Mr. President,

I have the honor to speak on behalf of the Member States of the Community of Latin American and Caribbean States (CELAC).

At the outset, our group would like to express its appreciation for the outstanding and dedicated manner in which H.E. Ambassador Einar Gunnarsson, Permanent Representative of Iceland, and H.E. Ambassador Martin Garcia Moritan Permanent Representative of Argentina, and both of their teams, led this fifth review process.

Mr. President,

The adoption of the United Nations Global Counter-Terrorism Strategy by the General Assembly in 2006 marked a significant breakthrough in the fight against terrorism, as Member States recognized the concerns expressed by the Secretary General in the plan of action to address the global counterterrorism framework beyond law enforcement and security measures, highlighting the need to include measures to ensure respect for human rights and to address the conditions conducive to the spread of terrorism, such as prolonged unresolved conflict, challenges regarding the rule of law at the national and international levels, violations of human rights, the need to attend victims holistically, and social, economic and political marginalization.

After ten years, CELAC reaffirms its commitment to the United Nations Global Counter-Terrorism Strategy, and reiterates its determination to adhere to the principles enshrined in it, to develop all the actions provided for therein as the most effective way to address the threat of terrorism while guaranteeing full respect for the Rule of Law and Human Rights. We also maintain our commitment to the recently updated Strategy and reiterate the need to comply with the resolutions adopted at the United Nations including GA resolution 70/148 on the “Protection of Human Rights and Fundamental Freedoms while countering terrorism”. The horrific attacks perpetrated this same week in Turkey make it even more important to recommit to the Strategy and its full and effective implementation.

The Community of Latin American and Caribbean States reiterates its strong and unequivocal condemnation of all acts of terrorism as criminal and unjustifiable and reaffirms its commitment to fight terrorism in all its forms and manifestations, including the cases in which there are States directly or indirectly involved, in strict observance of international law and in particular, the Charter of the United Nations. To this end, among other actions, we will strengthen and reinforce, if necessary, our national legislation and will promote active and effective international cooperation mechanisms to prevent, investigate, punish and eliminate all manifestations of this scourge. Likewise, we commit to take quick and effective actions to prevent, penalize and eliminate the financing, whether they are individuals or groups, as well as the devising of any terrorist act and to deny safe haven to instigators, sponsors, authors, promoters or participants in terrorist activities, in accordance with the international legal framework, including the relevant international treaties and the relevant resolutions of the United Nations.

In this regard, CELAC takes note of Secretary Generals' Report A/70/826 on the Activities of the United Nations system in implementing the United Nations Global Counter-Terrorism Strategy, which includes important inputs from all entities of the Task Force, and concludes with a number of observations and recommendations. We also take note of the Secretary-General’s Plan of Action to Prevent Violent





Extremism (A/70/674), as well as of the debates held on 7 and 8 April this year, on the Geneva Conference on Preventing Violent Extremism.

CELAC shares the concern expressed by the Secretary-General in his report relating to the spread of violent extremism as and when conducive to terrorism, and in that regard we recognize the need to give additional attention to the issue of social media being used by terrorist groups. We also recognize the need to tackle conductive to the spread of terrorism, with a renewed perspective of the linkage between peace and security, human rights and development, taking into account the 2030 Agenda for Sustainable Development. While noting that “violent extremism” still lacks an internationally agreed definition, CELAC member States express their concern about the involuntary consequences such notion might have.

The Community of Latin American and Caribbean States recognizes the important role fulfilled by civil society countering terrorism and the need to fully respect the rights of freedom of expression and association. In that regard, we encourage Member States to prevent the abuse of non-governmental, non-profit and charitable organizations by and for terrorists that are used as a means to incite, glorify, defend and promote terrorist actions and their leaders.

Mr. President,

CELAC underscores that the measures to combat terrorism must always be conducted in strict observance of international law, including international human rights, humanitarian and of refugees law. Only those measures adopted in accordance with the UN Charter and other relevant international norms can be successful and garner broad support from the international community. Actions taken outside the international legal framework are unjustifiable, illegal and unacceptable. CELAC recalls, in this sense, General Assembly Resolution 70/148 on the "Protection of human rights and fundamental freedoms while countering terrorism", adopted by consensus on 17 December 2015.

CELAC countries would like to highlight once again the right to privacy, which is essential to human dignity, and a fundamental civil human right, and whose protection is crucial in safeguarding individuals against the abuse of power. We remain deeply concerned at the negative impact that State illegal surveillance and/or interception of communications, including extraterritorially, may have on the exercise and enjoyment of human rights. We welcome the strengthened language in this resolution on this issue.

Our Community strongly rejects the use of Information and Communication Technologies in violation of International Law, directed against any Member State, and underscores the importance of ensuring that the use of such technologies is fully compatible with the purposes and principles of the United Nations Charter and International Law, in particular sovereignty, non-interference in internal matters, the right to privacy, and the internationally recognized rules of peaceful coexistence among States. Furthermore, any interference or restriction on the right to privacy should be adequately regulated by law, subject to effective oversight, and to appropriate redress, including through judicial review or other means, to ensure measures are not arbitrary.

In the context of the global counterterrorism framework, CELAC countries reiterate their commitment to intensify international efforts directed to safeguard cyberspace and promote its exclusive use for the achievement of peaceful purposes and as a vehicle to contribute to both economic and social





development, as well as to promote messages of tolerance and mutual respect. Moreover, we uphold, once again, our firm belief in multilateralism in combating terrorism. Congruently, the Community of Latin American and Caribbean States also rejects the unilateral elaboration of blacklists accusing States of allegedly supporting and sponsoring terrorism. This action is inconsistent with International Law.

Concerning the establishment of the Al Qaeda and Da’esh sanctions regime by the Security Council as a measure in the fight against terrorism, the group recognizes the steps taken by the 1267/1989/2253 Sanctions Committee towards more effective, inclusive and participative working methods and transparent clear procedures. In this regard, CELAC strongly supports the role of the Ombudsperson, which has significantly improved the fairness and transparency of the delisting process. We believe the Ombudsperson position should be made permanent and due process further enhanced in the Security Council sanctions regimes, especially given the preventive nature of the measures. Furthermore, CELAC expresses its support to the Security Council’s firm commitment to ensuring that the Office of the Ombudsperson is able to continue to carry out its role effectively and independently, in accordance with its mandate.

Mr. President,

CELAC strongly condemns, the systematic recruitment and use of children to perpetrate terrorist attacks, as well as the violations and abuses committed by terrorist groups against children, including killing and maiming, abduction and rape and other forms of sexual violence, and notes that such violations may amount to war crimes or crimes against humanity. Every child alleged as, accused of, or recognized as having infringed the law, particularly those who are deprived of their liberty; as well as child victims and witnesses of crimes, should be treated in a manner consistent with his or her rights, dignity and needs, in accordance with international law; in particular, the Convention on the Rights of the Child, and bearing in mind, relevant international standards on human rights in the administration of justice; taking into account, the age, gender, social circumstances and development needs of such children. In this regard, CELAC urges Member States to take measures to effectively reintegrate children formerly associated with armed non-State actors that commit terrorist acts given their potential status as victims of violations of international law. The Community of Latin American and Caribbean States also stresses that the proliferation of the illicit trade in small arms and light weapons, among other phenomena, may also fuel, terrorism.

CELAC therefore calls upon Member States to eliminate the supply of weapons, including small arms and light weapons, to terrorists and to non-State actors, in accordance with relevant General Assembly and Security Council resolutions; and also calls upon Member States to find ways to intensify and accelerate the exchange of operational information regarding trafficking in arms; and to enhance coordination of efforts at the national, sub-regional, regional and international levels. We urge Member States to take appropriate measures; including, in relation to management of stockpiles, and to share relevant best practices, as for preventing the diversion of small arms and light weapons to non-State actors and terrorist groups.





Mr. President,

CELAC would also like to recognize the important work carried out by regional and sub-regional organizations in the implementation of the Strategy, and calls upon them to strengthen their cooperation in order to succeed in the fight against terrorism. At the same time, we are aware of the need to continually improve the role of the whole United Nations system, within its mandates, in the implementation of the Strategy.

In this regard, we urge United Nations Office on Drugs and Crime to undertake capacity building activities in our region, as well as to continue providing technical assistance, upon request, and taking into account the particular needs and national priorities of our countries. The tools developed by UNODC, including, inter alia, the counter terrorism legislative database, the online learning platform, and the technical assistance tool for countering the use of the Internet for terrorist purposes, are very useful for the prevention of and fight against terrorism.

Notwithstanding the significant efforts and achievements in the implementation of the strategy, as reported by the Secretary General, CELAC remains concerned that terrorism continues to constitute a serious threat to individual member States and to the international community as a whole.

In order improve the international counter-terrorism legal framework; our group of countries is convinced that a comprehensive convention against international terrorism (CCIT) is required. CELAC therefore calls upon Member States to recommit to resolve in the 71st session of the General Assembly, the outstanding issues that have been an obstacle for the achievement of this essential agreement, including those related to the exclusion of legal regimes from the scope of this Convention, finding common ground to signal as a whole the international community’s strong commitment in the fight against international terrorism.

Finally, Mr. President,

The members of the Community of Latin American and Caribbean States, reiterate their profound solidarity with the victims of terrorist acts, and underscore the need to provide them with the necessary support. CELAC reiterates the need to avoid the impunity of those who commit terrorist acts, in order to bring justice to the victims and their families. In this regard, we call upon Member States to fully cooperate in the fight against terrorism, in accordance with International Law.

Es un honor tomar la palabra en representación de los Estados Miembros de la Comunidad de Estados Latinoamericanos y Caribeños.

Permítame iniciar agradeciendo a sus excelencias, el Embajador Einar Gunnarsson, Representante Permanente de Islandia, y al Embajador Martín García Moritán Representante Permanente de Argentina y sus equipos, por la dedicación y destreza con que dirigieron este quinto proceso de revisión..

Señor Presidente,

La adopción de la Estrategia Global contra el Terrorismo de las Naciones Unidas por la Asamblea General en 2006, marcó un avance significativo en la lucha contra el terrorismo, ya que los Estados Miembros reconocieron las preocupaciones expresadas por el Secretario General en el plan de acción para abordar el esquema de lucha contra el terrorismo mundial más allá aspecto policial y de seguridad, poniendo de relieve la necesidad de incluir medidas para garantizar el respeto de los derechos humanos y para hacer frente a las condiciones que propician la propagación del terrorismo, como los conflictos prolongados sin resolver, desafíos en relación con el estado de derecho en los planos nacional e internacional, violaciones de los derechos humanos, la necesidad de atender de manera integral a las víctimas, y la marginación social, económica y política.

Después de diez años, la CELAC reafirma su compromiso con la Estrategia Global de las Naciones Unidas contra el Terrorismo, y reitera su determinación de aplicar los principios recogidos en la Estrategia, desarrollar las medidas que se contemplan en la misma como la vía más eficaz para acabar con la amenaza del terrorismo, asegurando a la vez, el pleno respeto del Estado de derecho y respeto por los Derechos Humanos. Nosotros mantenemos nuestro compromiso con la Estrategia actualizada recientemente y reiteramos la necesidad de cumplir con los acuerdos adoptados en las Naciones Unidas, incluyendo resolución de la AG 70/148 sobre la " Protección de los Derechos Humanos y las libertades fundamentales en la lucha contra el terrorismo". Los terribles atentados perpetrados esta misma semana en Turquía hacen que sea aún más importante volver a comprometerse con la Estrategia y su aplicación plena y eficaz.

La Comunidad de Estados de Latinoamericanos y Caribeños reitera su condena enérgica e inequívoca de todos los actos de terrorismo como criminales e injustificables y reafirma su compromiso de luchar contra el terrorismo en todas sus formas y manifestaciones, incluidos los casos en los que hay Estados involucrados directa o indirectamente, en estricta observancia del derecho internacional y, en particular, la Carta de las Naciones Unidas. Con este fin, entre otras acciones, vamos a fortalecer y reforzar, si es necesario, nuestra legislación nacional y promoveremos mecanismos de cooperación internacional activa y eficaz para prevenir, investigar, sancionar y eliminar todas las manifestaciones de este flagelo. Asimismo, nos comprometemos a tomar acciones rápidas y efectivas para prevenir, sancionar y eliminar la financiación, ya sean individuos o grupos, así como la planificación de cualquier acto terrorista y negar refugio a los instigadores, patrocinadores, autores, promotores o participantes en actividades terroristas, de conformidad con el marco jurídico internacional, incluyendo los tratados internacionales pertinentes y las resoluciones pertinentes de las Naciones Unidas.





En este sentido, la CELAC toma nota del informe del Secretario General A/70/826 sobre las actividades del sistema de las Naciones Unidas en la aplicación de la Estrategia Global contra el Terrorismo de las Naciones Unidas, que incluye aportes importantes de todas las entidades del grupo de trabajo, y concluye con una serie de observaciones y recomendaciones. También tomamos nota del Plan de Acción del Secretario General para prevenir el extremismo violento (A/70/674), así como de los debates que tuvieron lugar el 7 y 8 de abril de este año, en la Conferencia de Ginebra sobre prevención del extremismo violento.

La CELAC comparte la preocupación expresada por el Secretario General en su informe relativo a la propagación del extremismo violento a medida que propician el terrorismo, y en ese sentido, reconocemos la necesidad de prestar mayor atención a la cuestión de los medios de comunicación social utilizados por grupos terroristas. También reconocemos la necesidad de abordar las condiciones que propician la propagación del terrorismo, con una perspectiva renovada de la relación entre la paz y la seguridad, los derechos humanos y el desarrollo, teniendo en cuenta la Agenda 2030 para el desarrollo sostenible. Mientras observamos que el "extremismo violento " aún carece de una definición acordada a nivel internacional, los Estados miembros de la CELAC expresan su preocupación por las consecuencias involuntarias que esa noción podría tener.

La Comunidad de Estados Latinoamericanos y del Caribe reconoce el importante papel cumplido por la sociedad civil en la lucha contra el terrorismo y la necesidad de respetar plenamente los derechos de libertad de expresión y asociación. En ese sentido, alentamos a los Estados miembros a prevenir el abuso de las organizaciones benéficas no gubernamentales, sin fines de lucro y benéficas, por y para los terroristas, que se utilizan como un medio para incitar, glorificar, defender y promover acciones terroristas y sus líderes.

Señor Presidente,

La Comunidad de Estados Latinoamericanos y Caribeños subraya que las medidas de lucha contra el terrorismo siempre deben llevarse a cabo en estricta observancia del derecho internacional, incluidos los derechos humanos a nivel internacional, humanitario y del derecho de refugiados. Sólo aquellas medidas adoptadas de conformidad con la Carta de las Naciones Unidas y otras normas internacionales pertinentes pueden tener éxito y contar con el amplio apoyo de la comunidad internacional. Las medidas adoptadas fuera del marco legal internacional son injustificables, ilegales e inaceptables. La CELAC recuerda, en este sentido, la Resolución 70/148 de la Asamblea General sobre la " Protección de los derechos humanos y las libertades fundamentales en la lucha contra el terrorismo", adoptada por consenso el 17 de diciembre de 2015.

Los países de la CELAC quieren resaltar una vez más el derecho a la privacidad, que es esencial para la dignidad humana, y un derecho humano civil fundamental, y cuya protección es fundamental en la salvaguarda de las personas contra el abuso de poder. Seguimos profundamente preocupados por los efectos negativos que la vigilancia ilegal de Estado y/o intervención de comunicaciones, incluyendo extraterritorialmente, puedan tener sobre el ejercicio y el goce de los derechos humanos. Damos la bienvenida al lenguaje fortalecido en relación a este asunto en la presente resolución.

Nuestra Comunidad rechaza enérgicamente el uso de las Tecnologías de la Información y Comunicación en violación del derecho internacional, dirigido contra cualquiera de los Estados miembros, y subraya la importancia de asegurar que el uso de tales tecnologías sea totalmente compatible con los propósitos y





principios de la Carta de las Naciones Unidas y el Derecho Internacional, en particular, la soberanía, la no injerencia en los asuntos internos, el derecho a la privacidad, así como las normas internacionalmente reconocidas de la coexistencia pacífica entre los Estados. Por otra parte, cualquier interferencia o limitación del derecho a la privacidad deben ser reguladas adecuadamente por la ley, sujeta a una supervisión eficaz, y a una reparación adecuada, incluso mediante la revisión judicial u otros medios, para asegurar medidas que no sean arbitrarias.

En el contexto de la lucha contra el terrorismo global, los países de la CELAC reiteran su compromiso de intensificar los esfuerzos internacionales dirigidos a salvaguardar el ciberespacio y promover su uso exclusivo para la consecución de fines pacíficos y como vehículo para contribuir al desarrollo económico y social, así como para promover mensajes de tolerancia y respeto mutuo. Además, confirmamos, una vez más, nuestra firme creencia en el multilateralismo en la lucha contra el terrorismo.

Congruentemente, la Comunidad de Estados Latinoamericanos y Caribeños también rechaza la elaboración unilateral de listas negras, donde acusan a los Estados de supuesto apoyo y patrocinio al terrorismo . Esta acción es incompatible con el Derecho Internacional.

En cuanto al establecimiento del régimen de sanciones contra Al Qaeda y Da'esh por el Consejo de Seguridad como medida en la lucha contra el terrorismo, nuestros países reconocen las medidas adoptadas por el Comité de Sanciones 1267/1989/2253 encaminadas a métodos de trabajo más eficaces, inclusivos y participativos, y procedimientos claros y transparentes. En este sentido, la CELAC apoya firmemente el papel del Ombudsperson, que ha mejorado significativamente la equidad y la transparencia del proceso de exclusión. Creemos que la posición del Ombudsperson debe hacerse permanente debido a la mejora del proceso y aún más en los regímenes de sanciones del Consejo de Seguridad, especialmente teniendo en cuenta el carácter preventivo de las medidas. Por otra parte, la CELAC expresa su apoyo al compromiso firme del Consejo de Seguridad para garantizar que la Oficina del Ombudsperson sea capaz de seguir llevando a cabo su función con eficacia y de forma independiente, de conformidad con su mandato.

Señor Presidente,

La CELAC condena enérgicamente, el reclutamiento y la utilización de niños para perpetrar ataques terroristas, así como las violaciones y abusos cometidos por grupos terroristas contra los niños, entre ellos asesinato y la mutilación, el secuestro y la violación y otras formas de violencia sexual sistemática, y señala que tales violaciones pueden constituir crímenes de guerra o crímenes contra la humanidad.

Cada niño que se alegue o acuse, o se sepa que haya infringido la ley, sobre todo los que están privados de su libertad; así como los niños víctimas y testigos de delitos, deben ser tratados de una manera consistente con sus derechos, la dignidad y las necesidades, de conformidad con el derecho internacional; en particular, la Convención sobre los Derechos del Niño, y teniendo en cuenta, las normas internacionales pertinentes sobre los derechos humanos en la administración de justicia; teniendo en cuenta, la edad, el género, las circunstancias sociales y las necesidades de desarrollo de esos menores. En este sentido, la CELAC insta a los Estados miembros a adoptar las medidas pertinentes para reintegrar eficazmente a los niños que anteriormente hayan estado asociados con los actores armados no estatales que cometen actos terroristas, dado a su potencial estado de ser víctimas de violaciones del derecho internacional





La Comunidad de Estados de América Latina y el Caribe también hace hincapié en que la proliferación del tráfico ilícito de armas pequeñas y armas ligeras, entre otros fenómenos, también puede fomentar el terrorismo.La CELAC, pide a los Estados miembros, eliminar el suministro de armas, incluidas las armas pequeñas y armas ligeras, a los terroristas, así como a los agentes no estatales, de conformidad con las resoluciones pertinentes de la Asamblea General y del Consejo de Seguridad; y exhorta a los Estados miembros, a encontrar formas de intensificar y acelerar el intercambio de información operativa, en relación con el tráfico de armas; y mejorar la coordinación de los esfuerzos a nivel nacional, subregional, regional e internacional.

Nosotros instamos a los Estados miembros, a tomar las medidas apropiadas; incluyendo, en relación con la gestión de las existencias, y compartir las mejores prácticas relevantes, como para evitar el desvío de armas pequeñas y armas ligeras a agentes no estatales y a grupos terroristas.

Señor Presidente,

La CELAC también desea reconocer el importante trabajo realizado por las organizaciones regionales y sub-regionales en la aplicación de la Estrategia, y los exhorta a fortalecer su cooperación con el fin de tener éxito en la lucha contra el terrorismo. Al mismo tiempo, somos conscientes de la necesidad de mejorar continuamente el papel de todo el sistema de las Naciones Unidas, dentro de sus mandatos, en la aplicación de la Estrategia.

En este sentido, instamos a la Oficina de las Naciones Unidas para las Drogas y el Delito para llevar a cabo actividades de creación de capacidad en nuestra región, así como para continuar la prestación de asistencia técnica, a solicitud, y teniendo en cuenta las necesidades particulares y las prioridades nacionales de nuestros países. Las herramientas desarrolladas por la ONUDD, incluyendo, entre otras cosas, la base de datos legislativa contra el terrorismo, la plataforma de aprendizaje en línea, y la herramienta de asistencia técnica para la lucha contra el uso de Internet con fines terroristas, son muy útiles para la prevención y la lucha contra el terrorismo.

A pesar de los significativos esfuerzos y avances en la implementación de la estrategia, así reportados por el Secretario General en su informe, la CELAC continúa preocupada por el hecho que el terrorismo sigue representando una seria amenaza tanto para los Estados Miembros como para la comunidad internacional en su conjunto.

Con el fin de mejorar el marco jurídico internacional contra el terrorismo; nuestro grupo de países está convencido de que es necesario un convenio general contra el terrorismo internacional (CICT). Por lo tanto, la CELAC pide a los Estados miembros volver a retomar en la 71ª sesión de la Asamblea General, las cuestiones pendientes que han sido un obstáculo para la consecución de este acuerdo esencial, incluidos los relacionados con la exclusión de regímenes jurídicos del ámbito de aplicación de la presente Convención, encontrando así un terreno común para marcar el fuerte compromiso de la comunidad internacional en su conjunto en la lucha contra del terrorismo global.

Finalmente, señor Presidente,

Los miembros de la Comunidad de Estados Latinoamericanos y Caribeños reafirman su profunda solidaridad con las víctimas de actos terroristas, y enfatizan la necesidad de brindarles todo el apoyo que





requieran. La CELAC también reitera la necesidad de evitar la impunidad de aquellos que cometen actos terroristas, con el fin de hacer justicia a las víctimas y sus familias. En este sentido, hacemos un llamado a los Estados miembros a cooperar plenamente en la lucha contra el terrorismo, de conformidad con el Derecho Internacional.
