Reasons for Appeal for Services and Invoices

1. Form 500 notification letter for funding year 2009 was filed and approved to extent vendor contract until 10/01/2011.

2. Nothing from USAC in Form 500 notification letter for funding year 2009 explaining that extension deadlines for invoice and services needed to be filed.

3. When the form 500 for funding year 2009 was approved to extend contract it was understood by the school and the vendor that services and invoices were also extended with the contract.

4. This year when form 500 for funding year 2009 was filed it was stated in correspondence that services and invoice extensions deadline needed to be filed, which was different from the previous year.

5. Neither the School nor the Vendor were aware that extension deadlines for services and invoices were separate from the contract with the vendor.

6. Need an extension for services and invoicing as well as contract- new school construction still in progress

Extenuating Circumstances related to Extension

Summary related to time line for the construction of the new school building

In September 2008, a Value Engineering took place and the project evaluated. In September of 2009,

geothermal system was added to the project requiring the mechanical and therefore, a large part of the

electrical to be redesigned. In 2010 the completion of design was delayed in trying to get approval of the

design by the BIA. In June it went out to bid and was awarded in August of 2010 for a 16 month

construction project. Beginning of construction was further delayed while the general contractor

negotiated with TERO and further by abnormal weather days. Now the contractor is behind schedule in

large part due to delays in receiving bar joist on site.

Loneman School Corporation School Board Is requesting an extension of the Design Grant for Project 06A02 to the end of the business day June 21, 2010.

Due to many unforeseen circumstances Loneman School Corporation Is requesting an extension to the deSign phase of the new school project No. 06A02. The project manager retired and a replacement for him had to be found to pick up in the middle of the design.

We had problems with the direction and lack of communication with the Project Manager for the AlE Company we had hired to complete our design. That person was replaced and a new project manager was assigned and we pretty much had to redo all that was already in place. We had chosen to use ICF (Insulated Concrete Form) which required more documentation and design time then we had anticipated. The heating and cooling was designed for conventional heat pumps and then we received additional funding for geothermal which required the addition of a well field and more design. We Initially designed for a safe room as we were told we were In a Tornado Zone and then told we were not. The school board still wished to have as safe a building as possible so elected to continue with the safe room concept with the exception of tornado proof doors which were cost prohibitive. We also had to change the design to Include additional water storage to satisfy the more stringent fire code because the School board elected to have the buildings remain the property of the Bureau of Indian Affairs. There was asbestos discovered In the bus garage which was Included In the scope of work and additional deSign was required to remedlate the floor tile.

We have designed a building that has no frills, super energy efficient, very sturdy and as low maintenance as was allowable, We are very confident Loneman School and WHPaclflc will build a building that will be an asset to the community, the Bureau of Indian Affairs, and the Bureau of Indian Education.

We are issuing this Form 500 Notification Letter to notify you that the Schools and Libraries Division (SLD) of the Universal Service Administrative Company (USAC) has 'processed your FCC Form 500, Adjustment to Funding Commitment and Modification to Receipt of Service Confirmation Form.

Retain this letter for your records. A copy of this information has been provided to the service provider(s) whose Service Provider Identification Number(s) (SPIN) is featured on this Form 500.

DEADLINES:

Recurring services must be delivered during the funding year (between July 1 and June 30). In general, non-recurring services must be delivered between July 1 and September 30 following the close of that Funding Year. The deadline may be extended for delivery and installation of non-recurring services as described in Step 11: Service Delivery Deadlines and Extension Requests on our website.

Invoices must be postmarked no later than 120 days after the last date to receive service or 120 days after the date of the Form 486 Notification Letter, whichever is later. If an invoice is postmarked after the later of those two dates, payment will be denied.

You can request a Service Delivery Deadline Extension or Invoice Deadline Extension from USAC following the guidance posted on our website.

Discuss with your service provider(s) whether you prefer discounts on your bills or reimbursement after paying for services in full. USAC will process either reimbursements based on Form 472 (BEAR) or discounts based on Form 474 (SPI) for a given FRN. Once established, however, the selected process - SPls or BEARs - must be used consistently for the entire Funding Year.

NOTE: USAC will base the billing mode (reimbursement or discounting) on the first invoice type that it processes for payment. It is therefore imperative for the service provider and the customer to establish together the preferred invoicing mode.

NOTICE ON SERVICE START DATE

The Service Start Date as reflected on this letter may have been changed from what you indicated on the Form 500. The Service Start Date may not be before the Allowable Vendor Selection/Contract Date (AVS/CD) from the Form 470 cited for this FRN on the Form 471.
