HUNTLEY – A truck com-pany based in Canada couldbe fined by the Illinois Envi-ronmental Protection Agencyfor an accident that ultimate-ly contaminated a lake in SunCity Huntley and killed nearly3,000 fish.

The agency also orderedTrappers Transport in Mani-toba, Canada, to cover the costof a massive cleanup effortongoing at Wildflower Lake,located in the middle of theHuntley retirement commu-nity, and a nearby creek thatfeeds from the KishwaukeeRiver.

Agency officials still don’tknow whether a threat existsto residents who use the lakeand creek as they continueto investigate the extent ofthe contamination that killedthousands of fish.

The agency is awaiting testresults from a lab in Singa-pore, which apparently is theonly one that can develop astandard used to analyze thewater samples. Officials hopeto hear the results within theweek.

“It is not known if an en-vironmental threat exists forresidents who may use thelake or creek for recreationalpurposes,” IEPA spokespersonKim Biggs said. “The investi-gation is continuing and infor-mation will be provided as itbecomes available.”

The environmental hazardhappened July 25 after a Trap-pers Transport truck caughtfire on Interstate 90 near Hunt-ley. The water runoff fromthe firefighters’ hoses mixedwith a chemical carried by thetruck, seeped into a ditch andlikely entered a branch of theKishwaukee River that led toWildflower Lake.

WOODSTOCK – The first Il-linois county to be recognizedfor honoring Purple Heartrecipients celebrated PurpleHeart Day in style Aug. 7.

More than 200 people,many of them prior-serviceor active military, attend-ed the unveiling of a large,double-sided granite monu-ment at the main entrance tothe McHenry County Court-house. The monument honorsthe nearly 2 million Americanservice members who havereceived the medal for beingwounded or killed in combat.

More than a few audiencemembers have the medal thatthe military likes to say iseligible to all but desired bynone. Among them was Hunt-ley native Jeremiah Homuth,who lost his right arm to arocket-propelled grenade at-tack in 2005 while serving inAfghanistan with the Army’s10th Mountain Division.

“I think this is a reallynice gesture to Purple Heartrecipients, past and present,”Homuth said.

The hour-long ceremonyhad guest speakers, including

a Medal of Honor recipient andaircraft flybys. Although allfour branches of service wererepresented Aug. 7, the monu-ment and the ceremony were aMarine operation.

Marine veteran RichardYoung and his wife, Moni-ca, spearheaded getting themonument built and gettingMcHenry County recognizedas the state’s first PurpleHeart County, which allowsit to fly a special commemora-tive flag authorized under theIllinois Military Order of thePurple Heart.

Young and several otherveterans raised the flag on oneof the three new flagpoles thatwere erected as part of themonument. The retired sher-iff’s deputy never receivedthe medal but sought to hon-or those who have, includinghis father and his uncles, allof whom were wounded whileserving in the Army in the Pa-cific Theater of World War II.

The Purple Heart is the old-est American military medalstill awarded and was origi-nally conceived as a badge formilitary merit by Gen. GeorgeWashington. It also is the onlymilitary decoration for valorthat has no requirement of arecommendation – any sol-dier, sailor, airman or Marineis entitled to it if he or she iswounded or killed in action

against an enemy.It’s a fraternity that Dan

Finn, state commander of thePurple Heart order, does notwant to see grow. Behind the po-dium was a wall of honor withpictures of the 275 soldiers fromIllinois who have been killed inaction since the 9/11 attacks.

“We are the one veterans’organization that wants to goout of business,” Finn told theaudience.

Finn was one of severalguest speakers. State Rep. JackFranks, D-Marengo, called themonument “exactly the kind ofevent that makes us proud tocall McHenry County home.”

But the most poignantspeech came at the end fromAllen Lynch of Gurnee, a vet-eran of the Army’s 1st Caval-ry Division who received theMedal of Honor, the nation’shighest military honor, forrescuing and defending threewounded soldiers in a 1967battle in Vietnam.

He challenged the audi-ence and its veterans to makesure Americans, especiallychildren, understand the highcost of freedom.

“It’s up to us, we whoserved and those who pres-ently serve, to make surethis country is worth the sac-rifices the men and womenwho earned the Purple Heartmade,” Lynch said.

Since July 31, the consul-tant has been vacuuming con-taminated water that wentupstream of the lake after bar-ricading Wildflower Lake withberms to prevent polluted wa-ter from spreading.

Biologists from the IllinoisDepartment of Natural Re-

sources were at the scene Aug.1 hauling 15 barrels, each hold-ing 200 hundred dead fish, adepartment spokesperson saidFriday.

Despite the unknown ef-fects to the lake, the village’swater supply is unaffected, vil-lage officials said.

Huntley’s five water wellsrun at least 1,250 feet intothe ground and are protectedfrom direct routes of contam-ination. Officials also test thewater quality from the wellsdaily.

HUNTLEY – An elusivegroup of so-called “Polishgypsies” are responsible for aspat of recent home burglarieswithin the Sun City Huntleyretirement community, Hunt-ley police said.

Investigators believe an or-ganized faction of self-identi-fied gypsies have burglarized24 homes in Sun City since2011, including two recent bur-glaries July 25 and 28. Sun Citybefore last week hadn’t report-ed a residential burglary sinceOctober, police said.

The sporadic pattern fitsthe characteristics of a broad-er gypsy group, which chang-es targets and members fre-quently across multiple states,Huntley Deputy Chief MichaelKlunk said.

The group, which policebelieves comes from Polishdescent, has been linked toincidents in Chicago and thesurrounding suburbs, Klunksaid. Their techniques haveconfounded area police, sincethey target hard-to-trace itemssuch as jewelry and cash.

“A lot of them use fictitiousidentification. A lot of the timethe plates we come up with arefrom rental vehicles,” Klunksaid. “There’s often dead ends.It’s a difficult group to breakinto, with ever-changing par-ticipants and ever-changingvehicles.”

The shifty nature of theburglaries has put some Sun

City residents on alert.Police Chief John Perkins

met with neighborhood repre-sentatives July 28 to discussthe issue before his depart-ment circulated fliers noti-fying Sun City residents andarea businesses of the renewedbreak-ins.

Huntley police also have in-creased patrols in certain SunCity areas as they work withother departments that are in-vestigating similar reports.

In the majority of cases –dating to 2011 – men and wom-en of the group drive aroundSun City neighborhoods us-ing rental vehicles purchasedthrough fake identificationand look for residents leavingtheir homes.

They typically check forunlocked windows or doorsbut also have been known toforce their way into unattend-ed homes, Klunk said.

The burglaries usually hap-pen between 9 a.m. and 1 p.m.The most frequent area of activ-ity has been homes that borderCold Spring Drive, Klunk said.

Once inside, they checkmaster bedrooms, take jewelryand cash, stow the items awayin small handbags and leavewithin minutes, Klunk said.

As police investigate, theyurge residents to be vigilant.

“They have to make surethey have good, secure doors, aquality lock,” Klunk said. “Wealways recommend once peo-ple leave their home to circleback to see if anything looksout of the ordinary.”

Huntley mullsover road projects

HUNTLEY – After extend-ing Kreutzer Road west earli-er this year, Huntley officialsturned their focus eastwardlast week by asking for federaldollars to help fund a $6 mil-lion realignment of the localroad.

The long-term project wouldprimarily widen the easternportion of Kreutzer Road, be-tween Route 47 and HaligusRoad, to a three-lane cross sec-tion and reconfigure a smallbridge that crosses over a creek.

Officials increasingly havedone maintenance work onthe eastern stretch of Kreu-tzer Road, while the bridgehas been a frequent cause ofcar crashes, Village ManagerDave Johnson said.

“There’s an alignmentissue that we would like tostraighten out,” Johnson said.“It gets a significant amountof traffic with residents goingout to Huntley-Dundee Roador St. Mary Church, or Wing

Pointe [subdivision] residentsgetting on Route 47.”

Construction on the proj-ect likely won’t start untilfive years from now since of-ficials have to try and securefunding for the $6.03 millionestimated price tag. VillageBoard members started thelengthy process this week af-ter submitting a proposal for$1.5 million in federal funds.

Trustees made the requestwith the McHenry CountyCouncil of Governments,which now will spend the up-coming months ranking var-ious road projects from areamunicipalities before seekingfederal funding.

If the Kreutzer Road proj-ect ranks high enough, thevillage could see the fundingin 2017, 2018 or 2019.

In the meantime, village of-ficials will try and work witha nearby developer on lower-ing the village’s $4.53 millionestimated share of the project,Johnson said.

“We don’t have those dol-lars today,” he said. “If the de-

veloper doesn’t step up, it’s go-ing to be every bit of five yearsbefore construction starts.”

PAR Development agreedin the late 2000s to widen a por-tion of the road to a five-lanecross section, as part of an an-nexation deal that slated hun-dreds of acres south of Kreut-zer Road for development.

The developer has yet tomake the road improvements,Johnson said.

The village has success-fully formed partnerships inthe past. Officials and Centeg-ra Health System agreed lastyear to share costs to recon-figure a portion of Reed Roadfor the new Huntley hospital.

Aside from the multimil-lion dollar realignment, thevillage asked the county’scouncil of governments forfederal funds to resurfaceHaligus Road from Algon-quin Road south to Hunt-ley-Dundee Road.

The $675,600 project wouldrequire a $151,120 contribu-tion from the village, accord-ing to cost estimates.

The seemingly friendlyface at the front door pointingout the need to fix a crackeddriveway or repair a damagedroof just looking to pull off aquick scam has been replaced.

While the old summerscams still exist, local law en-forcement said faceless threatshave become much more prev-alent and seniors are the tar-get. McHenry County Sheriff’sdeputy Aimee Knop and Un-dersheriff Andrew Zinke saidthe “grandparent scam” hasbeen on the rise in the countyand is done exclusively overthe phone or Internet.

Knop said, in many cases,a person will call a senior andpose as a relative or grand-child. The person will mentionhow they are away on vacationand need money for an emer-

gency. With the rise of socialmedia, would-be scammers areable to easily find the names ofrelatives and when people areon vacation because of statusupdates and photographs.

“With the Internet, ourpersonal information is ev-erywhere so it is very easy toget,” Knop said. “When youtake pictures that show you’reon vacation or just celebrat-ed grandma’s birthday, it airseverything [scammers] need.”

Zinke said, the “grandpar-ent scams” pose a different setof challenges than the in-per-son soliciting scams commonafter storms. Because every-thing is done over the phone orcomputer, it can be difficult totrack offenders that might be lo-cated out of the state or country,in some cases, he said.

“People that started learningon computers 20 years [ago] arestarting to get to that senior-citi-

zen age,” Zinke said. “There is agrowing group of sophisticatedcomputer users getting older,and that is going to help.”

According to the BetterBusiness Bureau, one of themost common summer scamshave been bogus 5k eventswhere pre-registration feesare not refunded after “orga-nizers” cancel the event daysbefore its scheduled.

Knop and Zinke said goodprevention tips include nevergiving out personal informa-tion over the phone, verifyingwith family if someone claimsto be a relative and understand-ing agencies such as the IRSnever call a personal residence.

The McHenry County Sher-iff’s Office also holds quarter-ly scam prevention meetings.Anyone who thinks they havebeen scammed or were target-ed should report it to local lawenforcement, Knop said.

and unable to scrape together$15,000 – the cheapest option hecould find in Seattle – Velazcoturned to an unconventional andcontroversial option: an onlinemedical auction site calledMed-ibid, which largely operates out-side the confines of traditionalhealth insurance. The four-year-old online service links patientsseeking non-emergency care withdoctors and facilities that offer it,much the way Priceline unitestravelers and hotels. Vetting doc-tors is left to prospective patients:Medibid does not verify creden-tials but requires doctors to sub-mit theirmedical license numberfor patients to check.Velazco paid $25 to post his re-

quest for knee surgery. A fewdays later, he had bids for theoutpatient procedure from sur-geons in New York, Californiaand Virginia, including detailsabout their expertise. After ac-cepting the lowest bid -- $7,500,a fee that covered anesthesia andrelated costs -- he learned thathis surgeon would beWilliam T.Grant, a Charlottesville, Virginia,orthopedist.A few weeks later, after several

online discussions with Grant,Velazco arrived in Charlottesville,where he had rented a $50-a-night room and would spend twoweeks recuperating. On Dec. 4,2013, he underwent knee sur-

gery, performed in an outpatientsurgery center that Grant co-owns.“I’m back working four days

per week and climbing ladders,”Velazco said recently. “I’m doinggreat.”ToMedibid founder Ralph

Weber, a benefits consultant whosaid he left his native Canada forthe United States in 2005 to es-cape “socialized health care,”using the Internet to arrangenon-emergency medical care islong overdue. Americans, hesays, are increasingly going on-line to book travel and even findamate. Medibid enables them tostrip away the opacity that sur-rounds health-care pricing,Weber maintains, where chargesvary wildly even in the samemarket and can be nearly impos-sible for consumers to obtain.“We introduce transparency

and also competition,” saidWeber, whose company is basedinMurfreesboro, Tenn. “We are adisruptive innovation, a free-market alternative to Oba-macare.”

How it works

Weber said that about 120,000consumers -- Medibid calls them“seekers” -- have used the service.Many are uninsured, holders ofhigh-deductible plans or en-rollees in faith-based plans,which have grown as a conser-vative alternative to the Afford-able Care Act. Seekers arecharged $25 for each request orabout $60 for an unlimitednumber of requests per year.Roughly 6,000 doctors or sur-

gery centers and a handful ofhospitals, most seeking patientsfrom abroad, have registered as“bidders”; physicians pay a feeranging from $50 to bid on one

request to $250 to bid on many.Once a bid is accepted, Medibidbows out, and patients work outarrangements with the doctor.Many bids are a package deal,covering the facility fee, the sur-geon’s charge and anesthesiaservices. Patients pay the bidderin full, upfront and in cash or bycredit card.

Is it safe?

But critics, who agree hospi-tals’ prices are too often in-flated, arbitrary and opaque,express concerns about Med-ibid. They say the service pro-vides little in the way of qualityindicators for prospective pa-tients, something hospitals con-vey by granting a doctorprivileges and insurers do by ac-cepting doctors on a plan’s ros-ter. Surgery or procedures suchas colonoscopies are typicallyperformed in physician-ownedoutpatient centers, which aremore lightly regulated than hos-pitals and have fewer safeguardsfor patients. Unlike hospitals,which are required to track in-fections, outpatient surgery cen-ters are usually exempt fromsuch reporting requirements.And complications are rarelycovered under the terms ofMedibid.Medibid “is a phenomenon

that is in part being spawned bythe absurd, nonsensical and in-explicably unfathomable pricingof American health care,” saidArthur L. Caplan, head of thedivision of bioethics at NYULangone Medical Center in NewYork. “Cheap sounds good, butin these auctions you’re not get-ting any information: Was theguy at the bottom of his class inmedical school?”“In the current world you buy

the name -- the institutionalreputation of a doctor or hospi-tal. Insurance companies orhospitals drop people who havehigh complication rates or costsdue to errors, “ he added. “Med-ical care is not like buying awatch on the street or a hotelroom online. The stakes aremuch, much higher.”Marty Makary, an associate

professor of surgery at JohnsHopkins Hospital and the au-thor of “Unaccountable,” a 2012book about hospital quality,agrees. “I have concerns aboutthe lack of good metrics of qual-ity,” he said. “How do you knowwhat you’re getting?”Weber says that consumers

are competent to make such de-cisions without relying on aprovider directory or the impri-matur of a hospital.“Is there anything that says

the Internet is any worse than aBlue Cross directory?” he asked.“Once they choose a physician,we will send them the licensenumber, and there are a bunchof third-party sites” that pa-tients can use to check out adoctor. If a patient is dissatisfiedwith a doctor after accepting abid but before surgery, Medibidwill repost the query free ofcharge.

HUNTLEY – Mike Skalahas only recently returned towork at his business in Wood-stock and on the McHenryCounty Board.

A trip to the doctor forpain in his back and head ledto the discovery of a tumorjust below his brain stemon the lining of the tube hisspinal cord sits in.

“The tumor was largeenough where it was actuallytaking the spinal cord andpressing it against my verte-brae,” the Huntley residentsaid. “It was cutting off mylower body basically.”

The tumorwas too large forradiation treat-ment, whichcauses a tumorto grow beforeit shrinks, soSkala under-went a 13-houroperation in June to remove it.

“I’m still recovering,”Skala said. “I still don’thave everything back, butI decided at the beginningof August that I was goingback to the County Board anddoing work there. I felt strongenough to be able to do that.”

Reporter Emily Coleman satdown with Skala to talk aboutwhy he works in local govern-

ment and what changes he’sbeen making since his surgery.

Coleman: What has it been like

since the surgery?

Skala: There was a lot ofpeople that were very inter-ested and caring, and theprayers and love and supportwas quite honestly almostoverwhelming. I was veryhumbled to see how manypeople care about me. Mental Health Board buildingexpansion proving to be tricky

A new and improvedMcHenry County MentalHealth Board is doing its bestto take it in a more fiscally re-sponsible direction.

But dealing with one leg-acy from the old board – ahalf-empty, 22,000-square-footexpansion that taxpayers arestill paying off – is proving tobe tricky.

The expansion, actually aseparate building, sits behindthe Mental Health Board’sheadquarters in Crystal Lake.Former board members builtit anticipating future growththat never took place, andtheir successors are, at thevery least, discussing wheth-er it can be utilized in a man-ner that helps defray the cost.

However, the fact that it’sa public building financedthrough a unique federalbond program places limitson what can be done. Thebuilding is one of the manyissues that interim ExecutiveDirector Lyn Orphal has onher plate in steering the boardto a better future after a tu-multuous year of change thatcritics say was much neededand long overdue.

“There are so many differ-ent nuances that are popping

up as we work to find outwhat is allowable,” Orphalsaid. “It can open up a wholebig can of worms if we thinkwe can do something only tofind out that we can’t.”

And for the time being, theconventional wisdom seemsto be that the list of thingsthey can’t do with the build-ing is a much longer list.

The Mental Health Boardin 2009 made a pitch for theexpansion, arguing that it ranout of space at its 8,000-square-foot headquarters. It wouldfund the project with $4 mil-lion in federal bonding au-thority granted to the McHen-ry County Board as a meansto stimulate the economy andget people back to work in themidst of the Great Recession.

Three-million dollars wasused to build the new buildingand renovate parts of the orig-inal one, with the remaining$1 million covering planningand architecture costs.

The County Board ap-proved the bond issuance in2010 over the objections of aminority that questioned ex-panding government whiletaxpayers were hurting.

A number of the client agen-cies that the Mental HealthBoard funds also questionedthe need. Some pointed to theexpansion as proof to their al-

legations that the board hadfar exceeded its primary mis-sion to distribute tax moneyto agencies working with thementally and developmental-ly disabled. They also allegedthat the money to pay back thebonds would do more good giv-en to them, especially in a statethat has chronically under-funded social service agencies.

Time would justify the con-cerns.

The same Great Reces-sion that created the fundingmechanism shrank propertyvalues and, therefore, shrankthe Mental Health Board’srevenues, 96 percent of whichcome from local property tax-es. Its staff has shrunk from50 full-time equivalents at thetime of the building’s con-struction to about 14 today.

And if property tax rev-enues continue to fall, theamount spent each year pay-ing back the loan will becomea bigger financial hit as theboard finds fewer and few-er things to cut. The MentalHealth Board paid $474,386last year in debt service andoccupancy expenses, accord-ing to its annual report.

Anyone who’s ever been inMcHenry County court for atraffic offense knows there aretwo pipers to pay: the fine andthe court fees.

The judge hands down thefine, plus whatever fees thecircuit clerk will charge. Andwhen you walk to the clerk’soffice to pay the fees, they of-tentimes add up to more thanwhat the judge ordered you topay for breaking the law.

A class-action lawsuit, how-ever, alleges the process usedby the county’s 22nd JudicialCircuit is unconstitutionaland that defendants over theyears have been improperlycharged millions of dollars.

The suit filed Aug. 13 in feder-al court in Rockford claims feesimposed by the circuit clerk’s of-fice after cases are adjudicatedare, in fact, added fines, whichviolates defendants’ constitu-tional right to due process andgovernments’ constitutionalprohibition against ex post factoaddition of penalties.

And because they are fines,the total paid often illegally ex-ceeds the maximum financialpenalty allowed under statelaw, the lawsuit alleges.

The lawsuit lists four plain-tiffs represented by three at-torneys and names CircuitClerk Katherine Keefe as thedefendant in her capacityholding the office. Court finesand fees are set by state stat-ute, not by Keefe or the court’sjudges.

“There are a whole bunch of[fees] that are statutorily con-sidered fines,” said attorneyMatt Haiduk, one of the plain-tiffs’ attorneys. “In McHenryCounty, you walk out of courtwith an order that says, pay$50 plus court costs, but theproblem is that the only per-son who can order fines is thejudge. People are leaving court

It can lease space onlyto fellow government agen-cies, not private interests.And the hurdles that wouldbe involved in selling thebuilding could likely negateany cost savings in doingso, at least for a number ofyears.

The legal opinion on whatcan and can’t be done contin-ues to evolve, said McHen-ry County Board memberPaula Yensen, D-Lake inthe Hills. Yensen holds theCounty Board’s voting seaton the nine-member MentalHealth Board.

“There still isn’t a con-sensus about what we cando with the building be-cause we receive differingopinions … it seems likeevery time we are readyto move forward there’sa new wrinkle,” Yensensaid.

But the board has madesome progress. It discov-ered that it can charge oc-cupancy fees to the fourmental health agencies thathave space in the original8,000-square-foot building,Yensen said. It will start do-ing so next fiscal year.

Yensen, a fiscal hawk,was appointed to the boardin 2013 as talk of the needfor an overhaul of theboard gained strength. Allbut two of the board’s cur-rent members have beenappointed in the past 18months.

While Yensen opposedthe building expansion andvoted against it when itcame up four years ago, shedoes not consider tellingpeople “I told you so” near-ly as productive as havinga plan for the here and now.She said she is confident thenew board will come up witha solution to help defray thebuilding costs.

“I think people in thecommunity and on theCounty Board understandthat we are moving forwardin resolving these problemsin a very positive manner. Ireally believe that,” Yensensaid.

HUNTLEY – A lake at SunCity Huntley re-opened Aug. 15after preliminary results froma lab in Singapore revealed thechemicals that spilled and con-taminated the lake wouldn’tharm residents.

The Illinois EnvironmentalProtection Agency last weeksent two rounds of samplesfrom the retirement commu-nity’s Wildflower Lake tosoutheast Asia for testing. Thecleanup effort ongoing at thelake since July 31 is now wind-ing down, IEPA spokeswomanKim Biggs said.

“The Illinois EPA and Il-linois Department of PublicHealth have determined thatthe water from the lake wouldnot cause adverse health ef-fects for the residents,” Biggssaid. “We are still reviewingdata to determine what, if any,effects might still be presentfor the aquatic life.”

The environmental hazardhappened after a truck fromTrappers Transport, basedin Manitoba, Canada, caughtfire July 25 along Interstate 90near Huntley. The water run-off from the firefighters’ hosesmixed with a chemical carriedby the truck and likely entered abranch of the Kishwaukee Riverthat leads to Wildflower Lake.

The chemical contamina-tion killed nearly 3,000 fishinside the Sun City lake anda nearby creek that feeds fromthe Kishwaukee River. Resi-dents typically use the lake tocatch and release fish.

Upon hearing about the con-tamination, the state environ-mental agency ordered TrappersTransport to cover the cleanupcosts and replace the dead fish.Environmental officials are stilldetermining the tab for the workand also don’t know when thefish will be replaced.

They are still consideringwhether to fine the truck com-pany for the contamination.

Biggs said the agency canwork with the company on acompliance agreement or referthe issue to the Illinois AttorneyGeneral’s office, which wouldassess any financial penalty.

She’s warm and affableand speaks in slow, soft,measured tones. But whenyou listen to her describethe battle to provide pastoralcare to immigrant detain-ees in the McHenry CountyJail, you know Sister JoAnnPersch is one nun you don’twant to mess with.

Sweet as an angelbut tough as nails

When local county, jailand immigration officials in2007 told Sisters Persch andPat Murphy they weren’tallowed access to the jailto provide pastoral care tothe immigrant population,the nuns became the faceof Illinois’ Access to Reli-gious Ministry legislation.The law allowed them in thejail, and what Sister Perschdescribed as access to de-tainees not granted at oth-er detention centers in thecountry.

“Pat and I have a mottothat we do all of this peace-fully, respectfully, but wenever take no for an answer.That’s how we got where weare,” Persch said.

“We never take no for ananswer because these menand women deserve this,and if we don’t speak up forthem, who’s going to do it?”

McHenry County has a10-year-old contract with Im-migration and Customs En-forcement to house up to 400immigrants who are await-ing deportation proceedings.Some of those detained areallowed to stay in the countyfor any number of reasons.The immigration defensesare too many to list here.

Those who are not so for-tunate are sent back to theirnative country but firstprocessed through the Chi-cago-area Broadview Deten-tion Center. It’s the last stopbefore deportation.

The Sisters’ InterfaithCommittee for DetainedImmigrants prays weeklyoutside the Broadview Cen-ter. What Sister Persch seesthere still sends shocks toher system. Men and womenshackled at the hands andfeet, packed onto vans to besent off. Tearful goodbyes

with loved ones who remainin the country. Farewellsthat are never long enough.

“Every time, I come outready to cry,” she said. “Ijust can’t believe that’s howwe’re sending people outof this country. … You tellus they’re civil detainees,they’re not criminals, thenwhy are you sending themoff in shackles? That alwaysbothers me.”

But at the McHenryCounty Jail, it’s a little dif-ferent, Persch said.

“They’re hopeful,” shesaid. “Some know they mightbe deported, but some havecourt dates hoping maybethey’ll get to stay. At Broad-view, that’s it. They’re done.”

As part of the county’spastoral care program, vol-unteers – there are about adozen on average each week– come every Tuesday, out-fitted with religious read-ing materials to provide tothe detainees, an allowanceunique to McHenry Coun-ty, Persch said. They visitwith them, pray with andfor them. The volunteerstake home stacks of prayerrequests. They call a detain-ee’s family members withupdates on their loved one.They have testified at depor-tation hearings. If a detain-ee doesn’t have money, thecommittee will put $10 ontheir commissary.

from the county jail’s criminalpopulation. But like criminal de-fendants awaiting trial, detain-ees here wear the same orangejumpsuits, they eat the same jailfood and are allowed visits withfamily through a monitor. De-pression is all too common.

But for many in this pop-ulation, Persch said, theircrime was not having the legalpaperwork for a better life.

“They’re not definitely nothardened criminals,” she said.“The majority of them mighthave an infraction of the law,but a lot of them don’t. Theywere picked up some otherway, but they have no papers.”

Maralee Gordon, is theRabbi at Crystal Lake-basedMcHenry County JewishCongregation and part of theInterfaith Committee for De-tained Immigrants since thebeginning. She talked with theShaw Media about nationalimmigration issues – the po-litical tug of war to pass mean-ingful reform, the images ofprotesters demonstrating atthe border that’s flooded withimmigrants – the vast major-ity children fleeing war tornareas of Central America.

Rabbi Gordon described axenophobia she can’t wrap herhead around.

“It’s very strange to methat, here we are in a countryof immigrants, that we havethis whole hue and cry frompeople that we should not wel-come immigrants,” she said.“This country is built on thework of immigrants.

“Knowing that everybodyin this country is an immi-grant … it’s incumbent on usto recognize that part of our-selves and have compassion

and care for the immigrantpopulation.”

Both Gordon and Perschtook their break time on arecent Tuesday to meet withShaw Media in the jail lob-by. A request to Immigrationand Customs Enforcement toobserve the weekly meetingsin the jail was denied on thegrounds Immigration and Cus-toms Enforcement didn’t haveenough staff to accommodatesuch a request.

Such denials are not for-eign to Sister Persch. In 2008,she and Sister Murphy weredenied entry into both theBroadview Center and McHen-ry County Jail. But politicalpressure and a new law on thebooks eventually forced theirhands. And so the pastoralcare program was born.

“All of this was always verypleasant but pleasantly sayingno,” Persch said.

David Warren of CrystalLake also was key to the Inter-faith Committee from the get-go. He and a handful of othersfirst met twice monthly withthe jail’s Chinese population.

“They took my little lemon-ade stand and turned it into aFortune 500 company,” saidWarren, who belongs to theOrder of Secular Franciscanswith the Catholic Church.

When describing the minis-try and those it serves, Perschlikes to tell the story of “the oldrabbi.” The rabbi asks God,“When does night becomeday?”

To which God responded,Persch said, “When you canlook in the eyes of every manand woman and see them asyour sister or brother. Untilthen, it is night.”

“We are living in darkness,when we can’t see these peopleas human beings in need of ourlove and support.”

McHenry County State’s Attor-ney’s Office had been servedwith the lawsuit Wednesday.Keefe deferred comment to thestate’s attorney’s office, whichlikewise was limited in what itcould say.

“We’ll consult with our cli-ent, take a look at case law that’sbeen cited and form an opinionon it,” First Assistant State’s At-torney Norm Vinton said.

The plaintiffs include two

individuals convicted of driv-ing under the influence, oneof improper lane use and oneof speeding between 11 and 14mph over the speed limit.

In the case of the two DUIplaintiffs, a judge fined them$1,250 and $1,000 each. But thefees added an additional $1,538and $1,771, respectively, re-sulting in totals exceeding the$2,500 maximum fine allowedby statute for their type of of-fense, the lawsuit states.

Haiduk said the fines shouldbe part of the court proceedingsin McHenry County. He saidlawbreakers in Kane and othercounties know what they will

be paying in court fees beforethey leave the courtroom.

The lawsuit argues thatfees charged to administerprograms unrelated to thecharge are actually fines, and,therefore, cannot be levied af-ter court proceedings withoutdue process. The two plaintiffscharged with improper laneuse and speeding each paid $28to finance the state-mandateddrug court, mental health courtand child advocacy center.

“The fines imposed by theclerk without a court orderare void and must be refundedto plaintiffs and all similarlysituated individuals,” the law-

suit states.A federal judge has to cer-

tify the class-action lawsuitbefore it can proceed. If thelawsuit is certified and peoplecan join to recoup their fines,the number of plaintiffs in theclass and the money involvedcould be substantial.

It proposes an eligible class ofan estimated 750,000 people whohave been sentenced since 2003to pay fines and court costs fortraffic, misdemeanor or DUI of-fenses. As for the amount fromwhich to draw for restitution,the lawsuit singles out eightdifferent fines and fees totalingmore than $23.5 million paid to

the county for that time period.While there are numerous

separate court fees a circuitclerk can charge, about 30 ofthem are the most common.And they can add up.

The Northwest Herald askedthe Circuit Clerk’s Office for a2012 story on court fees to cal-culate them for an adult driverpulled over by a sheriff’s deputyfor speeding 15 mph above thespeed limit. Besides the $50 fineand court supervision for plead-ing guilty, the driver would payan additional $220 in fees.

Skala: I’m going to try tolive life more. I had been aworkaholic prior to this, andmy wife made a commentto me that really hit home.She said, “I’d rather haveyou than have the money,”meaning the work I do for themoney so that we can havea good retirement. She said,“If you’re not in retirement,what good is it?” And she’sright. People are more pre-

cious than stuff.

Coleman: So what made you

decide to get involved with local

government?

Skala: In 1997, our oldestwas just about a year and ahalf. I went to private Catholicschool, and my wife went topublic school. So we were hav-ing that question about how wewere going to school our chil-dren. I said I don’t mind send-ing them to the public schoolsystem as long as they’re goingto get a good education.

We started inquiring as towhether the school district,which was [District] 158, wasa good, quality school district.They just happened to be hav-ing elections that spring forthe school board, so I decidedthe only way to find out wasto get on the school board. SoI ran and I was elected. That’show it all started.

Coleman: Was there something

in particular about how the county

government was being run that you

found frustrating?

Skala: Well, I didn’t see –and I still don’t see – a lot ofgood focus being put towarddoing what’s right for countyresidents. That’s a frustratingpart of county government.There’s a lot of people makingpolitical decisions instead ofdecisions that are good for thepeople of the county. A lot ofthe individuals I feel are notdoing board work; they’redoing staff work.

Coleman: What do you mean?

Skala: As board members,we’re asked to make deci-sions, and we should be mak-ing high-level decisions asfar as policy and direction onwhere the county should begoing. As you start doing staffwork, then you’re getting intothe weeds. You’re trying todo the work of the people youhired to work.

M A R E N G O – T h elong-awaited move to a largerfacility began Monday for theMarengo-Union Library, asstaff and volunteers will workto set up their new home foran early September opening.

The massive move of books,materials and furniture fromthe library’s State Streetbuilding in downtown Maren-go means the library will beclosed through the week ofSept. 8, when the staff is slatedto re-open the new library onGrant Highway in Marengo.

The transition marks theend of a three-year building

project that officially beganin summer 2011, when thelibrary acquired its futurehome, the former Micelidrapery plant, 19714 E. GrantHighway, for $1.2 million.

“Everyone is really excit-ed to have a lot more spaceand be able to provide morefor the community,” said Li-brary Director Kevin Drinka,whose involvement with theproject started earlier thisyear after former directorMary Hanson retired.

The 20,000-square-foot ret-rofitted plant is about threetimes larger than the li-brary’s longtime home at 200S. State St., which it has occu-pied since 1991.

The move into the new fa-cility will happen in stages,with staff and nearly 50 vol-unteers tasked with packingthe library’s collection firstand then unloading and or-ganizing the books at the newlocation.

Furniture and other larg-er items will be moved intothe new building later thismonth, Drinka said.

Although the library willbe closed during the three-week move, residents canstill return rented materialsat drop-off locations at eitherlibrary building, Drinka said.

Officials also are planninga grand-opening celebrationin October.

The Affordable Care Act was supposed tomendwhat Presi-dent Barack Obama called a broken health care system, butits best-known programs— online insurance and ex-pandedMedicaid for the poor— affect a relatively small

portion of Americans.A federal office you’ve probably never heard of is supposed to fix

health care for everybody else.The law created the Center forMedicare andMedicaid Innova-

tion to launch experiments in every state, changing the way doc-tors and hospitals are paid, building networks among caregiversand training them to intervene before chronic illness gets worse.One example: GeorgeWashingtonUniversity’s $1.9million

award to improve care and cut costs for at-home dialysis patients.Another: CareFirst BlueCross BlueShield’s $24million grant to re-duce unnecessary hospital visits for chronically ill Medicare pa-tients.The center’s 10-year, $10 billion budget is the largest ever de-

voted to transforming care. In several states the office is working tooverhaul medicine for nearly all residents— not just those withgovernmentMedicare andMedicaid coverage.Every fewmonths it awards test grants of $3million or $10mil-

lion each— or sometimes tens of millions— to community groups,clinics, hospitals, insurance companies, nursing homes and states.Its programs touchmillions of patients. Hundreds of organizationshave gottenmoney.More than $2 billion has been doled out orcommitted since 2011.

Skeptics on both sides

One of the biggest experiments is the center itself. Skeptics, in-cluding Republicans but also those who support the health law,wonder if it’s up to the task.“While I certainly appreciate innovation in the delivery of health

care, the CMMI is just another big government bureaucracy cre-ated by Obamacare that costs billions and duplicates other efforts,”Utah Sen. OrrinHatch, ranking Republican on the Senate FinanceCommittee, said through a spokesman. Hatchmused at a hearinglast year whether the center’s hundreds of tests represent “barelycontrolled chaos.”Even policy pros who hope the innovation lab succeeds wonder

if its investment will pay off and complain that it is slow to discloseinformation on spending and results.“This is absolutely necessary” to try to change how care is bought

and delivered, says Christopher Koller, president of theMilbankMemorial Fund, a nonprofit that works to improvemedical deci-

sionmaking. “Is this the right way to do it? A whole bunch of ex-periments? Is the innovation center adequately resourced in an ad-ministrative way to do this? The jury is still out on this.”

Who’s getting money

With a staff of 265 and growing, CMMImust not only adminis-ter ACOs and other reimbursement tests that reward quality careat lower cost. It alsomanages hundreds of grants and dozens ofcontractors hired tomonitor and evaluate the programs.Projects tend to focus on people with expensive diseases such as

cancer, diabetes, heart failure and schizophrenia. In one round ofgrants, awardees were urged to deploy projects “as rapidly as possi-ble” and show results within six months.The JohnsHopkins University got $19.9million to improve care

for East Baltimore’s chronically sick andmentally ill. An Asian-American community group got $2.7million to help low-incomeCalifornians navigate themedical system. TheUniversity of Ten-nessee got $3million to help ensure repeat hospital patients inMemphis stay on their medications after discharge. IntermountainHealth Care got $9.7million to test software that forecasts the bestways for caregivers to interact with patients.Many efforts don’t just involve the elderlyMedicare and poor

Medicaid patients inHHS’ primary insurance programs. Six statesincludingMaine, Arkansas andOregon got up to $45million eachto involve commercial insurers and their members as well as gov-ernment programs in trials to improve health and control costs.
