SUBJECT: FY 2003 RENEWAL APPLICATION FOR CONTINUATION FUNDING FORSTD/HIV PREVENTION TRAINING CENTER

BACKGROUND

The Dallas County Health and Human Services STD/HIV PTC is one ofthe original (4) fourPTC's established by the CDC in 1979. The STD/HIV Prevention Training Center acollaboration between the University ofTexas Southwestern Medical Center at Dallas, andDallas County Health and Human Services Department will provide innovative public andprivate STD clinician training and evaluation for United States Public Health Service(USPHS), Region VI through a variety of curricula performed in two clinic sites.

OPERATIONAL IMPACT

There will be on operational impact to Dallas County.

FISCAL IMPACT

The total cost for operating the proposed Prevention Training Center Part 1: STD Medicaland laboratory Services Training is $430,156. This application to CDC requests $182,596in grant funds to provide the salary and fringe benefits for one program manager, oneadministrative assistant, and one laboratory technician. $21,086 for travel, $7,041 forsupplies, $13,250 for other, $55,859 for indirect cost and $150,324 for contractualservices. There is no financial impact to Dallas County.

It is respectfully recommended that the Dallas County Commissioners Court does herebyapprove the Renewal Application for Continuation Funding for the STD/HIV PreventionCenter Part1: STD Medical and Laboratory Services Training Grant to the Centers forDisease Control and Prevention, and authorize the County Judge to sign the applicablegrant documents on behalf of ~"as County.

Will comply, or has already complied, with therequirements .; Title II and III of the UniformRelocation A 3tance and Real Property Acqui­sition Policies\ct of 1970 (P L 91-646) whichprovide for fair and equitable treatment of personsdisplaced or whose property is acquired as a result­of Federal or federally assisted programs. 12. Will comply with the Wild and Scenic Rivers Act of1968 (16 U.S.C. §§1271 et seq.) related toprotecting components or potential components ofthe natonal wiid and scenic rivers system.

1. CERTIFICATION REGARDING DEBARMENTAND SUSPENSION

The undersigned (authorized official signing for theapplicant organization) certifies to the best of his orher knowledge and belief, that the applicant, definedas the primary participant in accordance with 45 CFRPart 76, and its principals:

(a) are not presently debarred, suspended, proposedfor debarment, declared ineligible, or voluntarilyexcluded from covered transactions by anyFederal Department or agency;

(b) have not within a 3-year period preceding thisproposal been convicted of or had a civiljudgment rendered against them for conunissionof fraud or a criminal offense in connection withobtaining, attempting to obtain, or performing apublic (Federal, State, or local) transaction orcontract under a public transaction; violation ofFederal or State antitrust statutes or conunissionof embezzlement, theft, forgery, bribery,falsification or destruction of records, makingfalse statements, or receiving stolen property;

(c) are not presently indicted or otherwisecriminally or civilly charged by a governmentalentity (Federal, State, or local) with com­mission of any of the offenses enumerated inparagraph (b) of this certification; and

drug-free workplace;(3) Any available drug counseling, rehabil­

itation, and employee assistance programs;and

5. CERTIFICATION REGARDINGENVIRONMENTAL TOBACCO SMOKE

Public Law 103-227, also known as the Pro-ChildrenAct of 1994 (Act), requires that smoking not bepermitted in any portion of any indoor facility ownedor leased or contracted for by an entity and usedroutinely or regularly for the provision of health, daycare, early childhood development services,education or library services to children under theage of 18, if the services are funded by Federalprograms either directly or through State or localgovernments, by Federal grant, contract, loan, or loanguarantee. The law also applies to children'sservices that are provided in indoor facilities that areconstructed, operated, or maintained with suchFederal funds. The law does not apply to children'sservices provided in private residence, portions offacilities used for inpatient drug or alcohol treatment,service providers whose sole source of applicableFederal funds is Medicare or Medicaid, or facilitieswhere WIC coupons are redeemed.

EXECUTIVE ORDER 12372

Effective September 30, 1983, Executive Order 12372(Intergovernmental Review of Federal Programs) directed OMB toabolish OMB Circular A-95 and establish a new process forconsulting with State and local elected officials on proposed Federalf1Illl1lcial assistance. The Department of Health and Human Servicesimplemented the Executive Order through regulations at 45 CPR Part100 (Inter-governmental Review of Department of Health and HumanServices Programs and Activities). The objectives of the ExecutiveOrder are to (1) increase State flexibility to design a consultationprocess and select the programs it wishes to review, (2) increase theability of State and local elected officials to influence Federaldecisions and (3) compel Federal officials to be responsive to Stateconcerns, or explain the reasons.

The regulations at 45 CPR Part 100 were published in the FederalRegister on June 24, 1983, along with a notice identifying the

Department's programs that are subject to the provisions of ExecutiveOrder 12372. Information regarding PHS programs subject toExecutive Order 12372 is also available from the appropriateawarding office.

States participating in this program establish State Single Points ofContact (SPOCs) to coordinate and manage the review and commenton proposed Federal f1Illl1lcial assistance. Applicants should contactthe Governor's office for information regarding the SPOC, programsselected for review, and the consultation (review) process designed bytheir State.

This is the continuing grant application budget, and required narrative for the Centers forDisease Control and Prevention Grant # R 30ICCR618393-04, Part I - Clinical andLaboratory Training, Dallas County Health and Humans Services, 2377 Nonh SternmonsFreeway, Suite 428, Dallas, Texas 75207, Effective Grant Period, April 1, 2003 - March31,2004.

This continuing grant application budget totals $430,156, allowing for the remaining$1,000 of baseline funds to be expended by the Centers for Disease Control andPrevention, STDIHIV Prevention Training Branch, to support the National Network ofSTDIHIV Prevention Training Centers marketing display. This $1,000 fund contributionto the NNPTC display is being contributed by all NNPTC grantees, and will be utilizedfor exhibit rental and shipping to and from a series of NNPTC Marketing Committeedesignated national professional meetings.

STD Nurse Clinician Position Cut - This continuing grant application is submitted withthe deletion of a nursing position from the Dallas County Health and Human ServicesSTDIHN NNPTC, which has been in place in all grant cycles since1979. The grantrequirement to open a satellite training site in U.S.P.H.S., Region VI, other than in theState of Texas, increased subcontract costs. The nursing staff position cut has becomenecessary to limit the grant budget to current levels. In the last two grant announcementcycles, there has been level funding while costs for satellite training sites, satellitebroadcast training and inflation have increased.

Response has been limited with severaladolescent/university providers responding and one student has enrolled in an'Intensive' course. The STDIHIV Prevention Training Center (PTC), Part I, Clinical and LaboratoryTraining, Dallas, Texas, perfonned 23 training activities for 684 participants inU.S.P.H.S., Region VI, between April 1 - October 31, 2002. The Dallas PTC,Part I, exceeds performance objectives under the terms of the grant application.

All projected courses at the Dallas and Little Rock PTC sites, UT SouthwesternMedical Center at Dallas, and 11 STD "Road Shows" have been performed insupport of CDC Syphilis Elimination National Initiatives, JailJPrison Initiatives,and Minority Health Initiatives in the federal region. In addition to projectedLaboratory Methods Course with 7 students, three sections for 20 NursePractitioner graduate students entitled, ''Wet Mounts & Gram Stains," wereperfonned in response to two Dallas University Nurse Practitioner TrainingProgram requests.

Quadrant-Wide Collaborations Year 03 -The collaborative focus on theMississippi Valley Syphilis High Morbidity Area (HMA) corridor in the U.S.continues as an NNPTC focal point of training activities. Part n Coordinator, Ms.Tracee Belzle, had accepted responsibility to take the lead on follow-upworkshops during 2002. A three-part NNPTC training activity at MississippiValley State University, Itta Bena, Mississippi, is projected to become acollaboration course for the 3TC partners of the AETCs, NNPTCs and RTCs byDecember 31, 2003; The Program Manager and Administrative Assistantparticipated in the initial planning telephone conference Monday, November 4,2002.

Primary Care - Plan of Action - Collaboration Year 03 The Dallas NNPTC,Part I, had projected two SID ''Road Show" courses in Hope and Pine Bluff,Arkansas, in early 2003. The Dallas and Little Rock NNPTCs will performworkshops in the Migrant Worker Health Center STD Update, Hope, Arkansas,and the Pine Bluff, Arkansas, SID Workshop in 2003. Tom Davis, NNPTCProgram Manager, conferred with Estilita Quimosing, M.D., Medical Director,Jefferson Comprehensive Care Clinic, Pine Bluff, Arkansas, and Derrick Newby,AETC Program Coordinator, Pine Bluff, Arkansas, in the San Francisco,California 3TC Conference. Dr. Quimosing and Mr. Newby are open to acollaboration workshop in Pine Bluff, and confrrm receiving our regularmarketing mailings. The Family Practice Intensive Review Course, May 31 ­June 2, 2002, UAMS, Little Rock, Arkansas, is an excellent annual platform toreach primary care providers in Arkansas. It is projected that the ArkansasTraining Center will continue this annual training activity in the coming grantyear. The Dallas NNPTC faculty has an annual STD Update, November 1 - 2,2002, and invited the UAMS, NNPTC, as guest faculty at UT Southwestern.

Inquiry About Oklahoma Training Partnership, or 'Money, money ... showus the money!' The Dallas NNPTC received an inquiry from Mr. Bill Pierson,Oklahoma State STDIHIV Representative, Ronald Greenfield, M.D., Chief,Infectious Diseases, Leonard Slater, M.D., Assistant Professor of InfectiousDiseases, and Karen Wendel, M.D. [fonnerly of the Johns Hopkins NNPTC], TheUniversity of Oklahoma Health Sciences Center, Infectious Diseases Division;concerning a collaboration with the Dallas Clinical PTe. Collaboration ispossible but would require additional funding to consider such an expansion oftraining activities.

Native American Collaborations Year 03 . In this grant cycle, we continue along collaborative history with the LH.S. Workgroup, and the Navajo Nation, byrecruiting an STDIHIV trained Lakota Sioux physician, Lois Steele, M.D., andidentified Native-American Physician Provider Organizations for the IRSWorkgroup. The Dallas NNPTC, Part I, Program Manager, performed a Syphilispresentation to the 115 Community Health Representatives (CHRs) Organizationin Albuquerque, New Mexico, June 11,2002. The CHRs are Native Americankey community health opinion leaders in Navajo and other Native Americancommunities/tribes in the Southwestern United States. We project that we willperform a minimum Of one Syphilis workshop upon request in New Mexico orArizona by March 31, 2003.

HRSA Primary CarelJailIPrison Collaborations Year 03 - We areexperiencing increasing STDIHIV training interest in staff in JailslPrisons in thisregion. The Dallas NNPTC, Part I, performed a five-part series of workshops toDallas County Jail Health Care Providers, June 4, July 9, August 6, August 27,and September 3, 2002. It was a one-day, seven-hour, STDIHIV/Syphilis JailWorkshop. Oklahoma State Prison Trainee· Mr. Ray Fugate, CDC Advisor,assigned to the Oklahoma Department of Health, arranged for a private jailprovider clinician, Correctional Healthcare Management of Oklahoma City,Oklahoma, to attend the STD Clinician Course - Comprehensive, April 8 -19,2002. The clinician, Ms. Tina Carney, strongly suggested the need for all of hercolleagues to attend this high quality training. Texas State Prison Trainee - TheDallas PTC trained Steven Peck, D.O., a Texas Department of Correctionsphysician from TexaS Tech University in Abilene, Texas, in an STD ClinicianCourse - Intensive, February 11 -15, 2002. Dr. Peck requested we contact hissupervising physician, making our services available to all physicians in the TDChealth care system A personal letter of invitation, brochures and applicationswere mailed on April 28, 2002. The Dallas County Jail physicians are regularattendees at STDIHIV!Hepatitis training functions at the campus of UTSouthwestern.

BACKGROUNDIISSUEOn December 19, the Commissioners Court, at their regularly scheduled session, authorized the award ofBid No., 2001-20 2000 to Diversey Lever for the period ofDecember 21, 2000 through December 20,2001.The contract provides dishwashing chemicals, equipment and consultant services for the Sheriffs Cook Chilland West Tower kitchen facilities. In accordance with contract terms and upon mutual agreement, thecontract may be extended for a fmal twelve month period based on the existing terms, conditions and pricing.As a result of Diversey Lever's compliance with contract specifications, the Sheriffs Department requestthat the County exercise the final twelve month extension option contained within Bid #2000-027-229. .

Diversey Lever has agreed to extend the contract for dishwashing services in accordance with the existingterms, conditions and pricing set forth and awarded.

FINANCIAL IMPACT:The contract is based on a cost per meal per person of $0.00314. Consequently, should the CommissionersCourt concur with extending Bid# 2000-027-229 for additional twelve month period and based a yearlyaverage number ofmeals of9,005,400 (750,450/month) it is anticipated that Dallas County will incur annualexpenditures totaling approximately $28,260.00.

RECOMMENDATION:It is the recommendation of the Purchasing Department that the Dallas County Commissioners Courtauthorizes the fmal twelve (12) month extension of Bid No 2000-027-229, effective December 21, 2002through December 20,2003.

Back2round/lssueOn May 21, 2002, Dallas County Commissioners Court approved the Data Services OutsourcingMaster Agreement and fourteen (14) Service Level Agreements between Dallas County andSchlumberger Serna, Inc. to be effective November 1, 2002 with Court Order #2002-947. Thetransition process has been completed and the contract has been initiated.

Schlumberger Serna has requested that the County modify its Master Agreement to allow othergovernment entities to utilize this contract. Article 791 of the Texas Local Government Code authorizescontracts between government agencies to perform governmental functions and services such as street, roadsand drainage. Additionally, Section 791.025 of the Texas Government Code permits Interlocal agreementsbetween local governments for the purchase of goods and services.

The Civil Section of the Dallas County District Attorney's Office has approved the attached language changeto the Master Agreement.

Financial ImpactThere is no financial impact on Dallas County with this contract change.

Recommendation:The Purchasing Department recommends that the Commissioners Court approve the contractchange. This is respectfully submitted to the Commissioners Court for its consideration. A CourtOrder has been scheduled for this formal agenda.

791.025. Contracts for Purchases

(a) A local government, including a council of governments, may agree with another localgovernment or with the state or a state agency, including the General Services Commission, topurchase goods and services.

(b) A local government, including a council ofgovernments, may agree with another localgovernment, including a nonprofit corporation that is created and operated to provide one ormore governmental functions and services, or with the state or a state agency, including theGeneral Services Commission, to purchase goods and any services reasonably required for theinstallation, operation, or maintenance of the goods. This subsection does not apply to servicesprovided by firefighters, police officers, or emergency medical personnel.

(c) A local government that purchases goods and services under this section satisfies therequirement of the local government to seek competitive bids for the purchase of the goods andservices.

Road and Bridge District 4's Sheriff's Office Special Investigations Division loan offer

BACKGROUNDIn FY89, Commissioners Court and the Sheriff agreed to fund a self-liquidating Special InvestigationsDivision (SID). Included in this original agreement was a loan from then Commissioner Nancy Judy,Road and Bridge District 2 to the Sheriff's Office in order to establish the Special Investigations Division.The Office of Budget and Evaluation has not been able to find the particulars on the loan or the payback.However, institutional memory is that it occurred and it was paid back.

OPERATIONAL IMPACTThe original intent of SID was to be a standalone drug enforcement unit developing their own intelligenceand performing their own arrest activities. As such, SID was created with a supervisor heavy structure.SID is staffed with a Captain, a Lieutenant, a Sergeant, six deputies and two secretaries. In addition, SIDuses the manpower of the Intelligence Division (one Lieutenant and six deputies) and the CriminalInvestigations Division (one Lieutenant, one Sergeant and ten deputies) when additional resources areneeded.

As time passed it became apparent that operating a standalone drug enforcement program was not anefficient use ofmanpower. So over the last couple ofyears the deputies authorized for SID have becamemore involved with multi-jurisdictional taskforces. Since SID was no longer functioning as a standalonedrug enforcement unit the supervisor heavy structure became outdated. In addition, SID had never attaineda self-liquidating status.

During the FY2002 budget process the Office of Budget and Evaluation recommended thatCommissioners Court eliminate the supervisors (Captain, Lieutenant, and Sergeant), clerical staff and threedeputies through attrition. Thereby, leaving the three deputies that were working on the multi-jurisdictionaltaskforces. The Office ofBudget and Evaluation further recommended that two deputies authorized in theIntelligence Division for two de-populated jails be eliminated through attrition.

As part of the FY2002 budget the Commissioners Court agreed to this recommendation. However, early inOctober 2001, the Sheriff's Department received Department of Justice permission to use seized Federalfunds to offset other expenditures in the Sheriff's Office budget in order to maintain SID in FY2002.

As part of the FY2003 budget the Commissioners Court was unable to fund the continued operation ofSID and approved the elimination of the supervisors (Captain, Lieutenant, and Sergeant), clerical staff andthree deputies through attrition. The three deputies that were working on the multi-jurisdictionaltaskforces were transferred to the Intelligence Division. Additionally, two deputies authorized in theIntelligence Division for two de-populated jails were approved for eliminated through attrition.

The week prior to the adoption of the FY2003 Budget, the Sheriff requested and Commissioners Courtgranted a request to have the County Auditor's Office review information provided concerning civilforfeitures pending in the courts and determine if any could be certify as revenue for FY2003. The generalunderstanding was that if the County Auditor certified that the SID would be self-liquidating that theCommissioners Court would allow it to continue to operate in FY2003. The County Auditor's Officereviewed the civil forfeitures and provided Commissioners Court a document that stated that the"probabilitv of receipt offunds for reviewed cases totaling $319,000 within FY03 is high".

The FY2003 projected budget for SID is $739,000. Assuming the County Auditor certifies $319,000 incivil forfeitures for FY2003 there still is a funding gap of $420,000. In order to allow SID to operate forFY2003 Road and Bridge District 4 has requested that Commissioners Court authorize a loan of Road andBridge funds in the amount of $420,000 to cover the funding gap. Commissioner Mayfield fully expectsto be reimbursed for the loan in FY2003 or future years as funds become available and may be legallyexpended.

LEGAL IMPACTThe County Auditor's Office, District Attorney's Office and the Office of Budget and Evaluation havereviewed Commissioner Mayfield's loan offer and have determined that there are appropriate road relatedexpenditures in the Debt Service and/or Major Capital Projects fund for which the Road and Bridge fundsmay be used; thereby, freeing up General Fund appropriations for the Sheriffs Office Special InvestigationDivision for FY2003.

The District Attorney's Office further determined that a majority of Commissioners Court would need toapprove any appropriation transfer related to this loan offer.

FINANCIAL IMPACTThe FY2003 projected budget for SID is $741,000. Assuming the County Auditor certifies $319,000 incivil forfeitures in FY2003. Road and Bridge District 4 would need to loan the Sheriffs Office $420,000in order to operate SID for FY2003.

RECOMMENDATIONThe Office of Budget and Evaluation presents for discussion Commissioner Mayfield's offer to loan$420,000 from Road and Bridge District 4 allocated funds to cover the operating cost of the SheriffsOffice Special Investigations Division for FY2003.

1) DISTRICT COURT ADMINISTRATION - requests approval for:

a) reduced cost for parking authorized at the juror rate of $3.00 per day at theGeorge L. Allen, Sr. Courts Building, Underground Parking Garage forMonty J. Buhrow, a law student who will be volunteering as a law clerk forthe lOl st District Court from January 2, 2003 until May 30,2003.

b) to appoint Donna Roach, Jury Bailiff to be in charge of the central juryroom and the general panel. The statutory term is for two years beginningJanuary 1 of each odd-numbered year. The appointment of Ms. Roach isfor two years beginning January 1,2003.

TRAVEL REQUESTS

1) INSTITUTE OF FORENSIC SCIENCES - requests approval for KarinHendley to attend the Agilent GC-MDS Troubleshooting and Maintenance inRichardson, TX on December 6, 2002 and use of a County vehicle with gas creditcards: $320 (Registration Fees) is available in General Fund, Forensics, Crime LabDepartment, Conference Training Account, FY Budget 2003(00120.3311.04210.2003)

2) PURCHASING - requests approval for Phillip Vasquez to attend the USCommunities Advisory Board Meeting in Walnut Creek, CA on December 5-6,2002 at DO cost to Dallas County.
