MAHARASHTRA MUNICIPAL CORPORATIONS Acr.No. PMC.3010fC.R.394flO/UD-22.-Tbe following draft Rules, which the Government of Maharashtra,

proposes to make in exercise of the powers conferred by sub-section (J) of section 456 A read with sections 244and 245 ofthe Maharashtra Municipal Corporations Act (LIXof 1949), and ofall other powers enabling it in thatbehalf, with a view to regulating and control the display ofsky-signs and advertisement in the areas ofMunicipalCorporations, is hereby published as required by sub-section (2) ofthe said section 456A, for thc information ofall persons likely to be affected thereby; and notice is hereby given that the said draft will be taken into considerationby the Government ofMaharashtra on and after the expiry of a period of thirty days from the date of publicationof this notification in the Maharashtra Government Gazette.

2. Any objection or suggestion, which may be received by the Principal Secretary (UD-2), UrbanDevelopment Department, 4th Floor, Mantralaya, Mumbai 400 032, from any person with respect to the saiddraft, within the aforesaid period, will be considered by the Government.

Draft Rules

No. PMC.3010/C.R.394/10/UD-22.-Whereas, by the Government of Maharashtra, L"rban DevelopmentDepartment, Notification No.MC-3010fC.R.394/10/UD-22, dated 21st June, 2014 published in the MaharashtraGovernment Gazette, Extraordinary Part-loA Central sub division, dated 21st June, 2014 announced its intensionto make rules, in exercise of the powers conferred by sub-section (1) of section 456A read with sections 244 and245 ofthe Maharashtra Municipal Corporations Act ( LIX of 1949), with a view to regulating and control thedisplay of sky-signs and advertisementin the area of the Municipal Corporations.

And whereas, the objections and suggestions received pursuant to the said notification within the periodmentioned therein have been considered by the Government.

Now, therefore, in exercise of the powers conferred by sections 244 and 245 read with sub-section (J) ofsection 456A of the Maharashtra Municipal Corporations Act (LIX of 1949), the Government ofMaharashtraafter previous publication, as required by sub-section (2) of the said section 456A and in supersession of theBombay Provincial Municipal Corporations (Control ofAdvertisement and Hoarding) Rules, 2003 and all othersrules, orders, instruments issued by the Government ofMaharashtra and Municipal Corporations in this regards,exercising powers delegated under the Maharashtra Municipal Corporation Act, make the following rulesregulating control of the display of sky-signs and advertisement in the area ofthe Municipal Corporations, asfollows, namely:-

1. Short title, extent and commencement.---{J) These rilles may be called the Maharashtra MunicipalCorporations (regulation and control of the display of sky-signs and advertisement) Rules, 2014.

(2) They shall apply to the area of all the municipal corporations established and constituted under theMaharashtra Municipal Corporations Act (LIXof 1949).

(3) They shall come into force at once.

2. Definitions.-(l) In these rules, unless the context otherwise requires,-(a) "Act" means Maharashtra Municipal Corporations Act;(b) 'I Advertisement" means and includes any device or representation in any manner such as

announcement or direction by word, letter, model, sign by means of posters, hoarding boards, banners,temporary arches, illuminated signs, name boards, direction boards, balloons, etc.;

(c) "Agency)' means an applicant who may be an individual! Government, semi-Governmentorganizations, registered charitable organization, firm, partnership or a company incorporated under theCompanies Act, 1956 ;

Cd) ,e Banner" means cloth or any other material, which contains some advertisement orannouncement or written matter for display in public place;

(e) "Building wrap advertisement" means an advertisement displayed on any building frontage usuallystretched across the building frontage or on scaffolding of a building under construction or repair or bysticking or fixing it to a glass frontage or window;

(fJ "Building wrap electronic advertisements without any use of poles, etc. which are used to erecthoardings" means an advertisement displayed on any building frontage, which is not a heritage structure,using digital displays, which can be switched on at night time and may flash or appear in a synchronizedmanner in one or more different colours;

Provided that such board, frame or other contrivance be ofone continuous face and not open work, and donot extend in height more than three feet above any part ofthe waH, or parapet or ridge to against, or on whichit is fixed or supported;

(iii) Any word, letter, model, sign, device or representation as aforesaid, relating exclusively tothe business of any Government authority and so placed that it cannot fall into any street or publicplace;

(iv) Any notice ofland or building to be sold, or let, placed upon such land or buildings;(y) "Stop line" means the line at which the traffic must stop before crossing tbe junction at signal

intersection;(z) "Temporary arches" means temporary structures erected across the road for greeting of

personalities or for display of advertisement;(aa) "Temporary advertisement" means and refers to advertising, within a li~nited area or road

at times of a festival or celebration for a limited period. This permission will be with respect totemporary boardings, arches, banners or pole-flags. Bulk commercial hoardings, arches; banners orpole-flags. Bulk commercial hoardings shall include those displayed on a mobile media such as aservice van and/or delivery vehicle;

(ab) "Tri.vision advertisement (Or' Tri-Ad ') "means an advertisement hoarding that uses rotatingtriangular panels in a synchronized manner such that the three faces of the triangular section areseen one after the other displaying three different advertising messages. These could be illuminatedor non-illuminated;

(ac) "Vehicle track" means such part of the road on which the vehicles are permitted to travel;(ad) "WaH painting advertisement" means an advertisement displayed by painting it directly

on the wall or structure of a building or any civil structure;(ae) "waH stickers" means a big piece of paper or any other material used to advertise in the

public places;(II) The word and expressions used but not defined herein shall have tbeir respective meaning as assigned

to them under the Act,

3. Permission for advertisement :- (1) No agency, without tbe permission in writing from the CompetentAuthority, shaH erect, exhibit, fix, retain or display. any advertisement by means ofhoarding, posters, sky signs,kiosks, waH paintings, waH stickers, balloons whether existing or not. Such permission shall not be granted,unless prior scrutiny of such advertisement is made by the Competent Authority and it is satisfied tbat theerection or fixing of such advertisement is not likely to offend against decency or morality and is fulfiHing all thenorms mentioned in these rules and the provision contained in the Act in this regards.

(2) (a) Subject to the provisions of section 79 of the Maharashtra Municipal Corporations Act, and theserules, Corporation shaH permit advertisement by various means mentioned in sub-rule (1) on Municipal landsby inviting tenders.

(b) All existing hoardings on the date of commencement of these rules onMunicipal lands shall be removedat expiry of existing agreement or grace period of three months from the date from which these rules come intoforce, whichever is earlier.

(3) (a) Any other Agency desirous the display of advertisement or erect the hoardings on their land orpremises shall have to obtain a valid license from the competent authority as per the provision contained inthese rules and under the relevant sections of the Act.

(b) The competent authority while granting such license shall also take into account the provision of theDevelopment Control Regulations.

(4) Permissions for advertisement shall not ordinarily be refused if they are in conformity with theDevelopment Control Regulations, provisions of the Act and these rules, unless there is any specific objectionseither from the policedepartment or if the same offends the light or ventilation or creates nuisance or obstructionsto the residents around. The competent authority, may give reasons to be recorded in writing, in case ofrefusing the permission for advertisement.

(5) Ifthe hoarding is not erected within 3months, the permission granted sball stand revoked or cancelled.However, any agency including applicant berein may apply a fresb by adopting the procedure laid down in thisbehalf.

(6) If a structure is found erected for purpose of the display of advertisement or a hoarding is erected oradvertisement displayed without valid permit, such hoarding or advertisement shall be liable to be remoedwithout a notice to the agency and the agency shall also be liable to pay penalty as prescribed by the Corporationfrom time to time.

(ii) The hoarding which would obstruct the vision ofthe sea, sunrise or sunset from a location designatedfor such v;SiOD.

(iii) The building, which has no occupation certificate.(iv) The building, where action under the Act or under the Maharashtra Regional and Town Planning

Act, 1966 is pending either at Municipal Corporation level or in a court oflaw or the owner of I.he buildinghas been issued with a stop work notice under the Acts.

(v) The building, which has been declared dangerous (partly or fully) or has been issued with a noticeunder the Act..

(vi) An advert.isement which is likely to offend public maral and decency will not be permitted. If theCommissioner is satisfied that the contents of display thereof violates norms of public normality anddecency, the agency shall forthwith remove the display, after receipt of such intimation in writing.

(vii) An advertisement which is in such form as it will obstruct the path of pedestrians and obstructtheir visibility.

(viii) An advertisement is likely to affect any local amenity.(ix) An advertisement which will obstruct the visibility of any existing advertisement.

6. Sizes of Hoardings.- (1) The standard size of the hoarding boards shall be as follows(i) 3.05 meters (10 feet) x 6.10 meters (20 feet)(ii) 6.10 meters (20 feet) x 6.10 meters (20 feet)(iii) 7.625 meters (25 feet) x 7.625 meters (25 feet)(iv) 9.15 meters (30 feet) x 6.10 meters (20 feet)(v) 12.2 meters (40 feet) x 3.05 meters (10 feet)(vi) 12.2 meters (40 feet) x 6.10 meters (20 feet)

Provided that, the competent authority may allow an advertisement of a different size, in case ofadvertise'menton.-

(i) Dead wall,(ii) Entrance of subways,(iii) Railings on an over-bridge and such other riches of odd size as well as on floating boards, floates,

vessels and vehicles.(2) It shall not be permissible to erect hoarding larger in size than the largest standard size.Provided that, hoarding ofthe non-standard size 60 feet x 20 feet may be permitted on the top of a building,

subject to structural stabiJity ofthe buiJding.(3) No hoarding shall be erected to a height exceeding 12.25 metre (40') above the road level. The lower

base or the bottom of hoarding shall be a height not Jess than 3 metres from the surface ofthe below .(4) The maximum height of I.he hoarding erected on the terrace of a building shall not be more than 12.2

metres (40') from the terrace level.(5) Aminimum distance of 1.50 metres sha]] be maintained beyond the edge oHhe formation width of the

existing road or street.(6) The lower bottom of the hoarding board shall not be at a height less than 3.05 meters (10 ft.).(?) The advertisement along roads shall not be permitted within a distance of25 metres from the stop line

ofthe approach road.(8) Sandwich (back to back) and (V' shape) hoarding having standard size can be permitted.(9) The structural framework supporting advertisement board shall not be outsized compared, to the

permitted board size and shall be within tolerance limits on either side laterally. ",0 vertical tolerance is permittedexcept the columns up to the ground clearance. Any incremental deviation shall be deemed to be an increase inthe size of I.he advertisement board against norms and breach of the terms and conditions of the permit.

(10) Existing hoardings of non-standardized sizes or specifications which are permitted prior to these rulesshall be given a grace period of three months to rectify the same.

(11) Non lit or backlit advertisement boards, of suitable size decided by competent authority, on top and atthe rear side ofthe Bus Queue shelters can be permitted. However, the advertiser will have to pay additionalcharges or premium as decided by the Corporation.

(12) Construction fence may be allowed as non lit special advertising structure, temporary in nature,which wi1lbe non-standard advertising field, subject to height restriction of 10' from the ground.

(e) Responsibility of removal ofhoarding as per specific direction of any Hon'ble Courts or when hoardingis not permitted by Corporation shall, however, lie upon the railway authority.

15. Hoardings on the Premises of Gther Public Authorities.-(a) Agencies desirous to erect hoardings onthe land or premises of other public authorities, whether Government, Semi-Government, viz. InternationalAir-Port Authority of India, Defence Ministry, public sector Undertakings etc. have to obtain a valid permit orNo Objection Certificate from the concerned Authority.

(b) The demand notices for advertisement fees shall be sent to the concerned advertising agencies as perschedule ofthe Corporation. The concerned authorities are requested to provide the names of agencies, location,size, period and all other details of the hoardings on their premises.

16. Special Norms for Display of Advertisements by Floating Ballons.-Permission for illuminated ornon-illuminated advertisements by means of floating balloons can be granted subject to the compliance ofconditions as follows :-

(a) The agency shall display the balloon in such a manner that does not interfere with or obstructother displays of advertisements.

(b) The agency shall make all the necessary arrangements for watching the balloon for any emergencyduring the display of the said advertisement by means of balloon.

(c) The agency shall produce No Objectiop Certificate from the Civil Aviation Department of theGovernment of India, wherever necessary and shall observe all its rules and regulations.

(d) The agency shall be liable to pay damages for any accident or any injury which may be caused toany property or person by reason of keeping the said balloon or the material, gas or any device used inrespect thereof or by reason of the fall or otherwise of the said balloon or any part thereof due to storm,faulty construction, negligence, accident or any other cause whatsoever.

17. Special Norms for Display of Advertisement on Business Premises.-The advertisement, such asilluminated Glow sign boxes and illuminated or neon-sign name boards on the business premises. shall bepermitted and regularized as per the provisions laid down in Act and these rules. Permission for display ofadvertisement, such as Glow sign boxe~ and illuminated or neon-sign name boards on the business premises,can be granted subject to the compliance of the conditions mentioned below and also subject to compliance ofPart-X- signs and outdoor display structure ofNational Building Code. Exceptions can also be made in respect ofmultiple advertisements on big size boards on malls, big bazars, shopping centres, hospitals, banks, cinematheatres. etc.:-

(a) No illuminated sign in red, amber or green colours shall be erected or maintained within ahorizontal distance of 10 mtrs. of any illuminated traffic sign. All advertising signs illuminated by lightother than a white light at a height ofless than two storeys or 6 mtr. above the footpath, whichever be thegreater height, shall be so displayed that it does not interfere with any sign or signal of traffic control.

(b) No person shall erect any sign which is of such intense illumination as to disturb the residents inadjacent or nearby residential buildings. Notwithstanding any permission given for such erection, anysuch sign which after erection is, in the opinion.of the authority, of such intense illumination as it disturbsthe occupants of adjacent or nearby buildings, shall on the order of the authority, be suitably altered orremoved by the owner of the site concerned within such reasonable period as the authority may specify.

(c) No electric sign other than those necessary in the opinion ofthe authority in the interest of publicamenity, health and safety, shall be operated after 11.00 p.m.

(d) No ground sign shall be erected so as to obstruct free access to or egress from any building.(e) No projecting sign or any part of its supports or framework shall project beyond the building.

However, it shall not project beyond the plot line facing the street.(fJ On business premises advertisement related to products sold or services rendered only can be

permitted.

18. 3. All electrical components shall confirm to BIS.4. Underground cable should be 16 sq,mm.2 core.5. Meter Box, ELCB, MCB, Fuse Cutout, Timer Contractor and Locking Arrangement should be as per

requirement ofBESCOL.6, Illumination: 2 Nos. 400 watt metal halide LIGHT FIXTURES.7, Earthling 1.8m deep below the ground using GI Pipe, Funnel, Charcoal, Salt, Brick Masonry work, etc.
