Foyer.TheatreManager Makeannouncementsrelevanttotheevacuationand

EMERGENCYPROCEDUREIFYOUDISCOVERAFIREWhenever fire occurs, the main consideration is to get everybody out of thepremises safely. Protection of life is paramount; protection of property is ofsecondconsideration.Intheeventofdiscoveringafire;1. Immediatelyoperatefirealarmcallpoint.2. Attackfireonlyifyouhaveyouhavebeentrainedintheuseoffirstaidfirefightingequipmentandfeelitissafetodoso.

3. DONOTTAKEPERSONALRISKS.4. On hearing the fire alarm the Theatre Manager/ Front of HouseManager/AMEYshouldcontactemergencyservicesimmediately.(In every case of an outbreak of fire or suspicion of fire, the fireservice shall be summoned, regardless of the size of the fire orwhetherthefirehasapparentlybeenextinguishedbystaff.)

5. Once the alarm is raised, the evacuation procedure shouldcommence immediately and nominated staff are to proceedwiththeirduties.

6. On leaving the premises, staff should gather in front car park, inorder to establish, where practicable, that all persons haveevacuatedfromthepremises.

SPINNEYTHEATRECONDITIONSFORHIRING

ApplicationsforHiring:1. AllapplicationsforthehireoftheTheatreandTheatreFoyerforeitheroneor

moreengagementsmustbeinwritingontheformattachedandforwardedoncompletiontotheTheatreManager(hereinafterreferredtoastheManager).Thepersonbywhomthisapplicationformissignedshallbeconsideredthehirer.Whereapromotingorganisationisnamedintheapplicationforhirethatorganisationalsoshallbeconsideredthehirerandshallbejointlyandseverallyliablehereonwiththepersonwhosignstheform.

FeesandCharges:2. FeesandChargeswillbeinaccordancewithascaleprescribedbytheSchool

Governorsorasadvisedseparatelyfromtimetotimebutanyapplicationnotfallingwithinsuchscaleswillbespeciallyconsideredandachargequoted.Feesandchargesarepayableasfollows:

a) Upondemandthehirerwillpay£180onbookingasanon- returnabledepositandpartofthehiringfee.Thehirer'sattentionis directedtoClauses32-34hereofwhichdealwithcancellations.

b) Thebalanceofhiringchargesshallbepayabletwoweeksbeforetheevent.IfthepaymentisnotreceivedbytheTheatreManagementbythisdate,thehiringwillbesummarilycancelledandthedepositforfeited.

c) TheHirerisresponsibleforobtainingtwoFirstAiders.

d) Inadditiontothefeesandchargesherein/beforementionedthehirer will,ifcalleduponbytheManager,forthwithdepositwiththeTheatre ManagementasumofmoneytobespecifiedbytheManagerasa securityforthedueperformanceofthehirer'sobligationsunderthese conditionsandagainstlossordamagetotheTheatreManagementor itsproperty.Ifsuchadepositshallnotbemadewithinfourteendays fromthedateofnotificationofdemandtheTheatreManagement shallbeatlibertytodeclarethecontractofhiringcancelledbythe hirerandtheprovisionsoftheconditionsastocancellationsbythe hirerwillapply.

3. Anyfurthercharges,feesordemandsarisingoutofthiscontractofhiringandtheseconditionssubsequenttothenotificationofacceptanceshallbedueandpayableondemandbytheManager.


Publicity

4. a) Nopublicannouncementofanyfunctionshallbemadeuntilwritten notificationofacceptancehasbeenreceived.Allparticularscontained inany posterofnoticeofameeting,function,performanceor entertainmentmustbeclearlyandcorrectlystated.Theremustbeno FlyPostingadvertisingeventsatthehiredpremisesandany infringementofthisrequirementwillentitletheTheatreManagement atitsoptiontocancelthehiringwithoutcompensationtothehirerof anylossarisingtherefromwhatsoever,theTheatrerefunding50% ofhehiringdeposit.TheTheatreManagementwillthereafter exerciseitsrighttorefusetoacceptanyapplicationsforthe hiringofanypremisesinitsownershipfromthehirer.

b) Inadvertisingthevenue,thetitleisSpinneyTheatre,The NorthamptonSchoolforGirls.

5. a) Nocopyrightwork(otherthancopyrightmusic,theperformingrightsof whicharevestedinthePerformingRightsSocietyLtd)shallbe performedwithoutthelicenceoftheownerofthecopyright.

b) Wherecopyrightmusic,theperformingrightsofwhicharevestedin thePerformingRightsSocietyLtd,isperformedinthehiredpremises duringthehiring,thehirerwillobtainfromtheManagerprogramme returnsformsandshall,within24hoursoftheexpirationofeach engagement,completeanddeliverthesametotheManager.

c) Ifthehirershallfailtocompleteanddeliverthesaidformsassaid withinthetimespecified,thentheTheatreManagementmaycancel anyotherengagementsinanypremisesownedbytheTheatre Managementthatthehirermay,atanytime,havemadewithout incurringanyliabilitytothehiringwhatsoeverandforthereturnofany feepaidtothem,therefore,lessanamountequalto50%of thetotalfeewhichwouldotherwisehavebeenpayableirrespectiveof suchcancelledengagementwhichsummayberetainedbythe TheatreManagementasliquidateddamagesforthelossofsuch bookings.6. ThehirershallindemnifytheTheatreManagementagainstanyinfringement ofcopyrightwhichmayoccurduringthehiring.Programme:7. a) Thehirershall,ifrequiredbytheTheatreManagement,supplyto theManagerforapprovalacopyoftheprogrammeofany entertainmenttobegivenbyhimnotlessthansevendaysbeforethe presentationofsuchentertainment. b) Inanycase,acopyofsuchaprogrammeshallbegiventothe Manageraftertheevent.


LicensedBars:8. a) Nointoxicatingliquorwillbeconsumedonthehiredpremisesor broughttheretootherthanthatsoldorsuppliedbythelicensee.All barswillclosehalfanhourbeforethetimeshownonthebooking formatcloseoffunction,oratsuchtimeastheManagershall determineandinanyeventinaccordancewithaJusticesLicence. TheTheatreManagementgivesnoundertakingthataJustices Licencewillbeavailableinrespectofanyhiringorinrespectofany particularhours.

b) NodrinksorfoodmaybetakenintoorconsumedintheAuditorium.NonSmokingPolicy9. SpinneyTheatreoperatesaNoSmokingpolicy.Thisincludesall areasinthebuildingincludingthefoyer,auditorium,backstageareas. dressingroomsandtoilets.MusicandDancing10. AlltheconditionsattachedtothePublicIndoorEntertainmentLicenceforthe

hiredpremisesshallbedulyobserved.AcopyofsuchlicencemaybeseenonapplicationtotheManagerandthehirershallbedeemedtohavenoticeof allconditionsattachedthereto.Ifthehirerisdesirousofusingthehiredpremisesforpublicmusicand/ordancingonanyoccasionnotcoveredbythe PublicIndoorEntertainmentLicence,heshouldfirstseekthepermissionoftheTheatreManagementandpaythecostofobtainingtheconsentoftheJusticetothesaiduse.

11. a) Thefollowingconditionsshallapplytothepresentationof cinematographyexhibitionsinthehiredpremises: i) Noexhibitionshallbepresentedtowhichthepublicisonlyadmitted

withoutpayment,providedthattheexhibitionisnotgiventomembers ofachildren'scinemaclubotherthanaclubconnectedwitha religiousoreducationalinstitution.

ii)Anexhibitiongivenbyanorganisation(hereinaftercalled"an exemptedorganisation")withrespecttowhichthereisinforceatthe timeoftheexhibitionacertificateoftheCommissionersofCustoms andExcisecertifyingthattheorganisationisnotconductedor establishedforprofit.

b) Exhibitionsgivenbyexemptedorganisationsshallnotbepresentedin thehiredpremisesonmorethanthreedaysduringanyoneperiodof sevendays.

c) Applicationforthehireofthehiredpremisesforpurposesofholdinga cinematographyexhibitionmustbeaccompaniedbyacertificateofthe hirerthattheexhibitionwillfallwithinoneoftheclassesreferredtoin sub-paragrapha)ofthisparagraph.


d) Nocinematographyexhibitionshallbegiveninthehiredpremises unlessatleastsevendayspriornoticeinwritingstatingthenameand subjectofthefilmhasbeengiventotheManagerandthehirershall, withinthatperiodifsorequiredbytheTheatreManagement,givea previewofthefilmtosuchpersonsastheymaydirect.Ifthehirer, havingbeenrequiredtodoso,failstogiveapreviewofafilmas aforesaidoriftheTheatreManagementserveatanytimeuptothe exhibitingofthefilm,anoticeonthehirerthattheyobjecttothe exhibitionofanyfilminthehiredpremises,thenthatfilmshallnotbe showninthehiredpremises.

e) Nocinematographyexhibitioninvolvingtheuseofinflammablefilm shallbepresentedinthehall.

Betting,GamingandLotteries:

12. Thehirershallnotinanycircumstances:

a) Holdorpermittobeheldinanypartofthehiredpremisesanylottery, unlesssuchlotteryshallbe,bylawspermittedbyvirtueofthe provisionsofBettingandLotteriesAct1934,theGamingAct1968, TheBetting,GamingandLotteriesAct1963,TheBetting,Gaming andLotteriesAct1964andtheLotteriesandAmusementAct 1976andanyothermodificationamendmentorre-enactment hereoffromtimetotimeinforceandshallbeoperatedentirelyin accordancewiththeprovisionsofsuchActsor,

b) Useofpermitthehiredpremisesoranyparthereof,tobeusedforthe purposeofunlawfulgaming.

SubLetting:

13. Thehirershallnotsub-letthehiredpremisesoranypartthereof.Shouldhedosoorattempttodoso,thehiringwillstandcancelledandthechargespaidforfeited.TheTheatreManagementwillthereafterexercisetherighttorefuseanyfurtherapplicationforthehiringofitspremisesbythehirerorpurportedsub-hirer.

14. a) UndernocircumstanceswilltheTheatreManagementmakegoodor acceptresponsibilityorliabilityinrespectofanydamageortheftor lossofanypropertygoods,articlesorthingswhatsoeverplaced, deposited,broughtorleftuponthepremiseseitherbythehirerforhis useorpurposeorbyanyotherperson,orleftordepositedwithan officerorservantoftheTheatreManagementandthehirerwill indemnifytheTheatreManagementandtheirservantsandofficersin respectthereof.

b) TheTheatreManagementwillnotbeliableforanylosstoany breakdownofmachinery,failureofsupplyofelectricity,leakageof water,fire,governmentrestrictionsoranyotherunforeseenevent whichmaycausethepremisestobetemporarilyclosedorthehiring tobeinterruptedorcancelled.


c) ThehirershalleffectPublicLiabilityInsurancecovertoaminimum limitofindemnityof£2,000,000againstdeathorinjurytoanyperson orlossordamagetopropertyarisingoutoftheuseofthepremisesby thehirerandmayberequiredtoproducetotheManageracurrent insurancepolicycoveringtheriskreferredtoatleast21daysbefore thedareofhiring(seeNotesforGuidance).

RightsofEntry

15. Therightofentrytothehiredpremisesisreservedtoanymemberofthe TheatreManagementandanypoliceofficerondutyatanytimeduringthe hiringandtoanyotherpersonauthorisedbytheManager.

16. Thehirer,servants,agentsandcontractorsshall,duringthehiringandduring suchothertimesastheyoranyofthemshallbeinthehiredpremisesforthe purposeofthehiring,complywithallreasonablerequirementsoftheTheatre Manager'sofficers.

HoursofUseandHirer'sResponsibilities:

17. Thehiringdoesnotentitlethehirertouseorenterthehiredpremisesany othertimethanthespecifichoursforwhichtheyarehiredunlessprior arrangementshavebeenmadewiththeManager.

a) Thehirershall,duringthehiring,beresponsiblefor:

i) Theefficientsupervisionofthehirepremisesincludingthe effectivecontrolofchildren,thepreventionofunauthorisedentry tothehiredpremises,theorderlyandsafeclearanceofthehired premisesincaseofemergency.

ii) Thesafetyofthehiredpremisesandthepreservationofgood orderanddecencytherein.

iii) Ensuringthatalldoorsgivingegressfromthehiredpremisesare keptunfastenedandunobstructedandimmediatelyavailablefor exitduringthewholetimethehiredpremisesareinuseandthat noobstructionisplacedorallowedtoremaininanycorridor givingaccesstothehiredpremises.

iv) Ensuringthatnopersonsarestandinginanyofthegangways, blocking theseatingorsittinginanyofthegangways.

v) Anylossordamagetothehiredpremisesandfittingsequipment andotherpropertythereonarisingasadirectconsequenceof thehiring.

b) Thehirershallprovidesuchnumberofattendanceandstewardsas may,intheopinionoftheManager,benecessarytosecurethe observanceandperformanceoftheforegoingClauseforthis condition.


TheminimumnumberofStaffforanyeventheldintheTheatre (andfallingwithintheconditionsofthePublicandEntertainmentLicence)shallbesix.Exceptwhereotherwisearranged,fourwillbeprovidedbythehirersoftheTheatreandtwowillbeprovidedbyTheNorthamptonSchoolforGirls.AllstewardsmustattendameetingwiththeDutyManager10minutesbeforethedoorsareopentothepublictobebriefedonemergencyprocedures.AllstewardsmustwearidentificationsothattheycanbeeasilyidentifiedbytheManagementandpublic.

c) NominatedFirstAidersmustbeeasilyidentifiable(e.g.byuniformor namebadge).

d) FirstAidersmustsitinthedesignatedseats,L51andL52.

e) Ifthehirerfailstoobserveandperformanyoneormoreofthe stipulationsintheforegoingprovisionsofthisconditiontheTheatre Managementmay:

i) Chargetoandrecoverfromthehireranyexpenseincurredby theTheatreManagementinengagingpoliceconstablesorother personstosecuresuchobservanceandperformance:

ii) Cancelanyotherengagementforanyroomorroomsinthe hiredpremisesthatthehirermayhavemadewithoutincurring anyliabilitytothehirerwhatsoeverotherthanforthereturnof anyfeepaidtothemand,therefore,lessthananamountequal tofiftypercentofthetotalfeewhichwouldotherwisehavebeen payableinrespectofsuchcancelledengagementswhichsum mayberetainedbytheTheatreManagementasliquidated damagesforthelossofsuchengagements.

18. a) Thehirershallensurethatnoundesirablepersonispermittedto enter,remainorotherwisemakeuseofthehiredpremisesandthat nopersonshalltrespassonpartsofanySchoolCampusand buildingnotincludedinthehiring.

b) Nomorethan628peoplewillbeallowedintheaudience,whenusingtheFulllayout.Nomorethan577intheDanceformat,nomorethan580inthePitformat,nomorethan529intheMoatformat,nomorethan466intheRunwayformat,nomorethan455intheSmallHouseformatandnomorethan292intheBalconyformat.

19. Thehirershallnotbepermitthepremisestobeusedinamannercausing,or likelytocausenuisanceorannoyancetoowneroroccupiersofadjoining premisesorforanyimmoralorobscenepurposes.

20. TheTheatreManagementreservestherighttoputastoptoany entertainmentormeetingwhich,intheopinionoftheManager,isnotproperly conducted,withoutgivingrisetoanyclaimforarefundofthehiringfee.


Animals:

21. ExceptwiththeconsentinwritingoftheManager,thehirershallnotcauseor sufferanyanimalinhischargeorinthechargeofanypersonorpersons resortingtothehiredpremisesduringthehiringtoenterorremaininthehired premises.

VacatingthePremises:

22. a) Thehirershallberesponsibleforvacatingthepremisesatthetime shownonthebookingformandalsoensurethatthepremisesare leftinacleanandorderlystate.Anyexcesscleaningofdressing roomsorspacesafteranyeventwillberecharged.AtTheSpinney Theatretheproperty,i.e.tabs,lights,blacksetc.takendownor removedmustbereturnedtotheiroriginal positionasontheget-in.

b) Ifthepremisesarenotvacatedattheagreedtime,allextratimewill bechargedattheagreedrate.

CareofPremises:

23. Nobolts,nails,tacks,screws,bits,pinsorotherlikeobjectsshallbedrivenintoanypartofthehiredpremisesnorshallanyplacardsorotherarticlesbefixedthereto.

Refreshments:

24. AlldrinksandbeveragesshallbeservedundertheauspicesofTheSpinneyTheatreManagementandthelicenseesinbar,coffeebaranddiningareas.Ifahirerhasanyspecificcateringrequirementsorqueries,theymustindicatetheseonthebookingformforapproval.

25. a) Intheeventofthepremisesbeinghiredforthepurposeof exhibitionsorsimilarfunctionstheproposedarrangementsforstall, stands,gangwaysetc.andanyproposedconstructionshallbe agreedbythehirerwiththeManagerbeforethedateof commencementofsuchhiring.

b) TheTheatreManagementreservestherighttoreimburse themselvesofanycostsofadditionalhireofequipmentorservices usedduringthehireperiod.

Flagsetc:

26. a) Noflags,emblems,postersorotherdecorationsshallbedisplayed outsideanypartofthehiredpremiseswithoutthepreviousconsent oftheManager.


b) TheTheatreManagementreservestherighttoremoveanyflag, emblemorposterattachedtooroutsidethehiredpremiseswhich shallbecomesodirtyortornastobeuntidyorunsightly.

c) Thehirershallremoveanyflag,emblem,posterorotherdecoration displayedinsidethehiredpremisesif,intheopinionoftheManager, itshallbeunseemlyorexposethehiredpremisestoanundueriskor fire.

d) Onnoaccountshallcottonwoolorhighlyinflammablematerialbe usedfordecorationorotherpurposes.

LightingandElectricalSafety:

27. Thestagelightingequipmentshall,atalltimes,beoperatedbyqualified electriciansorotherpersonswhomtheTheatreManagementapproveforthat purposeandbynootherpersonwhatsoever.(Applicationsforsuchapproval tobemadetotheManagernoless7daysbeforethehiring).Whereasound amplificationsystemisprovidedthismayonlybeusedunderthesupervision oftheTheatreTechnicalManager.

28. Noadditionallightsorextensionsfromtheexistingelectriclightfittingsshall beusedwithoutthepreviousconsentoftheManager.

29. Electricalappliancesbroughtontothepremisesshouldbetestedforelectrical safety.PortableApplianceTestCertificatesmayberequiredfor inspection.

OnStageandBackstageSecurity:

30. Nopersonsotherthanthepersondirectlyconcernedwiththepresentationof anyfunctionshallbepermittedonthestageorintheancillary accommodationadjoiningthestage.

Auction:

31. Nopartofthehiredpremisesshallbeusedforthesaleoffurnitureorothergoodsbyauctionorotherwiseexceptwhenthehiredpremisesarespecificallyhiredforthatpurposeorforthepurposeofholdingasaleofworkorothersimilarhiringand,insuchcases,anyauctionshallbeincidentaltothemainpurposeofthehiring.

Cancellation:

32. Ifthehirershallcancelanyhiringofthehiredpremisesthenthefollowing chargescaleshallapply:

a)Cancelleduptoandincluding1monthbeforeevent-25%oftotalhiringfee

b)Cancelleduptoandincluding2weeksbeforeevent-30%oftotalhiringfee

c)Cancelleduptoandincluding1weekbeforeevent-50%oftotalhiringfee


33. TheTheatreManagementshallhavetheabsoluteandunfetteredrightto cancelanycontractofhiringatanytimeatitsownabsolutediscretionand shallnotbeliableforanyclaim,cost,action,demandorcompensationin respectofanylossordamagearisingfromsuchcancellationexceptthatthe paymentsorhiringfeeshallberefunded.

34. Withoutprejudicetotheirrightsofcancellationorrepudiationherein contained,theTheatreManagementshallbeentitledsummarilytocancelthe hiringatanytimebeforeorduringthehiring:

a) Ifthehirerfailstoobservetherequirementsofanyconditionsetout above,or

b) If,atanytimepriortothecommencementofthefunctionthe programmeorotherdetailsoftheparticularsreferredtointhe applicationformhavenotbeensuppliedor,ifsupplied,havenot beenapprovedbyandonbehalfoftheTheatreManagement.

Claims:

35. Anycomplaintarisingoutofthehiringandanyclaimsordemandsinrespect thereofmustbemadeinwritingtotheManagerwithin7daysoftheoccasion ofsuchacomplaint.

36. TheTheatreManagementacceptsnoresponsibilityforanypropertylefton thehiredpremisesaftertheperiodofhiring.

37. Anynotice,demandorrequestbytheTheatreManagementtooruponthe hirermaybesentbyordinarypre-paidpostaddressedtothehireratthe hirer'saddressgivenintheapplicationformandshallbedeemedtobemade orservedatthetimewhenthelettercontainingthesamewouldbedelivered intheordinarycourseofpost.

Variations:

38. TheTheatreManagementreservestherighttoalterorvarytheseconditionsoranyoneofthemandtoaddordeleteconditionsatitsabsolutediscretionandbyservingacopyofsuchvariedconditionsonthehirerbeforethecommencementofthehireperiod.

TheconditionsofhirearenotintendedtoabsolvetheTheatreManagementfromitsliabilitiesasownersofthepremises.Usersofthepremiseshaveageneraldutytotakeallreasonablecareandareremindedthat,insomeinstances,theycouldbeheldlegallyliabletopaycompensationforlossordamagetopropertyorinjurytopersons,anditisforthisreasonyouarerequiredtoeffectsuitableinsurance.(NoinsurancecoveroftheTheatreManagementcoversyourrisks).

Manyusers/hirerswillalreadyhavepublicliabilityinsurancecoverfortheirusualactivitiesbutitisstronglyrecommendedthattheinsurancecompanyconcernedshouldbeadvisedinwritingoftheworkingoftheTheatreManagement'sconditionsandconfirmationobtainedfromsuchinsurersthatthepolicyisfullyoperativeinrespectoftheuseoftheTheatreandPerformingArtsCentre.

Whereanyuser/hirerisamemberof,oraffiliatedto,anationalgroupororganisation,thenenquiriesshouldbemadetoascertainwhetheranyinsurancecoverisavailableforthebenefitoftheuser/hirerthroughthatnationalgroupororganisation.
