2 Budget Estimate for year 2014-
2015.
It was decided that the unspent Ward Development Fund can be carried forward to the next year but in one year the allocation shall be restricted to a maximum of Rs.1.00 Crore. Any unspent balance beyond that shall lapse. It was further decided that since the tenure of Mayor terminates on 31st December,
31stthe term of the fund allocated to the Mayor will be from Ist January to December. The Committee unanimously resolved that the Ward Development Fund may be utilized upto 10% in advance, which will be adjusted in the next financial years fund. Thereafter, the Committee unanimously approved the budget estimates for the year 2014-15 with following modifications :-The Budget Estimates for the Fire & Emergency has been increased from Rs. 200.00 lacs to 1200.00 lacs. This increase is a token provision for purchase of Turn Table Ladder. The Budget Estimates of 2014-15 under Plan has been enhanced by Rs. 1000.00 lacs and the overall change in the Budget Estimate 2014-15 is as follows:-

The Committee considered and resolved that the licence of the present contractor of Night Shelter in Idle Truck Parking, Sector-26, Chandigarh be extended for further four months w.e.f. 8.12.2013 to 7.4.2014 as a special case on the same terms and conditions.
It was also resolved that instructions be issued to the licencee of Night Shelter in idle Truck Parking, Sector-26, Chandigarh to allow free stay to the homeless, rickshaw pullers, labourers and pavement dwellers with immediate effect upto 28.2.2014.
It was further resolved that the reserve price for auction of Night Shelter in Idle Truck Parking, Sector-26, Chandigarh, be fixed as Rs. 79,000/- i.e. equal to 75% of the present licence fee of Rs. 1,05,000/-.
The Committee resolved that a detailed agenda in this regard be brought in the next meeting of the Committee and meanwhile status quo be maintained, so that the persons who have already made bookings should not suffer.

1 Confirmation of the minutes of the 235th
meeting of the Finance and Contract
Committee held on 04.02.2014 at 11.30
a.m. in the Committee Room of the
M.C., Chandigarh.
It was also resolved that the advance payment be made to the
Safaikaramcharies & other Class-IV employees of the Corporation for
summer uniform. Further it was also resolved that they would submit the
receipt of expenses incurred on uniforms and stitching within three months,
otherwise the recovery be made from their salary.

Gaushala Sector-25, Chandigarh.
The Committee considered and unanimously resolved that the existing
agreement be continued till the visit of the Councillors to ascertain the
credentials of said gaushala.

i) Sh. Pardeep Chhabra pointed out that a policy regarding usage of lawn adjoining hotels situated in various sectors /Industrial Area be discussed.
The Committee considered & resolved that the booking of the lawns adjoining hotels situated in various sectors/Industrial Area be continued as it was being done on the basis of existing terms & conditions till the framing new policy & decision of F&CC thereon.
ii) Policy regarding auction of Exhibition Ground, Sector-34, Chandigarh.
The Committee considered & resolved that the Exhibition Ground, Sector-
34, be auctioned only for Diwali Festival & Winter Festival.
iii) Agenda to be placed for framing policy regarding Taxi Stands.
The Committee considered & resolved that the existing system be
continued and the report of the Committee be examined and a policy in this
regard may be placed in F&CC.
The matter was taken before the
next meeting of F&CC i.e. 237th
meeting held on 29.05.2014.
iv) Automation of paid parking of Shastri Market and Kiran Cinema in Sector-22.
The Committee considered & resolved that paid parking be started in
Sectors-43 and the concerned branch will frame the policy regarding
imposition of paid parking in other sectors also.

with the Road divisions about
the matter.
v) Issuance of parking passes for media persons.
The Committee considered & resolved that the parking passes be issued to the media persons including Editors, those accredited by the Administration and those, who cover the Municipal Corporation. The Committee also recommended that 5 passes including three complementary be issued to Additional Commissioner and Joint Commissioner, Municipal Corporation, Chandigarh. It was further resolved that two parking passes instead of one be issued to the Chief Engineer & Superintending Engineers (P.H. & B&R).

3 Issuance of Gur to Sewermen working under Public Health Division No.4, Municipal Corporation Chandigarh.
The Committee considered and resolved unanimously that 1.00 kg. Gur per month per Sewerman working under P.H.Division No.4, M.C., Chandigarh, be issued on the pattern of safaikaramcharies working under Medical officer of Health, Municipal Corporation, Chandigarh.
Issued to the eligible workers.
4 To establish the facility for integrated counselling and testing centre for HIV/Aids/ STI at Civil Dispensary at Dadu Majra & Kajheri.
The Committee considered and resolved that the Chandigarh State Aids Control Society, Chandigarh be allowed to establish the facility for Integrated Counselling & Testing Centre for HIV AIDS/STI at Civil Dispensary Dadu Majra & Kajheri. Further it was also resolved that the Municipal Corporation will not provide any extra space/room and equipment for testing and even the entire cost related to staff salary, infrastructure and consumable items will not be met out by the Municipal Corporation. Further the Committee authorized the Commissioner, Municipal Corporation to take any decisions regarding MOU.

8 Amendments/Elaborations in the
existing terms and conditions of Paid
Parking Areas.
The Committee considered and approved the proposed amendments in the clauses of terms & conditions of paid parking areas as under :-
2. Earnest Money deposit:- Each participant of auction shall deposit earnest money equivalent to 10% of the reserve price before the commencement of the auction.
The successful bidder shall have to deposit an additional amount equivalent to 15% of bid amount offered by him at the drop of hammer.
The earnest money and the additional deposit of 15% bid money shall be refunded to concerned bidder after deposit of security deposit (bank guarantee + 2 months’ license fee) and completion of other formalities.
In case successful bidder fails to deposit an additional amount equivalent to 15% of bid money offered by him at the drop of hammer, the earnest money of the successful bidder shall be forfeited and 2nd
highest bidder shall be considered for declaring as successful bidder. In case he/she is interested otherwise the 3rd bidder will be considered accordingly.
In case successful bidder fails to complete the requisite formalities within the stipulated period as per letter of intent, the licensor shall be at liberty to forfeit 25% amount of deposit besides withdrawing the Letter of Intent.
3. Security Deposit:- The licencee shall deposit security of following amounts and in following manners:-
(a) Bank Guarantee (BG) of amount equivalent to 4 months’ licence fee in favour of Commissioner, Municipal Corporation, Chandigarh (MCC) within 10 days of issue of letter of intent. The bank guarantee should be valid for a period of 18 months to cover the period of 1 year of licence and another 6 months for finalization/closing of accounts. 38.Termination of license: -The license shall stand terminated automatically on completion of license period.
The licensee can request for premature termination of license by giving 3 months notice or by depositing money equivalent to 3 months licence fee. However, it is made clear that no such request should be entertained before an expiry of 3 months period from the date of taking over the possession.
In case of default, the licensee shall be liable to deposit an amount equivalent to 3 months license fee within 3 days of demand raised by the licensor, failing which, the licensor shall be at liberty to
recover the same from the Bank Guarantee of the Licensee, lying with the Licensor.
In addition to above, it is also made clear that such a licensee who surrenders the PPA prematurely i.e. before completion of license period as per initial allotment or subsequent extension, he/she shall not be permitted to participate in any subsequent auction of any paid parking area for a period of one year from the date of handing over the possession back to the Licensor in respect of surrendered PPA.
If the licensor wants to terminate the licence deed before the expiry date then the licensor will give at least one month notice or pay money equal to one month licence fee. In an event of making payment as above, the Licensor will be entitled to take over possession within 24 hours thereafter.

4. In case of any immoral activity creating public nuisance or any other violation in that open space, the Municipal Corporation has right to cancel the MOU at any time without any prior notice.
5. Whole of the expenditure for the development of open space will be borne by the Hotelier including electricity / water charges (in case any light is installed in open space).
6. The permission to use open spaced can be withdrawn by the Municipal Corporation, Chandigarh without assigning any reasons.
7. The Hotel owner will not create any right to Tenancy / ownership and it would particularly be confined to maintenance and beautification of the traffic island/ round about / green belt / open space / road reservation / road berm / verge.
8. The landscaping / beautification would be strictly carried out as per approved drawing / designed by the M.C. Chandigarh.

38. Termination of license: -The license shall stand terminated automatically on completion of license period.
The licensee can request for premature termination of license by giving 3 months notice or by depositing money equivalent to 3 months licensee fee. However, it is made clear that no such request should be entertained before an expiry of 3 months period from the date of taking over the possession.
In case of default, the licensee shall be liable to deposit an amount equivalent to 3 months license fee within 3 days of demand raised by the Licensor, failing which, the Licensor shall be at liberty to recover the same from the Bank Guarantee of the Licensee, lying with the Licensor.
In addition to above, it is also made clear that such a licensee who surrenders the PPA prematurely i.e. before completion of license period as per initial allotment or subsequent extension, he/she shall not be permitted to participate in any subsequent auction of any paid parking area for a period of one year from the date of handing over the possession back to the Licensor in respect of surrendered PPA.
If the licensor wants to terminate the licence deed before the expiry date then the licensor will give at least one month notice or pay money equal to one month licence fee. In an event of making payment as above, the Licensor will be entitled to take over possession within 24 hours thereafter.
In case, the licensee prematurely surrender the PPA consecutively or in case he is running more than one PPA in Chandigarh at same time and there
occurs 2 occasions of his premature surrender in respect of any PPA then he should be liable to be blacklisted as per the policy of the Chandigarh Administration issued vide No. Notification No. 1927-F& PO (3)-2009, dated 27.02.2009.

2. The Committee felt that term for the auction would be two years and further decided that extension be given for one year subject to mutual agreement with the 5% increase of the reserve price. Accordingly the earnest money/reserve price or any other deposits will be proportionately increased.
3. The site plan of the auctioned site will be uploaded on the official website of M.C. and also be displayed at the site of the auction.
4. Some members were of the view that the participation of the applicants in the auction be restricted only to the persons engaged in the sale purchase of car business. The Commissioner, Municipal Corporation pointed out that though we can impose reasonable restrictions on eligibility, but as per the Hon’ble High Court order preference is not to be given to either the 43 nos. car dealer or the other litigants. However, the committee thereafter decided that reasonable restrictions needs to be imposed, so that some fly by night operators may not enter into the business and fleece the public. It was decided that a committee should be formed and the interested applicant should be required to demonstrate before the committee by way of any documentary evidence that they have been in past dealing in sale/purchase of old cars. The applicant shall be allowed to participate only after the satisfaction of the said committee.
