Brief Description:-
The “Ganga Darshan Guest House” is located at near Bank of River
Ganga and centrally located at inside of Lard Shiva temple and heart of
city comprising of 38 double occupancy rooms and suit. The caretaking
cum house-keeping contractor is responsible to look after day to day
functioning of guest house around the clock for the esteemed guest of the
Guest House.

TENDER OPENING AND CLOSING DATE AND TIME: Those
firm/company, proprietorship firm who are interested may obtain tender

BID SECURITY/EMD:-2% amount of contract value (which will
be refundable after submission of performance security @ 10%
of contract value) in form of FDR/Bank guarantee.

GENERAL TERMS AND CONDITIONS:-
1. SCOPE OF WORK :
a. HOUSEKEEPING: To render all housekeeping and conservancy
services of highest standards befitting the status of Guest House.
b. CATERING SERVICES: To render food and beverage services of
highest standards and to extend special services as required by the
guest house Board.
c. SECURITY SERVICES: To provide security service, by detailing, by
uniformed Chowkidar.
d. LAUNDRY :To render laundry services of high standard for
furnishings and linens, and to render laundry services for staying
on chargeable basis at prevailing market rate.
e. General Administration: To co-ordinate with respective member of
guest house for smooth running of guest house and to maintain all
the records as required by the guest house BOARD.
f. Supervision: To Supervise the employees hired and deployed by the
tenderer and to supervise the quality of meal from time to time
including raw materials, and to supervise the quality of all meals
during special lunch or dinner including raw materials.
g. Manpower:
i. The contractor should deploy below indicated trained
manpower to provide good quality of services at GDGH Guest
House at his own cost. The below indicated manpower for
running of the Guest House round the clock in all the days
including Sundays & Holidays on shift basis should be
deployed at GDGH Guest House.

ii. The contractor and his deployed personnel at GDGH Guest
House together shall be responsible for performance of the
following duties:
(i) There are 38 rooms in total. Housekeeping and maintenance is to be carried out for 34 rooms and for 4 rooms that are reserved for Guest house Trust Board. Housekeeping shall also include kitchen, store room, reception, dining hall, common passages, terrace and the inside perimeter wall of guest house. All the 38 rooms have attached toilets, out of which 34 rooms will be for guest and remaining 4 rooms shall be reserved permanently for the Guest House Trust Board. All rooms have air conditioners, some of them have twin beds, and some have bed of double size. Ground floor has 4 rooms, a kitchen and store room, including a large hall (contractor must assess the ground floor to use for reception and waiting area, dining possibilities), and a common wash room. There are 8 rooms on each floor from 1st to 4th floor. Rooms on the fifth floor are part of the reserved rooms for Guest House Trust Board. Two rooms on 1st floor is also reserved for TRUSTEES. These floors are connected by a stair well and an elevator. Passage open to air is also available around the building. All the rooms shall always be kept neat and tidy to enable the contractor to allot them at any time.
(ii) The floors of all the room will be cleaned daily with
detergent chemical (eco friendly ) and will be kept clean all the time. Cleaning of the toilet commode / WC Pan wash basin and floor area with ‘Sanifresh’, harpic ,’ phenyl twice daily i.e. , morning and afternoon. Cleaning material like soap deodorant room freshenerlizolharpicodonil stick phenyl etc. (eco friendly cleaning material ) shall be purchased on requirement basis.

(iii) The contractor shall make beds and clean all the
room daily .the required number of linen & towels ( including all AC room) will be provided by the guest House trust board. The contractor has to do laundry work for bed linens, towels bed spreads blankets (dry clean ) pillow covers etc. , at his cost. The room should be well maintained. Housekeeping includes dusting of sofa set , television, Air conditioner, Furniture etc. , & removal of cobwebs.
(iv) Conservancy works includes sweeping mopping
collection and dumping of garbage /unwanted material in the designated dustbins inside as well as outside the compound guest house building once of day. Cleaning mopping and swabbing of room, corridors staircases and other constructed areas floors of guest house building twice a day. Removal of cobwebs from all the areas of guest house building on regular basis.
(v) the contractor should ensure security of the
fittings, fixtures, furniture, soft furnishings and other item available in the guest house. He should ensure cleaning of all furniture and furnishings including ceiling fans, pedestal fans, windows glass panes, electrical fittings Air Conditioner units daily. In case of any loss in any manner. The contractor shall replace them with the item of the equal quality .fridge, television washing machine and computer with accessories etc. , wherever provided shall also be dusted and cleaned without damaging them.
(vi) The contractor’s men shall take care of the wall
calendars , clocks, AC and TV remote , etc. provided in the guest house rooms and other place and ensure changing of batteries whenever and whenever required.
(vii) All the room are to be checked for bed , towel
soap water supply functioning of TV , Refrigerator Air conditioner geyser, light fitting bathroom fitting etc.

(viii) Bed tea will be provided in rooms on demand
from the guest staying in the room. Breakfast lunch and dinner for all will be served only in the dining hall (exempted in special Cases)
(ix) The contractor shall take order before hand
from the guests regarding their food requirements. The guest house trust will also place separate order on the contractor for any official programs/ function / special occasions.
(x) The contractor shall suitably display the menu
with detail and rates in the dining areas for the meals and breakfast .
(xi) Adequate paper napkins should be kept on the
dining table before commencement of meals for the convenience of the guests.
(xii) To provide Tea/ coffee/ Soft drinks breakfast lunch and dinner as per the requirement the guest/ occupants of the suites when allotted.
(xiii) Food and accommodation to the contractor men
will not be provided under this contract.
(xiv) Cooking shall be done in hygienic condition for which a trained cook should be detailed in all the shifts. The contractor shall detail presentable well-mannered and trained attendants.
(xv) Kitchen will always be kept clean in a spic and
span condition. Cutlery and crockery as well as cooking utensils will be kept spotless by cleaning with slandered scouring powder &scrubber,Cooks must turn out in clean hygienic condition and must be free from any diseases.
(xvi) Medical check-up should be carried out once in
six months and a medical certificate, as proof of the check is to be produced from AMA/ Regd. Medical practitioner. If in the opinion of the trust , any employee of the contractor is found to be suffering from any disease , the trust at its sole

discretion may ask the contractor to remove such employee without questioning the decision of the guest house trust board in this respect and trust will be entitled to restrict such employee from entering the premises.
(xvii) Required kitchen equipment crockery / cutlery
shall be provided by the contractor. The contractor is to ensure that the items are maintained properly at all time. The crockery / cutlery damaged or broken by the contractor staff shall be replaced by the contractor will crockery / cutlery of same quality immediately.
(xviii) Contractor has to serve the food as per the
prescribed menu approved by trust management. There will be no compromise on food quality. If there is any noncompliance of food quality of any item of the menu, the proportionate amount of that item will be deducted from the cost of the menu. It will be done on the basis of the food related complaints endorsed by the guests in food complaints register available with reception supervisor. After seeing the genuine of the complaints by the trust representative, necessary action will be taken in this regard.
(xix) The contractor has to follow the terms and
conditions strictly.
(xx) Obtaining the labor license before commencement of the contact work from the competent authority is the responsibility of the contractor , if engaged twenty or more than twenty workers.
(xxi) The contractor shall deploy his staff for the
contract works at his own risk and cost.
(xxii) Force Majeure :- Neither party shall bear responsibility for the complete or partialnon – performance of any of its obligations ( except for failure to pay any sum which has become due on account of receipt of goods / service under the provisions of the contract ) if the non-performance results from such force majeure circumstances as

flood , fire , earthquake and other acts of god , as well as war , military operation , blockade , acts or actions of state authorities or any others circumstances beyond the control of the parties that might arise after the conclusion of the contract.
(xxiii) The contractor shall extend EPF and ESIC
benefits as provided under the relevant laws to all his employees from the date of commencement of the contract. For the said purpose, the contractor shall get his establishment registered under the employee’s provident funds and miscellaneous provisions act 1952 directly with the appropriate regional provident fund commissioner. He shall also get himself registered with the employee’s state insurance corporation authorized.
(xxiv) The contractor shall be responsible for fulfilling
the requirement of all the statutory provision of minimum wages payment of bonus act, industrial disputes act contract labor (regulation and abolition) act and all other labour and industrial enactment at his own risk and cost in respect of all the workers and employed by him. The contractor shall keep up to date record required to be maintained under these stator enactment and authorized representative of guest house trust shall be entitled to inspect these record at any time.
(xxv) The contractor will not allow or permit his
employee to participate in any tradeunion activities or agitation in the guest house premises.
(xxvi) The contractor can not discontinue the work
without the consent of the guest house trust board. If the contractor is unable to continue the contact for any reason , he ie permitted to terminate the contract by giving minimum 3 month’s notice.

iii. The contractor shall exclusively manage catering arrangements like
supply of tea/snacks, meals, lunch, dinner etc. as and when
required by the guests at the specified rates fixed by the GDGH as
per price list Annexure-II. Personnel deployed should be well
mannered and well versed in cooking and preparation of food and
serve Indian food/tea/snacks etc. to the guests & collect the
approved rates only from the Guests/Visitors before they leave the
Guest House. Contractor will arrange all the food items which are
required in Guest House for serving the guest(s) and collect the
charges from guests.
iv. Raw materials like tea, coffee, masalas, ghee, refined oils (loose oil
shall not be used) and eatables like bread, butter jam etc. to be
served to the guests shall be fresh and of good quality and
manufactured by well-know manufactures. List of few branded
items have been mentioned at Annexure “III”.
v. A sample menu has been provided as per Annexure-II GDGH shall
in its discretion order for any of the menu. Note: No any non-veg
items are strictly prohibited in the guest house and if the
contractor found in such activity the contract shall be
terminated by C.E.O. of the trust.
2. ELIGIBILITY AND SELECTION CRITERIA FOR EVALUATION OF BIDS=
The Bid will be open in two parts:-
(i) Technical bid (Envelop-I) All technical qualifying documents with
tender fees and EMD
(ii) Financial bid (Envelop-II )Only Annexure-IV, rate quoted by the
contract
(iii) Both bid documents technical and financial in a separate envelop
to be submitted
A. ELIGIBILITY CRITERIA FOR TECHINICAL BID:-
1. Bidder should have valid statement/trade license running for
carrying out the business of hotel, catering, caretaking, of guest
house services or two or three star hotels or ISO certified hotel
during last two years ending last month. (enclosed proof of
documents)

2. Bidder should have minimum experience of two year for successfully
running of the hotel, catering, caretaking of guest house in
government/PSU’s reputed private organization ending 31.03.2017
(enclosed work order and certificatory completion certificate) as
proof of documents.
3. The bidder who has completed two similar contract work, costing
not less than 40% of our estimated cost i.e-
Total Estimated Cost for a day 34 room * 2500 per day = Rs
85,000
Total Estimated Cost for a year Rs 85000* 365 = Rs 3,10,25000
40% of Total Estimated Cost Rs.1,24,10,000
4. The Average annual turnover during last three years, ending 31st
March of the previous financial year, shall be at least 50% of
estimated cost. The bidders financial capability shall be decided
based on the average annual turnover.
50 % of Total Estimated cost 3,10,25,000*50%=1,55,12,500
5. Following document should be attached with the bid:
• The Copy of Balance sheet along with the proof of filing return of last
3 years submitted to IT department will be attached with bid.
• Copy of PAN Card
• In case of partnership firm partnership deed is required to be
attached, in case of company a copy of memorandum of association
is also required to be attached along with the above mentioned
documents.

6. All pages of the Tender document must be signed by the authorized
signatory and sealed with the stamp of the bidding firm as token of
having accepted all the Terms and Conditions of this Tender.
7. Tender shall be submitted in official tender form only. If submitted in any other manner, the same shall be rejected. No bidder shall be issued more than one Tender Form.
8. The services to be rendered by the contractor must not be sub-contracted.
9. No paper shall be detached from the Tender Document.
10. The name and address of the bidder shall be clearly written in the space provided for the purpose and no over-writing, correction, insertion shall be permitted in any part of the tender unless duly countersigned by the bidder. The tender should be filled in and submitted strictly in accordance with the instructions contained herein, otherwise the tender is liable to be rejected.
11. Person signing the bid or other documents connected with tender must clearly write his/her name and also specify the capacity in which signing.
12. CEO are competent authority of the trust reserves the right to reject any or all the tenders without assigning any reason.
13. CEO are competent authority of the trust right to change any condition of the Tender before opening of the Bids.
14. Canvassing in any form will make the tender liable to rejection.

15. The Bidder should quote in the attached Financial Bid Format at Annexure-IV,(in separate sealed envelop) The bidder who will qualify in technical bid, will eligible for open of financial bid. The bidder who will disqualify in technical bid the financial bid will not be open and security amount (EMD) will be refunded.
16. Particulars of the tenderer as per – Annexure-I to be enclosed to the Bid.
17. Tenders received without proper documents, shall be rejected.
B. SELECTION CRITERIA:
The CEO or competent authority reserves the right to obtain
feedback from the previous/present clients of the Bidder and may
depute its team(s) to inspect the site(s) at present contract(s) for
on-the-spot first hand information regarding the quality of food
and Caretaking services provided by the Bidder. Decision of CEO
or competent authority with regards to award of the contract will
depend upon the feedback received by it from the previous/and
present clients and also from its team(s) deputed for the purpose
and fulfill the eligibility criteria of clause sub clause (i) of clause- 2
(The decision of the CEO or competent authority in this regard will
be final and binding on all bidders.

D. PERIOD OF CONTRACT:
The contract will be entered initially for the period of One Year with
yearly extension for two more years on same rate, terms &
conditions based on the satisfactory performance assessed by the
CEO/ competent authority.
E. PAYMENT CLAUSE:
a). The contractor should ensure quarterly depositing of minimum of
40% of the occupancy earnings. If he fails to made payment on time
then will liable to pay interest @ 2% per month, but he will insure
the said limit upto 30 days only after that the contract will be
terminated and security will be forfeited.
b). On receiving the work order, the contractor shall also give in
writing under his signature and seal that he agrees to abide by all
the terms and conditions of the conditions.
F. PENALTY CLAUSE :
a) In case contractor fails to carry out work satisfactorily and
any discrepancy is noticed proportionate charges will be
recovered from monthly bill of contract at the prevailing
market rate.
b) Periodical review of complaint book shall be done and if
contractor is found responsible for deficiency in
services/behavior, suitable action shall be taken by the
Trust and partial/full security deposit shall be forfeited.
c) The contractor and his men will ensure that no damages
are caused to any property of GUEST HOUSE in the event
of any damage , the amount will be compensated by
deducting the same from the contractors bill as per the
prevailing market value of the things damaged.

d) The contractor shall be liable for any expenses, loss of
damage which the factory may incur or sustain by reasons
due to contractors fault.
G. SECURITY CLAUSE
a. Police Verification Report with photograph for each contract worker should be submitted by the contractor within 30 days from the date of commencement of work to prove the credentials of the workers.
b. The contractor should submit the list of workers engaged in a particular contractor to the office of TRUST before the commencement of the work for issuing of temporary identity Card.
c. Two character certificates duly attested by two different Gazetted officers for each contract worker should be submitted by the contractor to the office of TRUST for issuing of temporary identity Card.
d. The contractor and his men must follow the GUEST HOUSE discipline and security instructions from time to time. His men shall not enter any unauthorized location without the knowledge of the manager and supervisor or his authorized person.
e. Police Verification Report for each worker duly filled in by the contractor is to be submitted by the contractor to the office of the TRUST along with tow passport size photographs for issuing of identity Card.
f. All persons employed by the contractor including the contactor shall possess the
g. Identity Card bearing photograph and other particulars while on duty, which will be issued by the office of the TRUST.
h. The contractor or his workers shall not move
around the factory/estate except in the assigned/designated area of work.

i. The contractor should not bring any article/ material/stores that are not required in connection with the performance of the
contract. j. The men/materials/ equipment/vehicles of the
contractor is subjected to check by the TRUST for security reasons.
k. If any employee of the contractor is found to commit any misconduct or misbehavior, the TRUST at its sole discretion may take suitable action against his worker and will be entitled
to restrict Such employees from entering the GUEST HOUSE premises.
l. Prompt replacement of any personnel whose presence is considered as Detrimental to
GUEST HOUSE interests is the responsibility of the contractor.
m. All contract employees should have proper dress code for easy identification by indicating the contractor’s symbol.
n. The contractor shall be responsible for his
employees, observing all the security instructions as issued by the factory from time
to time. o. All guest rooms/Offices should be cleaned only
in the presence of Contract Supervisor. If any theft or some untoward incident takes place at guest house, during the Contract period, it is the sole responsibility of the contractor to
settle the issue. p. Whenever the contract is terminated or the
contract comes to an end, or factory management decides that the contractor
should not be allowed to carry out the work herein agreed, in that event, the Trust will be entitled to restrain the contractor from entering the said premises.

q. The premises covered in this contract shall continue to be in the possession of the factory and the contractor is only permitted to enter
the premises to render services herein mentioned. The contractor. The contractor
shall not have any rights whatsoever in the above premises.
r. Any dispute with the residents/staff will be addressed by the Manager and /or Supervisor and his decision will be final and binding.
H. a. SECURITY DEPOSIT (PERFORMANCE SECURITY): The successful
bidder has to submit within 15 days from date of issue of letter of
acceptance, 10% of the contract value as Security Deposit in the form
fixed deposit/Bank guarantee drawn in favor of “Shree Kashi
Vishwanath Temple trust” for a period of 1 year & same will be
refundable after satisfactory completion of contract or from the date of
short closure of contract .
a. FORFEITURE OF SECURITY DEPOSIT: If the Contractor fails to
perform the contract obligation to the satisfaction or violates any
term & condition mentioned in the agreement then CEO or
appropriate authority has empowered to forfeit 100% of security
deposit. The contractor has no right to challenge its in any court.
b. RELEASE OF SECURITY DEPOSIT: The release of security deposit
is further subject to the production of clearance certificate to be
obtained from chief executive officer of the trust. The clearance
certificate may be issued by the chief executive officer after verifying

I. Other terms and condition of contract:-
1) Qualification of staff:- a) The contractor’s manager and supervisor shall be
sufficiently professionally qualified ( diploma certificate of not less then one year duration in hotel management / catering from a recognized institute ) and with experience on the job to ensure smooth operation the service at set forth in the scope of work and terms and condition. He should be conversant with English and Hindi and should have working knowledge of other popular Indian language.
b) The contractor shall detail manager and supervisor as indicated at points XX in two shifts. The contractor, supervisor has to supervise the quality of all meals including raw materials from time to time to supervise all the meals during special lunch or dinner or parties etc.
c) The manager and supervisor shall not be counted against any other staff. The manager and supervisor shall not be allowed to perform the duties of cooks or house keeper or steward. The supervisor so detailed by the contractor shall be exclusively for this contract. The contractor shall not be allow to detail him for any other duty or against any other contract.
d) For steward , they should possess the diploma / certificate from the recognized institute of minimum 6 month’s duration in ‘food & beverages service” or should have one year experience in three star hotels / central govt. guest house / public sectors owned guest house as a steward. (the contractor should furnished a proof of same with satisfactory work completion certificate in respect of steward from the organization where he worked for one year )

e) The cook (head) should possess the minimum qualification of matriculation / 10th standard passed. He should have a minimum 03 year working experience in two star hotel / Central Govt. / public sector unit owned guest house as a cook. For asst. cooks, he should be matriculation / 10th standard passed and minimum one year experience in two star hotels / central govt. / state govt. / public sector as a cook. ( the contractor should furnish a proof of the same with satisfactory work completion certificate )
2) Contractor’s personnel and attendance a) The shift timings and the strength of staff on duty is to
be decided by the contractor in consultation with the in-charge of guest house trust board contractor shall ensure that he deploys his men (cook , house keeper , steward , chowkidar etc.) in a manner that it does not violate any labour law regarding the continuous deployment on duty of workmen with rest/ shift break / weekly off.
b) All the employee working in the guest house under the control of the contractor will sign daily attendance showing in and out timings .this drill is compulsory since recording attendance is a security requirement.
c) Contractor’s representative posted as in-charge at guest house should necessarily be fluent in speaking Hindi & English and should have working knowledge of other Indian languages.
d) The contractor should provide one day weekly off to his workers on rotational basis without affecting the normal working of guest house i.e. the contractor has to deploy manpower during the contractor period of entire one year (365 day).
e) After concluding of contract contractor should not remove any contract worker without consulting trust.
f) The contractor shall not employ any person below the age of 18 year for execution of the work. contractor may engage workers preferable in the age group between 18 and 45 year and in no case age should be more than 60 year and out of which , minimum 70% should be male employees. Female employee should not be detailed in the night shifts. The trust reserves the right to deny the entry of the workers whose age is above 60 years.

g) Suitable of the contract worker brought by the
contractor will be examined by trust and they will be allowed to work only if they found suitable.
h. The contractor shall maintain necessary qualified / trained competent personnel in each category and for each work as specified. They should meet all the requirements and fulfill all the activities mentioned in the schedule.
i. Prompt replacement of any personnel whose performance is not satisfactory is the responsibility of the contractor.
j. The Services of some workers may be utilized for multiple purpose at different locations as when required by the TRUST.
k. The TRUST has no responsibility whatsoever for the contractor’s employees and the contractor will be solely responsible for managing his employees. In the event of any dispute between the Contractor and his employees, the contractor alone will be responsible for settlement of any claim and consequences that may arise out of any such dispute, whether statutory or otherwise.
l. In the event of any dispute between the contractor & staff / guest or and his employees, the decision of the Trust is final and binding on both the parties.
m. The contractor shall be solely responsible for any claim arising out of employment or termination of employment of his employees and any other statutory payment.
n. The contractor should conduct surprise checks on their staff meant for the above service and also for their punctuality and behavior.
o. The contractor should provide special arrangement for darshan/poojan of vishwanath temple on the request of devotees staying in the guest house.
3) SPECIFIC REQUIREMENT/RESTRICTION:
a) Consumption of Liquor and Non-Vegetarian food is not allowed inside
and in the premises of the guest house. Contractor has put-up
signage on this requirement of all room and common areas and very
clearly mentioned this specific requirement to the guest during check
in process.

b) Rent of the each individual room shall not exceeds Rs 2500/- per
night excluding applicable taxes.
c) The contractor shall be responsible for payment of disc/cable
connection for TV available in the guest house. Which will be
reimbursed to the contractor by guest house trust on actual basis.
d) Additional newspaper/ periodicals will be made available as actual
cost to the visitors on demand, besides the news paper/periodical
provided by the contractor.
e) All the contract employee should have proper dress code for easy
identification by indicating the contractor symbol. The additional
man power as and when required on special occasion will also be
arranged by the contractor for which the contractor would claim the
amount subsequently by submitting a separate bill. In the particular
for large functions and during the trust boards member visits, the
contractor shall deploy extra specially trend cooks and waiters.
f) If the trust at any time requires the contractor to do any work beyond
that provided within the scope of work details in the terms and
condition of the contract, due to certain agency, the contractor shall
undertake such addition work as and when required by the trust.
g) If the TRUST at any time requires the contractor to do any work
beyond that provided within the scope of work detailed in terms and
conditions of the contract, due to certain exigencies, the contractor
shall undertake such additional work and when required by the
TRUST.
4) SAFETY CLAUSE:
a) All contract workers engaged by the contractor should strictly follow all safety instructions, rules and regulations from time to time without fail.
b) The contractor should provide safety gadgets, safety instructions and protecting cloths, Safety shoes to his workers and ensure that they do use
and wear the same at the time of working without fail.

c) The contractor’s men should maintain good
personal hygiene and should not suffer from any contagious disease.
d) The contractor should take all necessary safety
measures at the time of working near electrical overhead/ underground cable/ equipment.
e) The TRUST will not be responsible for any loss suffered by the contractor or his mentor whatsoever reason.
f) Neither the contractor nor his workers shall bring articles like beedi, cigarettes, gas or any item capable of causing fire or any other contraband at
the workplace.
5) Record Keeping:
The supervisor/caretaker will record in the register maintained for
the purpose the names of the guest, rooms allotted, issue and collect
back room keys and almirah keys, collection of tariffs, issues of
receipts to guest, maintain the account and the collected tariffs shall
be deposited with guest house office on weekly basis also the record
for issue of soaps etc. to be maintained
3. EXTENSION TO THE VALIDITY OF THE CONTRACT OR
TERMINATION OF CONTRACT:
a) The Chief Executive officer of the trust, reserves the rights
to terminate or short close the contract without assigning
any reason or when the performance is found not
satisfactory at the risk and cost of the contractor with one
month notice. However in exceptionally grave
circumstances, the Trust reserves the right to cancel the
contract without any notice.
b) By the contractor may withdrawal the contract prematurely
by given minimum three month notice, however in that
case 100% security deposited will be forfeited.

c) On the termination/expiry of the contract the contactor will
handed over all the equipment/furniture/articles etc.
supplied by the guest house in good working condition,
falling which the item will have to be replace to guest
house.
d) The TRUST reserves the right to extend the validity of the
contract by 50%(i.e for six months) without any increase in
the rate, but by increasing the cost with same terms and
conditions. But at the same time, contractor is not
permitted to demand for any extension.
4. ARBITRATION:
Any dispute or differences arising under or out of the contract shall be
referred to the sole arbitration of XXXX or any other person appointed
by him to act and there should not be any objection to any such
appointment that the arbitrator so appointed will be a Govt. servant.
The award of the arbitrator shall be entitled to extend the time of award
by the consent of the party from time to time. The venue of the
arbitration will be at the discretion of the arbitrator, subject as
aforesaid. The arbitration and conciliation Act 1996 and rules frame
their under or any statutory modification thereof for the time being
enforce shall be deemed to apply to the arbitration proceeding under
this clause.
