FIFA Protection of minors: "Minor player application guide" In September 2016, FIFA issued the attached note, which provides guidelines for the registration of minor players. For the first time, by means of this note, FIFA seem to recognise and address further exceptions to article 19, par. 1 of the Regulations on the Status and Transfer of Players (RSTP) in addition to those mentioned in article 19, par. 2 of the RSTP. In particular, the note recognises the possibility to register minor players even in the following events: 1. the minor player moving to another country without his/her parents due to humanitarian reasons could not be expected to return to his/her country of origin given that his/her life or freedom would be threatened on account of race, religion, nationality, membership of a particular social group or political opinion (unaccompanied refugee player); 2. the minor player's education was clearly the primary reason for the international move without his/her parents and the maximum duration of the minor player's registration for the club concerned did not exceed one year, provided that the minor player immediately returned home after the end of the educational programme or turned 18 before the end of said programme (exchange student player). These two cases have been identified by the FIFA jurisprudence and do not find any reference in the RSTP. which the player intends to be registered or if it is a neighbouring country: in this event, the circumstances of article 19 para. 2 c) shall apply. Three different scenarios may be identified: 1. Both player’s biological parents move internationally: in this case the player

follows his parents who are moving to the new country. 2. Only one of the player’s biological parents moves internationally: this could be due

to the fact that the parent not moving is deceased, or still alive but not a custody-holding parent.

3. Neither of the player’s biological parents move internationally: this situation may arise, for example, in cases where the parental authority is awarded to a third person (legal guardian) because it has been taken away from the player’s parents or because both parents are deceased, but also in those cases where the player’s custody-holding parent resides in a new country.

In all of the above-mentioned scenarios, the application to request FIFA to apply the exception must be submitted via TMS. Interestingly, this seems to be the first time that FIFA publicly acknowledge the scenario whereby a legal guardian is involved. It is also possible to register the minor by means of the limited exemption proceedings according to FIFA Circular Letter no. 1209, whereby the player is an amateur and his/her parents have parental authority. The second checklist concerns the exception provided under Article 19, par. 2(b) RSTP. It regulates the case of a player aged between 16 and 18 who is moving within the territory of the EU or EEA. Two scenarios may be identified: 1. The player moves from a country outside the territory of the EU/EEA to an EU/EEA

country. 2. The player moves from one EU/EEA country to another country within the

territory of the EU/EEA

In both cases, the documents to be submitted are the same and shall be submitted via TMS. According to now consolidated CAS jurisprudence, the exception under article 19, par. 2(b) also applies in the event the player actually moves from a country outside of the EU to an EU country but the player is a citizen of an EU country. Under this exception, it is not possible to register the minor through the limited exemption proceeding. The third chart refers to the exception provided under article 19, par. 2(c) of the Regulations, in which “both the player and the club are within 50 km of their common borders and the distance between the two is less than 100 km”. In other words, the distance from the player’s domicile to the closest common border of the neighbouring association is not more than 50 km and the distance from the same common border of the neighbouring association to the club’s headquarters is not more than 50 km.

In this sense, it is important to highlight that the abovementioned distance of 50 km shall be measured in terms of “straight point-to-point distance”. Besides, the 100-km distance between the player’s domicile and the club’s headquarters shall be measured in terms of “route travelled”. Under this exception, the limited exemption proceedings are applicable only if the player still resides with both parents and they have not recently moved neither internationally nor within their country of residence. In any case, the documents to be submitted under each of the above circumstances are the same.

Dear Sir, Dear Madam,

We refer to art. 19 and annexe 2 of the Regulations on the Status and Transfer of Players (hereinafter: the Regulations) and in particular to the administrative procedure governing applications for first registration and international transfer of minors.

In an effort to ease your administrative burden, and in order for the sub-committee appointed by the Players' Status Committee for the proper implementation of the provisions on protection of minors (hereinafter: the sub-committee) to be able to duly assess each application based on the specific situation of the respective minor player, we are pleased to provide you with the enclosed "Minor player application guide" that outlines the pertinent documents to be included in the application depending on the various individual circumstances surrounding the international move of a minor player (d. enclosure). The said "Minor player application guide" also indicates under which circumstances a minor application must be submitted via the Transfer Matching System (TMS) and when it should be submitted via fax or ordinary mail, as well as the specific instances where the limited exemption from the general obligation to refer applications for approval to the sub­committee in the sense of art. 19 par. 4 of the Regulations (d. FIFA Circular no. 1209) may, if granted, be used by an association to register minor players for purely amateur clubs, i.e. clubs without a professional team and without a legal, financial or de facto link to a professional club.

In this respect, we would like to emphasise that, as a matter of principle, the exceptions to the general rule that a player may not be transferred internationally unless he is over the age of 18 contained in art. 19 par. 2 of the Regulations, as well as the 5-year-rule (d. art. 19 par. 3 and 4 of the Regulations) and the relevant jurisprudence, are considered to be exhaustive.

As regards existing jurisprudence referred to in the preceding paragraph, to this day, the competent deciding bodies only on limited occasions and with extreme reservation have granted exceptions outside of those contained in art. 19 of the Regulations for very specific groups of players. In particular, the sub-committee has occasionally accepted applications, under very strict conditions, in which: 1) the minor player moving to another country without his/her parents due to humanitarian reasons could not be expected to return to his/her country of origin given that his/her life or freedom would be threatened on account of race, religion, nationality, membership of a particular social group or political opinion (unaccompanied refugee player); or 2) the minor player's education was clearly the primary reason for the international move without his/her parents and the maximum duration of

the minor player's registration for the club concerned did not exceed one year, provided that the minor player immediately returned home after the end of the educational programme or turned 18 before the end of said programme (exchange student player).

Furthermore, we would like to draw your attention to the fact that the practical application of the relevant provisions of the Regulations on the protection of minors by the relevant deciding body on a case-by-case basis and within the aforementioned exhaustive scope, i.e. exceptions as per art. 19 par. 2 of the Regulations, 5-year-rule and jurisprudence on unaccompanied refuge players and exchange student players, is of the utmost importance in enabling FIFA to prevent the discrimination and unfair treatment of the (foreign) minor players.

Consequently, all applications for approval of the first registration or international transfer of a (foreign) minor player must clearly indicate in detail the specific circumstances concerning the situation of the respective minor player, and must also contain pertinent documentation that supports the request.

Since each application will be assessed on a case-by-case basis, it is not possible to delineate general conditions that need to be fulfilled in order for an exception, particularly one outside the wording of art. 19 par. 2 of the Regulations or the 5-year-rule (d. art. 19 par. 3 and 4 of the Regulations), to be granted by the sub-committee.

Finally, please take note that this information is of a general nature and thus, it is without prejudice whatsoever. Whereas the FIFA administration is responsible for the investigation of the facts of each case, only the competent bodies of FIFA, in casu, the sub-committee, can render a decision based on specific circumstances of each application. Therefore, please understand that the enclosed documentation is meant merely to serve as a guide for the administrative application process, but it cannot prejudice any decision taken by the sub­committee.
