As required by O.C.G.A. 43-45-8 (3), the Georgia Structural Pest Control Commission submits the follow

annual report.

The Georgia Structural Pest Control Commission met monthly during Fiscal Year 2011 on the following

dates:

All meetings began at 9:30 AM with the exception of the February 8th

meeting, which began at 10 AM.

MINUTES OF THE GEORGIA STRUCTURAL PEST CONTROL COMMISSION MEETING

December 14, 2010

A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201 of the Agriculture Building on December 14, 2010. The following commission members were present: Jimmy Allgood, Chair, Maurice Redmond, Vice-chair, Ann Hyde, Chris Gorecki, Dr. Brian Forschler, Bodine Sinyard and Derrick Lastinger.

B. Also in attendance were Jim Harron and Josh Wiley with the Georgia Department of Agriculture, GPCA and CPCO representatives, registrants and other members of the pest management industry.

C. Motion was made by Mr. Sinyard to approve the minutes of the November meeting. Mrs. Hyde seconded the motion and motion passed.

D. The Commission approved company license applications (see Attachment 2). E. Mr. Wiley updated the Commission regarding a proposed Houston County Pest

Management Ordinance. He attended a recent meeting with the Houston County Board of Health. The Commission requested a copy of the draft ordinance. Mr. Lastinger mentioned that the department’s participation in the meeting was to address licensing concerns and questions.

F. Mr. Edge provided a legislative update. He mentioned that the November revenue numbers have increased 6% and that forty new house members and twelve senators will begin terms in the January 2011 session.

G. Mr. Gorecki discussed the Methods of Application document that he developed from 75 structural pesticide label reviews. Mr. Lastinger mentioned that at the November meeting the Commission requested that the Department, CPCO and GPCA to review and comment. Several comments have been received and reviewed. He will forward the revised document to US EPA pesticide registration staff for review and comment and send an updated version to the commission for final review prior to the January Commission meeting.

H. Mr. Lastinger reminded instructors and sponsors of recertification training to resubmit course applications and outlines to receive approval for recertification credit in 2011. Mr. Harron mentioned that course applications that request IPM credit but do not include IPM content on the course outline will not receive IPM credit approval. Mr. Lastinger followed-up on the Department’s effort to improve recertification monitoring. He discussed the January pilot to review recertification courses and the compliance assistance efforts that will continue through December 2011. Mr. Allgood added that the Department is required to monitor recertification training under the US EPA Cooperative agreement. Dr. Forschler reviewed the Department’s monitoring procedure and emphasized that instructors should not be concerned as we should all benefit from the audits.

I. Dr. Forshcler updated the Commission on the January Commission meeting location information. He also recommended the Healthy Homes website as a good resource for bedbug IPM in multifamily housing.

J. Dr. Forschler discussed the recent UGA review of the Department’s inspection and enforcement data on pesticide use in schools. The research indicated that PMP’s are not providing IPM services in schools. He also discussed the national School IPM 2015 document and apparent goal to eliminate pesticide use in schools.

K. Mr. Wiley discussed how to meet the specific areas treated requirement for WDO treatments. He also updated the Commission on recent efforts to address unlicensed pest control operators.

L. Mr. Harron mentioned that three colonies of Africanized honeybees have been recently reported in Georgia. He also clarified licensing requirements for treating the Kudzu Beetle that has become a common structural pest.

M. The Commission reviewed 118 applications for the certification examination.

MINUTES OF THE GEORGIA STRUCTURAL PEST CONTROL COMMISSION MEETING

February 8, 2011

A. The Georgia Structural Pest Control Commission convened at 10:00 a.m. in the Rooker Fireside Room located in the East Campus Village on the University of Georgia Campus in Athens on February 8, 2011. The following commission members were present: Jimmy Allgood, Chair, Maurice Redmond, Vice-chair, Ann Hyde, Chris Gorecki, Dr. Brian Forschler, Bodine Sinyard and Derrick Lastinger.

B. Also in attendance were Jim Harron and Josh Wiley with the Georgia Department of Agriculture, GPCA and CPCO representatives, registrants and other members of the pest management industry.

C. Motion was made by Mr. Sinyard to approve the minutes of the December meeting. Mr. Gorecki seconded the motion and motion passed.

D. The Commission approved company license applications (see Attachment 2). E. Dr. Ray Noblet, head of the Department of Entomology at the University of Georgia,

welcomed the Commission and attendees. F. Mr. Gorecki discussed the proposed Methods of Application guidance document. He

thanked Mr. Lastinger for facilitating comments from the various groups including US EPA. Motion was made by Mr. Gorecki to accept the Methods of Application document as a Commission guidance document. Mr. Sinyard seconded the motion and motion passed.

G. Mr. Lastinger discussed the Structural Pest Control Section’s priorities for FY2011-13. He highlighted the following areas:

o Self-auditing and reporting outreach o Targeted investigations of unlicensed operators o National regulatory participation in structural pesticide associations and

issues o Routine inspections of pesticide use and pesticide use record keeping o Targeted inspections of pesticide use in sensitive environments (schools,

daycares, nursing homes, restaurants) o Compliance assistance efforts, tracking and outreach o Structural fumigation outreach, compliance assistance and monitoring o Monitoring recertification training for quality assurance o Address compliance/enforcement issues with training using enforcement

data trends o Employee registration training manual and exam revision o Host National Structural Pesticide Inspector Workshop (2011) and co-host

National Pesticide Program Manager Workshop on structural pesticide issues (2011) and host the Association of Structural Pest Control Regulatory Officials (ASPCRO) conference (2013)

Mr. Gorecki mentioned that state regulatory officials in Florida are reviewing the GDA self-

audit and reporting policy and considering adopting a similar policy. Mr. Harron added that the Structural Pest Control Section staff is meeting this afternoon to discuss unlicensed operator investigations.

H. Mr. Harron discussed recertification course requirements and asked the Commission to review the need for specific training on pre-construction treatments and integrated pest management (IPM). The pre-construction treatment training was added to address compliance issues with these types of treatments and the issues have declined along with new home construction. While practicing IPM is increasing important, IPM principles are included in most training sessions. Dr. Forschler shared his concerns regarding a change in current IPM training requirements. Mr. Lastinger discussed the current policy on course content requirements.

I. Mr. Harron mentioned that several requests have been made from those that were not able to attend the GPCA Winter Conference due to the road conditions. The Commission discussed that exceptions could not be made due to regulatory requirements and the fact that training is widely available.

J. Mr. Lastinger discussed some recent concerns regarding the use of Truth termite bait. He clarified that partial bait tube applications would not be using the product consistent with the pesticide use directions.

K. Dr. Forschler provided the UGA Urban Pest and Structural Entomology Research Program Progress Report. He also mentioned that the Dirty Jobs TV segment featuring pest control on Sapelo Island will air on March 1st.

L. Mr. Wiley mentioned that pesticide use record keeping compliance has improved. M. Mr. Lastinger discussed Commissioner Black’s recent effort to save the Farmers and

Consumers Market Bulletin by reaching out to Georgia consumers for subscriptions. He provided subscription forms.

N. Mr. Redmond discussed the importance of collaborating with other state agencies when appropriate and beneficial.

O. Mr. Allgood recognized the successful cooperation of the Georgia Department of Agriculture and the Structural Pest Control Commission over the past 3 years.

MINUTES OF THE GEORGIA STRUCTURAL PEST CONTROL COMMISSION MEETING

March 8, 2011

A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201 of the Agriculture Building on March 8, 2011. The following commission members were present: Jimmy Allgood, Chair, Maurice Redmond, Vice-chair, Ann Hyde, Chris Gorecki, and Derrick Lastinger.

B. Also in attendance were Jim Harron and Josh Wiley with the Georgia Department of Agriculture, GPCA and CPCO representatives, registrants and other members of the pest management industry.

C. Motion was made by Mr. Gorecki to approve the minutes of the February meeting. Mrs. Hyde seconded the motion and motion passed.

D. The Commission approved company license applications (see Attachment 2). E. Mr. Allgood introduced Mr. Billy Skaggs, Chief Operations Officer and Dr. Reuben Beverly,

Director of Plant Industry. F. Mr. Skaggs discussed the Department’s Strategic Planning Process that started last week

with the Steering Committee meeting. As part of the process, the Structural Pest Control Technical Group will be meeting in the near future. Derrick Lastinger will represent the Department on this group.

G. Dr. Reuben Beverly recognized the Structural Pest Control Section staff and the Commission for their service to the industry.

H. Mr. Skin Edge updated the Commission on legislative matters. I. Mr. Lastinger discussed the Methods of Application guidance policy and how it is a useful

tool for the industry to help PMP’s comply with pesticide use record keeping requirements. J. Mr. Lastinger discussed generic termiticides and the registration requirements for these

products. Recently, a new product Adonis had been registered but the label did not include a defined treatment use pattern under the Georgia rule.

K. Mr. Lastinger provided copies of the Stored Product Pest bulletin authored by Dr. Dan Suiter.

L. Mr. Allgood recognized Dr. Forschler and his students on a recent episode of the Dirty Jobs TV show.

M. Mr. Wiley discussed the Department’s recent activities with unlicensed operators. N. Mr. Harron discussed recent issues with the Ensystex Isopthor label. The label requires the

product be placed in Ensystex stations only. EPA confirmed this label requirement. Ensystex plans to submit a label amendment to EPA to allow placement in other approved stations.

O. Commissioner Black announced that the Department is ready for change and that the support of Governor Deal and cooperation of the General Assembly will enhance these efforts. He also mentioned that the Market Bulletin subscription website and other website improvements would be online soon.

P. Mr. Lastinger recognized Raymond Davis for 38 years of service to the Department. Mr. Davis retired on March 1st.

Q. Mr. Lastinger mentioned that Florida structural pesticide regulators have contacted the Department for information on Georgia’s self-audit and reporting policy.

R. Mr. Lastinger mentioned that the recent inspector team meeting focused on enhancing the program’s outreach and compliance assistance activities.

S. The Commission reviewed 107 certification exam applications.

April 12, 2011

A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201 of the Agriculture Building on April 12, 2011. The following commission members were present: Jimmy Allgood, Chair, Maurice Redmond, Vice-chair, Ann Hyde, Chris Gorecki, Bodine Sinyard, Dr. Brian Forschler and Derrick Lastinger.

B. Also in attendance were Jim Harron and Josh Wiley with the Georgia Department of Agriculture, GPCA and CPCO representatives, registrants and other members of the pest management industry.

C. Motion was made by Mr. Sinyard to approve the minutes of the March meeting. Mrs. Hyde seconded the motion and motion passed.

D. The Commission approved company license applications (see Attachment 2). E. Mr. Allgood reviewed the history of certification exams and application reviews. Mr.

Lastinger discussed the Commission’s regulatory requirements and the current quarterly reviews. A Motion was made by Mr. Sinyard to review certification exam applications on a monthly schedule. Mr. Gorecki seconded the motion and motion passed. The new schedule will begin with the July Commission meeting and the application deadline will be June 1st.

F. Mr. Lastinger discussed the Commission’s “Cheating Policy” and two examinees that were found cheating on the exam by the proctor. The policy was enforced in both situations.

G. Mr. Lastinger discussed the new termiticide Adonis 2 F PPC. This product includes a perimeter only use pattern which is allowed under the defined treatment rule.

H. Mr. Lastinger discussed Commissioner Black’s strategic planning initiative for the Department. As part of the process, Structural Pest Control Technical Group was established to make recommendations on how to make the program more effective and efficient while meeting the needs of consumers, operators and the program’s regulatory responsibilities. The group includes 14 industry members, Mr. Lastinger and Dr. Forschler. The group had their first meeting on March 29th with a second meeting scheduled for April 19th.

I. Mr. Allgood read a letter from Commissioner Black recognizing the Commission as a valuable partner with the Department in overseeing the state’s structural pest control industry.

J. The Commission met with the Mr. Andrew Burger, the owner of BBBK. Mr. Burger, requested that the company name be changed to Bugs Burger Bug Killers, Inc. While the name is similar to other names, the Commission approved the request since the company has held this name as a federally-registered service mark since 1985.

K. Dr. Forschler discussed Dr. Suiter’s Termite and IPM workshops in Griffin. He mentioned that attendance was low for the IPM workshop.

L. Mr. Wiley discussed that some unlicensed companies have been found offering bed bug inspections using dog detection. Mr. Lastinger reported that EPA announced grant awards

to five organizations to implement new approaches for bed bug management. Mr. Redmon mentioned that the Georgia Public Health Department suggests hiring a pest management professional to treat hotels for bed bugs and other pests.

M. Mr. Edge updated the Commission on legislative matters. The Governor plans to call a special session this summer.

N. Mr. Allgood recognized Mr. Harron’s service to the Department, industry and Commission. Mr. Harron retires on June 1, 2011.

term and promoted Mr. Lastinger to the Director of the Structural Pest Control Section. F. GPCA lobbyist, Tiffany Coletta, provided a legislative update and indicated that a special

session is scheduled to begin on August 15th. G. Mr. Lastinger discussed the Department’s priority of monitoring the use of pesticides in

schools. He also mentioned US EPA’s recent announcement on new regional activities to increase implementation of IPM in schools. Activities will include outreach on IPM techniques to PMP’s that contract with schools for pest management services. Dr. Forschler discussed concerns with pest monitoring and action thresholds to justify pesticide applications in schools. He also mentioned a recent survey conducted by his graduate student on Georgia schools contracting pest management services. The survey reported that 92% of the state’s school districts contract pest management services.

H. Mr. Lastinger discussed US EPA’s recent rodenticide mitigation decision and the new label changes for professional use products. The industry needs to be aware of the new label restrictions. Mr. Gorecki recommended an article in the May issue of NPMA Pestworld for a good summary of the new restrictions and issues that PMP’s will face with the implementation of the new risk mitigation measures.

I. Dr. Forschler mentioned that UGA budget cuts may begin to reduce faculty in the near future. He also discussed some of the studies that his students are currently working on.

J. Mr. Wiley discussed a situation that prevented a DCO to provide proper supervision. He also mentioned that he had started a dialogue with the National Entomology Scent Detection Canine Association (NESDCA) on licensing requirements.

K. Mr. Lastinger mentioned Commissioner Black’s press release last week to remind Georgia consumers of the importance of hiring licensed pest control professionals for the inspection and the control of bed bugs in homes and businesses.

L. Mr. Lastinger mentioned that in collaboration with US EPA & University of California, Georgia hosted a workshop for Structural Pesticide Regulatory Officials in Atlanta last week. 27 states were represented. Officials discussed emerging issues.

MINUTES OF THE GEORGIA STRUCTURAL PEST CONTROL COMMISSION MEETING

JUNE 14, 2011

A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201 of the Agriculture Building on June 14, 2011. The following commission members were present: Jimmy Allgood, Chair, Maurice Redmond, Vice-chair, Ann Hyde, Chris Gorecki, Dr. Brian Forschler, Bodine Sinyard and Derrick Lastinger.

B. Also in attendance were Joshua Wiley with the Georgia Department of Agriculture, GPCA and CPCO representatives, registrants and other members of the pest management industry.

C. Motion was made by Mr. Sinyard to approve the minutes of the May meeting. Mrs. Hyde seconded the motion and motion passed.

D. The Commission approved company license applications (see Attachment 2). The Commission also approved certification examination applications.

E. Ann Hyde was commended for her many years of service on the Commission. Mr. Allgood recognized her dedication to her position.

F. Derrick Lastinger discussed ASPCRO’s involvement with the EPA on the new rodenticides label requirements ASPCRO sent a survey to the states to collect additional information on regulatory and enforcement issues and state needs. EPA announced that it is moving forward with product cancellations for non-compliant rodenticides.

G. Mr. Allgood mentioned that Derrick Lastinger had been proactive in addressing in-house pesticide application in schools. After meeting with Commissioner Black and State School Superintendent Dr. Barge, GDA agreed to make a list of recommendations. One of the main concerns discussed at the recent meeting included that some pesticide applications are being made by school staff that have minimal or no pesticide application training or experience. GDA sent a letter to Dr. Barge on June 1st including the following recommendations:

Georgia Department of Agriculture recommends that schools hire a licensed pest control company to provide pest management services. Licensed companies are required to have credentialed employees to properly apply pesticides and pest management practices to effectively manage infestations.

To ensure the safe use of pesticides, in-house pesticide applications are limited to school staff that have completed the Georgia Competent Applicators of Pesticides Program (GCAPP) or hold a commercial pesticide applicator’s license in category 35 Industrial, Institutional and Health Related Pest Control (see below for more information).

H. The ASPCRO bed bug survey was discussed by Mr. Lastinger. He mentioned that ASPCRO is

engaged in bed bug regulatory issues and coordinating some efforts with US EPA. ASPCRO is sending out a survey to the states to gather information from state lead agencies to best

determine how ASPCRO can best assist state programs. Mr. Lastinger asked for assistance from the state pest control associations with some of the survey questions hat would need industry input to best answer. Valera Jesse with the GPCA offered to assist.

I. Dr. Forschler mentioned that the budget cuts at UGA are making a huge impact. The latest cuts removed 18 positions in the Agriculture College and included the sale of a farm. He discussed the national initiative of IPM in schools and US EPA’s recent decision to define verifiable IPM. Dr. Forschler reminded the industry to focus education and training on IPM.

J. Mr. Lastinger provided an update on progress with Commissioner Black’s strategic planning. The SPC Technical Group submitted their report on May 30th. The report of recommendations will be reviewed along with 20 other reports to be consolidated into one report of recommendations to Commissioner Black by the strategic steering committee. Mr. Gorecki mentioned that the committee plans to meet in July to review the reports. Mr. Lastinger thanked the SPC Technical Group members and group co-chair, Mr. Gorecki, for their time and efforts. Mr. Allgood mentioned that Commission and industry need to review the current SPC laws and rules to better understand the current requirements.

July 13, 2010

C. Mr. Allgood welcomed Mr. Lastinger to the Commission. D. Motion made by Mr. Gorecki nominated Mr. Allgood as commission chairman and Mr.

o The primary election is next week and run-offs are expected o The first significant increase in revenue occurred last month o The Georgia Association of Realtors (GAR) forms committee will meet on

August 20th to discuss the Wood Infestation Inspection Report (WIIR) as a requirement on the GAR Purchase agreement.

H. Mr. Harron updated the Commission on a recent Association of Structural Pest Control Regulatory Officials (ASPCRO) meeting hosted by the Georgia Department of Agriculture. The meeting included attendance by five regulatory officials from other states, Dr. Forschler and several pesticide registrants. The meeting was productive and ASPCRO continues to move forward with efforts to adopt termiticide testing standards.

I. The Commission met with Mr. Van Williams and Cliff Killingsworth, both representing PEST.COM. Both representatives explained how the company will market and sell Georgia WIIR’s and other pest management services through their website. The Commission discussed current licensing requirements and shared several concerns regarding how the company will meet the requirements. The Commission asked that the representatives of Pest.com meet with Mr. Lastinger and Mr. Wiley to further discuss the company’s plan to market and sell pest management services in Georgia, and they will report back the Commission.

J. The Commission and Commissioner Tommy Irvin recognized Jim Harron for his service on the Commission. Mr. Harron was presented with a plaque and a gift recognizing his service on the Commission from 1998-2010.

K. Mr. Lastinger discussed an email received from Atlanta Pest Control regarding the website for Zone Pest Solutions. The Commission reviewed the Zone Pest Solutions webpage

www.atlantapestcontrolcompany.com. The Commission requested that Mr. Lastinger survey other states regarding regulatory requirements and issues related to internet advertizing.

L. The Commission met with Mr. Chinedu Osondu regarding the recent expiration of his HPC certification. Since the training requirements were not met in this category, the certification expired. Mr. Osondu asked that his HPC certification be reinstated since he is the DCO and owner of his company. The Commission recognized the regulatory requirement must be met but agreed to allow him to retest once application is made for the certification examination.

M. Mr. Wiley updated the commission on recent inspections on companies operating in Georgia from out-of-state locations. These inspections are finding many problems. Mr. Allgood recognized the program’s efforts in this area along with continued efforts to address unlicensed operators.

N. Mr. Lastinger discussed the Structural Pest Control Section compliance monitoring and enforcement priorities for FY2011. He highlighted a few priorities that will receive additional focus for the next year in addition to current efforts with unlicensed operators and out-of-state companies.

o Compliance Assistance will be part of all routine company inspections and most activities will be tracked.

o Targeted Inspections for routine compliance monitoring of pesticides applied in vulnerable communities such as long-term care facilities, hospitals, schools and adult and child daycare centers.

o Routine Inspections focusing on pesticide use requirements and record keeping requirements.

Assistance is provided with a new application which will be posted on the website. The application will improve compliance with employee registration requirements and allow better tracking of dual employee registrations.

G. Mr. Harron discussed some recent concerns and complaints from attendees at recertification trainings that the presentations are not meeting their expectations. More specifically, attendees commonly report that course content was not as described, course did not meet the indicated length of time, presentation was mostly sales information and not meaningful instruction, information was not accurate and/or instructor was not prepared or familiar with course content. Mr. Harron mentioned that the department, as part of our EPA certification grant, is required to monitor recertification training session. He submitted a proposal to routinely monitor training sessions to the commission for consideration which the commission will review and discuss at the next meeting.

H. Mr. Allgood thanked GPCA for the article recognizing the Commission in their recent PROFILE publication.

I. Mr. Lastinger provided and discussed the annual certification and licensing activity report and the inspection and enforcement activity report for fiscal year 2010. He highlighted the new reporting of Compliance Assistance Inspections and Self-Reporting Meetings.

J. Mr. Edge mentioned that the Georgia Association of Realtors (GAR) forms committee plans to meet on August 20th to discuss the Georgia Wood Infestation Inspection Report as a requirement on the GAR purchase agreement.

K. Dr. Forschler mentioned that he participated in a recent training meeting with the Georgia Dept of Agriculture inspectors in Athens. As part of this meeting, a review of the school

inspection data was discussed. He mentioned the following about the school inspection data set:

o There was no indication of inspector bias o Most violations were attributed to a few technicians o A significant proportion of the insecticides listed on the PUR's from the school

inspections data set were pyrethroids o Pyrethroid use indicates baseboard spraying is common o Regular, scheduled baseboard spraying with pyrethroids is not considered an IPM

approach o The training and support provided by the pesticide industry could present a

conundrum for implementation of IPM principles o Emphasis on record keeping is necessary to validate IPM and Green Pest

Management services L. Mr. Wiley mentioned that during a routine inspection a misuse incident was found involving

Termidor SC. The product was applied in a garage for crawling insects. Since the label does not allow for indoor applications, the application is a misuse of a pesticide. The misuse incident resulted in an enforcement action.

M. Mr. Wiley presented a video taken from a security camera to the Commission involving a registered technician applying a liquid insecticide around open food items in a convenience store. As a result of the incident, the department has put in place a policy that if an inspector observes a pesticide application being made that may cause harm to human health and/or the environment then the inspector is responsible for notifying the technician of the concern with minimum disruption to the business or facility. Mr. Gorecki commented that the industry has a responsibility as well if any PMP observes an application being made that has potential to harm human health.

N. Mr. Lastinger updated the Commission on the Pest.com issue. He has not received a response from the representatives of the company.

MINUTES OF THE GEORGIA STRUCTURAL PEST CONTROL COMMISSION MEETING

September 14, 2010

A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201

of the Agriculture Building on September 14, 2010. The following Commission

members were present: Jimmy Allgood, Chair, Maurice Redmond, Vice Chair, Bodine

Sinyard, Dr. Brian Forschler, and Derrick Lastinger.

B. Also in attendance were Jim Harron and Josh Wiley with the Department of

Agriculture, GPCA and CPCO representatives and other members of the pest

management industry.

C. Motion was made by Mr. Sinyard to approve the minutes of the August meeting. Mr.

Redmond seconded the motion and motion passed.

D. The Commission approved the company license applications (see Attachment 2).

E. Mr. Lastinger confirmed that the old Commission website hosted by Kelly Registration

Systems is no longer active. He also mentioned that the Department’s IT section is

creating a meta tag for the department hosted website. Mr. Allgood reminded the

Commission that the guidance policies are posted on the website, and Mr. Lastinger

provided copies of the policies to each Commission member.

F. Mr. Skin Edge of GPCA updated the Commission on the Georgia Association of

Realtors (GAR) forms committee work to include a requirement for the Georgia WIIR.

The committee is considering several options to address the WIIR on the GAR

purchase and sale agreement.

G. Mr. Lastinger updated the Commission regarding the recent US EPA Region 4

conference call regarding the internet advertising/licensing issue. Other states have not

looked into this issue and do not plan to focus on this issue anytime in the near future.

H. Mr. Lastinger discussed the Department’s long standing self-reporting policy. He

provided copies of a draft of guidance policy on self-reporting. The draft policy will be

posted on the Department’s website and provided to GPCA and CPCO when finalized.

The guidance document provides information on self-auditing and the necessary steps

to voluntarily self-report violations. The Commission recognized the Department’s

effort to enhance outreach efforts to the industry on the incentives for self-auditing and

reporting. The Commission had no further comments on the policy.

I. Dr. Forschler discussed the history of IPM practices in termite management and the

importance of IPM as we consider future regulatory changes. He requested the

Department’s assistance with compiling termite related complaints from Georgia

consumers. Mr. Lastinger agreed to work with Dr. Forschler in compiling this

information.

J. Mr. Lastinger provided an update on the recent ASPCRO conference held in

Charleston, West Virginia. He highlighted several of the national issues and mentioned

the ongoing efforts to revise the current Termiticide Performance Standards. The

ASPCRO draft guidelines are posted on the ASPCRO website and comments can be

submitted through October 20, 2010. Mr. Harron discussed the termiticide registration

process and the amount of time it takes to for new products to become available.

K. Mr. Lastinger updated the Commission on an ongoing investigation being conducted by

the Department involving pesticide misuse incidents in restaurants. He mentioned the

Commission’s production of records request and that the company cooperated with the

request and provided the records.

L. The Commission reviewed applications for the certification examination.

OCTOBER 12, 2010

A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201 of the Agriculture Building on October 12, 2010. The following Commission members were present: Jimmy Allgood, Chair, Maurice Redmond, Vice-chair, Chris Gorecki, Bodine Sinyard and Derrick Lastinger.

B. Also in attendance were Jim Harron and Josh Wiley with the Georgia Department of Agriculture, GPCA and CPCO representatives, registrants and other members of the pest management industry.

C. Motion was made by Mr. Sinyard to approve the minutes of the September meeting. Mr. Gorecki seconded the motion and motion passed.

D. The Commission approved company license applications (see Attachment 2). E. Mr. Lastinger mentioned that a new web address has been created for the Commission

website. The new address is www.agr.georgia.gov/spcc. He also indicated that the website maintains 24 months of Commission meeting minutes.

F. Mr. Allgood mentioned the recent attention to bed bugs in the local news. Mr. Redmond discussed the Department of Community Health’s (DCH) outreach efforts to address bed bug issues in hotels. He also mentioned a bed bug handbook resource available on the DCH website. Mr. Lastinger discussed the NPMA bed bug survey and recent article that highlighted PMP expectations from state regulatory agencies.

G. Mr. Skin Edge of GPCA updated the Commission on the Georgia Association of Realtors (GAR) decision to include a check box on the GAR Purchase and Sale Agreement and the Brokerage Agreements indicating that Form F-13 entitled Protecting Yourself When Buying a Home was received by the buyer. The Form F-13 includes information about the importance of obtaining an Official Wood Infestation Inspection Report when buying a home. The new GAR agreements will be required in 2011.

H. Mr. Gorecki discussed his recent effort to compile a list of pest control application methods from a review of 75 structural pesticide labels. He offered the Pest Control Methods of Application document for the Commission to consider as a guidance policy. The Commission will review and plan to discuss at the November meeting. Mr. Wiley mentioned that he had reviewed the document but will forward the document to the department field staff for review and comment. Mr. Gorecki also discussed the current ventilation requirements and the Commission guidance policy allowing closed crawl spaces for new construction termite treatments. He provided handouts on closed crawl spaces. The Commission will review the materials and discuss further at the November meeting.

I. Mr. Wiley updated the Commission on a significant case involving the misapplication of pesticides in over 200 restaurants. The company did not agree to a settlement and the department will take further action.

J. Mr. Lastinger noted a recent increase in pest control operators and registered employees requesting reinstatement under the active military exemption policy. He stated that the

policy is still in effect. The Commission authorized the department in February 2003 to waive recertification or reregistration requirements upon proof of extended active military service.

K. Mr. Harron discussed that recertification course applications and outlines are often being submitted as 55 minutes in length as the norm when they should be planned for 60 minutes to meet the requirements for recertification credit.

MINUTES OF THE GEORGIA STRUCTURAL PEST CONTROL COMMISSION MEETING

NOVEMBER 9, 2010

A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201 of the Agriculture Building on November 9, 2010. The following Commission members were present: Jimmy Allgood, Chair, Ann Hyde, Bodine Sinyard and Derrick Lastinger.

B. Also in attendance were Jim Harron and Josh Wiley with the Georgia Department of Agriculture, GPCA and CPCO representatives, registrants and other members of the pest management industry.

C. Mr. Allgood mentioned that the retirement celebration dinner for Commissioner Irvin is being held this evening at the Atlanta Farmer’s Market.

D. Motion was made by Mr. Sinyard to approve the minutes of the October meeting. Mrs. Hyde seconded the motion and motion passed.

E. The Commission approved company license applications (see Attachment 2). F. Mr. Lastinger discussed the Houston County Health Department’s plan to draft a pest

management ordinance that will have specific pest management requirements for multifamily housing facilities. The County Health Department has a meeting scheduled for November 18th in Warner Robins to discuss the draft ordinance. Mr. Wiley is scheduled to attend and represent the department.

G. Mr. Allgood announced that the January 2011 Commission meeting will be hosted by the Department of Entomology and held on the University of Georgia campus in Athens on January 11th at 10:00 A.M. Mr. Lastinger added that the Public Notice had been filed announcing the 2011 Commission Meeting schedule. The Public Notice was posted on the Commission website and copies provided to Commission members and CPCO and GPCA.

H. Mr. Wiley discussed several pending cases for unlicensed pest control operators involving Bedbug management services.

I. Mr. Harron updated the Commission on the pending FSC case. An Administrative Order had been sent to FSC. In response to the order, FSC requested a hearing and the date is pending.

J. Mr. Lastinger mentioned that US EPA registered a new termiticide, Altriset. K. Mr. Lastinger announced that a notice had been sent to all instructors and sponsors of

recertification training as a reminder to resubmit courses to receive approval for recertification credit in 2011.

L. Mr. Lastinger mentioned that the department is in the process of reviewing the Methods of Application document that Mr. Gorecki asked the Commission to consider as a guidance document at the October meeting. The Department plans to provide comments on the document at the December meeting. The Commission asked CPCO and GPCA to consider submitting comments prior to the December meeting.
