until Monday, March 5. This survey

covers 101 positions in fields such

Even if you aren’t a manufacturing

company, please take a look at the

jobs in the survey. There are a

number of positions, such as jani-

tors, security guards, and van driv-

ers that are common to many com-

panies. Even if you only have one

position to report, you’ll still get a

copy of the completed survey.

Also look for the 2012 Professional

and Supervisory Survey, which is

coming out on Monday, March 5.

We’ve added a few new positions

The 2011-2012 National Sales

Survey is now available!

The new National Sales Survey fea-

tions. Data is broken down into a

Proposed Amendments to the Family and Medical Leave Act

On January 30, 2012, the Department of

Labor announced a notice of proposed

rulemaking (NPRM) for new statutory

amendments to the Family and Medical

Leave Act (FMLA) expanding the military

leave provisions and providing special

provisions for airline flight crew mem-

bers.

Highlights of the proposed rule include:

• Extending military caregiver leave to

eligible family members of recent

veterans (for up to five years after

leaving the military) with a serious

injury or illness incurred in the line

of duty

• Implementing a flexible, three-part

definition for serious injury or illness

of a veteran

• Extending military caregiver leave to

cover serious injuries or illnesses for

both current service members and

veterans that result from the aggra-

vation during military service of a

preexisting condition

• Extending qualifying exigency leave

to eligible employees with covered

family members serving in the Regu-

lar Armed Forces - currently it only

covers National Guard and reservists

• Including a foreign deployment re-

quirement for qualifying exi gency

leave for the deployment of all ser-

vicemembers (National Guard, Re-

serves, Regular Armed Forces)

• Adding special hours of service eligi-

bility requirement for airline flight

crew employees

• Adding specific provisions for

calculating the amount of FMLA

leave used by airline flight crew

employees.

The NPRM has not been published

in the Federal Register yet, so there

is no set deadline to submit com-

ments. For additional information

on the proposed amendments to

the FMLA, the DOL has created a

web page for the NPRM. ERA will

provide an update when the NPRM

is actually published in the Federal

Register.

A U.S. Department of Transportation rule prohibiting interstate truck and bus drivers from using hand-held cell phones while operating their vehicles

became effective on January 3, 2012. The new rule prohibits commercial drivers from using a hand-held mobile telephone while operating a commer-cial truck or bus. Drivers who violate the restriction will face federal civil

penalties of up to $2,750 for each of-

fense and disqualification from operat-ing a commercial motor vehicle for multiple offenses. Additionally, states will suspend a driver’s commercial driver’s license (CDL) after two or

more serious traffic violations. Compa-nies who allow their commercial truck and bus drivers to use hand-held cell phones while driving will face a maxi-mum penalty of $11,000. The rule does not require motor carriers to es-tablish written policies in terms of

company policy or training programs for their drivers.

However, motor carriers are prohibited from allowing or requiring their drivers to use hand-held mobile phones. A motor carrier may establish policies or

practices that make it clear that the employer does not require or allow hand-held mobile telephone use while driving a commercial motor vehicle. The carrier is responsible for its driv-ers’ conduct. If motor carriers don’t already have policies in place banning

their drivers from using hand-held

phones, they are now recommended to do so in light of this new federal rule. The final hand-held cell phone ban rule can be viewed here. In addition, you

The U.S. Department of Labor

(DOL) recently issued new fact

sheets on retaliation against em-

ployees for filing complaints or ex-

ercising their rights under three

laws enforced by the Wage and

Hour Division of the DOL.

The Fair Labor Standards Act

(FLSA)

The provisions of the FLSA deal

primarily with wage payment and

what activities constitute hours

worked. Retaliation against any

employee by an employer for mak-

ing a complaint either orally or in

writing, inside or outside the com-

pany, is prohibited. The prohibi-

tion also applies to retaliation by

former employers. For more infor-

The Family and Medical Leave

Act (FMLA)

The FMLA provides job-protected

leave for covered employees, in-

cluding health care protections.

Retaliation under FMLA includes

such actions as denying or inter-

fering with leave entitlement; dis-

charging or taking other negative

employment action against an em-

ployee or applicant because they

exercised their rights under FMLA;

or discriminating against an em-

ployee or other person for com-

plaining about unlawful acts un-

der the FMLA, filing charges, or

providing information in any in-

vestigation or proceeding. For

The Migrant and Seasonal

Agricultural Worker Protec-

tion Act (MSPA)

The MSPA protects migrant and

agricultural workers by establish-

ing employment standards and

requiring employers of these

workers to register with the DOL.

The Fact Sheet specifically ad-

dresses prohibited actions such

as intimidation, threats, coer-

cion, restraint, blacklisting, and

discharge or any other type of

discrimination against an em-

ployee for making a complaint or

participating in any proceeding

regarding violations under the
