Niniejszy Regulamin okrela:1) oglne warunki, zasady oraz sposb sprzeday prowadzonej przez Operato-ra za porednictwem serwisu internetowego www.calypso.com.pl w odniesie-niu do usug: Karnet Fitness z pakietem medycznym (FIT PLUS 365),2) szczegowe postanowienia umowy zawieranej z Operatorem na odlego za porednictwem serwisu internetowego www.calypso.com.pl, 3) zasady korzystania z usug Operatora i Karty oraz Obiektu tness.

1. DEFINICJE

1. Dni Robocze oznacza dni tygodnia od poniedziaku do pitku;2. Dostawa oznacza czynno faktyczn polegajc na dostarczeniu Karty w miejsce wskazane przez Uytkownika. Operator dooy stara, aby Dostawa odbya si w cigu 3 dni roboczych od momentu zawarcia Umowy;3. Dostawca patnoci oznacza przedsibiorc - eCard S.A. z siedzib w Warszawie; ul. Czackiego 7/9/11, 00-043 Warszawa, wpisan do rejestru przedsibiorcw prowadzonego przez Sd Rejonowy dla m.st. Warszawy, XII Wydzia Gospodarczy Krajowego Rejestru Sdowego, pod numer KRS: 0000042304, NIP: 5213103040, o kapitale zakadowym wynoszcym 30 259 488,00 z (w caoci opaconym), zapewniajcego obsug patnoci on-line;4. Formy patnoci uznawane przez Operatora formy patnoci opat wynika-jcych z Umowy. 5. Haso oznacza cig znakw literowych, cyfrowych lub innych wybranych przez Uytkownika podczas Rejestracji w Stree Klienta, wykorzystywanych w celu zabezpieczenia dostpu do Konta Uytkownika.6. Konto Uytkownika oznacza indywidualny dla kadego Uytkownika panel, uruchomiony na jego rzecz przez Operatora, po dokonaniu przez Uytkownika Rejestracji.7. Login oznacza indywidualne oznaczenie Uytkownika, wymagane wraz z Hasem do zaoenia Konta Uytkownika w Stree Klienta. Loginem jest adres poczty elektronicznej (email) wskazany przez Uytkownika.8. Karta / Karta Calypso oznacza kart abonamentow lub inn form zastp-cz umoliwiajc korzystanie przez Uytkownika z Usug Operatora. 9. Obiekt tness obiekt tness, w ktrym Operator lub Partner prowadzi dziaalno klubu tness pod mark Calypso Fitness; Pena lista obiektw tness znajduje si na Stronie Internetowej w zakadce Nasze Kluby na podstro-nie https://www.calypso.com.pl/nasze-kluby z wyczeniem nastpujcych obiektw tness:a) Calypso Fitness Warszawa Ursynw w lokalu mieszczcym si pod adresem: ul. Operator oznacza przedsibiorc - Calypso Fitness S.A. z siedzib w Warszawie (02-801) ul. Puawska 427, wpisan do rejestru przedsibiorcw przez Sd Rejonowy dla m. st. Warszawy w Warszawie, XIII Wydzia Gospodarczy Krajowego Rejestru Sdowego pod nr KRS 0000400719, NIP 525-251-96-84, o kapitale zakadowym w wysokoci 158.626 z (opacony w caoci),

prowadzcego dziaalno klubw tness pod mark Calypso Fitness i bdce-go jednoczenie wacicielem Strony Internetowej.12. Opata wpisowa jednorazowa opata w wysokoci wskazanej na Stronie Internetowej uiszczana w momencie skadania zamwienia przez Uytkowni-ka, zwizana z obsug administracyjno-techniczn Umowy. 13. Partner oznacza przedsibiorc: a) Fitness MCG Sp. z o.o. z siedzib w Warszawie ul. Puawska 427 (02-801 Warszawa) wpisan do rejestru przedsibiorcw przez Sd Rejonowy dla m.st. Warszawy, XIII Wydzia Gospodarczy Krajowego Rejestru Sdowego pod nr KRS 0000384688, NIP 525-250-73-33, o kapitale zakadowym w wysokoci 500.000 z,; b) Baltic Fitness Center Sp. z o.o. z siedzib w Warszawie ul. Warszawy w Warszawie, XII Wydzia Gospodarczy KRS pod numerem 0000395215, NIP 527-266-38-52, kapita zakadowy w wysokoci 650.000 z (wpacony w caoci), ktry wiadczy na rzecz Uytkownikw usugi pakietu medycznego;15. Patnik osoba trzecia wskazana przez Uytkownika, zobowizana do uiszczania biecych opat wynikajcych z Umowy, w szczeglnoci miesicznych opat za Usugi. Uytkownik ponosi odpowiedzialno za opnienie lub odmow uiszczania opat przez Patnika, a wskazanie Patnika nie zwalnia Uytkownika z obowizku uiszczenia opat w przypadku ich nieuiszczenia przez Patnika. 16. Regulamin Usug Karnet Fitness z pakietem medycznym oznacza niniejszy Regulamin.17. Regulamin Usug Fitness oznacza Regulamin wiadczenia usug tness przez Operatora lub Partnera, z ktrych Uytkownik moe korzysta na podstawie Umowy.18. Regulamin Pakietu Medycznego oznacza Regulamin udzielania wiadcze medycznych oraz Zakres usug medycznych oferowanych przez Partnera medycznego, z ktrych Uytkownik moe korzysta na podstawie Umowy. 19. Strona Internetowa oznacza strony internetowe, pod ktrymi Operator prowadzi dziaania informacyjne i marketingowe oraz Stref Klienta, dziaajce w domenie www.calypso.com.pl.20. Strefa Klienta oznacza podstrony Strony Internetowej za porednictwem ktrych Operator udostpnia Uytkownikom posiadajcym aktywne Konto Uytkownika funkcjonalnoci, w szczeglnoci moliwo zakupu towarw i usug, a ponadto newsletter, aktualnoci, moliwo ledzenia postpw treningowych, na warunkach okrelonych w niniejszym Regulaminie Usug oraz w Regulaminie Strefy Klienta.21. Umowa oznacza umow zawart z Operatorem przez Uytkownika na odlego w rozumieniu ustawy z dnia 30 kwietnia 2014 r. o prawach konsumenta (Dz. U. 2014 poz. 827 z pn. zm.), ktrej przedmiotem jest wiadczenie przez Operatora wybranych przez Uytkownika usug:a) Karnet Fitness z pakietem medycznym na czas okrelony 15 miesicy kalendarzowych (FIT PLUS 356);22. Usugi/Usugi Operatora oznacza usugi oferowane przez Operatora za porednictwem Strony Internetowej i usugi wiadczone na rzecz Uytkownika przez Operatora i Partnera Medycznego w ramach Karnetu Fitness z pakietem medycznym, tj.: (i) moliwo korzystania z usug Obiektw tness dziaajcych pod mark Calypso Fitness w zakresie siowni, zaj tness oraz sauny (z wyczeniem Obiektu tness w Bytomiu i Szczecinie Outlet Park), na warunkach okrelonych w niniejszym Regulaminie oraz Regulaminie Usug Fitness, oraz(ii) moliwo korzystania z usug pakietu medycznego obsugiwanego przez Partnera medycznego, na warunkach okrelonych w niniejszym Regulaminie oraz Regulaminie Pakietu Medycznego; Operator moe udostpni inne usugi niewymienione w niniejszym punkcie, ktrych szczegowe warunki zostan okrelone kadorazowo w odrbnych regulaminach i nie maj wpywu na zakres i warunki wiadczenia usug okrelo-nych w niniejszym Regulaminie Usug. 23. Uytkownik oznacza osob zyczn, posiadajc pen zdolno do czynnoci prawnych, majc w momencie zawarcia Umowy 18 66 lat, korzys-tajc z Usug Operatora lub Strefy Klienta w zakresie niezwizanym bezporednio z jej dziaalnoci gospodarcz lub zawodow. Uytkownik jest Osob Uprawnion w rozumieniu Regulaminu Pakietu Medycznego.

2. POSTANOWIENIA OGLNE

1.Operator za porednictwem Strony Internetowej oferuje Uytkownikom moliwo zakupu nastpujcej Usugi:Karnet Fitness z pakietem medycznym (FIT PLUS 365) obejmujcy moliwo korzystania z Obiektw tness Operatora i Partnerw dziaajcych pod mark Calypso Fitness (dalej: usugi tness) oraz usug pakietu medycznego obsugi-wanego przez Partnera medycznego (dalej: pakiet medyczny) przez czas okrelony 15 miesicy, z zastrzeeniem 4 ust. 8.2. Korzystanie z Usug, o ktrych mowa w ust. 1 nastpuje kadorazowo na podstawie Umowy zawartej na odlego pomidzy Operatorem a Uytkown-ikiem, na warunkach okrelonych szczegowo w niniejszym Regulaminie Usug, Regulaminie Usug Fitness, Regulaminie Pakietu Medycznego oraz wedug aktualnych cen wskazanych na Stronie Internetowej w momencie skadania zamwienia przez Uytkownika. 3. Ceny zamieszczone na Stronie Internetowej stanowi ceny brutto (z podatki-em VAT) i okrelone s w zotych polskich. Operator wystawia Uytkownikowi faktur w formie elektronicznej, ktra bdzie dostpna w Koncie Uytkownika. 4. Niezalenie od opat za poszczeglne Usugi Uytkownik jest zobowizany uici jednorazowo w momencie skadania zamwienia opat wpisow, z wyczeniem zamwienia Karnetu Fitness waciwego dla Obiektu macier-zystego w Rzeszowie lub w Mielcu. Opata wpisowa obowizuje w wysokoci okrelonej na Stronie Internetowej w momencie skadania zamwienia przez Uytkownika. Opata wpisowa ma charakter bezzwrotny, z zastrzeeniem 7.5. Uytkownik dokonuje patnoci za zamwione Usugi: i. przy uyciu cyklicznego obcienia karty patniczej (dalej: cykliczne obcienie karty) Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro lub ii. przelewem bankowym w formie polecenia zapaty (dalej: polecenie zapaty (PZ)), do 5-go dnia kadego miesica (dalej jako: patno miesiczna), zgodnie z zasadami szczegowo okrelonymi w ust. 7 15 poniej. Okresem rozliczenio-wym jest miesic kalendarzowy. Z uwagi na zawarcie Umowy na warunkach promocyjnych Uytkownik zobowizany jest do uiszczania patnoci miesicznych jedynie w pierwszych 12 kolejnych miesicach spord 15 miesicy obowizywania Umowy. Dostpne formy patnoci w przypadku systemu ePrzelewy: Pac z inteligo (inteligo), mTransfer (mBank), Pac z Orange (mBank), Przelew24 (Bank Zachodni WBK), Pac z iPKO (PKO BP), Pekao24Przelew (Bank Pekao), Pac z Citi Handlowy (CitiBank Handlowy), PayWay Toyota Bank (Toyota Bank), Pa z BO (Bank Ochrony rodowiska), Pac z Alior Bankiem (Alior Bank), T-Mobile Usugi Bankowe (Alior Bank), Millennium - Patnoci Internetowe (Bank Millennium), Pa z ING (ING Bank lski), Credit Agricole Bank Polska S.A., Eurobank patno online (Euro Bank S.A.), db Transfer (Deutsche Bank Polska S.A.), Pa z Plus-Bank (Plus Bank S.A), Przelew Volkswagen Bank direct (Volkswagen Bank Polska S.A), Pac z Idea Bank (Idea Bank S.A), e-transfer Pocztowy24 (Bank Pocztowy S.A), BLIK (Polski Standard Patnoci sp. z o.o.), Pac z Idea-Cloud, R-Przelew (Raieisen Bank Polska Spka Akcyjna), SkyCash, mPay, Getin Noble Bank S.A., Pa z Getin Bank, Pa z Noble Bank, Krajowa Izba Rozliczeniowa S.A. Uytkownik moe wskaza osob trzeci jako Patnika, ktry w przypadku wyraenia zgody poprzez podpisanie stosownego formularza, bdzie ponosi opaty wynikajce z zawartej przez Uytkownika Umowy. Opnienie lub odmowa uiszczania opat przez Patnika nie zwalnia Uytkownika od obowiz-ku uiszczenia nalenych Operatorowi opat. 7. Polecenie zapaty moe by stosowane przez wszystkie banki, ktre zawary porozumienie w sprawie stosowania polecenia zapaty. Sprawno i bezpiec-zestwo funkcjonowania polecenia zapaty jest monitorowane i chronione przez bank, w ktrym Uytkownik posiada rachunek bankowy. Cena za Karnet Fitness z pakietem medycznym w danym okresie rozliczeniowym nie uwzgld-nia opat zwizanych z procesem ustanowienia i realizacji patnoci w formie polecenia zapaty lub cyklicznego obcienia karty, ktrych wysoko kadora-zowo okrela bank Uytkownika.8. Uytkownik w momencie skadania zamwienia na Usugi zobowizany jest do uiszczenia opaty za pierwszy miesic obowizywania Umowy obliczonej proporcjonalnie do pozostaych dni do koca miesica, w ktrym zawarto Umow lub wskazano dat pocztkow oraz opaty wpisowej w penej wysokoci, przy pomocy przelewu bankowego poprzez zewntrzny system patnoci Dostawcy patnoci, a w przypadku zawarcia Umowy po 20 (dwudzi-estym) dniu danego miesica kalendarzowego, rwnie opat za nastpny peny miesic kalendarzowy obowizywania Umowy. 9. W przypadku patnoci w formie polecenia zapaty Uytkownik zobowizany jest do wskazania numeru rachunku bankowego oraz wyraenia na pimie zgody na dokonywanie obcienia rachunku bankowego Uytkownika, w celu dokonywania patnoci wynikajcych z Umowy. Uytkownik zobowizuje si do niewycofania zgody na polecenie zapaty (PZ) przez okres trwania Umowy oraz do zapewnienia wystarczajcych rodkw na rachunku bankowym na pokrycie patnoci w danym okresie rozliczeniowym. Nieskuteczne pobranie

opaty za dany okres rozliczeniowy w formie polecenia zapaty nie zwalnia Uytkownika od obowizku uiszczenia nalenej opaty za ten okres.10. W przypadku patnoci w formie cyklicznego obcienia karty patniczej, Uytkownik zobowizany jest do wskazania numeru i daty wanoci swojej karty patniczej oraz wyraenia zgody na cykliczne obcianie rachunku karty patniczej w celu dokonywania patnoci wynikajcych z Umowy. Zaznaczenie przez Uytkownika odpowiedniego pola w trakcie skadania zamwienia na Stronie Internetowej oznacza wyraenie zgody, o ktrej mowa w zdaniu poprzedzajcym. Patnoci cykliczne autoryzowane s przez Dostawc patno-ci eCard S.A. za porednictwem serwisu rozliczeniowego eCard S.A. Dane karty patniczej Uytkownika nie bd zapisywane przez Operatora. Karta patnicza bdzie identykowana przez Operatora wycznie na podstawie unikalnego numeru oraz cigu znakw (tzw. Cardhash) przesyanych przez serwis rozliczeniowy Dostawcy patnoci eCard S.A., umoliwiajcych obcienie karty patniczej w celu opacenia opat wynikajcych z Umowy. Dane karty patniczej s zapisywane i przechowywane wycznie przez system rozliczeniowy Dostawcy patnoci eCard S.A. 11. Zgoda, o ktrej mowa w ust. 10, moe zosta w kadej chwili cofnita przez Uytkownika poprzez zoenie dyspozycji na adres: platnosci.cykliczne@calyp-so.com.pl. Dyspozycja cofnicia zgody powinna zosta przesana z adresu email Uytkownika wskazanego jako Login oraz zawiera numer Karty lub numer telefonu Uytkownika. 12. Kady przypadek nieskutecznej autoryzacji patnoci cyklicznych, o ktrych mowa w ust. 10, z wyczeniem nieskutecznej autoryzacji z powodu braku rodkw, powoduje konieczno ponownej rejestracji karty patniczej przez Uytkownika, zgodnie z zasadami o ktrych mowa w ust. 10. Dostawca patnoci moe zobowiza Uytkownika do dokonania dodatkowej autoryzac-ji patnoci cyklicznych w innych przypadkach ni wskazane w zdaniu poprzedzajcym.13. W przypadku cofnicia zgody, o ktrym mowa w ust. 11 lub nieskutecznej autoryzacji patnoci cyklicznych, okoliczno ta nie zwalnia Uytkownika od obowizku uiszczenia nalenych opat w danym okresie rozliczeniowym. 14. Wyraenie zgody, o ktrej mowa w ust. 9, powinno zosta dokonane przez Uytkownika w jednym z Obiektw tness, na formularzu zgody na polecenie zapaty udostpnionym przez Operatora. W przypadku wyboru dostawy Karty za porednictwem kuriera, Uytkownik wyraa zgod na polecenie zapaty podpisujc formularz przesany razem z Kart, ktry zostanie zwrcony Operatorowi przez kuriera. Uytkownik moe rwnie pobra formularz zgody ze Strony Internetowej oraz wypeniony odesa listem poleconym na adres Operatora. 15. Podpis Uytkownika na formularzu polecenia zapaty lub zgoda na cykliczne obcienie karty patniczej, uprawniaj Operatora do obcienia odpowiednio rachunku bankowego lub rachunku karty patniczej Uytkownika pen nalen kwot opat w okresie rozliczeniowym oraz w kadym kolejnym okresie rozliczeniowym obowizywania Umowy, bez koniecznoci kadora-zowego zawiadomienia o tym fakcie Uytkownika. 16. Karta moe zosta wydana Uytkownikowi: a) poprzez wysanie jej na adres wskazany przez Uytkownika w treci zamwienia za porednictwem kuriera, z zastrzeeniem, e do kwoty zamwie-nia naley doliczy opat za przesyk, w wysokoci okrelonej w treci zamwienia na Stronie Internetowej;b) w recepcji jednego z Obiektw tness, po werykacji tosamoci Uytkowni-ka z dowodem tosamoci oraz identykatorem zamwienia otrzymanym zgodnie z 3 ust. 2.17. Uytkownik, w recepcji jednego z Obiektw tness, a w przypadku odbioru Karty za porednictwem kuriera, w jego obecnoci, potwierdza wasnorcznym podpisem otrzymanie Karty (dalej jako: owiadczenie) oraz udziela Partnero-wi medycznemu zgody na wiadczenie usug medycznych. Formularze owiad-czenia oraz zgody na wiadczenie usug medycznych dostpne s w recepcjach Obiektw tness lub zostan dostarczone przez kuriera wraz z Kart, a take s dostpne na Stronie Internetowej. 18. Uytkownik wyraa zgod na wystawianie i przesyanie faktur elektron-icznych, ktre po ich wystawieniu bd dostpne w Koncie Uytkownika, na podstawie ustawy z dnia 11 marca 2004 r. o podatku od towarw i usug. Uytkownik moe pobra i zapisa faktur elektroniczn na swoim urzdzeniu w celu dalszego jej wykorzystania.

3. SKADANIE ZAMWIENIA

1. W celu zoenia zamwienia, Uytkownik wybiera zakadk Oferta na Stronie Internetowej. Ponadto Uytkownik wskazuje wymagane dane osobowe, loguje si na swoje Konto Uytkownika wpisujc Login i Haso, a jeeli jeszcze go nie posiada, dokonuje rejestracji Konta Uytkownika, zgodnie ze wskazwki podanymi na podstronie Strony Internetowej, a nastpnie okrela dodatkowo:a) rodzaj Umowy, b) Obiekt macierzysty,c) dat pocztkow,

d) form i szczegy patnoci,e) form Dostawy. Nastpnie Uytkownik przekazuje zamwienie Operatorowi wybierajc polecenie Kupuj i pac, w podsumowaniu zamwienia.2. Operator potwierdza niezwocznie Uytkownikowi fakt otrzymania zamwienia przesyajc wiadomo email i z t chwil dochodzi do zawarcia Umowy. 3. Po przekazaniu Operatorowi zamwienia, zgodnie z ust. 1 powyej, Uytkownik zostaje przekierowany na bezpieczn stron internetow Dostaw-cy patnoci, na ktrej - po zaakceptowaniu przez Uytkownika warunkw dokonania patnoci wymaganych przez Dostawc patnoci - uiszcza opaty w wysokoci okrelonej w podsumowaniu zamwienia.4. Po zawarciu Umowy oraz dokonaniu patnoci na zasadach okrelonych w Regulaminie Usug, Operator dokonuje Dostawy Karty w sposb wskazany przez Uytkownika spord dostpnych w momencie skadania zamwienia. Operator dooy stara, aby Dostawa odbya si nie pniej ni w terminie 3 Dni Roboczych od dnia zawarcia Umowy. W przypadku Uytkownika Startera, Operator nie dostarcza Uytkownikowi Karty, a korzystanie z Usug odbywa si na podstawie Karty Startera.5. Karta moe by wystawiona wycznie na Uytkownika, ktry zawar Umow.6. Karta nie moe by odsprzedawana lub przekazywana i udostpniana w jakikolwiek inny sposb osobom trzecim.

4. ZASADY KORZYSTANIE Z USUG

1. Uytkownik jest uprawniony do rozpoczcia korzystania z Usug w zakresie usug tness, po upywie terminu 14 dni od momentu zawarcia Umowy, chyba e Uytkownik w momencie skadania zamwienia da rozpoczcia wiadczenia Usug przed upywem terminu na odstpienie od Umowy zgodnie z 7 ust. 3, wwczas Uytkownik jest uprawniony do rozpoczcia korzystania z Usug po zawarciu Umowy lub od daty pocztkowej wskazanej przez Uytkownika, zgodnie z ust. 9.2. Postanowienie zdania poprzedniego nie dotyczy Uytkownikw ktrzy wybrali Obiekt macierzysty na terenie miasta Warszawy (z wyczeniem Obiektw Premium), ktrzy mog korzysta z usug wszystkich Obiektw tness, z wyjtkiem obiektw Premium, a take nie dotyczy Uytkownikw ktrzy wybrali Obiekt Premium jako Obiekt macierzy-sty, ktrzy mog korzysta ze wszystkich Obiektw tness. Uytkownik zobow-izany jest ponadto do przestrzegania zasad korzystania z Obiektw tness, okrelonych poniej.3. Uytkownik jest uprawniony do rozpoczcia korzystania z Usug w zakresie usug pakietu medycznego:a) w przypadku zawarcia Umowy do 24-dnia miesica od 1-go dnia miesica nastpujcego po miesicu, w ktrym upyn termin na odstpienie od Umowy zgodnie z 7 ust. 1, chyba e Uytkownik w momencie skadania zamwienia da rozpoczcia wiadczenia Usug przed upywem terminu na odstpienie od Umowy zgodnie z 7 ust. 3, to wwczas Uytkownik jest uprawniony do rozpoczcia korzystania z Usug w zakresie usug pakietu medycznego, od 1-go dnia miesica nastpujcego po miesicu zawarcia Umowy;b) w przypadku zawarcia Umowy pomidzy 25 a ostatnim dniem miesica od 1-go dnia miesica kalendarzowego nastpujcego po miesicu, w ktrym upyn termin na odstpienie od Umowy zgodnie z 7 ust. 1, chyba e Uytkownik w momencie skadania zamwienia da rozpoczcia wiadczenia Usug przed upywem terminu na odstpienie od Umowy zgodnie z 7 ust. 3, to wwczas Uytkownik jest uprawniony do rozpoczcia korzystania z Usug w zakresie usug pakietu medycznego, od 5-go dnia miesica nastpujcego po miesicu zawarcia Umowy.kadorazowo pod warunkiem udzielenia Partnerowi medycznemu na pimie zgody na wiadczenie usug medycznych, o ktrej mowa w 2 ust. 17.W przypadku okrelenia przez Uytkownika daty pocztkowej zgodnie z postanowieniami ust. 9 poniej, terminy rozpoczcia korzystania z Usug w zakresie pakietu usug medycznych bd odnoszone do daty pocztkowej ustalonej przez Uytkownika. 4. Uytkownik moe korzysta z Usug w zakresie usug pakietu medycznego, w zakresie i na zasadach okrelonych w Regulaminie Pakietu Medycznego, stanowicego zacznik do Umowy. 5. Z zastrzeeniem ust. 3, nieuiszczenie opat, o ktrych mowa w 2 ust. 4 oraz

ust. 8, lub niedopenienie formalnoci, o ktrych mowa w 2 ust. 9 lub ust. 10, lub nieudzielenia Partnerowi medycznemu na pimie zgody na wiadczenie usug medycznych w terminie 5 dni od dnia zawarcia Umowy spowoduje zawieszenie uprawnienia do korzystania z Usug w zakresie usug tness lub usug pakietu medycznego, do momentu zaksigowania przez Operatora patnoci lub dopenienia formalnoci. Zawieszenie uprawnienia do korzysta-nia z Usug z przyczyn, o ktrych mowa w zdaniu poprzedzajcym, nie zwalnia Uytkownika z obowizku uiszczenia nalenych opat za okres zawieszenia. Wznowienie uprawnienia do korzystania z Usug w zakresie usug pakietu medycznego nastpi od pierwszego dnia miesica nastpujcego po miesicu, w ktrym zaksigowano patnoci lub dopeniono formalnoci, a w przypadku zaksigowania patnoci lub dopenienia formalnoci midzy 25 a ostatnim dniem miesica, od 5-go dnia nastpnego miesica kalendarzowego.6. Operator oraz Partner medyczny zobowizany jest wobec Uytkownika do wykonywania Usug z naleyt starannoci. 7. Operator zobowizany jest wobec Uytkownika do:a) Dostarczenia Karty, b) Zapewnienia moliwoci korzystania z Usug w zakresie usug tness w wybranym przez Uytkownika Obiekcie macierzystym, z zastrzeeniem 4 ust. 2;c) Zapewnienia moliwoci korzystania w Obiekcie macierzystym oraz Obiekcie tness z siowni, zaj tness oraz sauny (z wyczeniem Obiektu tness w Bytomiu i Szczecinie Outlet Park), d) Zapewnienia moliwoci korzystania z Usug pakietu medycznego. 8. Umowa Karnet Fitness z pakietem medycznym na czas okrelony (FIT PLUS 365) obowizuje przez okres 15 miesicy kalendarzowych od dnia jej zawarcia, z zastrzeeniem ust. 9, gdzie terminem pocztkowym obowizywania Umowy jest ustalona przez Uytkownika data pocztkowa oraz z zastrzeeniem 5 ust. 8, gdzie okres zamroenia wydua okres trwania Umowy w odniesieniu do usug tness oraz usug pakietu medycznego o okres zamroenia. Po upywie okresu trwania Umowy, o ktrym mowa w zdaniu poprzedzajcym, Umowa ulega przeksztaceniu w Umow zawart na czas nieokrelony, z 3-miesicz-nym okresem wypowiedzenia, ze skutkiem na koniec miesica kalendarzowe-go, w przypadku, gdy Uytkownik nie zgosi Operatorowi na pimie, najpniej 1 miesic przed upywem okresu 15 miesicy trwania Umowy, braku woli dalszego korzystania z Usug.9. Uytkownik moe okreli dat pocztkow rozpoczcia korzystania z Usug inn ni data zawarcia Umowy, przypadajc nie pniej ni w okresie 30 dni od dnia zawarcia Umowy (dalej jako data pocztkowa), z zastrzeeniem ust. 1 i ust. 3. 10. Operator moe zawiera Umow na warunkach promocyjnych oraz udziela ulg, co zostanie odpowiednio wskazane w treci zamwienia.

5. ROZWIZANIE I WYPOWIEDZENIE UMOWY. ZAWIESZENIE UPRAWNIE UYTKOWNIKA

1. Umowa Karnet Fitness z pakietem medycznym na czas okrelony (FIT PLUS 365) nie moe zosta rozwizana przed upywem okresu na jaki zostaa zawarta, z innych przyczyn anieli okrelone w ust. 3 i ust. 4 poniej.2. Jeeli Umowa, o ktrej mowa w ust. 1 przestanie obowizywa przed upywem okresu na jaki zostaa zawarta z przyczyn wywoanych przez jedn ze Stron, okrelonych odpowiednio w ust. 3 i 4 poniej, Strona ta jest zobowizana do zapaty drugiej Stronie kary umownej za wczeniejsze rozwizanie Umowy, w wysokoci obliczonej jako iloczyn wartoci opaty miesicznej oraz liczby miesicy, ktre pozostay do koca okresu obowizywania Umowy, o ktrym mowa w 4 ust. 8, gdyby Umowa nie zostaa rozwizana. 3. Uytkownik ma prawo rozwiza Umow o ktrej mowa w ust. 1 ze skutkiem natychmiastowym w przypadku jednoczesnej niedostpnoci Usug, trwajcej duej ni 7 dni, z zastrzeeniem postanowie zdania kolejnego oraz e Operator i Partnerzy maj prawo do czasowego niewiadczenia usug i zamknicia Obiektu tness lub jego czci, w celu przeprowadzenia prac konserwatorskich, remontw lub innych koniecznych dziaa. Niedostpnoci Usug w zakresie pakietu usug medycznych nie jest oczekiwanie na spenienie wiadczenia przez Partnera medycznego. 4. Operator jest uprawniony do rozwizania Umowy o ktrej mowa w ust. 1, ze skutkiem natychmiastowym w nastpujcych przypadkach:a) Powstania zalegoci Uytkownika w regulowaniu opat wynikajcych z Umowy za trzy miesice obowizywania Umowy;b) Udostpnienia przez Uytkownika osobie trzeciej Karty w celu skorzystania z Usug, c) Kopiowania Karty w celu udostpnienia jej lub jej numerw osobom trzecim,

d) Naruszenia przez Uytkownika Regulaminu Usug Fitness w sposb powodu-jcy zagroenie ycia lub zdrowia dla innych osb korzystajcych z Obiektu tness, albo raco naruszajcy przyjte normy i obyczaje. e) Naruszania przez Uytkownika Regulaminu Pakietu Medycznego;f ) korzystania przez Uytkownika z Usugi w celach zwizanych bezporednio z prowadzon dziaalnoci gospodarcz, zawodow lub inn dziaalnoci o charakterze zarobkowym.5. Owiadczenie Strony o rozwizaniu Umowy lub wypowiedzeniu Umowy, dla swej skutecznoci powinno zosta dokonane pod rygorem niewanoci, w formie pisemnej. 6. W razie powstania zalegoci w zapacie ktrejkolwiek opaty miesicznej przekraczajcej 7 dni, Operator, rwnie za porednictwem Partnera, po uprzednim zawiadomieniu za pomoc jednego z nastpujcych kanaw: telefonicznie, smsowo, mailowo, osobicie lub pisemnie Uytkownika o zalegociach oraz o moliwoci zawieszenia dostpu Uytkownika do Usug Operatora (usug tness, usug pakietu medycznego lub cznie obu usug) i wyznaczeniu 7-dniowego terminu do zapaty zalegoci, moe w przypadku bezskutecznego upywu tego terminu, dokona natychmiastowego zawiesze-nia Uytkownika w uprawnieniach do korzystania z Usug. Zawieszenie Uytkownika w przypadku, o ktrym mowa w zdaniu poprzedzajcym, nie wymaga dodatkowego zawiadomienia Uytkownika o tym fakcie. Zawieszenie Uytkownika w uprawnieniach trwa do momentu uregulowania caoci zalegoci, z zastrzeeniem, e wznowienie uprawnienia do korzystania z Usug w zakresie usug pakietu medycznego nastpi od pierwszego dnia miesica nastpujcego po miesicu, w ktrym zaksigowano patnoci, a w przypadku zaksigowania patnoci po 25 dniu miesica, od 5-go dnia nastpnego miesi-ca kalendarzowego po zaksigowaniu patnoci. 7. W okresie trwania zawieszenia, o ktrym mowa w ust. 6, Uytkownik nie jest uprawniony do korzystania z Usug, a Operator, Partner lub Partner medyczny nie jest zobowizany do adnych wiadcze na rzecz zawieszonego Uytkowni-ka zwizanych z dostpem do Usug. 8. Uytkownik ma prawo do zamroenia uprawnienia do korzystania z Usug wycznie w zakresie usug tness na okres od 1 (jednego) do 3 (trzech) penych miesicy kalendarzowych jeden raz w okresie kadych 6 miesicy obowizywa-nia Umowy (dalej jako okres zamroenia). Okres zamroenia nie jest wliczany do okresu obowizywania Umowy. Dyspozycja zamroenia moe zosta zoona najpniej do 25 dnia danego miesica kalendarzowego poprzedza-jcego okres zamroenia. Data pocztkowa okresu zamroenia nie moe przypada pniej ni 12 miesicy kalendarzowych od dnia zoenia dyspozycji zamroenia. W okresie zamroenia Uytkownik jest zobowizany do uiszczania patnoci miesicznych w obnionej wysokoci odpowiednio za 1 (pierwszy) miesic okresu zamroenia (29 z), za 2 (drugi) miesic okresu zamroenia (39 z) oraz za 3 (trzeci) miesic okresu zamroenia (49 z). W okresie zamroenia Uytkownik nie jest uprawniony do korzystania z Usug w zakresie usug tness, zachowujc prawo do korzystania z Usug w zakresie pakietu usug medycznych. Dyspozycja zamroenia powinna zosta zoona pisemnie w recepcji Obiektu Fitness.9. Uytkownik nie jest uprawniony do korzystania z Usug w celu lub w ramach prowadzonej dziaalnoci gospodarczej, zawodowej lub innej dziaalnoci o charakterze zarobkowym.

6. REKLAMACJE

1. Uytkownik moe zgosi Operatorowi reklamacje dotyczc Umowy (niewykonania lub niewaciwego wykonania Umowy). Reklamacja moe by zoona w formie elektronicznej i przesana na adres poczty elektronicznej Operatora (reklamacje@calypso.com.pl). W zgoszeniu reklamacyjnym Uytkownik winien zawrze swj adres email numer Karty oraz opis zaistniae-go problemu. Operator niezwocznie, lecz nie pniej ni w terminie 30 (trzydzieci) dni rozpatruje reklamacje i udziela odpowiedzi na adres poczty elektronicznej Uytkownika, podany w zgoszeniu reklamacji.2. Reklamacje dotyczce niewykonania lub nienaleytego wykonania Usug przez Partnera lub Partnera medycznego, naley zgasza u Operatora. W przypadku zgoszenia reklamacji, o ktrej mowa w zdaniu poprzednim przez Uytkownika, reklamacja zostaje przekazana do waciwego Partnera lub Partnera medycznego, a Operator niezwocznie, lecz nie pniej ni w terminie 30 (trzydzieci) dni rozpatruje reklamacje i udziela odpowiedzi na adres poczty elektronicznej Uytkownika, podany w zgoszeniu reklamacji.3. Operator nie wyraa zgody na wzicie udziau w postpowaniu w sprawie pozasdowego rozwizywania sporw konsumenckich, stosownie do treci przepisu art. 32 ust. 1 pkt 2 ustawy z dnia 23 wrzenia 2016 r. o pozasdowym rozwizywaniu sporw konsumenckich (Dz.U. z 2016 r. poz. 1823).

7. ODSTPIENIE OD UMOWY

1. Z uwagi na zawarcie Umowy z Operatorem na odlego Uytkownik moe odstpi od Umowy bez podania przyczyn, skadajc stosowne owiadczenie

na pimie (na adres korespondencyjny: Calypso Fitness S.A. z siedzib w Warszawie, ul. Puawska 427, 02-801 Warszawa) w terminie 14 (czternacie) dni od dnia zawarcia Umowy. Do zachowania tego terminu wystarczy wysanie owiadczenia przed jego upywem listem poleconym. Wzr owiadczenia o odstpieniu od umowy zamieszczony jest przez Operatora na Stronie Internetowej. 2. W razie skutecznego odstpienia od Umowy jest ona uwaana za niezawart, a Strony zwracaj sobie wzajemnie wszystko co sobie wiadczyy, z zastrzeeni-em postanowie 8. W takiej sytuacji Operator z dniem skutecznego odstpie-nia od Umowy, zablokuj moliwo korzystania z Karty przez Uytkownika. 3. Uytkownik moe da rozpoczcia wiadczenia na jego rzecz Usug przed upywem terminu do odstpienia, o ktrym mowa w ust. 1. W takim przypadku Uytkownik, w razie zoenia skutecznego owiadczenia o odstpieniu od Umowy, zostanie obciony opat za korzystanie z Usug w okresie poprzedza-jcym odstpienie od Umowy proporcjonalnie do okresu do dnia zoenia owiadczenia o odstpieniu. Opata ta zostanie potrcona przez Operatora z nalenoci podlegajcych zwrotowi, o ktrych mowa w 8.

8. ZWROT NALENOCI

1. Operator dokonuje zwrotu Uytkownikom nalenoci w cigu 14 (czterna-cie) dni od dnia odstpienia przez Uytkownika od Umowy zgodnie z postanowieniami 7 ust. 1 powyej. 2. Zwrot nalenoci zostanie dokonany z wykorzystaniem systemu patnoci elektronicznych eCard lub ePrzelewy obsugiwane przez Dostawc patnoci. Operator dokonuje zwrotu nalenoci na rachunek bankowy Uytkownika lub na rachunek karty patniczej, wykorzystanych do uiszczenia opaty za Kart.3. Operator zastrzega sobie prawo do dochodzenia zwrotu nalenoci w wysokoci 30,00 zotych za kady przypadek skorzystania z Usug, od momentu zoenia przez Uytkownika owiadczenia o odstpieniu od Umowy. 4. Operator wolny jest od odpowiedzialnoci, gdy zwrotu nie dokonano lub dokonano z opnieniem wskutek przekazania przez Uytkownika bdnych danych wymaganych do przelewu bankowego lub uznania rachunku karty patniczej. Zwrot nalenoci dokonany zostanie w takim przypadku, niezwocznie po uzyskaniu ww. danych od Uytkownika.

9. DANE OSOBOWE I PLIKI COOKIES

1. Administratorem danych osobowych Uytkownikw przekazanych Operatorowi dobrowolnie w celu Rejestracji oraz w celu realizacji Umowy w zakresie usug tness lub w ramach innych okolicznoci okrelonych w Regulaminie Strefy Klienta, jest Operator. 2. Administratorem danych osobowych Uytkownikw przekazanych Operatorowi dobrowolnie w celu realizacji Umowy w zakresie pakietu usug medycznych jest Partner medyczny. 3. Operator powierzy Partnerom przetwarzanie danych osobowych Uytkown-ikw, ktrzy korzystaj z usug Obiektw tness Parterw.4. Dane osobowe przetwarzane bd przez Operatora i Partnera medycznego wycznie na podstawie upowanienia do przetwarzania danych oraz wycznie w celu realizacji zamwie lub usug wiadczonych przez Operatora lub Partnera medycznego, usug Strefy Klienta, obsugi procesu reklamacji oraz ewentualnego dochodzenia roszcze, jak rwnie w usprawiedliwionym celu administratorw danych osobowych.5. Dane osobowe dotyczce postpw treningowych Uytkownika przetwarzane w ramach dostpu do postpw treningowych bd przetwarzane wycznie na podstawie zgody Uytkownika wyraonej na pimie. 6. Dane osobowe przekazane do Operatora podawane s mu dobrowolnie, z tym jednak zastrzeeniem, e niepodanie okrelonych w Regulaminie Strefy Klienta danych w procesie Rejestracji uniemoliwia Rejestracj i zaoenie Konta Uytkownika oraz uniemoliwia zawarcie Umowy o prowadzenie Konta a take wiadczenie Usug przez Operatora i Partnera medycznego.7. Szczegowe informacje dotyczce warunkw przetwarzania danych osobowych Uytkownika oraz praw przysugujcych Uytkownikowi w zwizku z tym przetwarzaniem zostay zawarte w Polityce Prywatnoci dostpnej na Stronie Internetowej

10. POSTANOWIENIA KOCOWE I ZMIANA REGULAMINU USUG

1. Tre niniejszego Regulaminu Usug moe zosta utrwalona poprzez wydru-kowanie, zapisanie na noniku lub pobranie w kadej chwili ze Strony Internetowej.2. Regulamin moe ulec zmianie wycznie w zakresie postanowie organizacy-jno-porzdkowych, o ktrych mowa w pkt 8-17 Regulaminu Usug Fitness. O treci zmian kady Uytkownik zostanie poinformowany przez umieszczenie przez Operatora na Stronach Internetowych wiadomoci o zmianie.3. Poinformowanie o zmianie Regulaminu Usug Fitness, w sposb okrelony

powyej nastpi nie pniej ni na 14 (czternacie) Dni Roboczych przed wprowadzeniem zmienionego Regulaminu Usug Fitness. 4. W przypadku powstania sporu na gruncie zawartej Umowy lub w zwizku z ni, Strony bd dyy do rozwizania sprawy polubownie. 5. Prawem waciwym dla rozstrzygania wszelkich sporw powstaych na gruncie niniejszego Regulaminu lub w zwizku z nim jest prawo polskie. W przypadku rozbienoci pomidzy wersj polsk i angielsk wica jest wersja polska. 6. Niniejszy Regulamin wchodzi w ycie z dniem 1 listopada 2018 r. 7. Zaczniki do niniejszego Regulaminu stanowi:a) Regulamin Usug Fitness,b) Regulamin Pakietu Medycznego:- Regulamin udzielania wiadcze medycznych - Zakres usug medycznych oferowanych przez Partnera medycznego.- Zakres oraz regulamin wiadczenia usug concierge.

1. Uytkownik moe korzysta z Usug w zakresie usug tness w dniach i godzinach otwarcia danego Obiektu tness. Uytkownik przyjmuje do wiadomoci, i Obiekty tness mog by nieczynne w dni ustawowo wolne od pracy. 2. Uytkownik podczas wizyty moe korzysta z Obiektu tness, w zakresie usug tness, przez dowolny czas, z zastrzeeniem ust. 1. Szczegowy zakres usug dostpnych w danym Obiekcie tness oraz adresy Obiektw tness okrelone s na Stronie Internetowej, z zastrzeeniem, i w kadym Obiekcie tness, wskazanym na tej licie, Uytkownik posiadajcy wan Kart moe skorzysta z nastpujcych usug:a) Siownia, b) Zajcia tness, c) Sauna (z wyczeniem Obiektu tness w Bytomiu i Szczecinie Outlet Park).3. Dostp do Usug Obiektu tness nastpuje kadorazowo na podstawie Karty odczytanej w odpowiednim urzdzeniu. Pracownicy recepcji Obiektu tness maj prawo do werykacji tosamoci Uytkownika (na podstawie dokumentu tosamoci) i jej zgodnoci z danymi Karty. W przypadku nieposiadania takiego dokumentu przez Uytkownika, niewanoci takiego dokumentu lub niezgod-noci danych na Karcie i w dokumencie tosamoci, Partner lub Operator jest uprawniony do odmowy dostpu do Obiektu tness jak rwnie do zatrzyma-nia Karty Uytkownika. 4. Operator lub Partner jest uprawniony do odebrania Karty uytkowanej przez osob nieupowanion, niezgodnie z jej przeznaczeniem lub postanowieniami Regulaminu Usug. 5. Zabronione jest dokonywanie przez Uytkownika jakichkolwiek zmian w wygldzie Karty. Uyczanie lub jakakolwiek inna forma przekazania Karty przez Uytkownika innemu Uytkownikowi lub osobie trzeciej jest zabroniona. Uytkownik nie jest uprawniony do korzystania z Usug Operatora w celu lub w ramach prowadzonej dziaalnoci gospodarczej, zawodowej lub innej dziaal-noci o charakterze zarobkowym.6. Fakt zgubienia, zniszczenia lub kradziey Karty naley niezwocznie zgosi w recepcji Obiektu tness. W takiej sytuacji Operator niezwocznie dostarczy do recepcji Obiektu tness nowy egzemplarz Karty, pod warunkiem uprzedniego wniesienia przez Uytkownika opaty za duplikat Karty w wysokoci 20,00 zotych. W przypadku znalezienia Karty uprzednio zgoszonej jako zagubiona, Kart naley odesa do Operatora lub przekaza Partnerowi 7. Rozszerzenie zakresu Usug Karnetu Fitness, lub Obiektw tness wskaza-nych na Stronie Internetowej, nie wymaga zmiany Regulaminu Usug, z zastrzeeniem, e rozszerzenie to nie moe w adnym zakresie ogranicza dotychczasowych uprawnie Uytkownika w ramach Umowy.8. Rzeczy wartociowe Uytkownik zobowizany jest zdeponowa w recepcji lub oznaczonych szafkach depozytowych, znajdujcych si na terenie Obiektu tness. Za rzeczy wartociowe, ktre nie zostay zdeponowane w ww. miejscach, Operator lub Partner nie ponosi odpowiedzialnoci.9. Operator i Partnerzy maj prawo do czasowego niewiadczenia usug i zamknicia Obiektu tness lub jego czci, w celu przeprowadzenia prac konserwatorskich, remontw lub innych koniecznych dziaa. W przypadku gdy czas, przez ktry z winy Operatora lub Partnera Uytkownik nie moe korzysta z przysugujcych mu zgodnie z Umow wiadcze, wynosi powyej 8 godzin w danym dniu, Uytkownikowi przysuguje prawo do obniki opaty miesicznej, proporcjonalnie do iloci dni, przez ktre Operator lub Partner nie wiadczy Usug, gdzie za kady dzie niewiadczenia usug przez Operatora

FITNESS PASS WITH A MEDICAL PACKAGE SERVICE REGULATIONS (3 months for free)

These Regulations specify:1) the general terms, conditions, rules and manner of sales by the Operator through the website: www.calypso.com.pl in the scope of the following services: Fitness Pass with a medical package (FIT PLUS 365);2) the specic provisions of a distance agreement concluded with the Operator via the website: www.calypso.com.pl. 3) the rules of using the Operators services, Card and Fitness Facilities,

1. DEFINITIONS

1. Workdays - mean the days from Monday to Friday;2. Delivery - means the factual act consisting in delivery a Card to the place indicated by the User. The Operator will exercise the eorts to make the Delivery take no more than 3 workdays of the date of conclusion of an Agreement;3. Payment Service Provider - means the entrepreneur: eCard S.A. with its registered oce in Warsaw at Czackiego street No. 7/9/11, 00-043 Warszawa, entered in the register of entrepreneurs maintained by the District Court for the capital city of Warsaw, XII Commercial Division of the National Court Register at KRS No.: 0000042304, NIP No.: 5213103040, with the share capital of PLN 30,259,488.00 (paid-up in full), providing the online payment services;4. Methods of Payment - the methods of payment accepted by the Operator, resulting from the Agreement. 5. Password - means the combination of letters, digits or other character selected by the User during Registration in the Customer Zone, used for the purpose of securing access to the User Account.6. User Account - the individual panel for the User, launched for it by the Operator, after the User is registered on the Website.7. Login - the individual designation of the User, required with the Password for opening a User Account in the Customer Zone. The login is the email address indicated by the User.8. Card / Calypso Card - means the subscription card or another, replacement card, which allows the User to use the Operators Services. 9. Fitness Facility - the tness facility, in which the Operator or a Partner conducts the activities of a tness club under the brand of Calypso Fitness; The full list of tness facilities is available on the Website, in the Nasze Kluby (Our Clubs) bookmark on the page https://www.calypso.com.pl/nasze-kluby, excepting following tness facilities:a) Calypso Fitness Warszawa Ursynw in premises located at: ul. Puawska nr 427 w Warszawie;b) Calypso Fitness Warszawa Wola Park in premises located at: ul. Grczewska nr 124 w Warszawie,c) Calypso Fitness Warszawa Bielany in premises located at: ul. Przy Agorze nr 22 w Warszawie;d) Calypso Fitness Warszawa Galeria Pnocna in premises located at: ul. wiatowida nr 17 w Warszawie;e) Calypso Fitness Warszawa Wilanowska in premises located at: ul. Wilanowska nr 363 w Warszawie;f ) Calypso Fitness Warszawa Plac Unii in premises located at: Plac Unii/Puawska nr 2 w Warszawie;g) Calypso Fitness Warszawa Mangalia in premises located at: ul. Mangalia nr 2 w Warszawie;h) Calypso Fitness Warszawa Europlex in premises located at: ul. Puawska nr 17 w Warszawiei) Calypso Fitness Warszawa Arkadia in premises located at: Al. Jana Pawa II nr 82 w Warszawiej) Calypso Fitness Warszawa Galeria Mokotw in premises located at: ul. Wooska nr 12 w Warszawiek) Calypso Fitness Warszawa Wawer in premises located at: ul. K. Szpotaskiego w Warszawiel) Calypso Fitness Warsaw Spire in premises located at: Plac Europejski nr 1 w Warszawie,m) Calypso Fitness Piaseczno in premises located at: ul. Pawia nr 11 w Piasecznien) Calypso Fitness Piastw in premises located at: ul. Warszawska 43 w Piastowie10. Home Facility - The tness facility indicated by the User while placing an order, in which the User may use the services on the basis of the Agreement concluded with the Operator. 11. Operator - means the entrepreneur Calypso Fitness S.A. with its registered oce in Warsaw, at Puawska street, 02-801 Warszawa, entered in the register of entrepreneurs maintained by the District Court for the capital city of Warsaw in Warsaw, XIII Commercial Division of the National Court Register at KRS No.: 0000400719, NIP No.: 5252519684, with the share capital of PLN 158,626.00 (paid-up in full), operating the tness clubs under the Calypso Fitness brand and being the owner of the Website.

12. Entry Fee - a one-time fee in the amount indicated on the Website, paid when the User places an order, associated with the administrative and technical management of the Agreement. 13. Partner - means the entrepreneur: a) Fitness MCG sp. z o.o. with its registered oce in Warsaw, at Puawska street No. 427, 02-801 Warszawa, entered in the register of entrepreneurs maintained by the District Court for the capital city of Warsaw, XIII Commer-cial Division of the National Court Register at KRS No. 0000384688, NIP No. 5252507333, with the share capital of PLN 500,000.00; b) Baltic Fitness Center Sp. z o.o. with its registered oce in Warsaw, at Puawska street No. 427, 02-801 Warszawa, entered in the register of entrepreneurs maintained by the District Court for the capital city of Warsaw, XIII Commercial Division of the National Court Register at KRS No. 0000431757, NIP No. 525-253-81-96, with the share capital of PLN 5,000.00; - operating the tness clubs under the Calypso Fitness brand and providing the Services oered by the Operator to the Users;14. Medical Partner - means the entrepreneur the PZU Zdrowie S.A. compa-ny with its registered oce in Warsaw, ul. Konstruktorska 13, 02-673 Warsza-wa, entered in the register of entrepreneurs maintained by the District Court for the capital city of Warsaw in Warsaw, XII Commercial Division of the National Court Register at No. 0000395215, NIP No. 527-266-38-52, share capital of PLN 650,000 (paid-up in full) who provides the medical package services to the User;15. Payee - a third party indicated by a User, obliged to pay the day-to-day fees resulting from an Agreement, including the monthly fees for the Services. The User will be liable for the Payees delays in payments or refusal to pay the fees, and the indication of a Payee will not release the User of the obligation to pay the fees should the Payee fail to pay them. 16. Fitness Pass with a medical package Service Regulations m e a n these Regulations.17. Fitness Servie Regulations - mean the Regulations of provision of tness services by the Operator or Partner, which the User may use under an Agreement.18. Medical Package Regulations - mean the Regulations for providing medical services and the Scope of the medical services oered by the Medical Partner, which may be used by the User under an Agreement.19. Website - means the websites, at which the Operator conducts its information and marketing activities and the Customer Zone at www.calyp-so.com.pl.20. Customer Zone - means the pages of the Website, through which the Operator provides the Users with active User Accounts, with the functionali-ties, in particular with the possibility to purchase goods and services, as well as a newsletter, updates, training progress tracking, upon the terms and conditions specied in these Service Regulations and in the Customer Zone Regulations.21. Agreement - means the distance agreement, as dened in the Act on Consumer Rights of 30 April 2014 (Journal of Laws of 2014, item 827, as amended),concluded with the Operator by a User, the subject of which is the provision by the Operator of the services selected by the User:a) a Fitness Pass with a medical package for the specied period of 15 calendar months (FIT PLUS 356), 22. Services/Operators Services - mean the services oered by the Operator via the Website and the services provided to the User by the Operator and the Medical Partner under a Fitness Pass with a medical package, i.e.(i) the possibility to use the Fitness Facilities operating under the brand of Calypso Fitness, in the scope of gym, tness activities and sauna (excluding the Fitness Facility in Bytom and in Szczecin Outlet Park), upon the terms and conditions specied in these Regulations and in the Fitness Service Regula-tions, and(ii) the possibility to use the medical package services handled by the Medical Partner, upon the terms and conditions specied in these Regula-tions and in the Medical Package Regulations;The Operator may provide other services, not listed in this point, the specic terms and conditions of which will be specied each time in separate regula-tions and which will not aect the scope or the terms and conditions of provision of the services specied in these Service Regulations. 23. User - means an individual with full capacity for acts in law, aged 18 66 at the moment of conclusion of the Agreement, using the Operators Services or Customer Zone in the scope not directly associated with its business or professional activities. The User will not be a Protected Person, as dened in the Medical Package Regulations.

2 GENERAL PROVISIONS

1. Via its Website, the Operator oers the Users with the possibility to purchase the following Service:Fitness Pass with a medical package (FIT PLUS 365) covering the possibili-ty to use the Operators and Partners Fitness Facilities, operating under the brand of Calypso Fitness (hereinafter referred to as the medical package) for the specied period of 15 months, subject to 4 section 8;2. The Services, referred to in section 1, are used each time on the basis of a distance Agreement concluded between the Operator and a User, upon the terms and conditions specied in detail in these Service Regulations, the Fitness Service Regulations, the Medical Package Regulations and based on the current prices published on the Website upon the placement of an order by a User. 3. The prices published on the Website are gross prices (including VAT) and are specied in Polish zloty (PLN). The Operator will issue an electronic invoice for the User, which will be available after the Users logs in to its User Account. 4. Regardless of the fees for the respective Services, the User will be obliged to pay a one-time entry fee upon placement of an order, excluding the order of Fitness Pass for Home Facility in Rzeszow or Mielec. The entry fee will apply in the amount specied on the Website at the time when the User places an order. The entry fee is non-refundable, subject to 7.5. The User will pay for the ordered Services: (i) with the use of repetitive debits from a payment card (hereinafter: repetitive card debits): Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro or (ii) by wire transfer in the form of a direct debit (hereinafter: direct debit (DD)), until the 5th day of each month (hereinafter: monthly payment), based on the rules specied in detail in sections 7 15 below. The settlement period is one calendar month. Due to the conclusion of the Agreement on promotional conditions the User will be obliged to pay monthly payments only for rst 12 consecutive months from among 15 months of eective-ness of the Agreement. In the case of the ePrzelewy system, the available payment methods include: Pac z inteligo (inteligo), mTransfer (mBank), Pac z Orange (mBank), Przelew24 (Bank Zachodni WBK), Pac z iPKO (PKO BP), Pekao24Przelew (Bank Pekao), Pac z Citi Handlowy (CitiBank Handlowy), PayWay Toyota Bank (Toyota Bank), Pa z BO (Bank Ochrony rodowiska), Pac z Alior Bankiem (Alior Bank), T-Mobile Usugi Bankowe (Alior Bank), Millennium - Patnoci Internetowe (Bank Millennium), Pa z ING (ING Bank lski), Credit Agricole Bank Polska S.A., Eurobank patno online (Euro Bank S.A.), db Transfer (Deutsche Bank Polska S.A.), Pa z Plus-Bank (Plus Bank S.A), Przelew Volkswagen Bank direct (Volkswagen Bank Polska S.A), Pac z Idea Bank (Idea Bank S.A), e-transfer Pocztowy24 (Bank Pocztowy S.A), BLIK (Polski Standard Patnoci sp. z o.o.), Pac z Idea-Cloud, R-Przelew (Raieisen Bank Polska Spka Akcyjna), SkyCash, mPay, Getin Noble Bank S.A., Pa z Getin Bank, Pa z Noble Bank, Krajowa Izba Rozliczeniowa S.A. (Cooperative Banks from the SGB and BPS Groups). 6. The User may indicate a third party to be the Payee who, if it consents by signing a proper form, will pay the fees resulting from the Agreement concluded by the User. Payees delay in paying or refusal to pay the fees will not release the User of the obligation to pay the fees due to the Operator. 7. A direct debit may be applied by any bank that has concluded an agreement on application of direct debits. The eectiveness and security of functioning of direct debits are monitored and protected by the bank, in which the User has a bank account. The price for the Fitness Pass with a medical package in the given settlement period does not take into account the fees on account of the process of directing and executing the payment in the form of a direct debit or repetitive debiting of a card, the amount of which will be specied each time by the Users bank.8. The User, when placing an order for the Services, will be obliged to pay the fee for the rst month of eectiveness of the Agreement, calculated pro rata to the remaining number of days until the end of the month, in which the Agreement is concluded, or of the month that includes the initial data, as well as an entry fee in full, with a wire transfer via an external payment system of a Payment Service Provider, and in the case of conclu-sion of an Agreement after the 20th (twentieth) day of the given calendar month - also a fee for the next full calendar month of eectiveness of the Agreement. 9. In the case of the monthly fee in the form of a direct debit, the User will be obliged to indicate the bank account number and to express its consent in writing for encumbering the Users bank account for the purpose of making the payments under an Agreement. The User undertakes not to withdraw its consent for the direct debit during the eectiveness of the Agreement and to provide sucient funds on its bank account for covering the payments in the given settlement period. An ineective collection of

the fee for the given settlement fee in the form of a direct debit, will not release the User of the obligation for paying the fee due for that period.10. In the case of the monthly fee in the form of a repetitive debit, the User will be obliged to indicate the number and validity date of its payment card and to express its consent for repetitive debits of its payment card account for the purpose of making the payments under an Agreement. The consent referred to in preceding sentence is given by selecting the appropriate eld by the User upon placing the order in the Website. The repetitive payments will be authorized by the Payment Service Provider eCard S.A. via the eCard S.A. settlement website. The Users payment card data will not be recorded by the Operator. The payment card will be identied by the Operator solely on the basis of a unique number and combination of characters (so-called Cardhash) sent via the Suppliers settlement website of the Payment Service Provider eCard S.A. allowing to debit the payment card for the purpose of paying the fees under the Agreement. The data of the payment card will be recorded and stored solely by the settlement system of the Payment Service Provider eCard S.A. 11. The consent, referred to in section 10, may be revoked by the User at any time via platnosci.cykliczne@calypso.com.pl. The instruction to revoke the consent must be sent from the email address of the User indicated as the Login and the Users Card number or phone number.12. Every case of ineective authorization of the repetitive payments, referred to in section 10, except for ineective authorization for reason of lack of funds, will oblige the User to reregister its payment card in compli-ance with the rules specied in section 10. The Payment Service Provider may oblige the User to make an additional authorization of repetitive payments in other cases than indicated in the preceding sentence. 13. In the case of withdrawal of the consent, referred to in section 11, or of ineective authorization of repetitive payments, that circumstance will not release the User of the obligation to pay the fees due in the given settlement period. 14. The consent, referred to in section 9, must be given by the User in one of the Fitness Facilities, on the form of consent for direct debit, provided by the Operator. In the case of selection of delivery of a Card by courier mail, the User will consent for the direct debit by signing the form sent together with the Card, which will be returned to the Operator by the courier. The User may also collect the consent form from the Website, ll it in and send it back by registered mail to the Operators address. 15. The Users signature on the direct debit form or its consent for repetitive debit on its payment card, will authorize the Operator to encumber the bank account or payment card account of the User, with the fees due in the settlement period and in each subsequent settlement period of eective-ness of the Agreement, without the need to report that fact to the User each time. 16. The Card may provided to the User: a) by sending it to the address indicated by the User in the contents of its order, by courier mail, with the reservation that the amount of the order must be increased by the fee for shipment, in the amount specied in the contents of the order on the Website;b) at the reception desk of one of the Fitness Facilities, after verication of the identity of the User holding its identity card and an order identication document received under 3 section 2.17. At the reception desk of one of the Fitness Facilities, or in the presence of a courier (in the case of collection of a Card by courier mail), the User will conrm the receipt of the Card with its own signature (hereinafter: the declaration) and will grant the Medical Partner with the consent to provide medical services. The declaration forms will be available at the reception desks of the Fitness Facilities or will be delivered by the courier together with the Card, and will be available on the Website.18. The User expresses its consent for issuing and sending electronic invoices which, after issuance, will be available in the User Account, under the Tax on Goods and Services Act of 11 March 2004. The User may download and save an electronic invoice on its device, for future use.

3. ORDER PLACEMENT

1. To place an order, the User will select the Oferta ("Oer) bookmark on the Website. Moreover, the User will state the required personal data and log in to its User Account by entering its Login and Password and, if it does not have an account, it will register a User Account based on the guidelines on the page of the Website, and will additionally specify:a) Agreement type, b) Home Facility,c) starting date,d) method and details of payment,e) form of Delivery.

Then, the User will place its order with the Operator by clicking on Kupuj i pac (Buy and pay) in the order summary.2. The Operator will immediately conrm the fact of receiving an order, by sending an email to the User, thus concluding an Agreement. 3. After the order is transferred to the Operator as per section 1 above, the User will be rerouted to a secure website of the Payment Service Provider, on which after the User accepts the payment terms `and conditions required by the Payment Service Provider it will pay the payments in the amount indicated in the order summary.4. After concluding an agreement and making the payment upon the rules specied in the Service Regulations, the Operator will Deliver the Card in the manner specied by the User upon placing the order. The Operator will exercise the eort to make the Delivery take no more than 3 Workdays of the date of conclusion of the Agreement. In the case of the Starter User the Operator does not deliver the Card to the User and the User may use the Services on the basis of the Starter Card 5. The Card may only be issued to the User that has concluded an Agreement.6. The Card may not be resold, given or made available to third parties in any manner.

4. RULES OF USING THE SERVICES

1. The User will be entitled to start using the Services in the scope of the tness services after the lapse of 14 days of the moment of conclusion of the Agreement, unless the User, when placing the order, requests that the Services start to be provided prior to the lapse of the time limit for withdrawal from the Agreement as per 7 section 3 the User will then be entitled to start using the Services after concluding the Agreement or after the starting date indicated by the User as per section 9.2. The User will be entitled to use the Services in the scope of the tness services in the selected Home Facility and in other Fitness Facility located in the same city as the Home Facility (excluding Premium Facility i.e. Calypso Fitness& Wellness Center Wilanw in Warsaw and Calypso Fitness Adgar Plaza in Warsaw) and in Fitness Facility located in other city, if the amount of monthly payment is the same or lower as in the selected Home Facility, and thirty times in 6 consec-utive months during the period of eectiveness of the Agreement in other Fitness Facilities, upon the rules specied in sections 10 12. The preceding sentence does not apply to Users who have selected the Home Facility in the city of Warsaw (excluding Premium facilities) which will be entitled to use the services of all Fitness Facilities, excluding the Premium facilities, and it also does not apply to Users who have selected the Premium Facility as their Home Facility, which will be entitled to use all Fitness Facilities. Furthermore, the User will be obliged to follow the rules of using the Fitness Facilities specied below.3. The User will be entitled to start using the Services in the scope of the medical package services:a) in the case of concluding an Agreement until the 24th day of a month from the 1st day of the month subsequent to the month, in which the time limit has expired for withdrawing from the Agreement under 7 section 1, unless the User, when placing the order, requests that the Services be provided prior to the lapse of the time limit for withdrawal from the Agreement under 7 section 3 - the User will then be entitled to start using the Services in the scope of the medical package from the 1st day of the month subsequent to the month of conclusion of the Agreement;b) in the case of concluding an Agreement between the 25th and the last day of the given month from the 1st day of the calendar month subsequent to the month, in which the time limit has expired for withdrawing from the Agreement under 7 section 1, unless the User, when placing the order, requests that the Services be provided prior to the lapse of the time limit for withdrawal from the Agreement under 7 section 3 the User will then be entitled to start using the Services in the scope of the medical package from the 5th day of the month subsequent to the month of conclusion of the Agreement.each time on the condition that the Medical Package is given the consent in writing to provide medical services, referred to in 2 section 17.If the User species the starting date under the provisions of section 9 below, the dates of start of using the Services in the scope of the medical service package will refer to the starting date specied by the User. 4. The User may use the Services in the scope of the medical package services, in the scope and under the rules specied in the Medical Package Regulations attached to the Agreement.5. Subject to section 3, the failure to pay the fees, referred to in 2 section 4 or section 8 and section 81, and in the case of selection of monthly payments or payments by installments in the failure to perform the formalities, referred to in 2 section 9 or section 10 or in the failure to express the consent for the

Medical Partner to provide medical services within 5 days of conclusion of the Agreement, will suspend the right to use the Services, in the scope of the tness services or medical package services, until the payment is posted with the Operator or until the formalities are performed. The suspension of the right to use the Services for the reasons, referred to in the preceding sentence, will not release the User of the obligation to pay the fees due for the suspension period. The right to use the Services in the scope of medical package services will be resumed from the rst day of the month subsequent to the month in which the payment is posted or in which the formalities are performed, and in the case of posting the payment or performing the formalities after the 25th day of the given month from the 5th day of the subsequent calendar month.6. The Operator and the Medical Partner will be liable to the User for providing the Services with due diligence.7. The Operator will be liable to the User for:a) Delivering the Card, b) Providing the possibility to use the Services in the scope of tness services in the home Facility selected by the User, as well as only once per 6 consecutive months of eectiveness of the Agreement - in the Fitness Facility not being the home Facility, subject to section 2;c) Providing the possibility to use the gym, tness activities an sauna (excluding Fitness facility in Bytom and in Szczecin Outlet Park) in the home Facility and in the Fitness Facility.d) Providing the possibility to use the Medical Package Services.8. The Fitness Pass with a medical package Agreement for specied period of time (FIT PLUS 365) will be eective for 15 calendar months from the date of its conclusion, subject to section 9, where the rst day of eective-ness of the Agreement will be the starting date specied by the User and subject to 5 section 9, where the freezing period will extend the period of eectiveness of the Agreement in the scope of the tness services and medical package services, by the freezing period. After the lapse of the period of eectiveness of the Agreement, referred to in the preceding sentence, the Agreement will transform into the Agreement concluded for an unspecied period of time with 3 months notice period with eect as of the end of the given calendar month if the User fails to inform the Operator in writing, no later than 1 month prior to the lapse of the period of 15 months of eectiveness of the Agreement, of lack of its intention to use the Services further. 9. The User may specify the starting date of using the Services other than the date of conclusion of the Agreement, no later than 30 days of conclu-sion thereof (hereinafter: "starting date), subject to section 1 and section 3.10. The Operator may conclude an Agreement on promotional conditions or grant discounts, which will be specied properly in the contents of an order.

5. TERMINATION OF THE AGREEMENT. SUSPENSION OF USERS ENTITLE-MENTS

1. The Fitness Pass with a medical package Agreement for a specied period of time (FIT PLUS 365) may not be terminated prior to the lapse of the period of time, for which it has been concluded or for any reasons other than specied in section 3 and section 4 below.2. If the Agreement for a specied period of time ceases to be binding prior to the expiry of the time limit, for which it has been concluded, for reasons caused by one of the Parties, specied, respectively, in sections 3 and 4 below, the Party will be obliged to pay the other Party the contrac-tual penalty for early termination thereof, in the amount calculated as the product of the value of the monthly fee and the number of months left until the end of the period of eectiveness thereof, referred to in 4 section 8, if the Agreement has not been terminated.3. The User is entitled to terminate the Agreement referred to in section 1 with immediate eect, if the Services are not available for a continuous period of more than 7 days, subject to the provisions of the next sentence, and with the reservation that the Operator and the Partners are entitled to temporarily suspend the provision of services and to close the Fitness Facility or a part thereof for the purpose of performing renovations, repairs or other, necessary activities. The fact of waiting for the services to be provided by the Medical Partner does not constitute a case of lack of availability of the Services within the medical service package.4. The Operator is entitled to terminate the Agreement, referred to in section 1, with immediate eect, in the following cases:a) Users arrears in the payment of the fees under the Agreement for three full months of eectiveness of the Agreement,b) If the User lends its Card to a third party for the purpose of using the

Services,c) If a Card is copied for the purpose of lending it or its numbers to third parties, d) If the User violates the Fitness Service Regulations in the manner that poses a risk to the life or health of other persons using the Fitness Facility, or in the manner that grossly violates the adopted standards and practices.e) If the User violates the Medical Package Regulations;f ) If the User uses the Service for the purpose directly associated with business activities, professional activities or other paid activities5. For a declaration by a party on termination of the Agreement, to be eective, it must be drawn up in writing.6. In the case of arrears in payment of any monthly fees in excess of 7 days, the Operator, including through a Partner, after sending a notication to the User, using one of the following channels: phone, text, email, in person or in writing, of the arrears and of the possibility to suspend the Users access to the Operators Services (tness services, medical package services or jointly both types of services) and after setting a 7-day time limit for payment of the arrears, may, in the ineective lapse of that time limit, immediately suspend the Users rights to use the Services. The suspension of a User in the case specied in the preceding sentence, does not require an additional notication of that fact to the User. The suspension of the User will last until the whole arrears are paid, with the reservation that the right to use the Services in the scope of medical package services will be resumed from the rst day of the month subsequent to the month in which the payment is posted or in which the formalities are performed, and in the case of posting the payment or performing the formali-ties after the 25th day of the given month from the 5th day of the subsequent calendar month.7. In the period of suspension, referred to in section 7, the User will not be entitled to use the Services, and the Operator, Partner or Medical Partner will not be obliged to provide any services to the suspended User on account of access to the Services.8. The User is entitled to freeze the right to use the Services solely in the scope of tness services for a period of between 1 (one) and 3 (three) full calendar months, once in the period of any 6 months of eectiveness of the Agreement (hereinafter: the freezing period). The freezing period will not be counted in the period of eectiveness of the Agreement. The freezing instruction may not be submitted later than on the 25th day of the given calendar month prior to the freezing period. The starting date of the freezing period may not fall later than 12 calendar months of the date of submitting the freezing instruction. In the freezing period, the User will be obliged to make the monthly payments at a discounted level respectively PLN 29 for 1 (rst) month of the freezing period, PLN 39 for the 2nd (second) month of the freezing period and PLN 49 for the 3rd (third) month of the freezing period. In the freezing period, the User will not be entitled to use the Services in the scope of the tness services while retaining the right to use the Services in the scope of medical services. The freezing instruction must be submitted in writing at the reception desk of the Fitness Facility.9. The User is not authorized to use the Services for the purpose of or within conducted business, professional activities or other activities for prot.

6 COMPLAINTS

1. The User may submit a complaint regarding an Agreement (i.e. the failure to perform it or its improper performance) to the Operator. The complaint may be submitted in electronic form and sent to Operator's email address: (reklamac-je@calypso.com.pl). Users complaint should include its email address, Card number and description of the problem. The Operator will immediately, no later however than within 30 (thirty) days, examine the complaint and respond to it to Users email address indicated in the complaint.2. The complaints regarding the failure to provide Services or the improper provision of the Services by the Partner or Medical Partner, must be submitted to the Operator. Should a User submit a complaint, referred to in the preceding sentence, it will be transferred to the given Partner or Medical Partner, and the Operator will immediately, but no later than within 30 (thirty) days, examine the complaint and respond to it by sending an email to the email address of the User stated in the complaint.3. The Operator does not consent for participating in the proceedings in the cases of extrajudicial resolution of consumer disputes, based on the contents of the provision of art. 32 section 1 point 2 of the Act on Extrajudicial Resolution of Consumer Disputes of 23 September 2016 (Journal of Laws of 2016, item 1823).

7. WITHDRAWAL FROM THE AGREEMENT

1. Due to the conclusion of a distance Agreement with the Operator, the User may withdraw from the Agreement without stating the reasons by submitting a proper declaration in writing (correspondence address: Calypso Fitness S.A. z siedzib w Warszawie, ul. Puawska 427, 02-801 Warszawa) within 14 (fourteen)

days of concluding the Agreement. For the time limit requirement to be fullled, the declaration must be sent by registered mail prior to the expiry thereof. The template of the declaration on withdrawal from the Agreement has been published on the Website by the Operator. 2. In the eective withdrawal from the Agreement, it will be considered not concluded, and the Parties will give back all of the mutual considera-tions, with the reservation of the provisions of 8. In such a case, on the date of eective withdrawal from the Agreement, the Operator will block the User's capacity to use the Card. 3. The User may request that the Services be provided to it prior to the lapse of the time limit for withdrawal from the Agreement, referred to in section 1. In such a case, if the User submits an eective declaration on withdrawal from the Agreement, it will be encumbered with a fee for using the Services within the period prior to the date of withdrawal from the Agreement pro rata to the period until the placement of the declara-tion on withdrawal. The fee will be deducted by the Operator from the reimbursable amounts due, referred to in 8.

8. REIMBURSEMENT OF AMOUNTS DUE

1. The Operator will reimburse the Users for the amounts due within 14 (fourteen) days of the date of withdrawal by the User from the Agreement under the provisions of 7 section 1 above.2. The amounts due will be reimbursed through the eCard or ePrzelewy electronic payment systems handled by the Payment Service Provider. The Operator will reimburse the amounts due to Users bank account or payment card account used for making the payment for the Pass.3. The Operator reserves the right to seek reimbursement of the amount due of PLN 30.00 for each case of using the Services, from the moment when the User submits a declaration on withdrawal from the Agreement. 4. The Operator will be released from liability if the reimbursement has not been eected or has been eected with delay as a result of the fact that the User has stated wrong data for a wire transfer or payment card credit. In such a case, the amounts due will be reimbursed immediately after the User provides the above-mentioned data.

9. PERSONAL DATA AND "COOKIES

1. The Operator is the administrator of the User personal data voluntarily provided to the Operator for the purpose of Registration and for the purpose of performing the Agreement in the scope of the tness services or within other circumstances specied in the Customer Zone Regula-tions.2. The Medical Partner is the administrator of the personal data of the Users provided to the Operator on a voluntary basis for the purpose of performing the Agreement in the scope of the medical package services. 3. The Operator will entrust the processing of the personal data of the Users who are using the Partners Fitness Facilities, with the Partners.4. The personal data will be processed by the Operator and Medical Partner solely on the basis of a data processing authorization and solely for the purpose of performing the orders or providing the services by the Operator or Medical Partner, the Customer Zone services, the handling the complaints and potentially pursuing the claims, as well as for the justied purposes related to the tasks of personal data administrators.5. The personal data of the User training progress processed within access to training progress, will be processed solely on the basis of a written consent of the User. 6. The personal data is provided to the Operator on a voluntary basis, with the reservation that failure to provide the data specied in the Customer Zone Regulations within the Registration process will make the Registration impossible and will prevent the User from opening a User Account and from concluding an Account Agreement and from provision of the Services by the Operator and Medical Partner.7. Detailed information on the conditions of processing personal data of the User and the rights User has in connection with this processing are included in our Privacy Policy available on the Website.

10. FINAL PROVISIONS AND AMENDMENTS TO SERVICE REGULATIONS

1. The contents of these Service Regulations may be recorded by printing, recording on data carriers or downloading from the Website at any time.2. The Regulations may be amended only in the scope of the organiza-tional and order provisions indicated points 8-17 of the Fitness Service Regulations. The Operator will notify every User of the amendments by publishing a message on the Websites on the changes.3. The above-mentioned notications of amendments to the Fitness

Service Regulations will be sent no later than 14 (fourteen) Workdays prior to the introduction of the amended Service Regulations.4. In the case of a dispute related to the Agreement, the Parties will strive to resolve it amicably. 5. The disputes associated with these Regulations will be resolved in accordance with the provisions of the Polish law. In case of any discrepan-cies between the Polish and English version, the Polish version shall be binding.6. These Regulations take eect on November 1, 2018.7. The following documents constitute appendices hereto:a) Fitness Service Regulations,b) Medical Package Regulations:- the Regulations of providing medical services - the scope of the medical services oered by the Medical Partner.- the Scope and Regulations of Providing Concierge services.

Appendix No. 1. FITNESS SERVICE REGULATIONS

These Regulations specify the rules of using the tness services and the Fitness Facility within the Operators Service: Fitness Pass with a medical package (FIT PLUS 365).

1. The User may use the Services on the dates and in the opening hours of the given Fitness Facility. The User acknowledges that tness Facilities may be closed on statutory holidays. 2. During its visit, the User may use the Fitness Facility in the scope of the tness services for any period of time, subject to section 1. The detailed scope of the services available in the given Fitness Facility and the addresses of the Fitness Facilities are available on the Website, with the reservation that, in each Fitness Facility indicated on that list, the User with a valid Card, may use the following services:a) Gym, b) Fitness activities, c) Sauna (excluding Fitness facility in Bytom and in Szczecin Outlet Park).3. The access to the Fitness Facility Services is each time based on a Card read via a proper device. The employees of the reception desk of a Fitness Facility are entitled to verify the identity of the User (based on an identity document) and its compliance with the data on the Card. If the User fails to hold such a document, if such a document is invalid or if there is a discrepancy between data on the Card and the data on the identity document, the Partner or the Operator will be entitled to refuse to allow the User to access the Fitness Facility, and to hold the User's Card.4. The Operator or Partner is authorized to take away a Card that is used by an unauthorized person, in violation of its dedication or in violation of the Service Regulations.5. The User is prohibited from introducing any changes in the appearance of a Card. It is prohibited to lend or give a Card to any other User or third party. The User is not authorized to use the Operators services for the purpose of or within conducted business, professional activities or other activities for prot.6. The fact of losing a Card, its destruction or theft, must be reported immediately in the reception desk of the Fitness Facility. In such a case, the Operator will immediately deliver a new Card to the reception desk of the Fitness Facility, on the condition that the User has paid a fee for a copy of its Card, in the amount of PLN 20.00. In the case of nding the Card that has been reported as lost, it must be sent to the Operator or handed over to a Partner. 7. An expansion of the scope of the Fitness Pass Services and Fitness Facilities indicated on the Website does not require an amendment to the Service Regulations, with the reservation that the expansion may not limit the previous entitlements of the User under its Agreement.8. The User is obliged to deposit its valuables at the reception desk or in the deposit boxes located in the Fitness Facility. Neither the Operator nor a Partner will be responsible for the valuables deposited in the above-mentioned places.9. The Operator and the Partners are entitled to temporarily suspend the provision of services and to close the Fitness Facility or a part thereof for the purpose of conducting maintenance works, renovations or other necessary works. If the period, for which the User may not use the services under the Agreement, exceeds 8 hours on any given day due to the Operators or Partners fault, the User will be entitled to a discount in the monthly fee, pro rata to the number of days, on which the Operator or Partner has failed to provide the Services, where each date of the Operators or Partners failure to provide services will result in a 1/30 discount in the monthly fee, which discount will be returned to the User

Uytkownik zobowizany jest do stosowania si do przepisw przeciw-poarowych oraz instrukcji uytkowania poszczeglnych pomieszcze, urzdze i sprztu nalecych do Operatora lub Partnerw, udostpnionych w recepcji danego Obiektu tness, a w szczeglnoci instrukcji przekazywanych przez instruktorw.13. Uytkownik zobowizuje si do przestrzegania i zachowywania czystoci oraz stosowania si do oglnie przyjtych norm zachowania podczas korzysta-nia z Obiektu tness. Niedopuszczalne jest utrudnianie lub uniemoliwianie korzystania z Obiektu tness innym Uytkownikom, a take jakiekolwiek formy ubliania im lub groenia, w tym uywanie na terenie Obiektu tness, pomimo uwag ze strony personelu Klubu, sw powszechnie uznawanych za obelywe. Niedopuszczalne jest take zachowanie uwaczajce godnoci innych Uytkownikw, w tym zachowania wulgarne i obsceniczne, a take bdce przejawem rasizmu lub majce znamiona molestowania lub dyskryminacji z uwagi na ras, religi lub pe.14. Spoywanie alkoholu, palenie wyrobw tytoniowych lub papierosw elektronicznych oraz zaywanie jakichkolwiek rodkw psychoaktywnych na terenie Obiektu tness jest zabronione.15. Uytkownik zobowizany jest do noszenia obuwia kpielowego na gumowej, antypolizgowej podeszwie w pomieszczeniach takich jak azienki oraz pomieszczenia prysznicowe. W pozostaych przypadkach Uytkownik zobowizany jest do noszenia na terenie Obiektu tness zmiennego, krytego obuwia sportowego.16. Personel Obiektu tness nie posiada wyksztacenia medycznego. W razie jakichkolwiek wtpliwoci dotyczcych sprawnoci zycznej lub zdolnoci do wykonywania wicze zycznych, Uytkownik, przed przystpieniem do wykonywania jakichkolwiek wicze zycznych, powinien zasign porady medycznej.17. Zabronione jest korzystanie z Usug Operatora przez Uytkownikw bdcych pod wpywem alkoholu, rodkw majcych wpyw na krenie krwi i metabolizm komrkowy, rodkw antyhistaminowych, beta-blokerw lub rodkw uspokajajcych.

Zacznik nr 2. REGULAMIN PAKIETU MEDYCZNEGO

Regulamin udzielania wiadcze medycznych:

1. Zleceniobiorca umoliwia osobom, ktre wykupiy Abonament, podpisay owiadczenie o objciu ochron abonamentow i nie ukoczyy 67 roku ycia (dalej: Osoby Uprawnione), dostp do wiadcze zdrowotnych udzielanych w placwkach wsppracujcych z PZU Zdrowie za porednictwem infolinii medycznej PZU Zdrowie, zgodnie z zakresem usug oraz we wskazanej przez PZU Zdrowie placwce medycznej, z zastrzeeniem pkt. 3 i 7.2. Wyniki bada diagnostycznych i laboratoryjnych wydawane mog by jedynie bezporednio Osobie Uprawnionej lub osobie posiadajcej odpowied-nie upowanienie do odbioru.11.
