introduced a bill, HB2122, but had failed to obtain a fiscal note for the bill. When Iquestioned whether he had obtained a fiscal note, he responded in the negative. RepresentativePatterson proceeded to glare at me during the remainder of the hearing. After the hearing,Representative Patterson followed me to my office where we engaged in a heated discussion.Representative Patterson was extremely angry with me because I questioned the bill.Representative Patterson became red in the face and raised his voice at me.

    7. On another occasion at an ENR hearing on February 13, 2012, RepresentativePatterson inappropriately intimated that Chairman Frank Pratt had a conflict of interestregarding HB2775, a bill about swimming pool pumps, which Chairman Pratt sponsored.Representative Patterson essentially cross-examined Chairman Pratt during the committee

    11. Representative Patterson has constantly displayed behavior that is arrogant anddelusional. Representative Patterson tells me what he thinks I want to hear. For example, afterthe allegations concerning Ms. Escobar began to surface, Representative Patterson asked to talkto me in private. He assured me that nothing had occurred between him and Ms. Escobar. Yet,within days, the media released a police report where the incident was confirmed and showedotherwise.

    I2. Other members of the House have refused to meet with Representative Pattersonalone for fear of their safety. For example, Representative Farley asked me to be an arbiter andsit in a meeting between him and Representative Patterson. I agreed, but the meeting neveroccurred.

My personal observations of Representative Patterson have led me to concludethat he is ineffective, an embarrassmentto the caucus, and has engaged in a long pattern ofdisorderly and unprofessional misconduct that reflects poorly on himself, his party, the House,the State of Arizona, and worst of all, those who elected Representative Patterson to office.

    I, Macario Saldate IV, hereby declare:1. 1 am a Democratic member of the Arizona House of Representatives (the

    "House"): I have been a member of the House since 2011. I represent Legislative District 27.2. Unless otherwise stated herein, I make this Declaration based on my personal

    knowledge and/or observations.3. I am presently a member of the Energy and Natural Resources ("ENR")

    Committee and Higher Education, Innovation and Reform Committee.4. I have had many personal interactions with Representative Daniel Patterson and

    observed him interact with constituents, other legislators, and staff members.5. I have personally observed Representative Patterson display a pattern of

    disorderly, mean-spirited, aggressive, unprofessional, counterproductive, intimidating, anddisrespectful conduct that, at minimum, violated the House's Code of Conduct.

    6. For example, at an ENR hearing on February 14,2011, Representative Patterson.became visibly upset and angry when Representative Wheeler and I questioned one of his bills.Representative Patterson was incensed when Representative Wheeler asked whetherRepresentative Patterson had obtained a fiscal note on the bill. Representative Patterson said noand glared at Representative Wheeler. After the hearing, he followed us into RepresentativeWheeler's.roffice, He raised his voice at Representative Wheeler and became extremelyaggressive and red in the face. I thought to myself, this could be a situation where theconfrontation could become physical.

    7. Also on February 17,2012, Ms. Escobar called me and told me to watch my backand be careful because Representative Patterson might get physical with me. She also told methat Representative Patterson accused me of being racist because I had previously told

    Representative Patterson that he might have trouble securing the Mexican-American vote incertain southern legislative districts.

    8. During a more recent telephone call, Ms. Escobar told me that RepresentativePatterson had hit her, had weapons in the home they were sharing, and had a short temper. Ms.Escobar shared concerning information about the well-being and safety of RepresentativePatterson's daughter.

    9. After my conversation with Ms. Escobar, I informed the Speaker of the House,Representative Andy Tobin, about my concerns. Representative Tobin requested Imake areport to Capitol Police, which I did, and thereafter security was tightened at the Capito] for aperiod of time.

    .10. 1have confronted Representative Patterson about his behavior, and RepresentativePatterson simply denies that he has done anything wrong.

    I, Sally Ann Gonzales, hereby declare:1. I am a Democratic member of the Arizona House of Representatives (the

    "House"). 1 have been a member of the House since 2011. I represent Legislative District 27. Ihave also previously served in the House from 1996 through 2000.

    2. Unless otherwise stated herein, I make this Declaration based on my personalknowledge and/or observations.

    3. I am presently a member of the Employment and Regulatory Affairs Committee,Health and Human Services Committee, and Technology and Infrastructure Committee.

    4. I have had many personal interactions with Representative Daniel Patterson andobserved him interact with constituents, other legislators, and staff members.

    5. I have personally observed Representative Patterson display a pattern ofdisorderly, mean-spirited, aggressive, unprofessional, counterproductive, intimidating, anddisrespectful conduct that, at minimum, violated the House's Code of Conduct.

    6. For example, in Spring of last year, I witnessed Representative Patterson initiate aheated discussion with Representatives Wheeler and Saldate following an Energy and NaturalResources Committee hearing. I could hear Representative Patterson yelling and shoutingthrough the walls of my office.

    7. Also during a closed caucus last session, I witnessed Representative Pattersonbecome angry and upset toward Representative Pancrazi after Representative Pancrazi broughtup the domestic violence allegations against Representative Patterson. He spoke loudly, wavedhis arms up and down, and accused Representative Pancrazi of not knowing what she wastalking about. At one point, I thought he would jump out of his chair toward Representative. Pancrazi. Ialso saw Representative Farley try to stop Representative Patterson from yelling at

    8. I have also witnessed Representative Patterson exhibit loud and passionatebehavior on the floor.

    Representative Pancrazi, but Representative Farley was unable to stop Representative Patterson.The whole incident felt like it lasted at least five minutes.

    9. After learning that Representative Patterson owned guns, I became worried aboutthe safety> of all Members. On February 17, 2012, Representative Saldate told me that Ms ..Escobar requested that he tell Representative Patterson that she was staying at RepresentativeSaldate's property in Guadalajara, Mexico. I expressed my concern that Representative Saldateshould contact the proper authorities and Ibecame concerned for his safety.

    10. More recently, 1poke to Representative Patterson at length the day he came backto the House after the ethics complaint was filed. Representative Patterson told me thateverything in the media was all "lies." Based on my intuition and prior observations ofRepresentative Patterson, I had doubts about what he said.

    11. My personal observations of Representative Patterson have led me to concludethat Representative Patterson has engaged in a long pattern of disorderly and unprofessionalmisconduct that reflects poorly on himself, his party, the House, the State of Arizona, and worstof all, those who elected Representative Patterson to office.

    I, Margaret "Lynne" Pancrazi, hereby declare:1. I am a Democratic member of the Arizona House of Representatives (the

    "House"). I have been a member of the House since 2007. I represent Legislative District 24.2. . Unless otherwise stated herein, I make this Declaration based on my personal

    EducationCommittee, and Employment and Regulatory Affairs Committee.4. r have had many personal interactions with Representative Daniel Patterson and

    observed him interact with constituents, other legislators, and staff members.5. I have personally observed Representative Patterson display a pattern of

    disorderly, mean-spirited, aggressive, unprofessional, counterproductive, intimidating, anddisrespectful conduct that, at minimum, violated the House's Code of Conduct.

    6. As Tbegan my tenure as a Representative, I had a productive relationship withRepresentative Patterson and would often give h im rides because we lived in close proximityand he rode his bike everywhere.

    7. In the spring of 20 10, I become aware of media reports regarding Ms. JeneieneSchaffer's. domestic violence allegations against Representative Patterson. Concerned that aMember of the House was accused of such a serious matter, I raised my concerns in a closedHouse Democratic Caucus meeting. During this discussion, Representative Patterson becameextremely defensive, angry, belligerent, and directed his anger at me by loudly screaming "Youdo not know what you are talking about" and that I was "uninformed." He invaded my personalspace and got in my face during this discussion. Representative Farley attempted to interjectand diffuse Representative Patterson's anger; however, Representative Patterson pushed

    Representative Farley away and continued his tirade against me. Representative Pattersonattempted to threaten and intimidate me, but I refused to back down.

    8. Now, as a result of the pattern of Representative Patterson'saggressive behaviorand after having been the subject of one of his outbursts, I go out of my way to avoidinteractions with him and use e-mail whenever possible to avoid confrontations or engagementswith him. This approach is contrary to how I deal with other members because m y personalphilosophy is to directly confront all matters with those impacted and not back down from anyissue.

    9. 1have often described Representative Patterson as "Dr. Jekyll and Mr. Hyde" as aresult of his unpredictable mood changes from calm to explosive. For example, I have observedRepresentative Patterson act ina manner intended to intentionally intimidate those with whomhe disagrees, or otherwise does not get along, based on his facial expressions and changes in hisvoice which are distinctively different when he is angry.

    10. I observed Representative Patterson engage in inappropriate actions on the Housefloor in which I believe he crossed the line of impugning another Representative.

    11. I believe Representative Patterson is paranoid due to all the recent events, mostrecently exemplified at a legislative luncheon during which I was conversing with a fellowmember through handwritten notes regarding the quality of the food, yet asIooked up and sawRepresentative Patterson, he was glaring at us because he clearly thought we were exchangingnotes about him.

    12. I have observed Representative Patterson engage in heated discussions anddebates with other Representatives to a level I consider inappropriate and disrespectful. Ibelieve that Representative Patterson engages in actions intended to bully and intimidate thosewi th whom he interacts.

    13. I have heard allegations from others that Representative Patterson has gotten intopeople's faces and threatened those that he does not like and that many are known to avoid himlike the plague.

    15. Other members and I fear for our safety. For example, following the filing of theethics complaint, I returned to my home and found the front door and screen door swung open.Based on the timing of this occurrence and the fact that Mr. Patterson and I shared the samelandlord and used to live in close proximity to each other, that night and since, 1 have made a .habit of keeping a weapon near me when I sleep.

    16. Along with other members, I fear for my safety at the Capitol and have requestedadditional security. I have also escorted other members to their vehicles after hours.

    17. My personal observations of and interactions with Representative Patterson haveled me to conclude that Representative Patterson has engaged in a long pattern of disorderly andunprofessional misconduct that reflects poorly on himself, his party, the House, the State ofArizona, and worst of all, those who elected Representative Patterson to office.

    5. In the fall of 2010, r became aware of Ms. Schaffer's domestic violenceallegations against Representative Patterson. When I learned that Ms. Escobar had also madedomestic violence allegations against Representative Patterson, I became concerned thatRepresentative Patterson was not being held accountable for his actions.

    6. In the spring of 2011, following a caucus meeting, J witnessed RepresentativePatterson and Representative Farley engage in a heated shouting match. RepresentativePatterson had turned bright red and was yelling and screaming at Representative Farley. I wasunable to determine the Cause of this fierce disagreement, but Representative Patterson got rightinto Representative Farley's face with complete disregard for Representative Farley's personalspace.

    7. In addition to the incident with Representative Farley, in April 2011 while on thefloor, Representative Patterson impugned the character of another member who sponsored aparticular bill. Representative Farnsworth called for a point of order, which angeredRepresentative Patterson even more. Representative Patterson approached Representative

    Farnsworth afterward to justify himself, but I interpreted the manner in which he approachedRepresentative Farnsworth as intimidating and threatening.

    8 . Based on Representative Patterson's past behavior, I am concerned for mypersonal safety as well as the safety of my fellow members. Ihave been told thatRepresentative Patterson is a gun owner.

    9. Because of Representative Patterson's pattern of erratic behavior and failure tothink about the consequences of his actions, Iook the lead in filing the ethics complaint againsthim.

    10. After I filed the ethics complaint, Representative Patterson attempted to broker aquid pro quo with me. He told me that if I withdrew the ethics complaint, he would "considernot running again." Representative Patterson then further threatened me and said that.because itis an election year, the ethics complaint will. make the Democratic caucus look bad, I respondedthat this was not about making the Democratic caucus look good or bad, but that this was aboutholding him accountable for the pattern of domestic violence allegations against him and thepattern or his unethical behavior in the Legislature. Representative Patterson admitted to methat he has problems with his temper and that he is "working on it."

    4. I have had many personal interactions with Representative Daniel Patterson andobserved him iriteraet with constituents, other legislators, and staff members. I have consideredRepresentative Patterson a friend and have had him as a guest in my home. Prior to the filing ofthe ethics complaint against Representative Patterson, I had several civil interactions with him.

    5. However, I have also personally observed Representative Patterson display apattern of disorderly, mean-spirited, aggressive, unprofessional, counterproductive,intimidating, and disrespectful conduct that, at minimum, violated the House's Code ofConduct.

For example, based on my Concerns over Representative Patterson's inappropriatebehaviors, I prepared an ethics complaint against him in May 20 II, in which I was prepared toask the House Ethics Committee to investigate Representative Patterson's violation of theHouse Rules, specifically Rule I regarding disorderly behavior and breach of the House Rules.A copy of the draft complaint is attached asExhibit A (the "Complaint").

    7. As set forth in the draft Complaint, my concerns over Representative Patterson'sbehavior were based upon a pattern of inappropriate behavior, beginning with his criminal

    history and specific inappropriate encounters with other Representatives, includingRepresentative Farley and Representative Farnsworth.

    8. Because of the concerns of those involved in the altercations with RepresentativePatterson, I ultimately chose not to file the Complaint

    9. Since drafting the Complaint, I have become aware of two additional altercationsinvolving Representative Patterson and other Representatives, including Representative Weiersand Representative Reeve, in which Representative Patterson acted in an inappropriate, violent,andlor threatening and intimidating manner.

    ] O . Victims of Representative Patterson's outbursts and temper have told me thatduring the exchanges with Representative Patterson, they were fearful that RepresentativePatterson was going to strike them. These individuals noted that he intentionally stands in amanner to intimidate them by holding his hands to the side of his body with his fists clenched.

    11. I have also witnessed Representative Patterson lose control on the House Floor anumber oftimes while making his comments. I have often warned him to be careful about whathe says, to stick to the issue, and to avoid turning the issue into something personal. whichwould violate the House Rules.

    12. On at least one occasion I found Representative Patterson to be.dishonest with meregarding legislation. Representative Patterson represented to me that the presidents of the threemain Arizona Universities supported a bill Representative Patterson sponsored that would allowthe sale of alcohol on university campuses. I trusted Representative Patterson's representationand agreed to co-sponsor the bill. However, J found out that Representative Patterson'srepresentations were untruthful and that it was actually only university faculty who supportedthe proposed bill. 1would not have co-sponsored the bill had I know the University Presidentsdid not support it. At the time, I did not question Representative Patterson's representations, butin hindsight, I was naive and should have known better.

    13. At the end of February of this year, Representative Macario Saldate informed meabout Ms. Escobar's allegations of Representative Patterson's drug use and allegations that

    ineffective and inappropriate means to conduct our work at the Legislature and a clear violation

    Representative Patterson's daughter may be in danger. Rather than taking the risk that Ms.Escobar's allegations might not be truthful, 1 encouraged Representative Saldateto report theallegations to the appropriate authorities because of the seriousness of the allegations.

    14. I have witnessed Representative Patterson engage in a pattern of confronting othermembers in a manner that is intended to incite fear and intimidation, which I believe is an

    of the House Rules.15. I believe Representative Patterson has refused to be accountable for his behavior.16. My personal observations of Representative Patterson have led me to conclude

    that he has engaged in a long pattern of disorderly and unprofessional misconduct that reflectspoorly on himself, his party, the House, and the State of Arizona.

One Member impugning Members for their motives andconfrontations borderingon violence is not appropriate.Please note that I consider Mr. Patterson a friend. He was a guest in my home inFlagstaff last year and he visited my apartment in Phoenix just a few months ago towatch sports on television. I find him knowledgeable on the issues, articulate, and hisvoting record is nearly identical to mine. He has a good nature. I believe he has servedhis constituents well. I like Daniel Patterson.

    4. As part of'the Democratic leadership in the House, I have had to adpionishRepresentative Patterson for his unbecoming and unprofessional conduct on several separateoccasions and to request that he make appropriate apologies to this Legislature, staff, andlobbyists. For example, Democratic leadership has had to talk to Representative Pattersonabout (1) his unprofessional and threatening behavior toward lobbyists, (ii) unbecomingbehavior on the floor, including impugning another member, and (iii) his removal from theMilitary Affairs and Public Safety ("MAPS") Committee as a result of Representative Pattersonimpugning another member, refusing to be gaveled down, and storming out of the MAPShearing.

    5. I have also spoken to Representative Patterson about his failure to follow memberprotocol and procedure. For example, House Rules strictly prohibit a House member to leaveduring voting; leaving during voting on the floor is highly unusual. Yet, I have witnessed andheard about Representative Patterson repeatedly leaving during voting on the floor. On oneoccasion, Representative Patterson left the floor during voting, got into his car, and drove home.

    6. Representative Patterson has also displayed unbecoming and unprofessionalconduct during caucuses. On more than one occasion, I have witnessed him yell and scream

    about non-policy related issues. Representative Patterson habitually makes his argumentsvitriolic and personal. I am unable to keep track of all of these confrontations because theyoccur on such a frequent basis.

    7. Representative Patterson has failed to listen to leadership when it comes to staffcommunications. Since Ms. Escobar's allegations of domestic violence against RepresentativePatterson have surfaced, I have asked Representative Patterson not to contact staff about theissue, yet he continues to do so.

    8, Representative Patterson also has a history of "quid pro quo." I am aware ofoccasions where Representative Patterson has offered his vote on a certain bill in exchange foranother member to vote a certain way for one of his bills.

    9. Over the course of my time in leadership, I have attempted to engage inconversations with Representative Patterson but they often devolve into heated confrontations.For example, after Ms. Escobar's allegations of domestic violence against RepresentativePatterson surfaced, I gave Representative Patterson two hours to tell Olewhy he should not haveto resign. Representative Patterson denied all of the allegations and repeatedly said the situationwas not his fault. We fought over the phone and were unable to come to an agreement aboutwhat Representative Patterson should do. Despite Representative Patterson's denial of theallegations, the public records have shown me otherwise.

    10. Representative Patterson's conduct, without a doubt, reflects poorly on the House.Democratic leadership and I have had tomanage him since his first day in the Legislature. Eachtime Representative Patterson sits down with leadership to discuss his unbecoming andunprofessional behavior, he has promised to change. However, his pattern of behavior hasshown me that he is incapable of correcting his behavior.

    11. As a member of Democratic leadership, I can say that the Democratic Housemembers are routinely having to apologize for Representative Patterson's actions and disorderlyconduct

    1. I am a Republican member of the Arizona House of Representatives (the"House"). I have been a member of the House since January of 2010. I represent LegislativeDistrict 26.

    2. Unless otherwise stated herein, I make this Declaration based on my personalknowledge based on my research of publicly available information and/or observations.

    3. I am presently a member of the Education Committee and Technology andInfrastructure Committee and Vice-Chairwoman of the Military Affairs and Public SafetyCommittee.

    4. I believe that Representative Daniel Patterson has displayed a pattern ofdisorderly, mean-spirited, aggressive, unprofessional, counterproductive, intimidating, anddisrespectful conduct toward others.

    5. For example, when I first arrived at the House 1had met Representative Pattersonat a social function, We had discussed co-sponsoring an anti-domestic violence bill. I agreed toco-sponsor such a bill with Representative Patterson. That bill became known as "HB2588."

    6, After co-sponsoring HB2588 with Representative Patterson, T began 1 0 hear thatRepresentative Patterson had himself engaged in a pattern of domestic violence toward his exwife. Upon hearing about this, 1 decided to investigate whether these allegations of domesticviolence had merit.

    7. My investigation revealed that Representative Patterson had engaged in a patternof disorderly and violent conduct toward others, including one or more acts of domesticviolence toward his ex wife. As a result, I determined that co-sponsoring HB2588 withRepresentative Patterson would be unwise and I decided to "kill" HB2588. An email reflectingmy concerns in that regard is attached as Exhibit A (April 6, 2011 email chain). In fact, when I

    decided to "kill" HB2588, Ms. Lindsay Simmons, who represents the Arizona DomesticViolence Coalition, contacted m e and stated: "I n light of the circumstances, please be carefuland mindful of your safety." See Exhibit A.

    8. My investigation led m e to draft an ethics complaint against RepresentativePatterson (the "Proud Complaint") on or around April 4,2011. A true and correct copy of theProud Complaint, and Exhibits 1 through 3 thereto, are attached as Exhibit B . I believe that theProud Complaint was warranted, supported by verifiable fact, and I stand by everything statedtherein.

    9 . Ultimately, however, J decided not to file the Proud Complaint because r believedthat Representative Patterson's caucus is the appropriate group to address his disorderlymisconduct.

    lO. My investigation into Representative Patterson has led me to conclude that he hasengaged in a long pattern of disorderly, aggressive, and violent misconduct toward others thatreflects poorly on himself, his party, the House, the State of Arizona, and worst of all, thosewho elected Representative Patterson to office.

    11. On two separate occasions the Arizona Coalition Against Domestic Violence hascalled fOT the resignation of Representative Patterson. The two press releases from theCoalition are attached as Exhibit C.

    Republicans and Democrats in Arizona have finally found something to agree on, and Three Sonoransis even applauding Ron Gould for his stance against domestic violence amongst state legislators suchas Scott Bundgaard.

    "Getting in a fistf ightwith your girlfriend on the side of the freeway is behavior unbecorninqa senator,' Gould said Monday."I won't be led by somebody who does those kinds of things:

    What about other cases of domestic violence with current members of the state legislature?Will Republicans and Democrats stand strong against this horrif ic violence against women, or violenceagainst humans in general? .lhave been investigat ing a case for some time now, and with both the Scott Bundgaard case makingheadlines, and the video of Aubry Ballard being released, and finally with today (when this is beingwritten) being International Women's Day, the time has now come to write about this story,A few months ago the Tucson Weekly wrote about Daniel Patterson, Democrat from LD29 on Tucson'ssouthside. It appears that sometime around August of 2 01 0 , Daniel Patterson moved out of his homeand moved in with his new female friend.Jam not interested in personal issues here. Relationships come and go.However, a few issues of concern to the public were raised. It began with a restraining order due toallegations of domestic violence. Usually some credible evidence [s needed to get such an order, andindeed this was the case. But the restraining order could not be served on the LD29 representativebecause he was no longer Jiving at home. .The police tried to f ind out his new address, but the Democrats stuc~ together and would not reveal hisnew home. It was not too diff icult to get pictures of his car being parked outside his new address (notby me but by previous writers on this story) and to this day everyone in the party that J have talked toknows that he is living near the Glenn and Oracle intersection, and has been for many months now.This raises issues first of aUof him vot ing in a precinct in which he does not live in, wh1chis a felony,but furthermore running for off ice in a district the candidate does not live In, and continuing to live
