Who should use the guide? This guide is a helpful tool for all employees and employers who are covered by the

above award to identify their wages. The guide contains information about: who the award covers

wage rates, including rates for casual employees, junior employees, trainees and

apprentices if these employees are covered by the award penalties for working at particular times or under particular arrangements, including

some common penalty rates

allowances.

The award may provide other terms and conditions that are not contained in this guide, which must also be complied with.

Coverage

This industry award covers employers throughout Australia in the general retail industry and

their employees in the classifications listed in the award to the exclusion of any other modern award. The award does not cover employers covered by the following awards: - the Fast Food Industry Award 2010;

- the Meat Industry Award 2010; - the Hair and Beauty Industry Award 2010; or - the Pharmacy Industry Award 2010.

The award does not cover employees who are covered by a modern enterprise award, or an enterprise instrument (within the meaning of the Fair Work (Transitional Provisions and

Consequential Amendments) Act 2009 (Cth)), or employers in relation to those employees. The award does not cover employees who are covered by a State reference public sector

modern award, or a State reference public sector transitional award (within the meaning of the Fair Work (Transitional Provisions and Consequential Amendments) Act 2009 (Cth)), or employers in relation to those employees.

This award covers any employer which supplies labour on an on - hire basis in the industry set out in this instrument in respect of on - hire employees in classifications covered by this

award, and those on - hire employees, while engaged in the performance of work for a business in that industry. This subclause operates subject to the exclusions from coverage in this award.

This award covers employers which provide group training services for apprentices and/or trainees engaged in the industry and/or parts of industry and those apprentices and/or

trainees engaged by a group training service hosted by a company to perform work at a location where the activities described herein are being performed. This subclause operates subject to the exclusions from coverage in this award.

Where an employer is covered by more than one award, an employee of that employer is covered by the award classification which is most appropriate to the work performed by the

employee and to the environment in which the employee normally performs the work. NOTE: Where there is no classification for a particular employee in this award it is possible that the employer and that employee are covered by an award with occupational coverage.

Wages

The tables below have minimum hourly rates of pay and some of the most commonly used penalty rates.

Important: The tables below don’t include all of the penalty rates under the award. You’ll find a comprehensive list of penalty rates, and information about when they apply, in the Penalty Guide below.

You can calculate additional penalty rates under the award using PayCheck Plus at www.fairwork.gov.au. Important: If an industry allowance applies, it is included in the rates below. If an employee is entitled to other all-purpose allowances, the penalty

rates below won’t apply. All-purpose allowances are allowances added to a person’s base rate of pay before other entitlements (like penalty rates) are calculated. You can calculate penalty rates that include all-purpose allowances using PayCheck Plus at www.fairwork.gov.au.

The penalty guide below contains information about the penalties that are provided for in this award.

For full-time and part-time employees, the penalty amount in this table should be applied to the relevant rate of pay, being the base hourly rate plus any applicable all-purpose allowances.

For casual and part-time with loading employees, the way in which the penalty amount is applied depends upon the interaction between the casual/part-time loading and the penalty rate. The code displayed in the 'Amount' column of the penalty guide tells you which of the following calculations to use. If there is no code, the penalty does not apply to the casual/part-time with loading employees.

Frequency of Payment

Wages will be paid weekly or fortnightly according to the actual hours worked each week or

fortnight, or may be averaged over a period of a fortnight. From the first full pay period beginning on or after 23 August 2013, all wages shall be paid

on a regular pay day. The employer must notify the employee in writing as to which day is the pay day. Where for any reason the employer wishes to change the pay day, then the employer shall provide at least 4 weeks’ written notice to the employee of such change.

An enterprise which prior to the 1st January 2010, paid particular classifications of its employees on a monthly pay cycle may continue to pay these particular classifications of employees on a monthly pay cycle. However no employee classified at level 3 or below

under this Award may be paid on a monthly pay cycle and must be paid either weekly or fortnightly.

Pay Guide - Background

This guide provides information on wages, loadings and allowances.

Employers that an award applies to must provide at least the minimum terms and conditions in that award to all employees to whom the award applies.

One of the responsibilities of the Fair Work Ombudsman is to ensure compliance with the Fair Work Act 2009.

If an employer is able to demonstrate that they have paid at least the rates published in this guide, including wages, allowances and loadings, the Fair Work Ombudsman will be

satisfied that the employer has met those obligations under the award. The employer will need to have paid the wage rate for all hours worked and for the correct classification for the work the employee does.

The Fair Work Act 2009 requires that time and wages records be kept and pay slips issued. Employers will also need to demonstrate that this requirement has been complied with.

Who is not covered by this guide?

Despite the coverage provisions of this guide, conditions in this guide do not apply to an employee or employer while the employee or employer is covered by one of the following agreements:
