Recommendation THAT Council give Bylaw 20-2011 third reading. Council History On July 3, 2001, Council adopted Land Use Bylaw 8-2001. On May 10, 2011, Council authorized a Public Hearing for Bylaw 20-2011 to be held on May 24, 2011, at 7:00 p.m. On Ma y 24 , 2011, Council gave Bylaw 20-2 011 first an d second r eadings an d adopted a Conceptual Scheme for Pt. SW 5-52-22-W4. Background/Justification Strategic Plan: Governance Community Well Being X Environmental Sustainability X Economic Viability Service Delivery Stakeholder Communication Resource Management Policy: SER-008-022 “Redistricting Bylaws”; SER-008-019 “Conceptual Schemes”. A Conceptual Scheme ha s been approved for Pt. of SW 5-52-22-W4, based on the re quirements of County Policy. Legislative/Legal: The subject pa rcel is iden tified a s a Fragmented Country Residential Subdivision Outside the Country Residential Policy Area Boun dary in th e Municipal Development Plan (1-2007). The current districting is RA Rural Residential/Agricu lture District under the Land Use Bylaw. Economic: Pursuant to County Policy, the redistricting and development proposal w ill not be a financial bur den on rate payers of th e County. A developme nt agreeme nt is not required and there will be no financial implications to the County. Social: The proposal provides for additional rural resident ial options for citizens o f Strathcona County while protecting priority habitat and sensitive environmental features that are of value to the community. Environmental: The proposed conservation district pr otects the significant t ree stands, wetlands and wildlife corridors within the subject pro perty and is consiste nt with the environmental recommendations included as part of the approved Conceptual Scheme. Stakeholder: Adjacent landowners were notified by mail and the Public Hearing was advertised in the local newspaper. Interdepartmental: N/A Summary The proposed amendment would fa cilitate the redistricting of the Conceptual Sche me lands. A Conceptual Scheme provides a fra mework for the subsequent subdivision and/or d evelopment of the subject lands. The Municipal Development Plan identifies th e SW 5-52-22-W4 as a Fragmented Country Residential Subdivision, which allows consideration for the development of country residential lots on parcels that lie outside the Country Residential Policy Area subject to the preparation of a Conceptual Scheme. BYLAW 20-2011

A BYLAW OF STRATHCONA COUNTY IN THE PROVINCE OF ALBERTA, FOR THE PURPOSE OF AMENDING BYLAW NO. 8-2001, AS AMENDED, BEING THE LAND USE BYLAW.

WHEREAS it is deemed advisable to amend the Land Use Bylaw;

NOW THEREFORE, the Council of Strathcona County, duly assembled, pursuant to the authority conferred upon it by the Municipal Government Act, R. S.A. 2000, c. M-26, and amendments thereto, enacts as follows:

That Bylaw 8-2001, as amended, be amended as follows:

1. That approximately 9.98 hectares (24.7 acres) in the SW 5-52-22-W4, Lot 1 and 2, Plan 942 2691 be redistricted from RA Rural Residential/Agriculture District to RC Country Residential District as outlined on Schedule "An attached hereto.

2. That approximately 5.0 hectares (12.4 acres) in the SW 5-52-22-W4, Lot 1 and 2, Plan 942 2691 be redistricted from RA Rural Residential/Agriculture District to PC Conservation District, as outlined on Schedule "A" attached hereto.

3. This bylaw comes into effect after third reading and upon being signed.

Read a first time this 24th day of May, 2011.

Read a second time this 24th day of May, 2011.

Read a third time and finally passed this _____ day of _________, 2012.
