FarewellMessageFromTheFormerInspectorGeneralChristopherR.Mazzella

ItiswithconsiderablepridethatIpresenttoyoutheOfficeof theInspectorGeneral’s(OIG)2012AnnualReport.ThisisthefinalannualreportIwillbeofferingasIretirefromgovernmentserviceonApril26th.Likesomanybeforeit,thisreportdepictssignificantaccomplishmentsachievedbytheOIGinprovidingoversightof Countyprogramsandprojects.Indeed,inreflectingonthepastyearsthatI’veservedasInspectorGeneral,itisevidentourcumulativesuccessesareunmatchedwith224arrests;$165millioninquestionablecosts,damages,andlostrevenuesidentified;and$126.6millioninfinancialrecoveriesandincreasedrevenuesrecognized.Andonecanonlyimaginewhatdeterrentimpactouroversighthashadonpreventingothermalignedbehaviorormismanagement.

Recognizingtheimportanceof aneffectiveinspectorgeneral’soffice,theMayorandtheMiami-DadeCountyBoardof CountyCommissioners(BCC)haveconsistentlyendorsedandenactedlegislationtopromotetheOIG’sindependenceandautonomy,somuchsothattheOfficehasbecomenationallyrecognizedbytheAssociationof InspectorsGeneralasamodeluponwhichtocreatenewIGoffices.Thisinnovativeandprogressiveapproachbyourlawmakersishighlycommendable.Further,theMayorandBCChavealwaysfunded,withoutanyopposition,theoperationsandpersonnelneedsof theOIG,therebyassuringitsinstitutionalization.Thus,becomingareliable,independent,andautonomousagencychargedwithoversightof Countyprogramsandprojects,andinvestigatingCountyaffairsisgoodforthefutureof Miami-DadeCounty.Finally,IamverypleasedwiththeFederalBureauof Investigation’sdesignationof theOIGasacriminaljusticeagencyandof theaccreditationaffordedtotheOIGbytheCommissionforFloridaLawEnforcementAccreditation.ThesecharacterizationsmeanthattheOIGisoperatingunderthemoststringentandhighestprofessionalstandards.

HISTORYMorethanfifteenyearsago,afterbeingoutragedbyaseriesofcorruptionevents,thecitizensofMiami-DadeCountycalledfortransparentandcleangovernment�Inresponsetothepublic’sdemands,theMiami-DadeCountyBoardofCountyCommissioners(BCC)createdtheOfficeoftheInspectorGeneral(OIG)�ItsenablingauthoritywasenactedinDecember1997throughSection2-1076oftheCodeofMiami-DadeCounty�

Section2-1076legislationempowerstheOIGtoinvestigateandreviewallegationsofwaste,abuse,fraud,andmismanagementinCountyaffairs�ChristopherMazzellawasselectedastheCounty’sfirstInspectorGeneral(IG)inSeptember1998�HewasreappointedastheCounty’sIGin2005,andwasagainreappointedforanotherfour-yearterminDecember2009�

IntheoriginallegislationcreatingtheOIG,theBCCdeterminedthatinordertooverseesuchalargeanddiversegovernment,theOIGshouldbeindependentandautonomous�InMarchof2005,theBCCvotedunanimouslytogivetheOIGgreaterautonomyandindependencebyrevampingtheselectionprocessofthelnspectorGeneralandbyaffordingtheIGwithafour-yearrenewablecontract�UnlikesomesituationswheretheIGischosenbythesameelectedofficialswhocouldbecomesubjectsofaninvestigation,theMiami-DadeIGisselectedbyanindependentfive-memberpanelthatincludesthePresidentoftheMiami-DadePoliceChiefs’Association,theStateAttorneyandthePublicDefenderforthe11thJudicialCourtforMiami-DadeCounty,theChairpersonoftheMiami-DadeCountyEthicsCommission,andthelocalheadoftheFloridaDepartmentofLawEnforcement�TheBCCultimatelyapprovesthepanel’sselection�

FUNCTIONIGofficesarefoundthroughoutthecountryatalllevelsoflocal,state,andfederaljurisdictions�TheMiami-DadeCountyOIGisoftenviewedbyotherlocaljurisdictionsaroundthecountryastheleadingmodeluponwhichtostructuretheirorganizations,anditoftenlendsitssupporttootheragencies�

TheMiami-DadeCountyOIGhasjurisdictiontoinvestigateofficialsatanylevel,includingelectedofficials�Toperformitsprimarymission,theOIGisempoweredtorequireanyCountyofficial,agency,orinstrumentalitytoproducedocumentsandrecords�TheOIGmayalsoissuesubpoenasandadministeroathswhenproperandappropriate�

SATELLITEOFFICESBeginningin2000,theOfficeoftheInspectorGeneralexpandeditsoperationsbycreatingseveralpermanentoversightofficesaroundtheCounty�TheOIGdeploysinvestigators,auditorsandanalysts,asneeded,onallsatelliteassignments�Thesesatelliteofficesarenowhouseddirectlywithin

severaldepartments�ThefirstOIGsatelliteofficewasopenedatMiamiInternationalAirport,andbytheendof2002itwasstaffedwithfourfull-timespecialagents�Onaregularbasis,theMiami-DadeAviationDepartmentreferscomplexmatterstotheOIGforanindependentandobjectiveassessmentandanefficientresolution�

TheOIGhasalsohadapermanentpresenceattheMiami-DadeWaterandSewerDepartmentsince2000�Inaddition,from2007to2010theOIGwasphysicallypresentattheSouthDistrictWastewaterTreatmentPlantduringits$600millioncapitalupgradeprogram�TheOIGremainscommittedtoproactivecontractoversightastheWaterandSewerDepartmentembarksonanunprecedented$4billioninfrastructureoverhaul�

In2005,theOfficeoftheInspectorGeneralsteppedupitsoversightoftheCounty’sPublicHealthTrustanditsoperationofJacksonMemorialHospitalthatincludedopeningasatelliteofficeatJacksonMedicalTowers�OtherCountydepartmentsthattheOIGmaintainsastrategicpartnershipwitharetheSeaport,theHousingDepartment,theTransitDepartment,andthePublicWorksandWasteManagementDepartment�

Duringtheirconstructionphases,theOIGmaintainedanon-sitepresenceatthePerformingArtsCenterandattheMarlinsbaseballstadium�

INTERLOCALAGREEMENTWITHTHESCHOOLBOARDOFMIAMI-DADECOUNTYOurnewestsatellitebranchopenedin2008,asaresultofanInterlocalAgreementunanimouslyapprovedinDecember2007bytheBCCandtheSchoolBoardofMiami-DadeCounty�Underthisagreement,theOIGhastakenontheadditionalroleofInspectorGeneralforthenation’sfourthlargestschooldistrict�TheInterlocalAgreementgrantstheOIGtheauthoritytoinvestigateanyaspectoftheschoolsystem�Independentoversightisessentialtoaschooldistrictmanaging$4�3billioninpublicfunds�

ThefourthannualreportoftheMiami-DadeCountyPublicSchools(M-DCPS)IGwaspublishedforfiscalyear2011-2012�Inrelationtofraudfightingactivities,investigationsbytheOIGculminatedinseveralarrestsovertheyear�OneinvestigationresultedinthearrestofanoperatorofanM-DCPSSupplementalEducationServices(SES)programprovider�TheprincipalofDivineSports,Inc�(DivineSports),aFloridanot-for-profitcorporation,waschargedwith47feloniesrelatingtofraudulentbillingschemesinvolvingtheafterschoolSEStutoringprogramsatMiamiCentralHighSchool,MiamiNorthwesternSeniorHighSchool,andGoldenGladesElementary�Thecompany,DivineSports,wasalsochargedwiththesame47felonies�

AnotherrecentinvestigationledtothearrestofaformeremployeewhoworkedasasecretaryattheRegistrar’sOfficeoftheNorthMiamiAdultEducationCenter(NMAEC)from2007until2011�ThesubjectwaschargedwithFraudulentUseofPersonalIdentification�TheOIGinvestigationdeterminedthatthesubjectusedastudent’snameanddriver’slicensetoobtainFloridaPower&Light(FPL)serviceforherhome�ThesubjectsentFPLacoupleoffacsimilesusingthestudent’snameanddriverslicensetoopentheaccount�ThesubjectthenfailedtopayFPL$1,046fortheservice�

ACCREDITATIONANDCRIMINALJUSTICEAGENCYSTATUSTheCommissionforFloridaLawEnforcementAccreditation(CFA)wasformedin1993�Initially,theCFA’saccreditationprocesswasjustforlawenforcementandcorrectionalagencies�TheCFABoardiscomprisedoffoursheriffs;fourpolicechiefs;andonerepresentativeeachfromtheAssociationofCounties,theLeagueofCities,theStateLawEnforcementChiefs’Association,andtheStateofFloridaJudiciary�In2009,anInspectorGeneralwasaddedasaBoardmember�TheCFAworkedcloselywithFlorida’sInspectorsGeneraltodevelopprofessionalstandardsforFloridaInspectorGeneralinvestigativefunctions�

InMay2010,anassessmentteamfromtheCFAarrivedtoexamineallaspectsoftheMiami-DadeCountyOIG’spoliciesandprocedures,management,andoperations�TheMiami-DadeCountyOIGhadtocomplywithapproximately40standardsinordertoreceiveaccreditedstatus�TheCFA’sassessmentteamwascomposedoflawenforcementpractitionersfromsimilaragencies�Theassessorsreviewedwrittenmaterials,interviewedindividuals,andvisitedsatelliteoffices�

OncetheCFA’sassessorscompletedtheirreview,theyreportedbacktothefullCommissionBoard�TheMiami-DadeCountyOfficeoftheInspectorGeneralreceivedaccreditationinJuly2010�

Havingheldaccreditationforalmostathree-yearperiod,theMiami-DadeOIGhasagainundergoneamandatoryassessmentforreaccreditation�Duringthisprocess,agenciesarerequiredtodemonstratecompliancewithallmandatorystandards�TheOIGdemonstrateditsproofofcompliancewiththesestandards,whichwasdeterminedbyaMarch2013on-sitereviewofitspolicies,procedures,andpracticesbyanassessmentteamsentbytheCommission�

TheMiami-DadeCountyOIGisassistingtheMiami-DadeSchoolsPoliceDepartmentinitsquesttobecomeaccreditedthroughtheCommissiononFloridaAccreditation�TheMiami-DadeCountyOIGconductedareviewoftheSchoolsPoliceDepartment’spoliciesandprocedures,inspectedseveraloftheirfacilities,andprovidedrecommendationsonhowtoimprovetheirwrittenpoliciesandprocedures�TheSchoolsPoliceDepartmentisworkingonupdatingitspoliciesandproceduresinordertoapplyforaccreditation�

TheOIGhasalsobeendesignatedbytheFederalBureauofInvestigationasaCriminalJusticeAgency�Assuch,theOIGworkscloselywithotheragencies,includinglawenforcementagencies,incarryingoutitsmission�

In1998,Mr�MazzellaacceptedthepositionasMiami-DadeInspectorGeneraluponretiringfromadistinguished34-yearcareerwiththeFBI�SincetheOIGbecameoperationalinthefallof1998,theIGhasparticipatedonanumberoftaskforcesaimedatrestoringintegrityandethicsinourCountygovernment�Forinstance,Mr�Mazzella’sparticipationontheDebarmentTaskForceplayedanimportantroleintheadoptionoflegislationthatstrengthenedtheCounty’sdebarmentpolicytoexcludedishonestcontractorsandvendors�Healsoparticipatedoncommitteesstudyingprocurementandlobbyingreforms,andoftenlecturedtovariousprofessionalandcivicorganizationsonthetypesoffraudcasesinvestigatedbyhisOffice�Mr�Mazzella,asMiami-DadeCountyInspectorGeneral,servedasanactiveparticipantintheNationalAssociationofInspectorsGeneral(AIG),andin2001earnedthedesignationofCertifiedInspectorGeneral(AIGCertification)�

INVESTIGATIVEHIGHLIGHTSThe OIG Investigations Unit conducts investigations that may involve criminal and/or administrative allegations. When criminal allegations are sustained, the cases are forwarded to prosecutorial authorities for the filing of criminal charges. Administrative findings involving County employees, program abuse, or wasteful transactions are presented to the department director who is over the subject area. Investigative results are shared with the Board of County

Commissioners, the Mayor’s Office, and the public through the issuance of OIG advisory memoranda. The following are just some of the cases that the OIG Investigations Unit worked on during the year.

Inthefirstscam,prospectivebuyerspickedpropertiesfromlistingswithdelinquentMiami-Dadetaxes,andwrotecheckspayabletoMiami-DadeCountyorMDCShortSalesforthedelinquenttaxes�WritingthechecksouttotheCountyprovidedthevictimsameasureofcomfortinthelegitimacyofthetransaction�Thechecks(rangingfrom$6,000toover$30,000)weretakenbyGarcia,Young,AbreuorBou-NassartocheckcashingstoreswhereMDCShortSaleshadestablishedbusinessrelationships�BuyerswereassuredthattheywouldgetfulltitletothepropertyfromtheMiami-DadeCountycourts,andsomereceivedfraudulentlynotarizeddocumentsasproofoftheirpurchase�Thepropertieswereneverdeededtoanyofthevictimsandmostvictimslostalloftheirmoney�Afewrecoveredaminimalamountfromthedefendantsafterrepeatedrequeststhattheirmoneybereturned�Inthesecondvariationofthescam,thedefendantsusedthecompanyname,

AgreatconcerntotheOIGwastheabsenceofalandfillclosuredeadlineontheMunisportLandfillproject�Duetochangesindevelopers,thebankruptcyofonedeveloperandcourtinvolvementofareceiver,theprojectwasseriouslystalled�EventhoughtheCityofNorthMiamihadavailablegrantfundstocontinuewiththeclosurework,ithadnot�TheOIGrecommendedde-couplingthegrantfundingfromthecommercialdevelopmentofthesite�Similarly,theOIGauditcommentedonthefactthattheCityofMiami’sVirginiaKeyLandfillclosure

projectwasalsoatastandstill�Approximately$28millionhasbeensittingidleinarestrictedpooledcashaccountsince2005—bearingminimalinterest—whiletheCountycontinuestopaythedebtserviceonbondproceedsthatarenotbeingused�

ThefinalauditreportwasissuedinFebruary2012�Sincethen,significantactivityhastakenplacetomoveboththeMunisportandVirginiaKeylandfillclosureprojectsforward�InMay2012,theCityofNorthMiamifinallychoseanewdevelopmentteamforthesite�Moreimportantly,theCityretaineditsownengineeringconsultanttoproceedwithgroundwaterremediation�Thedeveloper,aspartofitsagreementwiththeCityofNorthMiami,isresponsiblefortheactuallandfillclosureandmustcompletethisactivitywithintenyears�

InMarch2013,theBCCpassedaresolutionapprovingtheexecutionofaninterlocalagreementbetweentheCountyandtheCityofMiamifortheremediationandclosureoftheVirginiaKeyLandfillsite�Theoriginalgrantagreementwasterminatedandreplacedbythisinterlocalagreement�TheCountywillconducttheremediationandclosure,whichwillincludethecompletionoftheSiteAssessmentReport(SAR),preparationofaRemedialActionPlan,constructionandimplementationoftheremedialsystemdesign,performanceoflandfillclosureconstruction,andsecuringlandfillclosurecertification�Todate,theCountyhasexecutedanagreementwithaconsultanttoprovidetheSARandremedialsystemdesign�

Theprojectisestimatedtocostapproximately$46million�Approximately$28millionof2005seriesbondfundingwillbeusedtofundtheCounty’sinitialefforts�Anewbondissuancewillbeneededforfundstocompletetheclosureproject�Uponcompletionoftheremediationandclosure,theCityofMiamiintendstousethesiteasapublicpurposepark�

AnimalServicesAuditRevealsAdministrativeMessAnOIGauditoftheAnimalServicesDepartment(ASD)resultedin10findingsand20recommendationsthatdocumentASD’sadministrativeandenforcementactivitiesastheyrelatetodograbiesvaccinationsandlicensetags�Theaudit’sprimaryobservationsaddressedASD’slackofawarenessorwillingnesstoresolvenon-compliantpracticesbylicensingstations(i�e�,veterinarians,petdealers,andhobbybreeders)�TheselicensingstationswerenotofferingtodogownersintheCountycertainbenefitsavailableunderCountyCode�Twobenefitsthatshouldhavebeenavailabletothepublicare:(1)thatveterinarianshavelicensetagsavailableforsaleatthetimethedogreceivesitsannualvaccination,and(2)thatreducedpricelicensetagsareavailableforsaletolow-incomeCountydogowners�TheauditnotedthatChapter5oftheCountyCoderequiresdogownersto

bothvaccinateandtagtheirdogsannually�Theauditdocumentedthatseverallicensingstationsdidnotmakedogtagsavailableforsale,inconveniencingdogowners,whowouldthenhavetoobtaindogtagsfromASDdirectly�ThisdisconnectalsoadverselyimpactedASD’sabilitytokeepitslicensingdatabasecurrent,becausethepaperworksubmittedbyveterinariansforrabiesvaccinationwasnotalwaysaccompaniedbythelicenserenewalpaperwork�Asaresult,doglicensefeeshadtobecollectedseparatelyfromtheowner,thusaffectingthedepartment’srevenuecollection�

TheOIGauditillustratesthatASDusedalaborintensiveandtime-consumingproceduretoprocessinformationsubmittedbylicensingstations�InFY2011,staffprocessedabout2,200MonthlyAccountingReportsattachedtowhichwere220,000rabiesvaccinationcertificates�ASDisconsistentlythreetofourmonthsbehindinitsdataentryofrabiesvaccinationinformation,whichcanresultininappropriatecitationsbeingissuedtoowners�ThebackloginprocessingthemonthlyreportssignificantlyimpactsASD’sabilitytotimelycompletetheannualreconciliations�Forexample,ASDcompleteditsFY2010annualreconciliationsinJuly2012�UntimelyreconciliationsimpairASD’sabilitytoinvoicelicensingstationsforthecostoftagsconsignedtothembutnotreportedassoldorreturnedtotheDepartment�

Moreover,veterinariansarenotrequiredtoreporteuthanizeddogs�Owners,ontheotherhand,maybeundertheimpressionthattheirveterinariansdoreporteuthanizedpets�ThismisunderstandingcausedOIGauditorstowitnessdistraughtdogownerstryingtorectifycitationsissuedtothempertainingtotheirdeceaseddogs�

Finally,OIGauditorsobservedthatASD’spetdealerlicensingstationregistrationprocessisnotwellcoordinatedandresultedinsomepetdealersnotbeingregisteredaslicensingstations�Inaddition,ASDhasnoprocedureforidentifyingclosedlicensingstationsandgettingbackitsunissuedtags�

InlightofcurrenteffortstoestablishadedicatedrevenuesourceforASDandforASDtobecomea“no-kill”shelter,theOIGbelievesthattheexpeditiousimplementationoftheaudit’srecommendationsisvitaltoenhancingthepublic’strustoftheCounty’sadministrationoverAnimalServices�

AuditofBasketballArenaContractManagementInApril1997,CountyCommissionersapprovedvariousagreementsforthedevelopmentandmanagementofanewarena,financedbythenewlyformedHeatGrouppartnership,BasketballProperties,Ltd�(BPL)�TheAmericanAirlinesArena(Arena)isCounty-ownedandsubsidized,builton17acresofwaterfrontpropertythattheCountypurchasedfromtheCityofMiamifor$37�6millioninearly1998�ConstructionoftheArenabeganinearly1998,andlessthantwoyearslatertheArenaofficiallyopeneditsdoorsonDecember31,1999�

InMay2012,theOIGreleaseditsauditthatfocusedontheCounty’sadministrationoftheManagementAgreement(Agreement)withBPLandits

accountingrecordsandfinancialreportingforfiscalyearsendingJune30,2005throughJune30,2010�UndertheAgreement,anyexcesscashflowderivedfromArenaoperationsaredistributedtoBPL,withoneexception�Aprofitsharingprovisionprovidesacomputationtoperform,ifArenaoperationsachieveacertainamountofexcesscash,allowingBPLtoretainthefirst$14millionof“ArenaDistributableNetCashFlow”(NetCashFlow)�Anyexcessover$14millionistobedistributedbetweenBPLandtheCounty,with60%oftheexcessamountgoingtoBPLandtheremaining40%totheCounty�Asoffiscalyear2012,Arenaoperationshaveonlygenerated$6�2millionofNetCashFlow,so

therehavebeennodistributionstotheCountytodate�

TheOIGauditfoundafundamentallackofcommunicationbetweenthedesignated“CountyRepresentative”andBPLpersonnelregardingtheiradministration,management,legalissues,andoperationoftheArena�InterviewsofCountyandBPLstaffrevealedthattheCountyhadlittleideaastowhytheArenafailedtogeneratesufficientreportableNetCashFlowtoresultinprofitsharing�Theseadministrativedeficienciescontributedtoauditfindingspertainingtothebudgetaryprocess,tothemonitoringofArenaassets,totheaccountingprocess,andtotheactualfinancialresultsattained�

Forexample,AnnualOperatingBudgetswereconsistentlysubmittedlateandAnnualCapitalBudgetswerenotbeingreceivedatallbytheCounty�TheOIGlearnedthatBPLspent$127,640(fiscalyear2008)to$2,549,810(fiscalyear2007)moreoncapitalexpendituresthanwasshowninits—undistributed—AnnualCapitalBudget�Overthecourseofsixfiscalyears,BPLoverspentitscapitalbudgetonfouroccasions,totaling$3�3million�Hadthe

FurtheradministrativelapsesincludedtheCounty’sfailureinmonitoringpersonalpropertyandequipmentinventorylistingsfortheArena($5�1millionofpropertyandequipment)�Similarly,theCountyhadneverhiredanindependentqualifiedengineertoinspecthowthe$200millionArenaisbeingmaintained�TheCountyalsolackedanunderstandingofArenaoperationsthataffectrevenues,suchasPremiumInventoryseatingticketsalescontracts,Arenaconfigurationandusage,non-Heateventusage,andthird-partyadvertising�AuditorsobservedunaddressedproblemsinBPL’saccountingpracticesandfinancialreporting,andfoundthatBPL’srecordedexpenseallocationshavebeeninconsistentandunsupportedbyauthoritativeaccountingrecords�CertainexpensesweredeemedquestionablewhencalculatingtheNetCashFlow,suchaspoliticalandcharitablecontributions,associationduesandsponsorships,certainlobbyingexpenses,andexecutivecompensation�

Toaddresstheseauditfindings,theOIGrecommendedchangesinadministrativeprotocolsandadjustmentstocertainamountsprovidedforinthecomputationofNetCashFlow�Theauditresultedintheimplementationofadministrativecontrolprotocolsfor21ofthe23OIGrecommendations,promotingfiscalprudenceandenforcingtheCounty’srights,asoutlinedintheAgreements�

However,twootherauditrecommendations,relatingtomonetaryadjustments,werenotpursuedbytheCounty�Statusreportsandcorrespondenceissuedinthefallof2012attemptedtoresolvetheOIG’sdisagreementwiththeCountyadministrationontheselastpoints�Attheendofthediscussion,CountyadministratorsrepliedtotheOIGthattheseexpenditures—whichincludedtheaforementionedlobbyingexpensesandpoliticalcontributions—were“customaryinaccordancewithindustrystandards”andthattheywouldnotseektorecoupthem�TheOIGclassifiedthisauditasclosedbutunresolvedduetothedisagreementoverthesetworecommendations�

JacksonHealth’sInternationalProgramFinallyIn-SourcedInOctober2010,anOIGauditoftheManagementServicesAgreementbetweenthePublicHealthTrust/JacksonHealthSystem(PHT/JHS)andFoundationHealthServices,Inc�(FHS)recommendedthat“PHT/JHSreevaluatetheentirearrangementbetweenitandFHSfortheoperationandmanagementoftheJacksonMemorialHospitalInternationalProgramandfortheprovisionofhospitalityandconciergeservices�ThisreviewshouldreevaluatethePHT/JHS’needanddesiretooutsourcebothoreitheroftheseoperations,andtheefficienciestobeachievedbythePHT/JHStomanageitsownprogramsdirectly�Non-monetaryconsiderations,suchasaccountabilityandtransparency,shouldalsobetakenintoaccountinthis,orinanyconsiderationregardingtheexpenditureofpublicfunds�”

AfterterminatingitsagreementwithFHS,thePHT/JHScreateditsownnot-for-profitentity,JacksonMemorialInternational,Inc�,tomarketthehospitalandmedicalservicestointernationalpatients�Afteroperatingforapproximatelyoneyear,PHT/JHSofficialssoughttowinddowntheactivitiesofitsnot-for-profitentityandfinallytransfertheoperationsin-house�Duringthatoneyearoperation,thenot-for-profitneverfullygotofftheground�IthadaBoardofDirectorsbutitsemployeesweretemporarilyplacedonthePHT/JHSpayrolluntiltheyweretobetransitionedtothenewnot-for-profit—whichneverhappened�Afteroneyear,thePHT/JHSreportedthatthedefactoin-sourcingoftheprogramprovidedunexpectedresultswitha40%reductioninexpendituresanda52%increaseinrevenues!

Intheend,thePHT/JHSfinallydissolveditsnot-for-profitandmadetheInternationalProgramadepartmentofPHT/JHS�Itwaswidelyrecognizedthatthiswouldnotonlysavemoney,butprovidetheincreasedaccountabilityandheightenedtransparencyoriginallyadvocatedbytheOIG�

(6)TheInspectorGeneralmay,onarandombasis,performaudits,inspectionsandreviewsofallCountycontracts�Thecostofrandomaudits, inspectionsandreviewsshall,exceptasprovidedin(a)-(o)inthissubsection(6),beincorporatedintothecontractpriceofallcontractsandshallbeonequarter(1/4)ofone(1)percentofthecontractprice(hereinafter“IGcontractfee”)�TheIGcontractfeeshallnotapplytothefollowingcontracts:

(a)IPSIGcontracts;

(b)Contractsforlegalservices;

(c)Contractsforfinancialadvisoryservices;

(d)Auditingcontracts;(e)Facilityrentalsandleaseagreements;

(f)Concessionsandotherrentalagreements;

(g)Insurancecontracts;

(h)Revenue-generatingcontracts;

(i)ContractswhereanIPSIGisassignedatthetimethecontractisapprovedbytheCommission;

(j)Professionalserviceagreementsunderonethousanddollars($1,000);

(k)Managementagreements;

(l)SmallpurchaseordersasdefinedinAdministrativeOrder3-2;

(m)Federal,stateandlocalgovernment-fundedgrants;and

(n)Interlocalagreements�

(o)GrantAgreementsgrantingnot-for-profitorganizationsBuildingBetterCommunitiesGeneralObligationBondProgramfunds�

Notwithstandingtheforegoing,theCommissionmaybyresolutionspecificallyauthorizetheinclusionoftheIGcontractfeeinanycontract�NothingcontainedinthisSubsection(c)(6)shall inanywaylimitthepowersoftheInspectorGeneralprovidedforinthisSectiontoperformaudits,inspections,reviewsandinvestigationsonallcountycontractsincluding,butnotlimitedto,thosecontractsspecificallyexemptedfromtheIGcontractfee�

(7)Where the InspectorGeneral detects corruption or fraud, he or she shall notify theappropriate law enforcement agencies� Subsequent to notifying the appropriate lawenforcement agency, the Inspector General may assist the law enforcement agency inconcluding the investigation�When the InspectorGeneral detects a violation of one (1)of theordinanceswithin the jurisdictionof theEthicsCommission,heor shemay fileacomplaintwiththeEthicsCommissionorreferthemattertotheAdvocate�

(8) The Inspector General shall have the power to audit, investigate,monitor, oversee,inspect and review the operations, activities and performance and procurement processincluding, but not limited to, project design, establishment of bid specifications, bidsubmittals,activitiesofthecontractor,itsofficers,agentsandemployees,lobbyists,Countystaff and elected officials in order to ensure compliancewith contract specifications anddetectcorruptionandfraud�

(9) The Inspector General shall have the power to review and investigate any citizen’scomplaints regarding County or Public Health Trust projects, programs, contracts ortransactions�

(10)TheInspectorGeneralmayexerciseanyofthepowerscontainedinSection2-1076uponhisorherowninitiative�

(11)TheInspectorGeneralshallbenotifiedinwritingpriortoanymeetingofaselectionornegotiationcommitteewhereanymatterrelatingtotheprocurementofgoodsorservicesbytheCountyistobediscussed�Thenoticerequiredbythissubsection(11)shallbegiventotheInspectorGeneralassoonaspossibleafterameetinghasbeenscheduled,but innoeventlaterthantwenty-four(24)hourspriortothescheduledmeeting�TheInspectorGeneralmay,athisorherdiscretion,attendalldulynoticedCountymeetingsrelatingtotheprocurementofgoodsorservicesasprovidedherein,and,inadditiontotheexerciseofallpowersconferredbySection2-1076,mayposequestionsandraiseconcernsconsistentwiththefunctions,authorityandpowersoftheInspectorGeneral�Anaudiotaperecordershallbeutilizedtorecordallselectionandnegotiationcommitteemeetings�

(12)TheInspectorGeneralshallhavetheauthoritytoretainandcoordinatetheservicesofIndependentPrivateSectorInspectorsGeneral(IPSIG)orotherprofessionalservices,asrequired,whenintheInspectorGeneral’sdiscretionheorsheconcludesthatsuchservicesareneededtoperformthedutiesandfunctionsenumeratedinsubsection(d)herein�

(e)Physicalfacilitiesandstaff�

(1)TheCountyshallprovidetheOfficeoftheInspectorGeneralwithappropriatelylocatedoffice space and sufficient physical facilities together with necessary office supplies,equipmentandfurnishingstoenabletheOfficetoperformsitsfunctions�

(2)TheInspectorGeneralshallhave,subjecttobudgetaryallocationbytheBoardofCountyCommissioners,thepowertoappoint,employ,andremovesuchassistants,employeesandpersonnel and establish personnel procedures as deemednecessary for the efficient andeffectiveadministrationoftheactivitiesoftheoffice�

(f) Procedure for finalization of reports and recommendationswhichmake findings as to thepersonorentitybeingreviewedorinspected�NotwithstandinganyotherprovisionsofthisCode,whenevertheInspectorGeneralconcludesareportorrecommendationwhichcontainsfindingsastothepersonorentitybeingreportedonorwhoisthesubjectoftherecommendation,theInspectorGeneralshallprovidetheaffectedpersonorentityacopyofthereportorrecommendationandsuchpersonorentityshallhave10workingdaystosubmitawrittenexplanationorrebuttalof the findings before the report or recommendation is finalized, and such timely submittedwrittenexplanationorrebuttalshallbeattachedtothefinalizedreportorrecommendation�Therequirementsofthissubsection(f)shallnotapplywhentheInspectorGeneral, inconjunctionwiththeStateAttorney,determinesthatsupplyingtheaffectedpersonorentitywithsuchreportwilljeopardizeapendingcriminalinvestigation�

(g)Reporting�TheInspectorGeneralshallannuallyprepareandsubmittotheMayorandBoardofCountyCommissionersawrittenreportconcerningtheworkandactivitiesoftheOfficeincluding,butnotlimitedto,statisticalinformationregardingthedispositionofclosedinvestigations,auditsandotherreviews�

(h)Removal�TheInspectorGeneralmayberemovedfromOfficeupontheaffirmativevoteoftwo-thirds(2/3)ofthewholenumberofmembersoftheBoardofCountyCommissioners�

(i)AbolitionoftheOffice�TheOfficeoftheInspectorGeneralshallonlybeabolishedupontheaffirmativevoteof two-thirds(2/3)of thewholenumberofmembersof theBoardofCountyCommissioners�
