Note 3.— In cases where the applicant does not fully meetthe medical requirements and in complicated and unusualcases, the evaluation may have to be deferred and the casesubmitted to the medical assessor of the Licensing Authorityfor final evaluation. In such cases due regard must be given tothe privileges granted by the licence applied for or held by theapplicant for the Medical Assessment, and the conditionsunder which the licence holder is going to exercise thoseprivileges in carrying out assigned duties.
Note 4.— Attention is called to the administrative clause in1.2.4.9 dealing with accredited medical conclusion.

If the Medical Standards prescribed inChapter 6 for a particular licence are not met,the appropriate Medical Assessment shall notbe issued or renewed unless the followingconditions are fulfilled:
a) accredited medical conclusion indicates that inspecial circumstances the applicant’s failure to meetany requirement, whether numerical or otherwise, issuch that exercise of the privileges of the licenceapplied for is not likely to jeopardize flight safety;
b) relevant ability, skill and experience of theapplicant and operational conditions have been givendue consideration; and
c) the licence is endorsed with any special limitationor limitations when the safe performance of thelicence holder’s duties is dependant on compliancewith such limitation or limitations

DEFINITIONS
Medical Examiner: A physician with training in AviationMedicine and practical knowledge and experience of theaviation environment, who is designated by the LicensingAuthority to conduct medical examinations of fitness ofapplicants for licences or ratings for which medicalrequirements are prescribed
Medical Examiners must be trained and shall also receiverefresher training in Aviation Medicine; Must demonstratecompetency before designation. Must have practicalknowledge and experience of the conditions in whichlicence holders carry out their duties
