FOR Umdoni’s ratepayers, a five percentincrease in rates for the 2014/15 finan-cial year will be “too much” in these

ONE of the mildest sentences known toour law was passed in a Scottburgh courtlast week when Alan John Muller fromUmkomaas was “detained until the courtrises”. However, although mild, it shouldwarn even the most law-abiding citizen howeasy it is to fall foul of the law in an instantof frustration or anger.
Convicted by Magistrate Chris Schoemanof assaulting 65- year-old John AndréJordaan through grabbing and pushing himagainst a wall, 53-year-old Muller served hissentence in the minute it took the magistrateto adjourn the court.
The incident occurred on 16 May 2013when Muller, one of the owners ofKwamnadi Lodge in Umkomaas foundJordaan, a tenant, at the stove in the kitch-en.
Jordaan had previously been bannedfrom entering the kitchen and surroundingarea for unspecified reasons and Mullerchallenged his presence there.
Jordaan replied that the stove had beengiven to him by the church and he was
checking on work being done on it by one ofthe staff.
Muller, who told the court that the stovehad been left by another man and hadeffectively become part of the household,told Jordaan to get out in accordance withhis banning.
Jordaan refused and an argumenterupted which saw Muller “forcibly move”Jordaan from the kitchen and down thepassage to the foyer.
Jordaan claimed he had been bruised andinjured in the process and laid an assaultcharge against Muller.
Defence counsel Peter Rousseauargued under the de minimus procedurethat the charge was frivolous but themagistrate ruled Muller guilty ascharged.
However, he also conceded in mitigationthat Jordaan had transgressed by enteringthe kitchen and he sentenced Muller interms of Section 284 of the CriminalProcedure Act to detention until thecourtrose.
This has the unique consequence that nocriminal record attaches to the convictedperson.

THE eThekwini MunicipalityExecutive Committee (Exco)has approved a proposed
south Illovo local area plan (LAP)which will mainly cater for the localautomotive industry.
Oncecompletedtheplanwillcom-prise of 3 792 residential homes,1316 207m2ofdevelopableindustri-al land and 51 810m2 of developa-ble commercial area.
The plan also includes the up-grading of interchanges betweenKingswayanduMgababaandthere-alignmentofanewbridgeover IllovoRiver.
Theplanhasbeenbroken into sixsub-districts.
The first district, known as the
light industryorcommercialdistrict,will be to the north of the LAP withabout 83.64 ha in extent.
It isproposedtobemainlyforlightindustrial or commercial develop-mentsassociatedwith theaccessibleand visible area at the interchangebetween the N2 route and the R603towards uMbumbulu. This districthas no major environmental re-straints.
The second district is mixed resi-dential which includes the existingIllovo village and surrounding are-as.This land,suitableforhigherden-sity residential development, is be-ing used for sugar-cane production.This district could accommodate anadditional 2 100 higher densityhomes and is also easily accessiblevia the R603 and R197 routes.
District three, also classified asmixed residential, will be aimed atproviding residential opportunitiesclose to the envisaged manufactur-inghub.Thisareacanaccommodate1 700 higher density residentialhomes for workers as well as to ad-dress general housing needs withinthe Illovo area.
The industrial district, the fourthdistrict, is identified as the primarymanufacturinghubandthepotentiallocality of an automotive supplierpark (ASP).
This type of districtwould have toaccommodate at least 100 ha of de-velopable industrial land. This siteshould gain access to theN2 route todevelop its manufacturing potentialandaccesstootherregionaldistribu-tion channels such as the Port of
Durban.The fifthdistrict, also an indus-
trial district, has 42% land availablefor development.
The area is also accessible via theR197 route and although no bulk in-frastructure within this district iscurrently available, theneed for eco-nomic diversification and invest-mentwithinthesouthdeemsit suita-ble for associated light industrialpurposes.
The sixth district is a restrictedarea mainly because it is associatedwith the landfill wayleaf areas limit-ing development and private devel-opment.
Due toa lackof currentbulk infra-structure in this area, it will requirea large scale of public capital invest-ment to address.

rates rebates is at this stage only aproposal for discussion and has notbeen finalised.
According to the reports, home-owners falling under the eThekwiniMunicipality will have to apply for arates rebate that, until now, has beenautomatic. This will have to be doneeachyear as the city looks to increase
the rates coffers.Every homeowner gets a rates re-
bate of R185 000 on their property’svaluation, regardless of the value. If,for example, your property is valuedatR1 million, the rebate isR185 000,which means you pay rates onR815 000. From the next financialyear, the rebate will continue to be
available, but property owners willhave to apply to the municipality forthe benefit or pay rates on the fullamount.
AccordingtoMofokengit isstillbe-ing discussed and nothing isfinalised.
“It should benoted that the mat-ter is only at this stage a proposal for
discussion and would still need to gothrough council processes for ap-proval. Ifapprovedtheregistrationofaratesrebateforresidentialpropertyowners will only be implemented inJuly 2015. Customers will be in-formed in due course on the processof the registration for a rates rebate,”Mofokeng said.

A 24-YEAR-OLD KwaMashu man ap-peared in the Scottsburg Magistrate’sCourt on 9 April on a charge of hijackinga car at Craigieburn at about 3.30pm onMonday, 7 April.
An alleged accomplice was shot deadby police shortly afterwards and a thirdsuspect is on the run.
A 52-year-old motorist from Craigie-burn, Umkomaas parked his ToyotaCressida beneath a tree near NaidoovillePrimary. He was accosted by three un-known men, one of whom threatened himwith a 9mm pistol. He managed to runaway and as he was doing so he saw hisattackers drive off in his car.
Alerted by radio, members of the Um-zinto K9 Unit and the Umkomaas SAPSlaunched a search for the suspects. Thefleeing car overturned and the three sus-pects fled and were intercepted by policeneartheOrrisaInninRoseneath.Thepolicecame under fire and returned it. Twenty-four-year old Thamsanqa Sanele Mthem-bu was arrested while a 38-year-old sus-pect was shot dead and the third suspectescaped. — Supplied.

WHILE a variety of specific dif-ferences are providing theflame for work disputes and
stoppages inUmdoni, andparticularlyUmzinto areas, the underlying gun-powder tomany of them is pay or lackthereof.
Pay rates for people doing the samejob,especiallyamongsemiorunskilledlabourers,canvary fromR126toR200per day at the whim of the contractor
paying it. That in itself is an issue — anumber of disputes and ongoing stop-pageshavearisenfromcontractorsnotpaying at all. This has been an allegedissue at times at the football field, thetest centre and the Riverside Park up-grade, among others.
TheMarchcouncilmeetingdebatedthe issue when it was pointed out thaton adjacent contracts, the Ugu con-tractor was paying R200 per day andthe Umzinto contractor R126 for thesame work.

“Community members have to ac-cept that they are just as important asweare if the fight against crime is to bewon,” a senior police officer told theFever.
He was talking against a back-groundofreportedunlockeddoorsandgates, unactivated alarms, valuablesandweapons left unsecured andunre-ported crime.
“It’s a chicken and egg situation toargue that the public doesn’t reportcrime because they don’t trust the po-lice to domuch about it. The flip side isthat the police cannot follow up oncrimes they know nothing about,” theofficer added.

The fiasco thateruptedat lastmonth’scouncilmeeting, inwhich all theANC councillors rose totheir feet and engaged in ugly unbridled ex-changes was inevitable. Such lack of disciplineandrespect for thehouse is theoutcometobeex-pected when the chairperson of Council (TheSpeaker) regularly displays contempt for therulesoforder,andabuseshispositionby launch-ing unsubstantiated and unnecessary personalattacks, and delivers lengthy politically chargedspeeches. The errant councillors are confidentthat suchmisconductwill never be pursued by aSpeakerwhose inconsistentandunfairhandlingof council process gets progressively bizarre aselections grownearer. Hewent as far as threat-ening councillors with legal action should theydare to expose the dubious conduct of officials inthe press. Cutting off the opposition andprotect-ing the cadres has become the order of the day.Democratic process and oversight have beentrumped by the desire to feed an outsized ego.Whilst it may be of much amusement to thosewho find joy in the perceived discomfort of oth-ers, suchdisregard for the rules of order cannotbe in the council’s best interest.

They were part of a two-monthinternational fashion internship atSAE Comunicazione Integrata inMilan.
Before being chosen designerMelinda Gopaul was under the im-pression that government pro-grammes only benefited peoplewho are well connected. However,her perceptions have sincechangedaftershewasselectedtobeamong theeightdesigners to bene-fit from the programme. The otherparticipants are Buhle Zulu, Nku-luleko Njapha, Jacqueline Munsa-mi, Kayleigh Savings, Sanele Cele,Sibusisiwe Msimang and Zama-khosi Mathe. The city’s fashion de-
velopment programme started in2011andhas benefited16aspiringdesigners.Deputymayorandchair-person of the Economic Develop-ment Committee, Cllr NomvuzoShabalala said thisprogrammewillboost local designers’ businessesbecause theyhadtheopportunityofexhibiting their clothing labels attop fashion cities such as Florence,Rome and Venice.
“We established this pro-grammeafterwerealised that fash-ion and textile sectors can contrib-ute to job creation. We have seengreat success with some designersopening their ownshopsafter com-pleting the programme and creat-ing job opportunities,” said Sha-balala.

The 15-year-old, a Grade 10 pupil at Amanzimtoti High isone of the youngest members of the U19women’s South Afri-can Action Cricket team.
She is one of 10 girls who will tour New Zeeland to play inthe World Cup in October. In preparation she attends trainingcamps with the team in Johannesburg over weekends.
In 2012 she played for the U16women’s South African ActionCricketteamwhentheycamesecondafterlosingagainstAustralia.Elsuné was named Woman of the Match during that game. She isa good all-rounder being a great spin bowler aswell as a great bats-man.
Besidesactioncricket,shealsoplaysindoorandfieldhockeyforherschool’s first team,softball andgolfandhasreceivedprovincial colours in all of them.
Althoughtalented, theyoungsportstar takesnothingforgrantedandrealises that talentalone isnotenough.
“Even if someone has natural talent, you still haveto train hard — if you don’t you won’t get anywhere.It takes a lot of discipline, focus and dedication,” shesaid.
According to her father Riaan, she takes after hermother, Rinette who was also a vivid sportswomanwhen she was younger. Her brother, 13-year-oldRuan is also sporty.
“Elsunéhasalwaysbeen interested inanysportwhere a stick and a ball are involved. She worksvery hard in both her sport and school work andwe are extremely proud of her,” Riaan said.
Elsuné has many role models in the sportingworld, including cricketers Dale Steyn andJacques Kallis and golfer Rory McIlroy.
Although she doesn’t receive any formal golfcoaching, she excels in it and admits that it isher favourite sport.
“I would love to be a professional golferone day playing the American tournaments.
“To excel in sport takes a lot of hardwork.Iamluckytohavethesupportofmyteachers,coaches, my parents and my grandfatherPeet Roode.
“They make sure I get to practice andgames on time and support me and watchwhen I play.”
