What is a criminal background check?

• The process of responding to an Identification Record request.

Identification Record contain FBI files including:

• Federal Employment• Naturalization• Military Service• Arrest records (rap sheet)

Arrest records contain:• Name of agency submitting the record i.e.,

state police• Date of arrest• Charge(s)• Disposition (if known)

Who is legally permitted to request a background check?

• US Dept of Justice advises – state statute establishing guidelines for licensure must, in itself, require fingerprinting and authorize the agency to exchange fingerprint data directly with the FBI.

• State statute must be authorized by US Attorney General

West Virginia’s Authority: Based on WV Legislative Auditor’s Office Opinion:• Board has authority to propose rules,

statute delineates requirements for licensure, including convictions

• Applicants must provide all the info that would be in an FBI check

• No prohibitions against the board requiring FBI checks
