PETITION GOALS

The goal of the Jackson and Nobles County Judicial Ditch No. 13 (JD 13) petition is to clean all of the open ditch within the watershed and construct new stretches of open ditch as well as replace and improve the mainline tile and multiple branches, laterals and their sub-branches/sub-laterals. All the proposed conditions will achieve at least the recommended drainage coefficient by the Natural Resources Conservation Service (NRCS). The JD 13 petition is public knowledge and can be found with either

Jackson or Nobles County staff.

EXISTING CONDITIONS

The information in this document has been prepared from the original JD 13 profile drawings and

alignment maps provided by Jackson County as well as a topographic survey done by ISG in January of 2015. A close representation of the JD 13 watershed was created using this information in conjunction with LiDAR contours, Minnesota Department of Natural Resources (DNR) Watershed lines, and aerial photographs. A map illustrating the existing JD 13 system can be found in Appendix A of the Final Engineer’s Report (FER).

Since 2003, Jackson County Public Works has keep recorded of all repairs that have occurred within the

JD 13 system. There has been 79 repairs that have been completed with another 5 repairs that have been reported this year. A map showing the repair locations within Jackson County can be found in Appendix A.

There are portions of the existing system which are need of repair which provided ISG the opportunity to televise the existing condition of the buried tile. Majority of the locations that were provided by Jackson County Public Works have too much water in the tile in order to properly televise the area. Branch TT was the only branch that had a water level low enough to televise the system. When reviewing

the televising footage from the existing Branch TT area, ISG has compiled a report showing that the existing tile has stress cracks throughout which the first sign is showing pipe failure, sediment accumulation, offset joints and root balls within the system. All of these aspects show a restriction in pipe capacity. Appendix E displays a televising report from the televising footage that was recorded.

PROPOSED CONDITIONS

In order to provide at least a 0.50 in/day drainage coefficient for buried tile and add depth to the system, the proposed JD 13 improvement project will consist of cleaning the entire mainline open ditch as well as replacing a portion or completely replacing 36 out of the 122 branches. The 36 branches that are being improved are the Main and Branches A, A1, B, B1, D, L, P1, S2, S13, S16, S21, S22, S23, S24,

S26, V, W, HH, JJ, JJ1, KK, KK1, KK3, RR8, WW, WW3, WW4 and WW5, as well as partial replacement of Branches H, P, S, S1, U, RR, SS, and TT. All of the proposed buried tile branches are shown in the Final Engineer’s Report are designed to achieve at least the 0.50 in/day drainage coefficient as recommended by the NRCS for buried tile. It is proposed to construction 3 new crossings within the open ditches, which will be sized to achieve the 1.0 in/day drainage coefficient.

A landowner meeting occurred on June 6th, 2019, which brought up some concerned landowners as well as some additional tile. Branch KK2 was planned to be connected onto but was requested by a petitioner

that the tile should be improved. Maps of the proposed changes and proposed improvement can be found in Appendix C.

Storage Options

It is proposed to create four storage basins throughout the watershed. Maps showing the location of the proposed basins may be found in the Preliminary Construction Plans in Appendix C.

It was brought to ISG’s attention that the location of Basin 1 in the FER a wetland certification has been completed. Therefore, impacting the current design of the storage basin located within the property.

Alternative Basin 1 has been developed to provide the same characteristics as Basin 1 in the FER. The alternative basin will be located on the west side of the open ditch in the SW ¼ of the NE ¼ of Section 12 of Round Lake Township. The proposed area is currently a low are along the open ditch that frequently floods and is a tough area to farm. The proposed basin would consist of an easement area of

approximately 13.6 acres including a 16.5-foot buffer. Alternative Basin 1 would be constructed with 3:1 side slopes and be approximately 4 feet deep. The relocation of the basin provides a closer haul route for excavated material to be placed in lower areas of neighboring farm fields.

The proposed basin would be constructed offline of the main open ditch channel therefore, acting as a floodplain storage area instead of inline of the main open ditch. A concrete weir will be located within the main channel to divert water into the basin from the main channel while still allowing normal flow through the weir. Having an offline storage system will not backup the main open ditch which would in

turn potential cause additional flooding within the system. For online storage systems, a larger volume and area is required in order to account for normal flow to being restricted.

After the landowner meeting on June 6th, ISG was informed that the landowner on Basin 4 was no longer in favor of have a storage basin located on their property. Therefore, Alternative Basin 4 was developed located in the NW ¼ of the NW ¼ of Section 36 of Lorain Township. Alternative Basin 4 would consist of an easement area of approximately 4.1 acres including a 16.5-foot buffer. The basin would consist of

3:1 side slopes approximately 18 feet deep. The alternative basin will consist of similar characteristics as the previous basin 4.

The proposed alternative basin 1 and 4 will supplement proposed basin 2 and 3 in achieve the 243.1 acre-feet of storage that was original designed for in the Final Engineer’s Report. Therefore, the proposed design does not impact the overall storage within the system.

Adequacy of the Outlet

Jackson and Nobles County Judicial Ditch No. 13’s outlet is located in the SE ¼ of the SW ¼ of Section 7 of Sioux Valley Township. The outlet is comprised of an open ditch that goes underneath 375th Ave that flows into Skunk Creek. The existing outlet is controlled by a bridge for 375th Avenue in the SE ¼

of the SW ¼ of Section 7 of Sioux Valley Township. The proposed outlet will be located in the same location as the existing. With the proposed storage basins described above, the peak flowrates and water surface elevations will decrease at the outlet of the JD 13 system.

It is the opinion of the Engineer that the outlet for Jackson and Nobles County Judicial Ditch No. 13 is adequate to handle the proposed improvement.

PRACTICALITY + FEASIBILITY

When a separable portion of a larger system is in need of repair, the drainage stature, M.S.103E.215, subd. 6, allows the separation of the cost of repair from the cost of improvement of the project. Separable maintenance can be applied to the segments of existing tile that will be replaced by the

proposed improvement. Detailed cost estimates of the potential repair and potential improvement cost estimates have been included in Appendix B which is summarized below in Table 1.

The preliminary estimated construction cost for Jackson and Nobles County Judicial Ditch No. 13 Improvement is approximately $1,033,035 for improving the existing open ditch, approximately $1,020,783 for the proposed open ditches, approximately $9,078,900 for the mainline and branch tile without road crossings, approximately $2,512,147 for the storage basins which $517,556 being

associated to the JD 9 watershed. The total estimated construction cost without crossings for the project is $13,653,892.

It is estimated that the Separable Maintenance cost for the project without road crossings is approximately $809,761 for the existing open ditch, $505,699 for the proposed open ditch and approximately $4,838,054 for the tile mainline and branches without road crossings. The total Separable Maintenance cost for the project is $6,153,513. The result is an overall net cost of $6,982,823 for the project after factoring in separable maintenance and without road crossing costs.

When the system crosses a roadway, a portion of the cost is assessed to the road authority responsible for that roadway. After factoring in the road crossing costs, the total landowner cost is estimated at $14,029,335, the costs assessed to road authorities is $506,196, and the net cost of the project is $7,207,570. Due to the size of the JD 13 system, it is recommended that the bid be broken up into multiple bid packages in order for contractors to feasibly bond and construct the project.

With the changes that have occurred since submitting the Final Engineer’s Report, the addition of Branch KK2, Alternative Basin 1 and Alternative Basin 4, the project costs have increased by approximately $25,448. Alternative Basin 1 has decreased the project costs by relocating the basin. Therefore the total improvement costs for the JD 13 system is approximately $14,054,783 including road authority costs.

The total separable maintenance is approximately $6,875,552 including road authority costs, therefore the net cost of the project is approximately $7,179,230. The viewers has given ISG an estimated benefit amount of approximately $7,500,000, therefore the net benefit of the proposed project is approximately $320,770. Since the proposed benefits are higher than the proposed costs to construct the project, the proposed project for the Judicial Ditch No. 13 system is feasible.

After factoring in road authority costs, permanent damages due to buffer strip acquisition and redetermination of benefits costs that total project costs for the improvement of JD 13 is approximately

$13,882,272.

CONCLUSIONS + RECOMMENDATIONS

The improvements proposed above to Jackson and Nobles County Judicial Ditch No. 13 are cleaning all of the mainline open ditch from the outlet in the SE ¼ of the SW ¼ of Section 7 of Sioux Valley Township to the existing mainline tile outlet in the NE ¼ of the SW ¼ of Section 30 of Ewington Township. The proposed project will also construct a new mainline open ditch from the existing open ditch to the NW ¼ of the NE ¼ of Section 25 of Lorain Township as well as Branch S open ditch from the NE ¼ of the SE ¼ of Section 25 of Lorain Township to the SW ¼ of the SE ¼ of Section 25 of Lorain Township. The improvements will replace and improve the following buried tile: the mainline, Branches; A, A1, B, B1,

D, L, P1, S2, S13, S16, S21, S22, S23, S24, S26, V, W, HH, JJ, JJ1, KK, KK1, KK3, RR8, WW, WW3, WW4 and WW5, partial replacement of Branches; H, P, S, S1, U, RR, SS, and TT. The proposed project will replace and improve Branch KK2 as well.

The proposed improvement project will construct 4 storage basins throughout the JD 13 watershed that will increase the water quality of the system as well as closely match or reduce the peak flowrates and water surface elevations at the outlet.

The project, as proposed, is practical and feasible and its necessity has been described above. The project will be a public benefit and contribute to the public welfare of this area. Therefore, the project should be considered for final approval, as described in this report.

It is recommended that the Ditch Authority call the Final Hearing for this project and submit this report to the regulatory agencies for input related to, among others, environmental concerns. If this project is received favorably at the Final Hearing, then detailed plans should be prepared and the project constructed
