FS-2017-02, Final Plat of Eagles Ridge No. 3, Council Report RESOLUTION APPROVING A 23-LOT FINAL PLAT OF SUBDIVISION CALLED EAGLES RIDGE PLAT NO. 3 FOR THE PROPERTIES LOCATED AT 3650 EAGLES RIDGE DRIVE AND 1510 TOWNHALL ROAD WHEREAS, New Leaf Homes LLC has submitted a 23-lot Final Plat of Subdivision called Eagles Ridge Plat No. 3 for the properties located at 3650 Eagles Ridge Drive and 1510 Townhall Road; and WHEREAS, the Final Plat, which will create 22 residential lots and an out-lot for stormwater management, is located within the corporate limits of the City of Beloit and contains the dedication of land to the City; and WHEREAS, the City of Beloit Plan Commission has reviewed and recommended approval of this Final Plat, subject to three conditions outlined below; and WHEREAS, this Final Plat substantially conforms to the Preliminary Plat, approved by the City of Beloit Plan Commission on August 9, 2017; and WHEREAS, the City Council of the City of Beloit has reviewed the proposed Final Plat of Subdivision called Eagles Ridge Plat No. 3, which pertains to the following described land: Lot 1 and Out-Lot 1 of Certified Survey Map Doc. No. 1930526 as recorded in Volume 34 on Pages 301-303, except Parcel “A” of Plat of Survey recorded 12/10/2015 as Doc. No. 2041659, being part of the SE ¼ of the NE ¼ and part of the NE ¼ of the SE ¼ of Section 28, Township 1 North, Range 13 East of the 4 th P.M., in the City of Beloit, County of Rock, State of Wisconsin. Said parcels contain 8.474 acres, more or less. NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of Beloit does hereby conditionally approve the 23-lot Final Plat of Subdivision called Eagles Ridge Plat No. 3, subject to the following conditions: 1. The applicant shall record the Final Plat with the Rock County Register of Deeds within one year of approval. The Final Plat shall not be recorded until a Development Agreement is approved by City Council. 2. Fees in lieu of parkland dedication shall be paid prior to issuance of the first Building Permit. 3. WHEREAS, New Leaf Homes LLC has submitted a 23-lot Final Plat of Subdivision calledEagles Ridge Plat No. 3 for the properties located at 3650 Eagles Ridge Drive and 1510 TownhallRoad; and

WHEREAS, the Final Plat, which will create 22 residential lots and an out-lot forstormwater management, is located within the corporate limits of the City of Beloit and contains thededication of land to the City; and

WHEREAS, the City of Beloit Plan Commission has reviewed and recommended approvalof this Final Plat, subject to three conditions outlined below; and

Topic: Final Subdivision Plat of Eagles Ridge No. 3 for the properties located at 3650 Eagles Ridge Drive and 1510Townhall Road

Overview/Background Information:New Leaf Homes LLC has submitted the attached Final Plat of Eagles Ridge No. 3, which includes the vacant 7.3-acreparcel located at 3650 Eagles Ridge Drive and the vacant parcel located at 1510 Townhall Road to be used for temporarystormwater detention.

Key Issues (maximum of 5): The subdivision of land requires approval of a Preliminary Plat, followed by approval of a detailed Final Plat,

which must substantially conform to the layout of the Preliminary Plat. A recorded Final Plat actually creates thelots, and may include the entire Preliminary Plat area or phases. The Preliminary Plat of Eagles Ridge No. 3 wasapproved by the Plan Commission on August 9

th. The Final Plat includes all of the Preliminary Plat area.

As shown on the attached plat, the applicant has proposed the completion of Eagles Ridge Drive and the creationof 22 new single-family lots with an average lot area of 11,500 square feet. The subject property is already zonedR-1A, Single-Family Residential. The attached Location and Zoning Map shows the location of the platted area.

The proposed street has a right-of-way width of 66 feet with pavement width of 32 feet, and will include newutilities and curb & gutter. As shown on the plat, proposed Lots 55-60 will drain to a proposed temporarystormwater detention area at the end of Quail Run, while the other proposed lots will drain to an existingstormwater detention area in the first phase of this subdivision.

The City and developer will soon begin negotiating a Development Agreement regarding infrastructure. Since thisnegotiation has not started, staff modified condition #1 to ensure that the agreement precedes recording.

The proposed plat includes numerous utility easements along the rear and side lot lines of the new residentiallots. Alliant Energy has requested slightly larger easements along the rear and some side lot lines.

The other Review Agents have reviewed the Final Plat and do not have any comments or concerns. The Final Plat substantially conforms to the approved Preliminary Plat and the lots meet minimum standards. The applicant is not proposing the dedication of any additional parkland, and the Parks, Recreation, &

Conservation Advisory Commission recommended accepting fees in lieu of parkland dedication on August 9th.

According to Section 12.04 of the Subdivision Ordinance, a Final Plat requires review by the Plan Commissionprior to City Council consideration. Following approval, the Final Plat will be submitted to the State of WI.

The Plan Commission reviewed this item on September 6, 2017 and voted unanimously (5-0) to recommendapproval of this Final Plat, subject to three conditions as shown on the attached Resolution.

Conformance to Strategic Plan: Consideration of this request supports City of Beloit Strategic Goals #3 and #5 by encouraging residential growth

with high quality infrastructure.

Sustainability: Reduce dependence upon fossil fuels – This subdivision will include a shared use bike/ped path.

Sustainability: The existing shared use path will be extended along the south side of Eagles Ridge Drive.

Staff Recommendation:The Planning & Building Services Division recommends approval of the attached Final Plat of Eagles Ridge Plat No. 3 forthe properties located at 3650 Eagles Ridge Drive and 1510 Townhall Road in the City of Beloit, subject to the followingconditions:

1. The applicant shall record the Final Plat with the Rock County Register of Deeds within one year of approval.2. Fees in lieu of parkland dedication shall be paid prior to issuance of the first Building Permit.
