INFORMACÍON SOBRE LA REUNIÓN DE LA MESA DIRECTIVA PARA EL PÚBLICO

Get Schools Cooking Grant Program

Executive Summary:

Get Schools Cooking, a program of Chef Ann Foundation, is for school districts who want to further build their food service programs to be focused on whole foods that are cooked from scratch. Through Get Schools Cooking, food service directors and their teams are guided through an intensive three-year program.

The program includes workshop experience, assessment, strategic planning, technical assistance, action planning, systems assistance, grant opportunity, and peer-to-peer collaboration to help move forward in building a sustainable and successful cook-from-scratch program. Goleta Union School District has been selected as one of the four district participants for the 2018 Get Schools Cooking grant valued at $128,000. The assessment portion of the grant will be conducted September 24th - 28th by school nutrition experts, Chef Ann Cooper, Beth Collins, and Loreen Farrell.

Executive Summary:

This proposed policy is updated to reflect NEW LAW (SB 751) that amended Section 42127.01 of the California Education code.

In a fiscal year immediately after a fiscal year in which the amount of moneys in the Public School System Stabilization Account is equal to or exceeds 3 percent of the combined total of General Fund revenues appropriated for school districts pursuant to subdivision (c) of Section 41202 and allocated local proceeds of taxes pursuant to subdivision (g) of Section 41202 for that fiscal year, a school district budget that is adopted or revised pursuant to Section 42127 shall not contain a combined assigned or unassigned ending general fund balance that is in excess of 10 percent of those funds.

We propose this change to the policy even though this section of the law does not apply to a basic aid school district or a small school district with less than 2,501 units of average daily attendance.

This version of the policy also removes language that addresses board action on estimated accrued but unfunded cost of workers’ compensation claims.

Proposed Board Policy BP 3100: Budget Business and Noninstructional Operations The Board of Trustees recognizes its critical responsibility for adopting a sound budget each fiscal year which is aligned with the district's vision, goals, priorities, local control and accountability plan (LCAP), and other comprehensive plans. The district budget shall guide decisions and actions throughout the year and shall serve as a tool for monitoring the fiscal health of the district. 15440-15451) The district budget shall provide for increasing or improving services for unduplicated students at least in proportion to the increase in funds apportioned on the basis of the number and concentration of unduplicated students in accordance with 5 CCR 15496. Unduplicated students are students who are eligible for free or reduced-price meals, English learners, and/or foster youth. 4. Assigned fund balance includes amounts which are intended for a specific purpose but do not meet the criteria to be classified as restricted or committed. The Board delegates authority to assign funds to the assigned fund balance to the Superintendent and authorizes the assignment of such funds to be made any time prior to the issuance of the financial statements. The Superintendent may further delegate the authority to assign funds at his/her discretion. 5. Unassigned fund balance includes amounts that are available for any purpose. When multiple types of funds are available for an expenditure, the district shall first utilize funds from the restricted fund balance as appropriate, then from the committed fund balance, then from the assigned fund balance, and lastly from the unassigned fund balance. Reserve Balance The district budget shall include a minimum reserve balance for economic uncertainties that is consistent with the percentage or amount specified in 5 CCR 15450. In any year that the district is notified by the Superintendent of Public Instruction that the amount of monies in the state Public School System Stabilization Account equals or exceeds three percent of the combined total of general fund revenues appropriated for school districts and allocated local proceeds of taxes, the district budget shall not contain a combined assigned or unassigned ending general fund balance that is in excess of 10 percent of these funds. Executive Summary: Websites for the Goleta Union School District (GUSD) and all the school sites are all managed internally by various people using WordPress software. As a result, there is very little consistency and keeping up with website ADA requirements remains a challenge. District IT staff has received several proposals from website design management companies that focus on schools to come up with a solution that would update our technology and websites to meet all ADA requirements, provide consistency across the District, and allow for ease of management and support. We have narrowed our search down to a preferred provider and would like to discuss the move forward with the project to upgrade our web presence throughout the district. Attachment:

Update on City of Goleta Funding for Crossing Guards Consent Item Action Item X Information Item

Executive Summary: For several years the City of Goleta has supported the District with an annual grant of $20,000.00 toward the cost of providing crossing guards for students attending schools within the Goleta city limits; Brandon, Ellwood, Kellogg, and La Patera. Last year, 2017-2018, the Board approved a Memorandum of Understanding between GUSD and the City of Goleta that formalized this financial support. For 2018-2019 GUSD has had to enter into a competitive community grant process with other local agencies for the funding. A letter has been written, documentation has been submitted and a presentation made to the grant committee. The decision originally scheduled for the September 8 meeting of the Goleta City Council has been delayed to the meeting on October 2, so we are still awaiting the final resolution on the funds. The total cost for crossing guards at the four schools is projected to be $43,000 for the 2018-2019 school year.

Executive Summary: This Memorandum of Understanding (MOU) between GUSD and United Parents/Padres Unidos (UPPU) is for parent education programming presented in Spanish. Coordinating funding support with Santa Barbara Unified School District, GUSD parents will have the opportunity to participate in: one10-week program, The Parent Project, that targets skills and strategies for parents of adolescent and pre-adolescent children; one ten-week program, Padres Adelante, to develop leadership skills, and increase the quality of parent engagement and involvement in the decision-making process with the express goal of increasing student academic achievement; and, one five-week computer course. The Computer course and the Parent Project Workshop will be held at Goleta Valley Community center, and the Padres Adelante Workshop will be held at Goleta Valley Junior High. Childcare and dinner are included. The total cost to Goleta Union School District for this parent outreach is $5,334.00. The programs outlined above are available free of charge to parents in all GUSD schools, Goleta Valley Junior High School (GVJHS) and Dos Pueblos High School (DPHS). GUSD will fund through a combination of LCAP funding, Title1Funding, and centralized District funding support. M.UPPUwillconductafive-weekbasiccomputercourseforparentsofGUSD,GVJH,andDPHSinSpanish,tobeheldattheGoletaValleyCommunityCenter.TheagreedcosttoGUSDis$234.1.IfthisAgreementisterminatedbeforeUPPUcompletesthe10-weekPadresAdelantecoursepursuanttoparagraph5,thenUPPUwillbepaid$90foreachclasssessionithassatisfactorilycompletedpriortothisAgreementbeingterminated.

2.IfthisAgreementisterminatedbeforeUPPUcompletesthe5-weekbasiccomputercoursepursuanttoparagraph5,thenUPPUwillbepaid$46.80foreachclasssessionithassatisfactorilycompletedpriortothisAgreementbeingterminated.

5.DuringthetermofthisAgreement,GUSDmightprovideUPPU,andUPPUmightprovidetoGUSD,withcertainproprietarybusinessortechnicalinformationorotherconfidentialmaterials(“ConfidentialInformation”).Exceptasrequiredbylaw,andprovidedthatallsuchwritteninformationormaterialsareclearlymarked“Confidential”,andprovidedthatalloraldisclosuresofsuchinformationormaterialsarereducedtoawritingclearlymarked“Confidential”thatisprovidedtotherespectivepartywithinthirty(30)daysofsuchoraldisclosure,InformationandmaterialsdisclosedbyGUSDorbyUPPU,willnotbeconsideredConfidentialInformationwhensuchinformationormaterials:(1)arenowpublicknowledgeorsubsequentlybecomesuchthroughnobreachofthisAgreement;(2)arerightfullyinUPPU’sorGUSD’spossessionpriortoDPHS’sorUPPU’sdisclosureasshownbywrittenrecords;(3)arerightfullydisclosedtoUPPUortoGUSDbyathirdparty;or,(4)areindependentlydevelopedbyorforUPPUorGUSDwithoutrelianceuponconfidentialinformationreceivedbyGUSDorUPPU.UPPUandGUSDherebyagreethatthereportswillnotbeconsideredConfidentialInformation.UPPUandGUSDwillholdsuchConfidentialinformationandmaterialsinconfidenceandeachherebyagreestousereasonableeffortstopreventitsdisclosuretothirdparties.GUSDacknowledgesandagreesthatGUSDwillprovideConfidentialInformationonlytotheUPPUExecutiveDirector.TheobligationssetforthinthisArticle11shallcontinueineffectforthree(3)yearsaftertheexpirationortheterminationofthisAgreement.6.Thetotalamountoftheaboveservicesis$5,334.EitherGUSDorUPPUmayterminatethisAgreementwithoutcauseandwithoutliabilitytothenon-terminatingpartybygivingatleastthirty(30)days’writtennoticetotheotherparty.

AFFILIATION AGREEMENT This Agreement, made and entered into this day, September 19, 2018, by and between Goleta Union School District hereinafter referred to as “AGENCY” and the Trustees of The California State University, California Polytechnic State University, San Luis Obispo, hereinafter referred to as “UNIVERSITY.”

WITNESSETH WHEREAS, it is agreed by the parties to be of mutual interest and advantage that students and faculty of the UNIVERSITY be given the opportunity to utilize AGENCY for Field Work/Internship purposes; NOW, THEREFORE, for and in consideration of the foregoing and in further consideration of the mutual benefits, the parties to this Agreement agree as follows: 1. The AGENCY will permit students of the UNIVERSITY to obtain Direct Field Work experience at the

AGENCY as mutually agreed upon between the parties under the direct supervision and responsibility of the faculty of the UNIVERSITY. In all instances, the UNIVERSITY will be responsible for the training students receive.

2. The period of assignment of students during each period, and distribution of students between areas of the

AGENCY will be mutually agreed upon between the UNIVERSITY and the AGENCY at the beginning of each training period.

3. The UNIVERSITY will not discriminate against any applicant for enrollment in its course of study because

of race, creed, sex, religion or national origin. The UNIVERSITY and its faculty accept full responsibility for the students’ learning activities.

4. The UNIVERSITY shall make every reasonable effort to ensure that all of their students and faculty

members comply with the policies, procedures and rules and regulations of the AGENCY and that their students and faculty members respect the confidential nature of all information which may come to them with respect to the AGENCY’S records.

5. The AGENCY may request the UNIVERSITY to withdraw from the AGENCY any student whose

performance is unsatisfactory or whose characteristics and activities are detrimental to the AGENCY in carrying out its responsibilities.

6. The UNIVERSITY shall inform students that they will be personally responsible for the cost of equipment

that is broken, damaged or lost due to any negligence on the part of the student. 7. The State of California will save harmless and indemnify the AGENCY against all claims, demands, suits,

judgments, expenses and costs of any and every kind, insofar as it may legally do so and subject to the availability of funds, on the account of the injury to or death of persons or loss of or damage to property arising in any manner out of this agreement.

8. The UNIVERSITY certifies as an agency of the State that it is insured through a self-insurance program.

Certification of self-insurance providing protection for the overall tort liability of the State, its officers and employees acting in the course and scope of employment, will be provided to the AGENCY upon request.

9. The AGENCY further agrees as follows:

a) to provide the UNIVERSITY necessary space of facilities or conference and classroom areas for student teaching as available;

b) to provide lounge and locker space for students as available;

c) to allow students and faculty members of the UNIVERSITY to utilize the AGENCY’S eating facilities at the student’s and faculty’s sole expense;

d) to make available areas for student’s training including the necessary equipment and supplies; e) to provide First Aid treatment for students or faculty members who are injured or become ill while at

the AGENCY; f) to encourage the faculty and students to participate in the AGENCY’S new employee orientation

program, if available. This program should provide information regarding AGENCY policies, rules and regulations, and facilities.

10. The AGENCY shall indemnify and hold harmless the University and its trustees, officers, employees and

volunteers from and against all claims, damages, losses and expenses including attorney fees arising out of the performance of the work described herein, caused in whole or in part by any negligent act or omission of the AGENCY, any subcontractor, anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable, except where caused by the active negligence, sole negligence, or willful misconduct of the University and its trustees, officers, employees and volunteers.

11. It is understood between the parties that under no circumstances is any member of the UNIVERSITY

student body or faculty to be considered agent or employee of the AGENCY. It is understood between both parties that the student participating in this Agreement is to be considered a volunteer of the AGENCY.

12. This agreement is for the term September 1, 2018 through August 31, 2023, unless terminated by

Executive Summary:

This Memorandum of Understanding is between the partnering district/charter school of the Santa Barbara County Teacher Induction Program (TIP) and the Santa Barbara County Education Office (SBCEO). this Induction program is designed to support new teacher development and growth in the profession by building on the knowledge and skills gained during the Preliminary Preparation program to implement a robust mentoring system that helps each participant work to meet the California Standards for the Teaching Profession. Research indicates such programs can improve teacher performance, satisfaction, and retention. GUSD currently has eight (8) qualifying candidates at a program cost of $2,500 per candidate. An additional $1,500 per candidate is allocated to mentors as a stipend. Attachment:

NATIONAL UNIVERSITY

STUDENT TEACHING AND PRACTICUM AGREEMENT

This agreement, effective on August 17, 2018, made by and between National University, a

California non-profit public benefit corporation (the "University”) and Goleta Union

Elementary School District a public entity (the "District”), with reference to the following

facts:

ARTICLE 1

RECITALS

1.1 Section 35160 of the California Education Code provides that the governing board of

any school district may initiate and carry on any program or activity, or may otherwise act in

any manner which is not in conflict with, or inconsistent with, or pre-empted by, any law and

which is not in conflict with the purposes for which school districts are established.

1.2 An agreement by a school district to provide student teaching or practicum experience

to students enrolled in an education credential program offered by an institution of higher

education approved by the California Commission on Teacher Credentialing (the

"Commission") is not inconsistent with the purposes for which schools districts are

established.

1.3 The University is accredited by the Western Association of Schools and Colleges, and

its education credential programs have been approved by the Commission.

1.4 The University desires that the District provide student teaching to students enrolled

in the University's teacher training curricula and/or practicum experience to students

enrolled in the University's student counseling and other credential curricula. The District

agrees to provide such student teaching and/or practicum experience on the terms and

conditions specified in this Agreement.

ARTICLES 2

DEFINITIONS

2.1 "Student" shall refer to a student enrolled in a program at the University which is

approved by the commission and which leads to an education credential

2.2 "Master Teacher" shall refer to an employee of the District holding a valid, clear

teaching credential issued by the Commission typically with three or more years teaching

experience.

2.3 "Student Teaching" shall refer to the active participation by a Student in the duties

and functions of classroom teaching under the direct supervision and instruction of one or

more Master Teachers.

2.4 "Student Teaching Assignment" shall typically refer to a full day of Student Teaching,

five days a week for 12 to 18 weeks, dependent upon program. Student Teaching

Assignments shall satisfy all requirements of the Commission.

2.5 "Practicum Supervisor" shall refer to an employee of the District holding a valid Pupil

Personnel Services or other credential issued by the Commission or equivalent certification

recognized by the District typically with three or more years experience as a school counselor,

school psychologist, school social worker, or other education specialist.

2.6 "Practicum" shall refer to the participation by a Student in the duties and functions of

a school counselor, school psychologist, school social worker, or school attendance worker

under the direct supervision and instruction of one or more Practicum Supervisors.

2.7 "Practicum Assignment" shall consist of between 90 and 600 hours of Practicum

depending upon the specific program requirements.

2.8 "Quarter Unit" shall refer to the amount of academic credit earned by a Student

through the successful completion as determined by the University of approximately 25

hours of Student Teaching or between 20 to 40 hours of Practicum.

2.9 School Site-employed supervisors must complete an orientation to the program’s

expectations to be knowledgeable regarding program curriculum and assessments, including

the TPEs and the California Teaching Performance Assessment (CAL TPA). School Site

employed supervisors are required to complete a minimum of 10 hours of initial orientation

provided through National University on the program curriculum, effective supervision

approaches such as cognitive coaching, adult learning theory, and current content-specific

pedagogy and instructional practices, program curriculum and assessments, including the

TPEs and the CAL TPA.

2.10 School Site with Student Teachers must have a fully qualified administrator.

2.11 University may request use of video capture for candidate reflection and CAL TPA

completion to reflect to the extent possible Student Teacher’s knowledge, skills, and abilities

to instruct TK-12 students while meeting state-adopted academic standards for their

program. School Site shall inform Credential Student Teachers of video recording policies in

place for the CAL TPA task video capture requirement.

ARTICLE 3

TERMS AND CONDITIONS

3.1 Student Teaching or Practicum. The District shall provide University students

with Student Teaching and/or Practicum in schools and classes of the District under the

direct supervision and instruction of a Master Teacher or Practicum Supervisor. The

University and the District from time to time shall agree as to the number of students

assigned to the District for Student Teaching and/or Practicum.

3.2 District Determination. The District at their sole discretion may refuse to accept, or

may terminate, any Student assigned to the District for Student Teaching or Practicum

based upon its good faith determination that the Student is not performing to the standards

of the District. Upon written notification by the District, the University shall promptly

terminate the Student's assignment to the District.

3.3 University Determination. The University shall determine the number of units of

Student Teaching or Practicum each Student shall receive. Students shall be able to be

eligible for more than one Student Teaching Assignment and/or Practicum Assignment at the

District.

3.4 District Reimbursement. University shall reimburse the District for supervision of

Student Teaching or Practicum at the completion of each semester or quarter, based on the

number of units earned by the student teacher or by a predetermined amount. The

university determines the rate, as set forth in “Exhibit A”. The University will make such

payment directly to the District. District acknowledges University Payment to Master

Teachers depends on the length of supervision where long and/or short assignments are

assessed on a pro-rated basis, as set forth in “Exhibit A”. District shall submit an invoice

based on generated report received from the University Honorarium Specialist. Stipend

paid to Master Teachers is based on the amount set forth in “Exhibit A” for supervision of

University Student Teachers. The total stipend amount for supervision per student shall

not exceed six hundred ($600). Upon receipt of invoice correlating to the University’s

Honorarium Specialist report, University shall pay the District at earliest convenience

following the date the District’s invoice is received.

3.5 Insurance. The District will obtain and maintain a broad form commercial general

liability insurance policy with coverage of at least $1,000,000 (one million) for each

occurrence and $2,000,000 (two million) in the aggregate, with no exclusion for molestation

or abuse. The District will provide the University with proof of such insurance upon

execution of this Agreement. For purposes of this Agreement, each of the District and the

University will provide workers’ compensation insurance coverage for their own employees,

and Students are not employees of either the District or the University.

University agrees to maintain at least $1,000,000 (one million) per occurrence and

$2,000,000 (two million) in General Aggregate Liability Insurance coverage, with no

exclusion for molestation or abuse. University agrees to provide District with a Certificate

of Insurance including an Endorsement/Additional Covered Party Amendatory

Endorsement/Additional Insured naming Goleta Union Elementary School District as an

additional insured party in conjunction with this Student Teaching and Practicum

Agreement.

University agrees that all Students are not employees of the District and are not entitled to

benefits of any kind or nature normally provided employees of the District and/or to which

employees are normally entitled, including but not limited to, State Unemployment

Compensation or Workers' Compensation. Students’ primary coverage for Student injuries

shall be Students’ personal medical insurance.

3.6 Termination of Assignment. In the event a Student Teaching Assignment or

Practicum Assignment is terminated before it is completed, the District shall receive

reimbursement of costs at the rate provided in Article 3.4 pro-rated to the nearest completed

Quarter Unit.

3.7 Representations. The University represents that all Students assigned to the District

for Student Teaching or Practicum are validly enrolled in a University credential program

approved by the Commission. The University makes no other representation, express or

implied, about, or assumes any responsibility for, the Student's fitness or qualification to

participate in the Student Teaching or Practicum. Nothing in this Agreement shall be

construed as a delegation by the District to the University of any of the District’s duties and

responsibilities for operation or supervision of the schools or classes of the District.

3.8 Certificate of Clearance. In accordance with California Education Code Section

44320, each credential candidate prior to assignment to District must obtain at their sole

expense a “Certificate of Clearance,” which includes a complete Live Scan Service. The

University will ensure that student’s receive a Certificate prior to beginning their

assignment in the district or hold a valid document issued by the CTC accounting for

fingerprint clearance.

3.9 Tuberculosis Clearance. In accordance with California Education Code Section

49406, each credential candidate prior to assignment to District must obtain at the

candidate’s sole expense an examination by a licensed physician or surgeon within the past

60 days to determine that he or she is free of active tuberculosis, prior to beginning the

candidate’s assignment in the District.

3.10 Video Assessment. District and University agree the use of video recording

equipment on any District property, including but not limited to, District classrooms, is

solely for the purpose of assessing student teachers as part of the credentialing process.

The District shall provide University Site Support Providers with any or all applicable

rules, regulations, and instructions relating to the assessment of student teachers. The

University and District agree no video recording of any student teacher will occur without

prior written notification of the name of the student teacher as well as date, time, and

location of the video recording to the principal of the school where the video recording is to

take place. Principal of the school within the District shall provide written approval of said

recording; subject to the parent/guardian authorizations set forth in section 3.12 of this

agreement.

3.11 Control, Supervision, Evaluation of Video Recording. The control, supervision,

evaluation, and/or direction of all student teachers and any other University personnel in

connection with the assessment of the student teachers, including, but not limited to, all

classroom video recording of the student teachers, shall be at the University’s sole

discretion.

The University and District agree no video recording of any District student shall be

permitted to occur without the express written approval and authorization from the

students’ parent/guardian.

3.12 Confidentiality of Student Records. For purposes of this Agreement and any

University Program Agreement, pursuant to the Family Educational Rights and Privacy

Act of 1974 (FERPA), University designates District and its Facilities/Educational Sites as

having a legitimate educational interest in the educational records of any student who

participates in the Student Teaching and Practicum experience to the extent that access to

the records is required by District programs or facilities to which the student is assigned to

carry out the relevant educational experience. District and its organizational components

(i.e., programs) agree to maintain the confidentiality of each Student’s educational record

in accordance with the provisions of FERPA.

3.13 Confidentiality of District Pupil Records. No Student will have access to or have the

right to receive any District pupil records, except to the extent necessary in the regular

course of assisting in providing services to pupils as part of the Student Teaching or

Practicum experience. The discussion, transmission, or narration in any form by Students

of any individually identifiable pupil information, educational, medical or otherwise, which

is obtained in the course of the Student Teaching or Practicum experience, is forbidden

except as a necessary part of the practical experience. To the extent a Student is given

access, they are subject to the privacy regulations outlined in the Family Educational

Rights and Privacy Act, 20 U.S.C. § 1232g; 34 C.F.R. Part 99, as amended (“FERPA”).

Otherwise, Students shall use de-identified information only (and not personally

identifiable pupil information) in any discussions about the Student Teaching or Practicum

experience with University, its employees, agents or others.

3.14 Publicity. Neither University nor District shall cause to be published or

disseminated any advertising materials, either printed or electronically transmitted, which

identifies the other party or its facilities with respect to this Agreement, without the prior

written consent of the other party. In addition, neither party may use the names, logos, or

trademarks of the other party without its prior written consent.

ARTICLE 4

GENERAL PROVISIONS

4.1 Term. This Agreement shall commence as of the date hereof and shall continue until

such time as either party gives the other party 30 days’ written notice of its intent to

terminate the Agreement. The termination of the Agreement shall be effective upon the date

specified in such written notice. Provided, however, all Students receiving Student Teaching

or Practicum from the District as of the date of such notice shall be permitted to complete

their Student Teaching Assignment or Practicum Assignment so long as said student is not

the cause of the termination of the agreement.

4.2 Attorney’s Fees. In the event any party hereto commences litigation for the

interpretation, specific performance, or damages for the breach of this Agreement, the

prevailing party shall be entitled to a judgment or award against the other in an amount

equal to reasonable attorney's fees and expenses incurred, together with all other appropriate

legal or equitable relief.

4.3 Notices. All notices, demands, or other communications given under this Agreement

shall be in writing and shall be deemed to have been duly given as of the second business day

after mailing by United States mail, postage pre-paid addressed to the addresses on page

four hereof, or to such other address or to such other person as any party hereto shall

designate to the other for such purposes in the manner hereinabove set forth. Personal

delivery of such notice, demand, or communication may also be made to the above-described

addressees and shall be deemed given as of the date of such delivery.

4.4 Integration Clause. This Agreement contains the entire agreement between the

parties relating to the transactions contemplated hereby and all prior or contemporaneous

agreements, understandings, representations, and statements, whether oral or written, are

merged herein. No modification, waiver, amendment, discharge, or change to the Agreement

shall be valid unless the same is in writing and signed by the party against which the

enforcement of such modification, waiver, amendment, discharge, or change is or may be

sought.

4.5 General Provisions. This Agreement (i) shall be binding upon and inure to the benefit

and be enforceable by the parties hereto and their respective legal representatives,

successors, or assigns, (ii) may be executed in any number of counter-parts, each of which

may be deemed to be an original, but all of which together shall constitute one and the same

instrument, (iii) shall be construed and enforced in accordance with the laws of the State of

California, and (iv) has been executed at San Diego, California as of the last date set forth

below.

4.6 Mutual Indemnification. University shall defend, indemnify and hold District, its

Board, officers, employees, agents, and volunteers harmless from and against any and all

liability, loss, expense (including reasonable attorneys’ fees) or claims for injury or

damages arising out of the performance of this Agreement but only in proportion to and to

the extent such liability, loss, expense, attorneys’ fees, or claims for injury or damages are

caused by or result from the negligent or intentional acts or omissions of University its

Board, officers, agents, or students.

District shall defend, indemnify and hold University, its Board, its officers, employees and

agents harmless from and against any and all liability, loss, expense (including reasonable

attorney’s fees) or claims for injury or damages arising out of the performance of this

Agreement but only in proportion to and to the extent such liability, loss, expense,

4.7 Arbitration. In the event of any dispute, claim, question, or disagreement arising

from or relating to this agreement or the breach thereof, the parties hereto shall use their

best efforts to settle the dispute, claim, question, or disagreement. To this effect, they shall

consult and negotiate with each other in good faith and, recognizing their mutual interests,

attempt to reach a just and equitable solution satisfactory to both parties. If they do not

reach such solution within a period of 60 days, then, upon notice by either party to the

other, all disputes, claims, questions, or differences shall be finally settled by arbitration

administered by the American Arbitration Association in accordance with the provisions of

its Commercial Arbitration Rules.

SUPERVISED INTERNSHIP AGREEMENT

Please check below all the applicable supervised fieldwork in which in your District will be participating with Brandman University Santa Maria Campus.

SCHOOL PSYCHOLOGY EDUCATION ADMINISTRATION x SCHOOL COUNSELING

THIS AGREEMENT is made and entered into by and between Brandman University hereinafter called the "UNIVERSITY," and the Goleta Union School District, hereinafter called "FIELDWORK SITE." WHEREAS, an INTERN, as defined in Appendix A, is required to enroll in education courses while serving under the supervision of experienced UNIVERSITY and FIELDWORK SITE professionals, during which time the INTERN shall hold an internship credential granted by the California Commission on Teacher Credentialing, (hereinafter the “COMMISSION”). I. RESPONSIBILITIES OF THE UNIVERSITY

A. The UNIVERSITY will assure that the student shall have completed the necessary educational prerequisites, if so required, to be eligible for supervised fieldwork.

B. The UNIVERSITY shall designate a faculty or staff member to coordinate, consult, and

collaborate with the classroom teacher or district designee of the FIELDWORK SITE, the activities of each student assigned to FIELDWORK SITE and student fieldwork experience.

C. The UNIVERSITY shall complete periodic observations and/or evaluations of the student

regarding his/her performance at the FIELDWORK SITE as per arrangement between the UNIVERSITY faculty or staff member and the FIELDWORK SITE supervisor.

II. RESPONSIBILITIES OF THE FIELDWORK SITE

A. The FIELDWORK SITE shall provide field experiences in such schools or classes of the

FIELDWORK SITE and under the direct supervision and instruction of such employees of the FIELDWORK SITE, as specified by the duly authorized representatives of the FIELDWORK SITE and the UNIVERSITY.

B. The FIELDWORK SITE shall provide students with experiences with a student population that is

diverse in terms of ethnicity, culture, language, socio-economics and/or special needs. C. The FIELDWORK SITE staff will promptly and thoroughly investigate any complaint by any

participating student of unlawful discrimination or harassment at the FIELDWORK SITE or

involving employees or agents of the FIELDWORK SITE, take prompt and effective remedial action when discrimination or harassment is found to have occurred, and promptly notify the UNIVERSITY of the existence and outcome of any complaint of harassment by, against, or involving any participating student.

D. To notify the UNIVERSITY of any change in its personnel, operation, or policies which may affect

the field education experience. E. Comply with all federal, state and local statutes and regulations applicable to the operation of the

program, including without limitation, laws relating to the confidentiality of student records. F. The FIELDWORK SITE staff shall comply with APPENDIX B regarding the FIELDWORK SITE’s

supervision of UNIVERSITY students. G. The FIELDWORK SITE acknowledges that each INTERN under this Agreement shall be a paid

employee of the FIELDWORK SITE and thus covered under the FIELDWORK SITE’S insurance policies, including Workers’ Compensation, to the extent available to other teachers. No intern shall be considered an employee or agent of Brandman University while performing services for the District.

III. THE PARTIES MUTUALLY AGREE

A. Neither party shall discriminate in the assignment of INTERNS on the basis of race, color, disability, gender, religion, national origin, ancestry, sexual orientation, or any other basis prohibited by law.

B. Any failure of a party to enforce that party’s right under any provision of this Agreement shall not

be construed or act as a waiver of said party’s subsequent right to enforce any provisions contained herein.

C. Notices required or permitted to be provided under this Agreement shall be in writing and shall be

deemed to have been duly given if mailed first class to the parties that signed this agreement and to the addresses below.

D. If any term or provision of this Agreement is for any reason held to be invalid, such invalidity shall

not affect any other term or provision, and this Agreement shall be interpreted as if such term or provision had never been contained in this Agreement.

E. In the event of any material default under this Agreement, which default remains uncured for a

period of twenty-one (21) days after receipt of written notice of such default, or in the event of the loss of WASC accreditation by the UNIVERSITY, this Agreement may be immediately terminated by the non-defaulting party.

F. This Agreement fully supersedes any and all prior agreements or understandings between the

parties or any of their respective affiliates with respect to the subject matter hereof. No change, modification, addition, amendment, or supplement to this Agreement shall be valid unless set forth in writing and signed and dated by both parties hereto subsequent to the execution of this

Agreement. G. This Agreement shall be construed in accordance with the laws of the State of California in effect

at the time of the execution of this Agreement. Should either party institute legal action to enforce any obligation contained herein, it is agreed that the proper venue of such suit or action shall be Orange County, California.

IV. TERM AND TERMINATION OF AGREEMENT

A. THE TERM of this Agreement shall be effective August 31, 2018 and shall continue in full force and effect through August 30, 2021. This Agreement may be renewed for one (1) additional term of the contract by mutual written consent of the parties.

B. THIS AGREEMENT may be terminated by either the UNIVERSITY or the FIELDWORK SITE with

or without cause upon thirty (30) days written notice provided that (subject to the other terms of this Agreement) all students performing fieldwork at the time of notice of termination are given the opportunity to complete their fieldwork at the Fieldwork Site.

Appendix A Definition of Internship

A. “INTERN” is defined according to the COMMISSION as a person who is enrolled in a COMMISSION-approved internship program and is serving with an Internship Credential issued upon the recommendation of the UNIVERSITY.

B. INTERNS shall not displace certificated FIELDWORK SITE employees. FIELDWORK SITE further

agrees to provide written certification that no person with the appropriate credential, background and qualifications is interested and/or available in the position that is the subject matter of this Agreement.

C. The internship may continue for a period of up to two years and the credential may be renewed upon

a showing of good cause. D. The internship program is being implemented in order to provide the INTERN with an opportunity to

gain field experience on a paid basis. In the event that the internship is being developed to meet an employment shortage, FIELDWORK SITE agrees to provide a statement regarding the availability of qualified, certificated individuals holding the appropriate credential.

E. The Internship Credential is issued for service only in the FIELDWORK SITE District and the

UNIVERSITY shall notify the COMMISSION of the FIELDWORK SITE’S participation.

Appendix B Specific Supervision Requirements for Each Program

School Counseling Fieldwork:

A. Provide an average of one (1) hour of individual or one-and-one-half (1.5) hours of small group supervision per week from an experienced school counselor with at least two years of professional experience.

B. Provide opportunities for students to gain a broad range of experiences, including experiences in:

a. Personal and career assessments b. Personal counseling experience in either an individual or group context c. Experience in School-based programs serving parents and family members d. Observing classroom instruction e. Attending district and school based meetings f. Mapping school-based community resources g. The candidate is to perform, under supervision, the functions of school counselors in

school counseling domains. h. Participating in professional development activities. i. Participating in individual or group supervision. j. Learning about and using technology and information systems. k. Learning about Individual differences and student diversity.

C. The FIELDWORK SITE shall provide activities that occur across at minimum of two of four

settings, including, (a) elementary, middle school or junior high, and (b) high school.

D. The FIELDWORK SITE in collaboration with the UNIVERSITY will designate one school counselor who has at least two years experience in school counseling to serve as the primary supervisor. The student may also work with other experienced school counselors for specific activities. In no case shall any supervisor be assigned by the FIELDWORK SITE to provide concurrent supervision for more than two interns or students.

E. The FIELDWORK SITE shall ensure that the student receives an average of one hour of

individual or one and one-half hours of group face-to-face supervision per week, although more time may be needed, especially at the beginning of the FIELDWORK experience.

F. The FIELDWORK SITE supervisor, in collaboration with the UNIVERSITY faculty, will complete at

least one written evaluation of the student's performance near the end of each university session.

G. The FIELDWORK SITE shall ensure that the student will be treated by the district as part of the professional staff and provided a supportive work environment, adequate supplies, counseling and test materials. In addition, it shall see that the student is encouraged to participate in district, SELPA, or county committees; and that he/she is provided release time as needed to attend professional development experiences or professional association meetings.

I. Specific Supervision Requirements School Psychology Fieldwork:

A. Provide an average of one (1) hour of individual or one-and-one-half (1.5) hours of small group

supervision per week from an experienced school psychologist with at least two years of professional experience.

B. Provide experiences with a diverse student population.

Executive Summary:

The Governing Board is required to adopt a conflict of interest code in compliance with Government Code 87300-87313. This agenda item presents a review of the revised Board Bylaw governing the District Conflict of Interest Code and the actual code presented in the attached exhibit.

Pursuant to Government Code 87303, the District's Conflict of Interest Code must be approved by the appropriate code reviewing body. For districts located entirely in one county, the code reviewing body is the board of supervisors of the county in which the district is located. Proposed Board Bylaw BB 9270: Conflict of Interest Board Bylaws The Board of Trustees desires to maintain the highest ethical standards and help ensure that decisions are made in the best interest of the district and the public. In accordance with law, Board members and designated employees shall disclose any conflict of interest and, as necessary, shall abstain from participating in the decision. (cf. 9005 - Governance Standards) The Board shall adopt a resolution that specifies the terms of the district's conflict of interest code, the district's designated positions, and the disclosure categories required for each position. Upon direction by the code reviewing body, the Board shall review the district's conflict of interest code and submit any changes to the code reviewing body. When a change in the district's conflict of interest code is necessitated due to changed circumstances, such as the creation of new designated positions, changes to the duties assigned to existing positions, amendments, or revisions, the amended code shall be submitted to the code reviewing body within 90 days. Conflict of Interest under the Political Reform Act A Board member or designated employee shall not make, participate in making, or in any way use or attempt to use his/her official position to influence a governmental decision in which he/she knows or has reason to know that he/she has a disqualifying conflict of interest. A conflict of interest exists if the decision will have a "reasonably foreseeable material financial effect" on one or more of the Board member's or designated employee's "economic interests, "unless the effect is indistinguishable from the effect on the public generally or the Board member's or designated employee's participation is legally required. (Government Code 87100, 87101, 87103; 2 CCR 18700-18709) A Board member or designated employee makes a governmental decision when, acting within the authority of his/her office or position, he/she votes on a matter, appoints a person, obligates or commits the district to any course of action, or enters into any contractual agreement on behalf of the district. (2 CCR 18702.1) A Board member who has a disqualifying conflict of interest on an agenda item that will be heard in an open meeting of the Board shall abstain from voting on the matter. (Government Code 1091) Even if there is not a prohibited conflict of interest, a Board member shall abstain from voting on personnel matters that uniquely affect his/her relatives. However, a Board member may vote on collective bargaining agreements and personnel matters that affect a class of employees to which his/her relative belongs. Relative means an adult who is related to the Board member by blood or affinity within the third degree, as determined by the common law, or an individual in an adoptive relationship within the third degree. (Education Code 35107) A relationship within the third degree includes an individual's parents, grandparents, great-grandparents, children, grandchildren, great-grandchildren, brothers, sisters, aunts, uncles, nieces, nephews, and the similar family of the individual's spouse/registered domestic partner unless the individual is widowed or divorced. Common Law Doctrine Against Conflict of Interest A Board member shall abstain from any official action in which his/her private or personal interest may conflict with his/her official duties. Rule of Necessity or Legally Required Participation On a case-by-case basis and upon advice of legal counsel, a Board member with a financial interest in a contract may participate in the making of the contract if the rule of necessity or legally required participation applies pursuant to Government Code 87101 and 2 CCR 18708. Proposed Exhibit E 9270: Conflict of Interest Board Bylaws RESOLUTION ADOPTING A CONFLICT OF INTEREST CODE WHEREAS, the Political Reform Act, Government Code 87300-87313, requires each public agency in California to adopt a conflict of interest code; and WHEREAS, the Governing Board of the Goleta Union School District has previously adopted a local conflict of interest code; and WHEREAS, past and future amendments to the Political Reform Act and implementing regulations may require conforming amendments to be made to the district's conflict of interest code; and WHEREAS, a regulation adopted by the Fair Political Practices Commission, 2 CCR 18730, provides that incorporation by reference of the terms of that regulation, along with an agency-specific appendix designating positions and disclosure categories shall constitute the adoption and amendment of a conflict of interest code in conformance with Government Code 87300 and 87306; and WHEREAS, the Goleta Union School District has recently reviewed its positions, and the duties of each position, and has determined that (changes/no changes) to the current conflict of interest code are necessary; and WHEREAS, any earlier resolutions, bylaws, and/or appendices containing the district's conflict of interest code shall be rescinded and superseded by this resolution and Appendix; and NOW THEREFORE BE IT RESOLVED that the Goleta Union School District Governing Board adopts the following Conflict of Interest Code including its Appendix of Designated Employees and Disclosure Categories. MINUTES OF REGULAR BOARD MEETING

1. CALL TO ORDER Board President, Carin Ezal called the meeting to order at 3:02 pm.

2. ORGANIZATIONAL BUSINESS

a. Call to Order President Carin Ezal called a regular meeting of the Board of Trustees of the Goleta Union

School District to order at 3:02 p.m., at the Jack Kramer Administration Center, 401 N. Fairview Avenue, Goleta. b. Roll Call – Present were board members Susan Epstein, Sholeh Jahangir, Carin Ezal, and Luz

Reyes-Martin. Richard Mayer was absent. c. The Pledge of Allegiance was led by Sholeh Jahangir, Clerk. d. President Ezal welcomed guests to the meeting and reminded the audience that the meeting

was being recorded.

3. APPROVAL OF THE AGENDA The Agenda for September 5, 2018 was approved with a motion by Susan Epstein and a second by Luz Reyes-Martin. Approved by a vote of Ayes - 4, Nays – 0, Abstain – 0, Absent – 1.

4. PUBLIC COMMENT GUSD Teacher and UTPG President, Sheri Scott welcomed board and cabinet to a new school year and reported that certificated staff were pleased with the smooth opening. They also felt they were treated very professionally and the trainings were engaging with the time well spent. Ms. Scott also thanked Assistant Superintendent David Simmons, for including the union representatives in the new teacher orientation meetings. Isla Vista parents, Kelly Hildner and Vicki Ben-Yaacov, both addressed the board with their concerns of food waste, reduction of plastic, one-time use utensils and trays in school lunch programs.

5. BOARD COMMITTEE REPORTS Luz Reyes-Martin attended the flagpole ceremony at Kellogg School where she met Bailey the Bulldog. Susan Epstein attended the Santa Barbara Foundation’s annual luncheon recognizing the Santa Barbara Woman and Man of the year in non-profit work. Sholeh Jahangir attended the back to school walk at Foothill School and Carin Ezal attended site visits on the first day of school with Dr. Lewis and Dr. Mayer. She also attended the Gifted Education Services parent meeting and thanked the board and cabinet for the changing of the board meeting time.

6. BOARD DISCUSSION – FOCUS ON DISTRICT VISION AND GOALS Dr. Lewis reviewed the Fall Superintendent Committee dates with the Board adding a new committee for NGSS – Next Generation Science Standards.

7. PRESENTATION/DISCUSSION/INFORMATION ITEMS a. Facilities Update: Conrad L. Tedeschi, Assistant Superintendent, Fiscal Services, briefed the

board about ongoing facilities projects and items of interest: 1) County request for disaster dumping sites update, 2) July water bills – drought surcharges, 3) Tree assessment – Safety.

b. Overview of GUSD CAASPP Results Presentation: Mary Kahn, Assistant Superintendent of Instructional Services shared a presentation of the latest district testing results.

c. First Reading of Revised Board Policy and Administrative Regulation 1312.3: Uniform Complaint Procedures. Dr. Margaret Saleh, Deputy Superintendent of Pupil Services, presented the revised board policy and administrative regulation 1312.3 to the board.

d. First Reading of Revised Board Policy and Administrative Regulation 5022: Student and Family Privacy Rights. Dr. Margaret Saleh, Deputy Superintendent of Pupil Services, presented the revised board policy and administrative regulation 5022 to the board.

The Board discussed and took action on the following items:

a. Approval of Award of RFP for Modernization – District-wide Phone System. Motion to approve the award of RFP for a new phone system was made by Susan Epstein and seconded by Sholeh Jahangir. The motion passes by a vote of Ayes - 4, Nays – 0, Abstain – 0, Absent – 1.

b. Adoption of Resolution 2018-16: The 2017-2018 and 2018-2019 Gann Limit. Motion to approve Resolution 2018-16 was made by Luz Reyes-Martin and seconded by Sholeh Jahangir. The motion passes by a vote of Ayes - 4, Nays – 0, Abstain – 0, Absent – 1.

c. Approval of the 2017-2018 Unaudited Actuals Financial Statements. Motion to approve the Unaudited Actuals Financial Statements was made by Sholeh Jahangir and seconded by Luz Reyes-Martin. The motion passes by a vote of Ayes - 4, Nays – 0, Abstain – 0, Absent – 1.

d. Approval of Memorandum of Understanding with Explore Ecology to Provide Garden Education Programs at All Schools. e. Approval of Reclassification of Job Description: Library Media Specialist (LMS). SUPERINTENDENT REPORTS Donna Lewis, Superintendent: • Reviewed future board agenda topics • Mentioned the calendaring of possible board workshops. • Reported that we have gained 17 students compared to the first day of school last year. • Thanked staff for getting schools ready for students return. • Shared that she toured every school on the first day with Board President, Carin Ezal, and Board Vice-President, Dr. Mayer. • Reported that all nine schools will have Back to School Night on Thursday, September 13. • Reminded everyone of the Lemon Run Fundraiser on Sunday, September 23. • Thanked Jeremiah Johnson and Maureen Ray for rolling out the new database system, Synergy, with our staff.

Dr. Margaret Saleh, Deputy Superintendent, Pupil Services: • Reviewed new staffing numbers for trainings. • Updated the progress on the Learning Tree playground renovation. • Shared that transfer requests will be decided on staffing day, Friday, September 7. • Attended the first of seven months of training for Judge of Teen Court. • Stated that she has visited all school sites over two days.

Conrad Tedeschi, Assistant Superintendent, Fiscal Services: • Shared that the Fiscal department closed the books. • Reported that a water main broke at Ellwood School yesterday, the water was shut off most of

the day and Marborg provided temporary restrooms. David Simmons, Assistant Superintendent, Human Resources:

• Shared that his department has been busy with new and returning staffing for the year and are still recruiting for more open positions. (16 Certificated and 48 Classified)

Mary Kahn, Assistant Superintendent, Instructional Services: • Held the initial professional learning set of modules for teachers. • Provided Synergy training, a Differentiation refresher for 2nd – 6th grades, a Tech refresher for K/1 and a refresher on English Language Development. • Presented a module on professional learning communities with the goal of aligning our work across sites. • Announced that the first district professional development day is tomorrow with Site leaders working on goals. • Stated that she has been working closely with our 3 new principals. • Shared that she has been working with Jeremiah and Maureen to roll out Synergy. • Reported that her department has worked very hard to provide textbooks and materials. • Mentioned that Library Media Specialists had the first of three days of professional development with Matt Zuchowicz from SBCEO.

• Expressed that the @Afterschool Coordinator is doing well. She is working on capacity building and working with her site leads and assistants. She has reported that we now have 3 staff at each site, and will possibly add El Camino as they are showing parent interest. • Attended the first Gifted Services Parent Advisory Committee meeting.

10. BOARD MEMBER REPORTS Luz Reyes-Martin: • Discussed possible Southern California Edison shutdowns.

Susan Epstein: • Explained that solar energy could run a back-up system. Sholeh Jahangir: • Shared that she logged on to the Synergy Parent Vue and felt it was user friendly. • Mentioned that she feels good energy at the schools, great start to the year. Richard Mayer: • Absent.

Executive Summary:

This Policy is updated to list all state and federal programs subject to the uniform complaint procedures (UCP) as specified in the Federal Program Monitoring instrument. It also reflects NEW LAW (AB 699), which includes immigration status as a prohibited basis for discrimination, and reflects NEW LAW (AB 365), which authorizes the use of UCP for alleged noncompliance with certain educational rights of children of military families. The Policy also is revised to clarify that, although complaints of employment discrimination are not subject to UCP, the district has an obligation to investigate such complaints using other district procedures. Regulation updated to reflect a requirement in AB 365 that the annual UCP notice include the educational rights of children of military families. Attachment: BP 1312.3 Proposed Document Fiscal Impact: None. Recommendation: It is recommended that the Board approve the Revised Board Policy 1312.3: Uniform Complaint Procedures.

Proposed Board Policy BP 1312.3: Uniform Complaint Procedures Community Relations The Board of Trustees recognizes that the district has the primary responsibility to ensure compliance with applicable state and federal laws and regulations governing educational programs. The Board encourages early resolution of complaints whenever possible. To resolve complaints which may require a more formal process, the Board adopts the uniform system of complaint processes specified in 5 CCR 4600-4670 and the accompanying administrative regulation. Complaints Subject to the Uniform Complaint Procedure (UCP) The district's uniform complaint procedures shall be used to investigate and resolve the following complaints: 1. 8. Any other complaint as specified in a district policy The Board recognizes that alternative dispute resolution (ADR) can, depending on the nature of the allegations, offer a process to reach a resolution to the complaint that is acceptable to all parties. ADR such as mediation may be offered to resolve complaints that involve more than one student and no adult. However, mediation shall not be offered or used to resolve any complaint involving sexual assault or where there is a reasonable risk that a party to the mediation would feel compelled to participate. The Superintendent or designee shall ensure that the use of ADR is consistent with state and federal laws and regulations. The district shall protect all complainants from retaliation. In investigating complaints, the confidentiality of the parties involved shall be protected as required by law. For any complaint alleging retaliation or unlawful discrimination (such as discriminatory harassment, intimidation, or bullying), the Superintendent or designee shall keep the identity of the complainant, and/or the subject of the complaint if he/she is different from the complainant, confidential when appropriate and as long as the integrity of the complaint process is maintained. The Superintendent or designee shall provide training to district staff to ensure awareness and knowledge of current law and related requirements, including the steps and timelines specified in this policy and the accompanying administrative regulation. Non-UCP Complaints The following complaints shall not be subject to the district's UCP but shall be referred to the specified agency: (5 CCR 4611) 1. Any complaint alleging child abuse or neglect shall be referred to the County Department of Social Services, the County Protective Services Division, and the appropriate law enforcement agency. (cf. 5141.4 - Child Abuse Prevention and Reporting) 2. Any complaint alleging health and safety violations by a child development program shall, for licensed facilities, be referred to Department of Social Services and shall, for licensing-exempt facilities, be referred to the appropriate Child Development regional administrator. 3. Any complaint alleging fraud shall be referred to the Legal, Audits and Compliance Branch of the California Department of Education. Any complaint alleging employment discrimination or harassment shall be investigated and resolved by the district in accordance with the procedures specified in AR 4030 - Nondiscrimination in Employment. Any complaint related to sufficiency of textbooks or instructional materials, emergency or urgent facilities conditions that pose a threat to the health or safety of students or staff, or teacher vacancies and misassignments shall be investigated and resolved in accordance with the procedures in AR 1312.4 - Williams Uniform Complaint Procedures. Executive Summary:

This Policy is updated to add options formerly in the Administrative Regulation regarding the disclosure of students' personal information for marketing purposes. The Policy also reflects state law which prohibits the collection of social security numbers or the last four digits of social security numbers for any purposes and NEW LAW (AB 699), which prohibits the collection of information regarding the citizenship or immigration status of students or their families. Proposed Board Policy BP 5022: Student And Family Privacy Rights Students The Board of Trustees respects the rights of district students and their parents/guardians with regard to the privacy of their personal beliefs and the confidentiality of their personal information. (cf. 5020 - Parent Rights and Responsibilities) (cf. 5021 - Noncustodial Parents) (cf. 5125 - Student Records) (cf. 5125.1 - Release of Directory Information) (cf. 6162.8 - Research) The Superintendent or designee may collect, disclose, or use students' personal information for the exclusive purpose of developing, evaluating, or providing educational products or services for or to students or educational institutions, such as the following: (20 USC 1232h) 1. Book clubs, magazines, and programs providing access to low-cost literary products 2. Curriculum and instructional materials used by elementary and secondary schools 3. The Superintendent or designee is prohibited from collecting, disclosing, or using a student's individually identifiable information, including his/her name, parent/guardian's name, home or other physical address, telephone number, or social security number, for the purpose of marketing or selling that information or providing the information to others for that purpose. The Superintendent or designee shall consult with parents/guardians regarding the development of regulations pertaining to other uses of personal information, which shall, at a minimum, address the following: (20 USC 1232h) 1. Arrangements for protecting student privacy when collecting, disclosing, or using students' individually identifiable information for any purpose 2. Arrangements to protect student privacy in the administration of surveys that may request information about the personal beliefs and practices of students and their families 3. The rights of parents/guardians to inspect the following, and any applicable procedures for granting reasonable access to the following in a reasonable period of time: a. Survey instruments requesting information about their personal beliefs and practices or those of their children b.
