To the Common Council: The undersigned City Clerk, in pursu- ance of the directions of this Council, sitting as a Board of Review of the spe- cial assessment roll for Paving District No. 3, respectfully report that the Board of Review met at the Council Chamber on the 6th day of November, instant, and making no change in the said special assessment roll, ordered the same to be reported to the Common Council. following report relative to the sum asked by the owners of property to release the right of way for the proposed alley running north and south through block three south, range four east in the City of Ann Arbor.

The following named persons will release the right of way without compensation, to wit: Jacob Laubengayer, Mack & Schmid, and Andrew Muehlig; and the following named persons for the sum set next after their name:

By Alderman Koch: Whereas, at a meeting of the Common

D. , iSgg, th i s ' Common Council ordered a certain public alley to be laid out and established within the corporate limits of the City of Ann Ar- j bor, Michigan, described as follows, to-wit: Commencing at the northwest corner of lot number fifteen in block number three south of Huron street in range four cast according to the plat of the village (now City) of Ann Arbor, running thence east eight feet; thence south parallel with the line of lots to William street; thence west sixteen feet; thence north parallel with the line of lots to a point twenty-two feet south of the south line of lot one in said block; thence northerly to a point ten feet west of the southeast corner of said lot one; thence north to Liberty street; thence east ten feet; thence south to the place of beginning.

Therefore, be it resolved and this Common Council hereby declares that all of the costs and expense attending the establishment of such public improvement, including the costs of the right of way and of the condemnation proceedings to procure the same, shall be charged against and is hereby ordered to be assessed on and against the lands, tenements and premises in and situate in the specia assessment district hereinafter designated, and that the lands, tenements and premises situate in the said special assessment district are in the opinion of the Common Council benefitted to the full extent of all of the cost of such public improvement.

Resolved further, that the special assess­ment district upon which the cost and ex­pense of such public improvement shall be levied and assessed according to the benefits coming therefrom to each parcel thereof, is hereby fixed and determined as follows, to-wit:

All of the lands, lots and parts of lots, tenements and premises in and contained in block number three south of Huron street, range four east according- to the plat of the village (now City) of Ann Arbor, Michigan.

Aid. Coon moved to adopt the above reso-lution and have same filed. Carried.

By Aid. Koch: Whereas, at a meeting of the Common

Council, held at the Council Chambers in the city of Ann Arbor, on the i8th day of Sep­tember, A. D . , 1899, it was among other things ordered, that a certain public alley be laid out and established within the corporate hmits of the city of Ann Arbor, State of Michigan, and hereinafter particularly men­tioned and described.

And, whereas, this Common Council has been unable to procure or obtain the right of way for such public alley over the private lands by agreement with the owners thereof, or to procure by gift, purchase or otherwise

the necessary right of way for said public alley over the private property within the limits thereof. And it is deemed necessaay to cause to be instituted proceedings in con­demnation of such private property for pub­lic purposes.

Therefore, be it resolved, and this Com­mon Council does hereby declare, that the laying out and establishment of a public al­ley within the corporate limits of the city of Ann Arbor, Michigan, bounded and de­scribed as follows: Commencing at the north­west corner of lot number fifteen in Block number three, south of Huron street, range four east, according to the plat of the vil­lage (now city) of Ann Arbor; running thence east eight feet; thence south, parallel with the line of lots to William street; thence west sixteen feet; thence north, parallel with the line of lots, to a point twenty-two feet south of the south line of lot one in said Block; thence northerly to a point ten feet west of the southeast corner of said lot one; thence north to Liberty street; thence east ten feet; thence south to the place of begin­ning, is a necessary public improvement, and deem and hereby declare it to be necessary to take the private property lying within the limits thereof for such public improvement.

Resolved further, that the City Attorney be, and he is hereby directed to institute and carry on the nece sary condemnation pro­ceedings in the Circuit Court for jhe County of Washtenaw, Michigan, under chapter ninety of the compiled laws of the State of Michigan for the year 1897, in the name of the city of Ann Arbor and against the lands and the owners and occupants thereof, lying within the limits of such public alley, to the end that the private property lying within the limits of said public alley may be con­demned to public use.

On motion, the resolution was adopted as follows:
