    A list of actions covering:

    Project Team 1 – Review of the existing legal and policy framework for highly automated and connected driving

    Chair: ERTICO/ACEA

    Rapporteur: EC

    Scope:

    Review policy and legal issues with a focus on automation.

    Coordinated approach/overview of the on-going actions, identify sector specific issues

    Give recommendations on the necessary amendments to the relevant legal instruments and policy orientations that can support the roll out of highly connected and automated vehicles. Focus on issues not already covered by other fora and sector specific issues

    Expected outcome: concrete recommendations to the EC by the end of 2016 for upcoming systems (target 2020) and at the end of 2017 for highly automated vehicles (target 2030)

    1) 1st PT1 Workshop on 12 May 2016: define scope, expected outcome

    Review and the expected outcome on the issues on the basis of the discussion paper, Definition of priorities for actions (tests, upcoming systems, fully automated vehicles)

    Need for dedicated teams/sessions? volunteers?

    2) 2nd PT1 meeting on 13 June 2016: Continue the consideration of the topics on the basis of the contribution received. Dedicated session?

    3) On this basis Chair/rapporteurs prepare 1st draft for consideration by WG2

    4) 3rd PT1 meeting after summer break

  • Topic 1: Testing on open roads

    Issues:

    No big legal obstacle identified even for higher levels of automation,

    Mainly national matter,

    However there may be a need for harmonization/cooperation for common criteria/return of experience

    Possible outcomes for the GEAR2030 roadmap: * Studies/further analysis of differences in existing national initiatives to allow large scale testing. Possible recommendations for a common set of rules for large scale testing/derogation. A distinction may be needed between cars on open roads and public transport vehicles in secured areas

  • Topic 2: Automation and the driver/other road users

    Issues:

    Traffic rules to be revised to include the possibility of having the vehicle taking over driving tasks (up to 100%)

    Conditions under which automation may be used/not be used

    Driver training/social rules

    Interaction between automated vehicles and other road users/other drivers (link with vehicle regulations)

  • Possible outcomes for the GEAR2030 roadmap:

    * For partial automation:

    • mapping of road traffic rules most important to harmonise for enabling cross-border automation

    • Identifying the needs for driver training /awareness-raising (inattention, limits of the systems, inexperienced drivers).

    * For full automation:

    Decision on the role of driver and responsibility of driver. Allowing absent/non active drivers = revision of road traffic code on illegal distractions.

    Allowing absent drivers = revising the need for licences?

    Issues

    Vehicles will have to cope with the existing infrastruture, but :

    Need for specific roadsigns for automation use? Lane markings?

    Need for digital mapping of speed limits? road works ? Electronic messages?

    Possible outcomes for the GEAR2030 roadmap: • Commitment on the road infrastructure of 2030? • Agreement on minimum data to be made accessible/readable from/for

    road infrastructure (speed limit, weight limitation, road restriction): • Identification of minimum requirements for road infrastructure: data

    layers, roadside markings and readability of road signs, design of secure stop areas.

    • Identification of required updates of infrastructure safety management directive and tunnel safety directive.

  • Topic 4: Liability issues

    Issues:

    Automated vehicles safer but new risks appear (distraction, failure, etc)

    Compulsory insurance for vehicle manufacturers if no driver?

    Determining the accident responsibilities becomes more complicated with inceasingly levels of automation?

    Determining the defects becomes more complicated with higher levels of automation?

    How to ensure legal certainty for manufacturers?

    Ethical issues: are there differences with the present situation? Effect on driver aceptance

    Need for event data recorder?

    Possible outcomes for the GEAR2030 roadmap: * Recommendations on how to deal with the liability issues for partially /highly automated and connected vehicles. Recommendations on possible amendments to the relevant legal framework. *Recommendations on how to deal with ethical issues

    10 km/ limit in Regulation 79: revision on going

    How to assess the safety of automated vehicles?

    How to ensure that the vehicle will cope with existing infrastruture/traffic rules

    How to ensure a good interaction vehicles/driver/other road users

    International issues/cooperation

    How to implement other issues in vehicles: PTI, C-ITS, EDR, cybersecurity, interoperability, etc

    Periodical technical inspections: what to check on automated vehicles

  • Topic 5: Vehicle regulations/standards

    Possible outcomes for GEAR2030 roadmap: * Defining needs for legislation updates in EU and UNECE legislation/standards. A distinction may be needed between cars on open road and public transport vehicles in secured areas * Agreement on principles for minimum testing requirements for periodic inspections.

  • Topic 6: Connectivity/data

    Issues:

    Connectivity is not a prerequisite but will help for higher levels of automation.

    Which communication infrastructrure is needed to support highly automated vehicles

    How to implement data protection for vehicle data?

    Which fair market for vehicle big data (ownership of data, reusability, access, etc)

    Different types of data should not be subject to the same rules

    How to ensure cybersecurity in the vehicle?
