MR Legal Lines – Question of the Month
W ith the help of McClelland & Anderson, we are taking the most recently asked questions from our legal hotline and putting them in
E-news. We will be featuring a different question each issue. QUESTION: I am a licensed salesperson selling my own home to a friend who is not working through an agent. Should I act as a dual agent or transaction coordinator in this transaction? ANSWER: You cannot act as either a dual agent or a transaction coordinator in this transaction. Either role requires you to serve as a "neutral" which you cannot do if you are one of the parties to the transaction. In other words, it would be impossible under these circumstances for you to represent both parties equally. You will need to act as a seller's agent and the buyer will be a customer without a principal/agency relationship. For more Legal Q&A, visit http://www.mirealtors.com/Legal-Resources

From the December Report:
This past month (November) has been focused on preparing for the Annual Awards Banquet. November 30th was the last day of the fiscal year. We ended the year in a very posi ve posi on financially. I am also experiencing my first transi on in leadership, which has been a posi ve experience. I worked closely with the incoming President on our new commi ees and they are ready to present to the BOD. I had my first Ombudsman experience in November when I spoke with a seller complaining about his REALTOR. He told me his story and I asked him what he wanted me to do for him. In the end, I think he just felt be er talking to someone neutral. I hired a cleaning company to come in bi‐weekly and they started this week. Coming up: Office visits to correct or deliver awards Taking 5 days vaca on around Christmas holidays Holly and I con nue to work on physical files and
filing systems Holly is also working on a website overhaul Strategic Planning and Core Standards compliance

What’s new to cmiar.com?
In December we made some changes to
the Members por on of our website. You will no ce
that the Naviga on bar has fewer choices. The
missing items (CMAR Bylaws, Policy & Procedures,
Financial Policy, and NGLR MLS Policy & Procedures)
now have their own page en tled “Governing
Documents”.
Also in December, we have begun making changes
to the public facing website. Soon the Naviga on
bar will be completely different. Don’t worry, all the
same informa on will be available (plus some!), but
will simply be reorganized. Keep checking back to
see the changes.
