Investing in Canada Infrastructure Program (ICIP)

Expression of Interest (EOI)

Guide

I. PURPOSE:

Manitoba signed the Investing in Canada Infrastructure Program Bilateral Agreement June 4, 2018.

The funding agreement will support infrastructure needs throughout Manitoba into 2028. In

preparation for an initial intake, Manitoba has implemented a two-step process that will provide

potential applicants with an opportunity to adequately plan and develop projects that align with the

new program terms and conditions and feed into long term strategic capital planning.

The first step is the Expression of Interest (EOI) which will provide an opportunity to gather initial

information on infrastructure priority projects over the next five years (2019-2023). The EOI will only

capture basic information on priority projects, project eligibility, project descriptions and anticipated

outcomes. The EOI provides a process to strategically prioritize, plan and budget accordingly.

The deadline for submitting an EOI to Manitoba is Friday, August 10, 2018 at 4:30pm (CST)

The EOI Guide has been developed using ICIP prescribed information.

Important Note:

1. The EOI is NOT an application for funding.

2. Costs incurred prior to formal application intake and project approval will not be eligible. This

includes costs for assessments and studies, project development, and construction costs.

II. ICIP OVERVIEW:

ICIP is a $1.17B cost-shared federal-provincial program that will support infrastructure needs

throughout Manitoba over the next 10 years.

ICIP employs an outcomes-based approach to project eligibility and focuses on delivering and

reporting results. An outcomes-based approach uses consistent indicators to measure program

targets and results. (see Appendix 1: ICIP Investment Streams - Outcomes and Indicators).

The program is divided into four investment streams:

1. Public Transit Infrastructure Stream (PTIS) - $546M

2. Green Infrastructure Stream (GIS) - $451M

Sub-stream:

a. Climate Change Mitigation

b. Adaptation, Resilience and Disaster Mitigation

c. Environmental Quality

3. Community, Culture and Recreation Infrastructure Stream (CCRIS) - $61M

4. Rural and Northern Communities Infrastructure Stream (RNCIS) - $112M

Additional Notes:

To be eligible for ICIP funding climate lens assessments may be required, but they are not

required at the EOI stage.

I) Greenhouse Gas Emissions Assessment is required:

a. For all projects that meet a climate change mitigation outcome

b. For all Emissions-intensive projects with total estimated eligible expenditures of ten

million ($10,000,000.00) or more; and

c. For all other projects with total estimated eligible expenditures of ten million dollars

($10,000,000.00) or more.

II) Climate Resilience Assessment is required:

a. For all projects that meet an adaptation, resilience and disaster mitigation outcome; and

b. For all other projects with total estimated eligible expenditures of ten million dollars

($10,000,000.00) or more.

Eligible Recipients

The following recipients are eligible to submit projects under the EOI:

A municipal or regional government established by or under provincial statute;

A public sector body that is established by or under provincial statute or by regulation or a

municipal or regional government;

When working in collaboration with a municipality, a public or not-for-profit institution that is

directly or indirectly authorized, under the terms of provincial or federal statute or royal charter

to deliver post secondary courses or programs that lead to recognized and transferable post-

secondary credentials;

A private sector body, including for-profit organizations and not-for-profit organizations. In the

case of for-profit organizations, they will need to work in collaboration with one or more of the

entities referred to above or an indigenous government listed below; and

The following Indigenous recipients:

o A band council within the meaning of section 2 of the Indian Act;

o A First Nation, Inuit or Metis government or authority established pursuant to a self-

government agreement or a comprehensive land claim agreement between Her

Majesty the Queen in Right of Canada and an Indigenous people of Canada, that has

been approved, given effect and declared valid by federal legislations;

o A First Nation, Inuit or Metis government that is established by or under legislations

whether federal or provincial that incorporates a governance structure; and

o A not-for-profit organization whose central mandate is to improve Indigenous outcomes,

working in collaboration with one or more of the Indigenous entities referred to above a

municipality or Manitoba.

General Eligibility of Projects:

Eligible projects will support public infrastructure defined as tangible capital assets primarily for

public use and/or benefit.

Projects must align directly to at least one or more program outcome related to a funding

stream.

Projects must also meet both stream-specific and general requirements.

Specific exclusions for investments will be identified in each stream and sub-stream.

Projects that are investments in health and education facilities are not eligible for contribution

funding under ICIP except as otherwise specified.

The following tables detail ICIP investment stream Outcomes, program requirements and additional

information to help determine project eligibility. Please review thoroughly before initiating an EOI

submission.

ICIP Investment Stream Details

PUBLIC TRANSIT INFRASTRUCTURE STREAM (PTIS) For a project to be eligible, it must meet at least one of the following OUTCOMES:

Project is INELIGIBLE if: Stream Specific Requirements:

1. Improved capacity of public transit infrastructure

2. Improved quality and/or safety of existing or future transit systems

3. Improved access to public transit system

1. It involves inter-city bus, rail, port or ferry infrastructure that is not part of public transit system.

Projects that connect citizens to a public transit system are consistent with a land-use or transportation plan or strategy, and where applicable, projects are consistent with the approved plans of regional transportation bodies.

STACKING & COST Sharing:

CANADA: Maximum funding from all federal sources to a PTIS project will not exceed:

a) Forty Percent (40%) of total eligible expenditures for new construction and expansion of public transit and active transportation that connects citizens to their public transit systems;

b) Fifty percent (50%) of total eligible expenditures for public transit rehabilitation projects; or

c) Twenty-five percent (25%) of eligible expenditures for any for-profit private sector Ultimate Recipients.

**Gas Tax is a federal source of funding and therefore cannot be used as municipal share.

MANITOBA: Municipalities may be eligible for up to 33.3% provincial funding

GREEN INFRASTRUCTURE STREAM (GIS)

SUB-STREAM For Projects to be eligible it must meet one of the following OUTCOMES:

Project is INELIGIBLE if: Steam Specific Requirements:

Climate Change Mitigation

1. Increased capacity to manage more renewable energy.

2. Increased access to clean energy transportation.

3. Increased energy efficiency of buildings.

4. Increased generation of clean energy.

1. It involves inter-city bus, rail, port or ferry infrastructure that is not part of a public transit system.

2. It is eligible under the Low Carbon economy Fund.

3. It is an energy retrofit project unless the energy retrofit project is an asset that is eligible under ICIP or under the National Housing Strategy.

4. It involves emergency services infrastructure.

1. Projects must demonstrate anticipated greenhouse gas emission reductions as determined by the GHG Emissions Assessment.

2. For projects involving higher order rapid transit, the adoption of vehicles that use a renewable fuel source in a public transit fleet, or active transportation projects, the projects must be consistent with a land-use or transportation plan or strategy, and where applicable, are consistent with the approved plans of regional transportation bodies.

Adaptation, Resilience and Disaster Mitigation

1. Increased structural capacity and/or increased natural capacity to adapt to climate change impacts, natural disasters and/or extreme weather events.

1. It relocates whole communities.

2. It involves emergency services infrastructure.

3. It relates to seismic risks.

Environmental Quality

1. Increased capacity to treat and/or manage wastewater and storm water.

2. Increased access to potable water.

3. Increased capacity to reduce and/or remediate soil and/or pollutants.

1. Wastewater projects must result in wastewater effluent that meets the Wastewater Systems Effluent Regulations where applicable.

2. Drinking water quality following completion of a drinking water project must meet or exceed provincial standards.

3. Solid waste diversion projects must result in a measurable increase in the quantity of material diverted from disposal as measured against a baseline using the Generally Accepted

Principles of Calculating Municipal Solid Waste System Flow.

4. Projects that reduce or remediate soil pollutants must undertaken on properties that are contaminated, as confirmed by Phase II Environmental Site Assessment

STACKING AND COST-SHARING: CANADA: The maximum funding from all federal sources to a project approved under GIS will not exceed: a) Forty percent (40%) of

total eligible expenditures for municipalities, regional governments and not-for-profit organizations;

b) Seventy-five percent (75%) of total eligible expenditures for Indigenous Ultimate Recipients; or

c) Twenty-five percent (25%) of total eligible expenditures for any for-profit, private sector Ultimate Recipients.

COMMUNITY, CULTURE AND RECREATION INFRASTRUCTURE STREAM (CCRIS) For a project to be eligible, it must meet at least one of the following OUTCOMES:

Project is INELIGIBLE if: Steam Specific Requirements:

1. Improved access to and/or increased quality of cultural, recreational and/or community infrastructure for Canadians, including indigenous peoples and vulnerable populations.

1. It has a private sector, for-profit Ultimate recipient.

2. It is a stand-alone daycare facility, for-profit daycare facility, daycare facility associated with a school board or a daycare facility funded under the early learning and Childcare Initiative.

3. It is a religious site that services as place of assembly for religious purposes, which includes among others, a site, church, mosque, synagogue, temple, chapel (i.e. within a convent or seminary), shrine or meeting house.

4. It is semi-professional sport facility that is primarily a commercial operation, such as those that serve major junior hockey leagues.

NOTE - Within Community Infrastructure Projects, elements of the project that include dedicated spaces for healthcare, education or tourism purposes, provincial or municipal services, or for-profit uses are ineligible under the program, except for dedicated healthcare or education spaces that benefit Indigenous people by advancing the Truth and Reconciliation Commission’s Calls to Action as approved by Canada.

1. Projects must be community-oriented, non-commercial in nature, open for use to the public, and not limited to a private membership.

2. “Community Infrastructure” is defined as community hubs and community centres. These publicly accessible, multi-purpose spaces that bring together a variety of different services, programs and/ or social and cultural activities to reflect local community needs.

3. The primary rationale for undertaking a sport infrastructure project cannot be to serve as a home facility for professional or semi-professional sports teams.

4. Health and education facilities must benefit Indigenous peoples by advancing the Truth and Reconciliation Commission’s Calls to Action as approved by Canada.

STACKING AND COST SHARING:

CANADA: The maximum funding from all federal sources to a project approved under CCRIS will not exceed:

a) Forty percent (40%) of total eligible expenditures for municipalities, regional governments and not-for-profit organizations, or

b) Seventy-five percent (75%) of total eligible expenditures for Indigenous Ultimate Recipients.

**Gas Tax is a federal source of funding and therefore cannot be used as municipal share of a project.

RURAL AND NORTHERN COMMUNITIES INFRASTRUCTURE STREAM (RNCIS) For a project to be eligible, it must meet at least one of the following OUTCOMES:

Project is INELIGIBLE if: Steam Specific Requirements:

1. Improved food security 2. Improved and/or more

reliable road, air and/or marine infrastructure.

3. Improved broadband connectivity.

4. More efficient and/or reliable energy.

5. Improved education and/or health facilities (specific to Truth and Reconciliation Commission’s Calls to Action).

1. It is housing 2. It is an early learning and

childcare facility. 3. It is a health facility, or a

primary or secondary education facility, except to benefit indigenous peoples by advancing the Truth and reconciliation Commission’s Calls to Action.

4. It is a highway or trade corridor infrastructure, except for portions that connect communities that do not already heave year round road access.

5. It is a resource development infrastructure, notably industrial resource development access roads.

1. Projects will be restricted to those situated within, and that are for direct benefit of, rural and northern communities with a population of 100,000 or less based on 2016 Statistics Canada Census data.

STACKING AND COST-SHARING:

CANADA: The maximum funding from all federal sources to a project that is approved under RNCIS will not exceed:

a) Fifty percent (50%) of total eligible expenditures for municipalities and regional governments with a population of five thousand (5,000) or more and not-for-profit Ultimate Recipients;

b) Sixty percent (60%) of total eligible expenditures for municipalities and regional governments with a population of less then five thousand (5,000);

c) Seventy-five percent (75%) of total eligible expenditures for Indigenous Ultimate Recipients; or

d) Twenty-five percent (25%) of total eligible expenditures for for-profit, private sector Ultimate Recipients.

**Gas Tax is a federal source of funding and therefore cannot be used as municipal share.

III. EOI INSTRUCTIONS:

To submit an EOI, follow these steps:

Step 1: Review this Guide and visit the links to the federal Investing in Canada Infrastructure

Program (ICIP) to learn more about the program.

Step 2: Prior to beginning, compile all the necessary data required to complete the submission.

There is a limit of five (5) projects that can be submitted in each online EOI form. If

your organization would like to submit more that five (5) priority projects, please

complete additional submissions as necessary.

Step 3: The project must be able to support a minimum of one Outcome measured by at least

one related Indicator. Refer to Appendix 1 for additional information on Investment

Stream Outcomes and the reporting Indicators, to assist in determining the project’s

eligibility.

Refer to Appendix 2 for eligible and ineligible costs.

Step 4: Complete the online EOI submission form: EOI FORM. Save a copy of the form if it

cannot be completed in one sitting. Use the “LOAD AN EXISTING FORM” button on

the form to upload the partially completed EOI submission file from your computer to

complete the submission.

Step 5: Print and save a copy of the complete electronic submission prior to clicking

“submit”. Once submitted, it will not be available to print or save. A confirmation

number will be provided, verifying the submission was received. Please retain this

number for your records.

IV. NEXT STEPS:

ICIP is a 10 -year program, and therefore several application intakes are expected. Currently,

Manitoba is anticipating that the first formal application intake will take place in the Fall of 2018.

The outcomes-based eligibility approach is new to federal/provincial cost-shared programming. In

anticipation of a formal application intake, we recommend a thorough review of the ICIP program

information within this guide, as well as the information available on Infrastructure Canada’s website.

The EOI process provides an opportunity to become more familiar and knowledgeable about ICIP

requirements, which will assist in identifying projects that align with ICIP objectives and eligibility.

APPENDIX 1: ICIP Investment Streams - Outcomes and Indicators

Projects eligible for funding under the ICIP investment stream must support at least one of the stream

Outcomes. A predetermined set of Indicators has been established by Canada to measure a project’s

performance in supporting the established Outcome(s) of each investment stream. Review the following

project Indicators and related Outcomes, along with supporting information, to establish under which ICIP

investment stream or streams a project may fit.

Types of CCR assets include but are not limited to; ice arenas, pools, galleries, libraries, museums, performance spaces, community centres, curling rinks, sports facilities. Definitions Accessibility: Taking appropriate measures to ensure persons with disabilities have access, on an equal basis with others, to the physical environment, to transportation, and to other facilities and services open and provided to the public. Benefit: In reference to Communities, Culture and Recreation infrastructure - providing opportunities for the target group to be involved in learning, social, cultural or physical activities or programming. Official Language of Minority Communities (OLMC): A community whose maternal or chosen official language is not the majority language in their province or territory – Francophone communities outside of Quebec and Anglophone communities inside of Quebec. List of OLMC communities provided by Heritage Canada, Official Languages Branch and based on Statistics Canada Census data. Universal design: Universal design is the design of products and environments to be usable by all people, to the greatest extent possible, without the need for adaptation or specialized design. Universal design is based on seven principles: equitable use; flexible in use; simple and intuitive; perceptible information; tolerance for error; low physical effort; and size and space for approach and use. When universal design principles are applied, products and environments meet the needs of potential users with a wide variety of characteristics, including disabilities. Vulnerable Population: Families or individuals who would likely have to spend a substantially larger share of their income than average on the necessities of food, shelter and clothing and thus would be living in a difficult economic circumstance.

Examples of transit-exclusive infrastructure include: roadway, tunnel, bridge, railway track, other/shared. Examples of active transportation infrastructure include, but are not limited to: bike/pedestrian lanes and sidewalks, footpaths and recreational trails, support facilities (such as bike parking facilities). Examples of safety related improvements include: video surveillance, driver safety, security support vehicles, passenger alarm system, cloud intelligence sharing/information management infrastructure, video screens and PA system for passenger announcements, barriers. APPENDIX 2 – ICIP Eligible and Ineligible Project Costs The following is a general overview of eligible and ineligible expenses under ICIP. Important Note: At the EOI stage, all costs incurred are INELIGIBLE. Project Costs: ELIGIBLE

o All costs considered by Manitoba and Canada to be direct and necessary for the successful

implementation of an eligible project excluding those explicitly identified under ineligible

expenditures or under specified stream.

o The incremental costs of employees of a proponent may be included as eligible expenditures

for a project under certain conditions.

Project Costs: INELIGIBLE o Costs incurred before application intake and project approval and any and all expenditures

related to contracts signed prior to Project approval except for expenditures associated with

completing climate lens assessments as required;

o All capital costs including site preparation and construction costs until Canada has confirmed

environmental assessment and Aboriginal consultation obligations as required;

o Costs incurred for cancelled projects;

o Costs of relocating entire communities;

o Land acquisition;

o Leasing land, buildings and other facilities; leasing equipment other than equipment directly

related to the construction of the project; real estate fees and related costs;

o Any overhead costs, including salaries and other employment benefits of any employees of

proponent, ay direct and indirect operating or administrative costs of proponent;

o Financing charges, legal fees and loan interest payment, including related to easements i.e.

surveys;

o Any goods or services costs which are received through donations or in-kind;

o Provincial sales tax, goods and services tax or harmonized sales tax for which the proponent is

eligible for rebate;

o Costs associated with operating expenses and regularly scheduled maintenance work; and

o Cost related to furnishing and non-fixed assets, which are not essential for the operation of the

asset/project.
