Dear Members,

8th March 2010 was a historic day being the 100th International Women’s Day! So, at the outset, I wish “Happy Women’s Day” to all the ladies who are reading this newsletter. Since ages, woman has been worshipped as Goddess in various forms in India. Today, women enjoy powerful positions in Indian politics with India witnessing the first lady President, the first lady Speaker of the Lok Sabha, Chairperson of the Ruling Alliance being a woman and so on. At BCAS too, we have the first lady office bearer. The role of woman has transformed from a ‘home maker’ to a ‘nation maker’ and with the Rajya Sabha passing the “Women’s Reservation Bill”, their role is set to increase further. From manual labour to scientific research, women have proved their capabilities in every field beyond doubt. Even in our profession, the number of women CAs is rapidly increasing. I send my best wishes to all women and salute this creative and wonderful gift of God to “man-kind”.

The impact of global warming and continuing deforestation has been catastrophic. United States has experienced the highest snowfall in more than a decade. Many cities in the world remained covered by snow for days together. Afghanistan known for its windswept deserts experienced heavy snowfall. Further, many cities in the world experienced unseasonal torrential rains and remained submerged for several days. The consequences of unbridled exploitation of natural resources are self defeating. We all can save trees by reducing paper consumption.

We at BCAS have decided to encourage our members to receive digitised copies of the Newsletter so as to strengthen the campaign: “Save Trees – Save Environment”. I am sure more and more members will respond to us positively in this endeavour. One of the leading newspapers estimated that in printing the Union Budget, almost 100 trees have possibly been sacrificed. Why not legislate for reduction in the number of copies for record purposes? In our offices, we should encourage the habit of printing on both sides of papers and taking printouts only if and when necessary. A small act on the part of each one of us would go a long way to save trees and Mother Earth from the approaching disaster.

Over 100 enthusiastic nature loving members from BCAS and the CTC (including their family members) participated in a nature walk at the BNHS land on 21st February 2010. Seeing the impact of global warming on nature, they vowed to contribute their might to preserve it.

A half day seminar on TDS organised at IMC on 13th February 2010 received an overwhelming response from all the 260 members who attended it.

The Union “Economic Survey” projects revival of the Indian economy. The Union Budget will promote economic growth of

the economy though inflationary. Over 2500 people gathered to listen to Mr. S.E. Dastur who analysed the Direct Tax Provisions of the Union Budget 2010 at the Yogi Sabhagriha, Dadar on 3rd March 2010. The live webcast of that event was watched by several thousand globally. As a part of community service, the Society has organised several other Budget Meetings in various parts of the city jointly with the Forum of Free Enterprise and other organisations.

An eventful Financial Year will get over soon. I shall meet you in the next F.Y. with an improved version of the Newsletter. We at BCAS believe in change ... for change alone promotes growth as perceived by Swami Vivekananda.

Seminar on Procedure for E filing of return under Service Tax Rules.Organized jointly with Chamber of Tax Consultants

& All India Federation of Tax PractitionersPursuant to the notification no.01/2010 dtd. 19/2/2010 every assessee who has paid a total service tax of rupees ten lakh or more including the amount paid by utilization of CENVAT credit in the preceding financial year is required to file the return electronically. The first Half Yearly Return to be filed under the new rules will be 25th April 2010.

A seminar on the practical aspects of processing and uploading an E–return under Service Tax is organized with a view to provide very timely and useful guidance to our members to deal with this change in rules.

Mr. Satyajit Mohanty Joint Commissioner of Service Tax has kindly agreed to grace the occasion and provide an overview of the system put into operation by the excise department.

Mr. V.U Brahmakshatri Superintendent - Service Tax will also grace the occasion and have an interactive session with the members to resolve their queries in day to day practice. A live demo of how to process and upload an E returns will also be given.

Modern day distractions and gradual movement towardsmaterialistic achievements; growing media focus (andattendant glamorization thereof) on financial gains – all at the cost of our basic values and ideals. Truth and Honesty are considered obsolete values by some.

These are the signs of the world today. It seems no one is spared of this malaise. Whether it is a large corporate empire or a small self made cobbler on the road side. Whether a politician or a professional – an actor or a litterateur; a sportsman or an accomplished dancer. Across all barriers, success is being measured more and more in monetary terms and, in the process, honesty is sidelined and ignored.

Recently, the Satyam episode brought the above situation to the forefront. Suddenly, our profession found itself right in the middle of the public firing line. Our professional brothers were accused of being part and parcel of one of the largest and most shocking financial scandals in the world. To add to these woes, there were ugly, public accusations floating around against the leaders of our profession.

Just when we were all dreading as to what more could go wrong for our profession, came a silver lining on the dark ominous clouds. CA T.N. Manoharan, a Past President of ICAI and one of the few men handpicked by the Govt. of India to rescue Satyam was selected by the Govt. for being awarded the Padma Shri. Mr. Manoharan, a fine friend and an ardent admirer of the BCAS has played a large role in one of the most remarkable and historic turn-around stories the world has seen. He epitomizes humility, selflessness and integrity.

The Reserve Bank of India has issued the following circulars and the PIB Press Note during the period under report

A. P. (DIR Series) Circular No. 33 dated February 09, 2010External Commercial Borrowings (ECB) Policy - Liberalisation

Presently, any change in the terms and conditions of ECB after obtaining Loan Registration Number (LRN) requires prior permission from RBI.

This circular has delegated powers to Authorized Banks, with immediate effect, to approve request for changes in the following cases, subject to specified conditions: -

a) Changes / modifications in the drawdown / repayment schedule Changes / modifications in the drawdown / repayment schedule of the ECB already availed, both under the approval and the automatic routes, may be permitted subject to the condition that the average maturity period, as declared while obtaining the LRN, is maintained. The changes in the drawdown / repayment schedule should be promptly reported to the DSIM, Reserve Bank in Form 83. However, any elongation / rollover in the repayment on expiry of the original maturity of the ECB would require the prior approval of the Reserve Bank.

b) Changes in the currency of borrowing Change in the currency of borrowing, if so desired, by the borrower company, in respect of ECB availed of both under the automatic and the approval routes, may be permitted subject to all other terms and conditions of the ECB remaining unchanged. Designated AD banks should, however, ensure that the proposed currency of borrowing is freely convertible.

c) Change of the AD bank Change of the existing designated AD bank by the borrower company for effecting its transactions pertaining to the ECB may be permitted subject to No-Objection Certificate (NOC) from the existing designated AD bank and after due diligence.

d) Changes in the name of the Borrower Company Changes in the name of the borrower company may be permitted subject to production of supporting documents evidencing the change in the name from the Registrar of Companies.

Press Release by the Press Information Bureau, Government of India, dated February 11, 2010Review of cases requiring prior approval of the Foreign Investment Promotion Board

The Cabinet Committee on Economic Affairs (CCEA) has taken the following decisions with regard to cases of foreign investment requiring prior Government approval.

Presently, proposals with total project cost up to Rs. 600 crore require approval from the Finance Ministry and proposals with total project cost up to Rs. 1,200 crore require approval from the CCEA. Henceforth only proposals involving total foreign equity inflow of more than Rs. 1,200 crore will require CCEA approval and Finance Ministry, based on the recommendations of the FIPB, will consider proposals with total foreign equity inflow up to Rs. 1,200 crore.

In the following cases where prior approval of FIPB / CCEA for making the initial foreign investment was taken, fresh approval will not be required to be obtained the FIPB / CCEA:

1. Cases of entities whose activities had earlier required prior approval of FIPB / CCFI / CCEA and who had, accordingly, earlier obtained prior approval of FIPB / CCFI / CCEA for their initial foreign investment but subsequently such activities/sectors have been placed under automatic route.

2. Cases of entities whose activities had sectoral caps earlier and who had, accordingly, earlier obtained prior approval of FIPB / CCFI / CCEA for their initial foreign investment but subsequently such caps were removed or increased and the activity placed under the automatic route.

3. Cases where prior approval of FIPB / CCFI / CCEA had been obtained with reference to activities / sectors requiring prior approval and also from the angle of provisions of Press Note 18/1998 or Press Note 1 of 2005.

A. P. (DIR Series) Circular No. 35 dated February 17, 2010 Memorandum of Procedure for channeling transactions through Asian Clearing Union (ACU)

Annexed to this circular is the updated Memorandum ACM containing Procedure for channeling transactions through the ACU. This update incorporates the changes effected in the settlement system of ACU mechanism at the 37th Board Meeting of the ACU held in June 2008.

Students Program on International Financial Reporting

StandardsThe Ministry of Corporate Affairs, The Finance Ministry, The Institute of Chartered Accountants of India, Securities and Exchange Board of India, different industry representatives and various professional bodies are working overtime to meet the deadline of India’s convergence to the global accounting language “International Financial Reporting Standards” IFRS by 2011.

There are various implementation challenges with regard to this convergence and the most critical amongst them is to educate and prepare the professionals for this transition. We at the BCAS are doing our best to help our members and students in capacity building in this area and getting them ready for this 2011 millstone event.

The Human Resources and the Accounting & Auditing Com-mittees have planned a one day program to introduce IFRS to students. This one day program is planned to familiarize students with the concepts of IFRS and their basic differenc-es with Indian GAAP. Members are requested to inform their students about the Details of the program, which are as follows:

Right to Information ClinicBCAS Foundation operates a Right to Information (RTI) Clinic on regular basis. RTI Clinic is operated by Mrs. Hema Sampat, a research scholar on the subject of RTI, Mr. A. K. Asher, Advocate & RTI activist and CA Mr. Narayan Varma, past president, BCAS.

The Clinic provides help and guidance to BCAS members as also to non-members, i.e., all citizens, for makingapplications under the RTI Act and also assists in resolving any related difficulties on the subject of RTI.

The RTI Clinic operates on every 2nd, 3rd and 4thSaturday from BCAS’s office – 11 a.m. to 1 p.m.

The next RTI Clinic days accordingly are 20th, 27th March and 10th, 17th, 24th April 2010. Please call the Society’s office (Ms. Shernaaz: 61377600) to obtain a prior appointment.

The next Charitable Trust Clinic will be held on Friday, 2nd April 2010, from 5 p.m. to 7 p.m. in the library room of BCA Society at New Marine Lines.

A total of 20 sessions of 3 hrs each will be held.

Sessions will be spread over on Tuesdays & Fridays evening & some

Saturdays afternoon at BCAS & HR College.

Timing: 5.30 to 8.30 or 2.30 to 5.30 on Saturday

All these would add substantial value to your capabilities and personality. We invite you to partake in the feast of knowledge in the year ahead and join the study circle(s) of your choice. As you are aware, we face a constraint of space and this forces us to restrict the enrolment to a certain number. Responding to the request made by our members, we are contemplating the possibility of starting a study circle in the western suburbs (between Bandra and Andheri). This study circle will meet 8 to 10 times a year, and will cover diverse topics on subjects such as Direct Tax, Indirect Tax, and IFRS etc. The study circle will be started if there is adequate interest expressed by members. Those interested in joining this study circle should send an e-mail to [email protected] subject line of the e-mail should state “Yes, I want to join the BCAS Suburban Study Circle”.Please also mention your full name and BCAS membership number.
