The Earp-Holliday Trial: An Account

by Douglas O. Linder (2005)*

On October 26th, 1881 in Tombstone, Arizona, one of the most famous Old South gunbattles occurred (Linder 2005). The Earp brothers, Wyatt, Virgil, and Morgan, and along with Doc Holliday were all livid with Ike Clanton. The Earp brothers and Holliday enforced a law that forbids firearms in public places. Clanton and McLaury already had an issue with the brothers and Doc before. He was asking for more with the taunts and threats. The brothers dragged Clanton to the courtroom and charged him for having a firearm in a public place. What really started this battle was Wyatt came out of the courtroom with a bad temper and whacked Clanton’s friend, Tom McLaury, in the head and shoulder with his revolver. Clanton and his family and McLaury’s family wanted the Earp brothers to pay, and they went to a gun shop to buy weapon. The men went up to the Earp brothers and when they did not hand over their weapons, the brothers made the first shots. This famous gunbattle only lasted thirty seconds, out of all these men, Wyatt Earp remained unharmed. Three men were killed: William Clanton, Frank McLaury, and Tom McLaury. The Earp brothers and Doc Holliday were filed for first-degree murder by Ike Clanton. The trial began on October 31st, 1881 behind closed doors. After all testimonies were said and done, the men were released. The Earp brothers and Doc Holliday had won the battle.
