Microsoft has changed licensing procedures using FTE staff instead of the number of computers. CURRENT CONSIDERATIONS: The Technology Department has taken proposals from 3 providers. The low bid is from Academic Superstore. This license will allow district employees to purchase the latest Windows operating system and/or a copy of Microsoft Office for approximately $10 each. FINANCIAL CONSIDERATIONS: The cost of $39,344.94 will be paid each year for the next 3 years. This is a significant savings over the previous license contract. Funds are budgeted annually for this purchase in the Technology Department. STAFF RECOMMENDATION: The Board of Education is respectfully requested to approve the 3 year contract for Microsoft software licenses, in the amount of $39,344.94 from Academic Superstore. BACKGROUND INFORMATION: Student enrollment information is collected at First Stop and housed in the Student Information Management System (Skyward) as students enter or exit Dodge City Public Schools for Pre-K through 12th grade. Information from Skyward is rolled into the Kansas Individual Data on Students (KIDS) to generate the correct funding of state aid for school districts. Student “headcount” information is reviewed weekly by First Stop for K-6 classrooms. Reviewed By: Administrative Cabinet BACKGROUND INFORMATION: Under the federal Elementary and Secondary Education Act (ESEA), better known as “No Child Left Behind” (NCLB), greater levels of accountability and achievement are required of the nation’s public schools. CURRENT CONSIDERATIONS: Schools in Dodge City Unified School District 443 have recently been recognized for continued excellence and student achievement. In addition to attaining Adequate Yearly Progress under the NCLB criteria, eight district schools have received at total of twenty (20) Standard of Excellence Certificates from the Kansas State Department of Education for exemplary student achievement on the 2011 Kansas Assessment Program. These awards reflect the hard work of the students of USD 443, the support of the public school by parents and the community, and the skill and dedication of the school district’s professional staff. FINANCIAL CONSIDERATIONS: There are no financial considerations for this information. STAFF RECOMMENDATION: The Board of Education is respectfully requested to receive the information regarding the Standard of Excellence Awards received by the Dodge City Public School for excellence in education, and commend the staff and students of the respective schools for their hard work and success in educating the children of Dodge City. BACKGROUND INFORMATION: In August, USD 443 was asked by the Kansas School Superintendents’ Association (KSSA) to have a representative join the Kansas City, Kansas superintendent and 9 other superintendents, in determining the best definition of College and Career Readiness, as well as define specific ways to assess students in this area. This includes the soft skills that employers and industry many times complain students do not have. Currently, this task force’s recommendation is slated for presentation to the State Board of Education in November. A critical component of this recommendation must include an assessment system that will be meaningful for students. CURRENT CONSIDERATIONS: Dodge City is currently using the State Assessment system. The consideration of other measures by this committee is vital to making student assessments relevant and meaningful for students. Finally, the goal of this KSSA workgroup, and another parallel taskforce from KASB, is to define College and Career Readiness and present recommendations regarding both the criteria and assessments to Dr. Diane DeBacker, Kansas Education Commissioner. FINANCIAL CONSIDERATIONS: There are no financial considerations associated with this report. STAFF RECOMMENDATION: The Board of Education is respectfully requested to receive this information regarding the work being done to define and assess College and Career Readiness in the State of Kansas, and the role that USD 443 staff is taking in this process. Workers’ Compensation is not a fixed tax, but a variable cost, driven by claims experience. Employers, not the insurance carrier, ultimately pay for claims because of the effect of these claims on the modifier over three years. CURRENT CONSIDERATIONS: The commitment to reduce both the frequency of accidents and the severity of accidents is necessary to stabilize and/or reduce the Workers’ Compensation modifier for USD 443, thus reducing annual premium cost. USD 443 will partner with KFSA to provide expertise for a three-year period by providing guidance and resources for:
• Facility reviews, • Management/Supervisor Training, • Safety training with high risk employees, • Designing a loss prevention program, and • Implementation of an effective/efficient accident investigation and accident management program.
FINANCIAL CONSIDERATIONS: The cost for the three-year partnership with KFSA is $13,576.00. The lawsuit, sponsored by a coalition of school districts representing over 152,000 Kansas school children was heard in District Court during June and July. Final arguments were made in early August and the case was given to the three-judge panel for deliberation and a verdict. CURRENT CONSIDERATIONS: It is anticipated that the decision of the judges will come prior to the end of the year in December. Regardless of the outcome, an appeal to the Kansas Supreme Court is anticipated by the unsuccessful party. Such an appeal would probably add up to one year before the final decision is made. Dodge City USD 443 continues to be represented at the meetings of the Schools for Fair Funding organization by Alan Cunningham and/or William Hammond. FINANCIAL CONSIDERATIONS: There are no additional financial considerations associated with this recommendation. Petrella Case status. In December of 2010, a group of Shawnee Mission parentsfiled suit asking that the LOB lid be voided and that the finance system shift tolocal property taxes. This is exactly the Brownback plan. Local property taxes willat least double over the next 10 years or educational opportunity will experiencean explosively widening gap. In March of 2011, the trial court dismissed theactionon technical "standing" grounds. The 10th CircuitCourt of Appeals inDenver heard arguments November 16, 2011, but has not issued a decision. Weexpected a decision this spring or summer but it has not been issued yet. If thetrial court is upheld, the parents may petition the United States Supreme Court forreview. If the trial court is overruled, the matter will return to the trial court for
further proceedings.
Gannon case status.
I reviewed the mechanics of the Gannon trial.
After 40 straight days of trial preparation, weekends included... the matter wastried to a three judge panel in Topeka. The Trial lasted 17 days in June, July andAugust. 44 witnesses testified (See witness list on trial calendar handout), 39 forthe plaintiffs and 5 for the defense. It was a fluid calendar during trial toaccommodate witnesses schedules over the summer. We only had to omit twowitnesses from our original plan due to time constraints.
662 exhibits were introduced into evidence. A total of 18,727 pages. 416 of thesewere plaintiffs' exhibits consisting of 11,892 pages. There were 246 defenseexhibits consisting of 6,835 pages. The Court requested a synopsis of what eachexhibit was intended to prove (see plaintiff exhibit synopsis handout) which isunheard of. It allowed us to focus the court's attention on just what to look for in

our 11,892 pages.
A court reporter tookall the testimony andproduced the trial transcript which runs3340 pages. Trial briefs of the legal issues involved were submitted. SuggestedFindings of Factwere submitted. The Judges requested "a suggested decision"from us which we submitted.
All of this is "the record."Thejudges must base their decision on what is here.The SupremeCourt will see all of this as they consider the case.
I included a full copy of myTrial daily summaries for those thatmay have missedseveral days as they came out.
We thanked the four plaintiffdistricts and their teachers and administrators,Wichita, Kansas City, Dodge Cityand Hutchinson for all their excellent work.We also thanked SFFF for sponsoring the litigation and supporting the kidsofKansas. Without SFFF and the commitment of the member districts, this simplywould not have happened.

Rupe and I then informally reflected uponthemilestones and unique aspects ofthe trial.
Rupe reviewed the appellate procedure once we geta trial court decision. Thelosing party has 30 days to file an appeal and the appeal is directly to theKansasSupreme Court. The Supreme Court will then set a briefing schedule which willmost like have deadlines in the late spring of 2013. Oral arguments should bescheduled in late summer of 2013 and we would normally expect a SupremeCourt decision in the late fall of 2013.
This should tee the action up for the legislative session of 2014 and schoolbudgets for the 2014-15 school year.
