Value Added Tax (VAT)

The charges set out in this Schedule of Chargers are exclusive of Value Added Tax. VAT may be chargeable in accordance with the provisions of the Value Added Tax Act or with any orders or regulations made under it or by virtue of any act replacing or amending it.

Other Charges

Information on charges for training, apron services, aircraft handling, passenger handling and equipment and labour hire are available from the Chief Executive on request.

Glasgow Prestwick Airport Standard Terms and Conditions

1. Glasgow Prestwick Airport is operated by Glasgow Prestwick Airport Limited.

Definitions

2. In these terms and conditions:

3. All references to the operator or hirer or user or Company in these terms and conditions shall include their respective officers, employees, agents, servants and sub-contractors unless otherwise explicitly provided.

4. All references to injury in these terms and conditions includes sickness.

Choice of law

5. The terms and conditions shall be construed in all respects in accordance with the laws ofScotland.

Effective date of these terms and conditions

6. These terms and conditions take effect from the date of conditions.

Variation of these terms and conditions

7. The Company reserves the right at any time to amend, vary or discharge any of these termsand conditions of use and or charges.

Aviation Conditions of Use at Glasgow Prestwick Airport

General Conditions

8. The use of the Airport is subject to the following conditions:

a) Compliance with local flying restrictions and remarks published from time to time in the UK Air Pilot and NOTAMS; and

b) Compliance with instructions, orders or directions published from time to time by the Chief Executive; and

c) Compliance with directives on security of airports and aircraft issued by or on behalf of relevant government departments.

9. Operators of international air services using aircraft in excess of 15 metric tonnes are required to comply with the requirements of the UK Department for Transport (DfT) for the screening of hold baggage, the arrangements for which have been agreed between the Company and DfT.

10. The operator shall pay the appropriate charges for the landing, take-off, parking or housing of aircraft. The operator shall also pay for any other supplies, services or facilities provided to him or to the aircraft at the Airport by or on behalf of the Company, and the charges for such supplies, services or facilities shall (unless otherwise agreed before charges are incurred) be those as may from time to time be determined by the Company. Unless some other arrangement has been agreed in writing by or on behalf of the Company, all charges shall be payable to the Company on demand or, if earlier, whether a demand has been made or not, before the relevant aircraft departs from the Airport.

11. So long as the aircraft, its parts and accessories, or any property within or which has been carried within the aircraft, shall be upon the Airport or upon any land within the Airport allotted by or rented from the Company, the Company shall have a continual lien both particular and general for all charges of whatsoever nature and whensoever incurred which shall be or become due payable to the Company upon either:

a) the aircraft, its parts and accessories or any property within or which has been carried within the aircraft, in respect of which the charges were incurred whether or not they were incurred by the person who is the operator at the time when the lien is exercised; or

b) any other aircraft, its parts and accessories or any property within or which has been carried within the aircraft, of which the operator in default is the operator at the time when the lien is exercised.

12. The said lien shall not be lost by reason of the aircraft departing from the land under the control of the Company but shall continue and be exercisable at any time as to the property and as to the aircraft, its parts and accessories when the aircraft has returned to and is upon any such land.

13. If payment of any such charges is not made to the Company within 14 days after a letter demanding payment thereof has been sent by post addressed to the registered owner of the aircraft at any place at which it carries on business, the Company shall be at liberty from

time to time and in such manner as it shall think fit, to sell, remove, destroy or otherwise dispose of the aircraft, any of its parts and accessories and the property in order to satisfy any such lien

14. The Company shall be entitled to charge interest on any charges payable pursuant to these terms which have not been paid within 10 days of the due date for payment. Interest will be calculated on a daily basis from the date upon which the charges became due for payment until the date of payment of the charges (both dates inclusive) at LIBOR plus 5% and such interest shall be payable on demand.

15. For new scheduled services and any programmed charter service the Company may require adequate security to be provided for the payment of such charges as may be estimated by the Company to be payable for a period of up to six months in respect of such services, and such security shall be provided prior to such services commencing.

16. Neither the Company nor its servants or agents shall be liable for loss, damage or injury sustained by any passenger or aircraft, its parts or accessories or any property contained within the aircraft, occurring while the aircraft is on the Airport, is in the course of landing or taking off at the Airport, receiving navigation information from the Airport, or being removed or dealt with elsewhere for the purpose of paragraph 13 arising or resulting directly or indirectly from any act, omission, neglect or default on the part of the Company or its servants or agents unless done with intent to cause damage or recklessly and with knowledge that loss, damage or injury of the type sustained would result.

Load and Weight Details

17. The operator shall furnish to the Company in such form as the Company may from time to time determine, information relating to the movements of its aircraft prior to departure of the aircraft in question or if by prior written agreement with the Company within 24 hours of each of those movements, including information about the number of terminal and transit passengers and the weight and volume of freight embarked and disembarked at the Airport.

18. The operator shall furnish on demand in such form as the Company may from time to time determine, details of the maximum total weight authorised in respect of each aircraft owned or operated by it. The operator shall also furnish without delay details of any changes in the maximum total weight authorised in respect of each aircraft owned or operated by it.

19. The operator shall furnish to the Company within 14 days of a written request made by the Company, copies of aircraft load sheets to enable verification of all details with respect to the passengers carried on any or all flights arriving at or departing from the Airport during a specified period. The operator shall, following a request in writing made by the Company, produce for inspection by any person duly authorised in writing by the Company the original copies of such documents.

20. Where the operator fails to provide the information within the period stipulated, the Company shall be entitled to assess the charges payable hereunder by the operator by reference to the maximum total weight authorised and the maximum passenger capacity of the aircraft type. The operator shall pay the charge assessed by the Company.

Landing and Related Services

21. The operator shall not be entitled, in respect of any claim it may have against the Companyto make any set-off against or deduction from the charges provided for in these Conditions. It must pay such charges in full pending resolution of any such claim.

Landing Charge Rebates

Training Flights

22. In the case of a flight at the Airport carried out for the sole purpose of training (ab initio) student pilots or testing qualified flying personnel, a rebate may be granted subject to prior written application for permission to make the flight and for the grant of a rebate made to the Chief Executive. In no event shall the rebated Standard Weight Charge be less than the Minimum Charge.

23. The Chief Executive has discretion to negotiate agreements at special rates for flying training programmes to be carried out at the Airport.

Technical Stops

24. Special rates for ‘technical stops’ by civil transport aircraft - i.e. landings for the sole purpose of changing crew, re-fuelling or other technical purpose, but excluding diversions, may be available at the discretion of the Company.

25. Prior notice of any intended technical stop must be given to the Chief Executive in order to qualify for the special rates.

Test Flights

26. In the case of a test flight (excluding flights on Certificate of Airworthiness tests) carried out shortly before the intended departure of a commercial aircraft, only the Minimum Charge will be payable, provided that:

a) such test flight is undertaken solely for the purpose of ensuring that for the intended departure the aircraft engines and/or instruments of the aircraft are serviceable; and

b) before the test flight is carried out the operator of the aircraft shall notify the on watch Air Traffic Control Officer of the intended flight and shall satisfy him of the need for such test flight.

Positioning Flights

27. The Chief Executive has discretion to grant rebates of the Standard Weight Charge on aircraft positioning movements immediately before or after public transport flights. This rebate will not be granted on flights resulting from a diversion because of bad weather.

28. Prior written application for permission to make the positioning flight and for the grant of any rebate must be made to the Chief Executive.

Special Provisions For Reduced Charges

Flying Clubs / Private Flights

29. In the case of flying clubs based at or visiting the Airport the Chief Executive may negotiateagreements for reduced charges for flights made for the purposes of the clubs’ activities at the Airport, but not flights made for hire or reward. The red annual landing cards, issued by

AOPA for light aircraft used for private and club flying, are not valid at the Airport for exemption from charges.

Surcharges

Flights Outside Normal Hours

30. Normal hours of availability and accompanying Category and Rescue and Fire Fightingcapability are published in the UK Air Pilot, AGA Section Schedule of Hours. Where flights are made outside these hours prior arrangements must be made with the Company and the Company may at its sole discretion impose surcharges in addition to Standard Charges.

Hazardous Cargo

31. A surcharge will be levied against the operator of an aircraft operating through the Airportwho has declared the carriage of hazardous cargo in accordance with good practice as determined by the CAA or ICAO. Such declaration shall be made by the operator at the earliest practicable time, without exception.

Fuel/Oil spills

32. Where large spills have occurred (Spill covering more than 2m2), and it is found to bethrough the fault of, failure in the Aircraft, the Aircraft operator’s equipment or the Aircraft Operators processes. GPA reserves the right to seek compensation for the clean-up and for any damage to the surface that has been caused

Housing and Parking Charges

33. Information about the charges payable for the housing of aircraft may be obtained from the Chief Executive on request.

34. The charges for parking of aircraft at the Airport will apply whether the aircraft is secured to the ground or to a structure on the Airport or is left unsecured.

35. For aircraft where the maximum total weight authorised is in excess of 10 metric tonnes, two hours free parking will be allowed. Such period will not apply to diverted aircraft, or aircraft transiting the Airport without loading or unloading passengers or freight, or aircraft arriving as a result of a positioning movement.

36. The Chief Executive may, at his discretion, abate or waive charges in relation to the parking of the aircraft at certain times and periods, or on certain parts of the Airport. The Chief Executive will supply details of the terms and conditions of the abatement or waiver of the charges upon the request of any operator who regularly parks aircraft at the Airport.

37. The Chief Executive may, at his discretion, decide that the parking of aircraft for periods of one month or more may be permitted at certain times of the year or on certain parts of the Airport. In this event the company will supply details of the terms and conditions of long term parking upon the request of any operator who wishes to park aircraft at the Airport, and the operator may apply to the Company for the benefit of these terms and conditions. Once such an application has been approved, the appropriate charge becomes payable and no abatement or waiver will be granted even though full use may not be made of the facilities which the application covers. At his discretion, the Chief Executive may allow another aircraft to be substituted for an aircraft for which a long-term parking charge has been paid.

38. The Chief Executive may at any time order an aircraft operator either to move a parkedaircraft to another position, or remove it from the Airport. Failure to comply with the order within the period specified in it will render the operator liable to a special charge equivalent to eight times the standard parking charges for every hour or part of an hour during which the aircraft remains in position after the period specified in the order has expired.

Air Navigation Services Air Navigation Charge Rebates

39. Air Navigation Charge rebates may be given in respect of any of the following:

a) non-public transport flights on a journey not exceeding 185 kilometres;

b) flights by fixed wing aircraft engaged on a scheduled journey not exceeding 185 kilometres;

c) flight carried out for the sole purpose of the training or testing of flying personnel;

d) aircraft positioning movements immediately before or after public transport flights. This rebate will not be granted on flights resulting from a diversion because of bad weather;

e) ‘technical stops’ by civil transport aircraft - i.e. landings for the sole purpose of changing crew, re-fuelling or other technical purpose, but excluding diversions;

f) ‘circuits’ - i.e. those phases of a flight conducted within the circuit pattern of the Airport in which the aircraft is in communication with the Air Navigation Service and is normally followed by a final approach or a go-round or a touch-and-go or another circuit or a landing.

40. A rebate may be granted to an aircraft constructor in respect of a flight carried out under the ‘B conditions’ specified in Schedule 2 of the Air Navigation Order 1989, provided that:

a) the aircraft is in course of construction at the Airport; and

b) the flight originates and terminates at the Airport without intermediate landing elsewhere.

41. Prior written application for the grant of rebates should be made to the Chief Executive.

42. Rebates will not be granted retrospectively.

Exemptions

43. Air Navigation Charges will not be charged in respect of a test flight (excluding flights on a Certificate of Airworthiness tests) carried out shortly before the intended departure of a scheduled commercial passenger or freighter aircraft, provided that:

a) The test flight is undertaken solely for the purpose of ensuring that, for the intended departure, the aircraft engines and/or instruments are serviceable;

b) Before the test flight is carried out, the operator of the aircraft shall notify the on watch Air Traffic Control Officer of the intended flight and shall satisfy him of the need for such test flight;

c) If a further test flight is considered necessary the operator shall again apply in the manner set out herein.

Rebates and exemptions from Air Navigation Charges will not be granted when aircraft are diverted or obliged to land exceptionally (e.g., by reason of bad weather, traffic congestion etc).

Apron Services Terms and Conditions

44. The use of Apron Services is conditional upon the operator / user’s compliance with instructions, orders or directions published from time to time by the Chief Executive.

Liability and Indemnity

45. The operator shall not make any claim against the Company and shall indemnify it (subject as hereinafter provided) against any legal liability for claims including expenses incidental thereto, in respect of:

a) delay, injury or death of persons carried or to be carried by the operator; and

b) injury or death of any employees of the operator; and

c) damage to or delay or loss of baggage, cargo or mail carried on to be carried by the operator; and

d) damage to or loss of property owned or operated by or on behalf of the operator and any consequential loss or damage arising from any act or omission of the Company in the performance of these services unless done with intent to cause damage, death, delay, injury or loss or recklessly and with the knowledge that damage, death, delay, injury or loss would probably result;

provided that:

e) all claims arising hereunder shall be dealt with by the operator; and

f) the Company shall notify the operator of any claims without undue delay and shall furnish such assistance as the operator may reasonably require; and

g) where any of the services performed by the Company hereunder relate to the carriage by the operator of passenger baggage or freight direct to or from a place in the United States of America then, if the limitation of liability imposed by Article 22 of the Warsaw Convention would have applied if any such act or omission had been committed by the operator but is held by a Court not to be applicable to such act or omission committed by the Company in performing this agreement, then upon such decision of the Court, the indemnity of the operator to the Company hereunder shall be limited to an amount not exceeding the amount for which the operator would have been liable if it had committed such act or omission.

46. The operator shall not make any claim against the Company in respect of damage, death, delay, injury or loss to third parties caused by the operation of the operator’s aircraft arising from an act or omission of the Company in the performance of these services unless done with intent to cause damage, death, delay, injury or loss or recklessly and with knowledge that damage, death delay, injury or loss would probably result.

47. Notwithstanding the provisions of paragraph 46, in the case of claims arising out of surface transportation which is provided on behalf of the operator and is part of the operation of loading/embarking or unloading/disembarking and/or is covered by the operator’s Contract of Carriage the indemnity shall not exceed the limits specified in the said Contract of Carriage, which shall not be less than £40 million per occurrence.

48. In the case of claims arising out of surface transportation which is not provided on behalf of the operator and/or is not part of the operation of loading/embarking or unloading/

disembarking and/or is not covered by the operator’s Contract of Carriage the waiver and indemnity herein contained shall not apply.

49. The Company shall not make any claim against the operator and shall indemnify it (subject as hereinafter provided) against any legal liability thereto in respect of:

a) injury to or death of employees of the Company, its servants, agents and sub-contractors; and

b) damage to or loss of property owned or operated by or on behalf of the Company and any consequential loss or damage, arising from an act or omission of the operator in the performance of these services unless done with intent to cause damage, death, delay, injury or loss, or recklessly and with knowledge that damage, death, delay, injury or loss would probably result.

50. Diplomatic mail and precious goods will be handled by the Company at the sole risk of the operator at all times and the Company shall be under no liability whatsoever for loss or damage thereto howsoever caused. The operator undertakes and agrees to indemnify the Company and its employees, servants agents and sub-contractors in respect of any Claims which may be made against them or any of them arising out of or in connection with such loss or damage.

51. The Company reserves the right to amend the charges for Apron Services from time to time as may be considered necessary by it to take account of changes in wages, costs of other relevant conditions.

52. The Company reserves the right to modify, suspend or terminate the provision of the services at any time, but will give notice of such intention so to do as is considered practicable in the circumstances.

Aircraft Operator’s Obligations

53. Acceptance by an operator of any of the services provided by or through the Company shall constitute acceptance by it of all the conditions to which they are subject and the operator shall:

a) Be responsible for supervising the loading and unloading of its aircraft and for supervision of the positioning and securing of all ‘dead’ loads so as to ensure the safety of the aircraft, its passengers and contents both in the air and on the ground;

b) Provide any special equipment not held by the Company necessary for the handling of unusually heavy or awkward items of freight;

c) Provide any special equipment required for handling animals;

d) Provide all materials including rope, webbing and timber which may be required for the proper stowing and securing of ‘dead’ loads in the aircraft;

e) Ensure that its staff co-operate fully with the Company to ensure the safe, efficient and economical operation of the Apron Services;

f) Pay such additional charges as the Company may reasonably demand in respect of the operator’s failure to comply with the foregoing Conditions of Use.

g) Be responsible for the safe custody at all times of diplomatic mail and precious goods. The expression ‘precious goods’ means anything falling into one or more of the following classifications:

i) Any cargo exceeding in value 250 French Gold Francs of 65½ milligrams gold of millesimal fineness 900 per gross kilograms or their equivalent; or

ii) Precious metals including platinum, gold and silver in any form; or

iii) Legal tender in bank notes or any other form, securities, shares and share coupons; or

iv) Precious stones, including diamonds, rubies, emeralds, sapphires, pearls and jewellery consisting of these items; or

v) Goods the subject of a special declaration of value pursuant to the IATA Conditions of Contract in force for the time being; or

vi) Cargo marked ‘VAL’ or similar on the aircraft cargo manifest and including things contained in passenger or crew baggage or inside other cargo.

Standard Services

54. Apron Services shall be provided by the Company to each aircraft allocated a stand on the Apron. The Apron Service Charges include the provision of the following standard services all of which will be rendered on the basis that the aircraft remains under the care and supervision of the operator at all times:

a) providing a marshal to assist on arrival at or departure from the stand;

b) placing chocks in position on the arrival of the aircraft on stand and providing for their removal on departure;

c) placing in position and any necessary movement of passenger and crew steps;

d) the provision of suitable ground power if required, up to a maximum of two hours;

e) flushing and replenishment of fresh water tanks and the operation of a toilet service unit;

f) provision of a suitable aircraft tow bar, the operation of a push-back tug and the manning of a portable fire extinguisher during engine starting for the purposes of departure of the aircraft from the stand;

g) the transportation of passenger and crew baggage between the baggage sorting area at the rear of the check-in desks and the aircraft and for arriving flights between the aircraft and the baggage reclaim area;

h) the transportation of freight between the aircraft operator’s cargo shed or bonded store and the aircraft;

i) the palletisation of cargo prior to loading onto the aircraft and depalletisation following unloading from the aircraft all under the supervision of the operator. The staff required for palletisation and depalletisation shall be provided at times which the Company judges to be compatible with traffic demands;

j) the loading and unloading of dead loads into and out of the aircraft under the supervision of the operator in accordance with paragraph 53; and

k) the stowing and securing of passenger and crew baggage, freight, stores and ballast in the aircraft under the supervision of the operator in accordance with paragraph 53.

55. The expression ‘dead loads’ referred to above shall not include catering supplies andequipment, supplies of liquor and tobacco in bulk or any goods ordered by or on behalf of passengers for delivery to the aircraft.

Additional Services

56. The following additional services are available on request and charges can be obtained on application to the Chief Executive:

a) changing of head or pillow covers supplied by the aircraft operator;

b) the replenishment of literature and air-sickness bags (both to be supplied by the operator);

c) the provision and filling of ballast bags;

d) the dressing of aircraft toilets;

e) the cleaning of aircraft baggage and cargo hold interiors.

Apron Service Charges

57. The charges payable in relation to an aircraft for the standard services shall be the charges specified in the Apron Services Schedule of Charges and shall be payable in respect of every movement except as varied in paragraph 60 below.

58. The Handling charge shall be calculated on the aggregate weight of all “dead” loads excluding the weight of passenger baggage unloaded from the aircraft and the weight of all “dead” loads excluding passenger baggage loaded onto the aircraft.

59. The off-loading and reloading of all or part of an aircraft to restore trim or for any other reason will be the subject of an additional charge based on the weight of the “dead” loads including the weight of the passenger baggage reloaded onto the aircraft and charged at the Handling rate shown in the Schedule of Charges.

60. The Apron Service Charges set out in the Apron Services Schedule of Charges may be varied. If an aircraft lands as a notified technical stop for the purpose of refuelling or for maintenance and requires only the services provided at paragraph 54 then the charges at“Apron Service Charges” in the Schedule of Charges will be charged for arrival only. Transportation of crew baggage will be charged as an additional service.

Training flights

61. Rates can be obtained from the Chief Executive for the provision of services to trainingaircraft.

Second or Subsequent Services to Aircraft

62. Where an aircraft returns to the stand for technical reasons or other circumstances of a likekind and the services required do not extend beyond those in paragraph 54 inclusive, then a charge of 50% of the Apron Service Charges in the Apron Services Schedule of Charges will be applied.

New Services

63. Operators may be granted introductory rebates for new services on prior applications.

Transiting Aircraft

64. An aircraft transiting the Airport with no change of load will pay Apron Service Charges for arrival only.

65. Aircraft handling services are provided by the Company. The charges for aircraft handling are inclusive of the following:

a) Full passenger check-in;

b) Passenger escort;

c) Full mishandled baggage facilities;

d) Load control / weight and balance;

e) Receiving flight plan, filing and ATC slots;

f) Acquiring weather package;

g) Crew briefing;

h) Arranging passenger / crew accommodation/transport;

i) Liaison with third parties, i.e. fuelling companies, etc. and supervision of aircraft cleaning, unloading/loading of catering etc;

j) Arrivals / departures messages;

k) Supervision of all off / on load;

l) Preparation and completion of trim/load sheets and preparation of short range flight plans;

m) Filing Air Traffic Control flight plans, crew briefing and meteorological briefing;

n) Air Traffic and Customs clearance.

Aircraft Handling Terms and Conditions

66. The following conditions apply to the aircraft handling charges:

a) A surcharge of 33% will apply to the rates on movements between 1800 and 0600 hours local time.

b) A reduction of 50% on the rates will apply to aircraft operating in Transit only (no load change).

c) Any abnormal activities e.g. passenger/baggage search (bomb scare) will attract additional charges.

67. Charges for freighter aircraft on application and will be in consideration of type of load etc.

68. In case of a night stop, a flight will be considered as two separate movements due to Customs / Immigration formalities plus extra hours for handling inbound/outbound.

69. ‘SPECIAL’ contract rates are available, depending on the number of movements per annum on a scheduled basis.

70. If departure is delayed by more than five hours, a surcharge of 33% may apply.

Conditions of Hire of Vehicles and Equipment

71. Vehicles or equipment hired will be continuously under the control of an employee of the Company duly authorised to drive or operate the vehicle or equipment in question.

72. Vehicles or equipment will only be hired on receipt of an application on the appropriate hire form or by telephone from regular users on the understanding that the hire form will be signed on completion of the hire.

73. The hirer on signing the equipment hire form, or for regular users requesting the hire, accepts these conditions of hire for the hire of vehicles and equipment.

74. The period of hire will be based on the time a vehicle or item of equipment is away from its garage or ‘standing’.

75. Unless otherwise stated the minimum period for the calculation of hire charges will be 15 minutes. Thereafter the charge will be in increments of 15 minutes or part thereof.

76. Hirings will not be aggregated except in a situation where a second hire period for the same item commences before the expiry of the minimum period.

77. The hire rate for each vehicle or item of equipment includes the cost of one driver or one operator and for a Fire Appliance the full manning crew.

78. The use of the vehicle/equipment is subject to its being available on the airport and not being required for the purposes of the Company. The decision as to whether it is so available being at the discretion of the Chief Executive.

79. The period during which any vehicle/equipment can be hired shall be at the discretion of the Chief Executive.

80. In consideration of permission relating to the hire being granted, the hirer undertakes and agrees:

a) to make no claim against the Company or any of its servants in respect of loss or damage to property or in respect of personal injury (including injury resulting in death) which may arise out of or in connection with the use of the vehicle/equipment other than claims which are properly attributable to wilful misconduct or gross negligence on the part of a servant of the Company;

b) to indemnify the Company and its servants against all legal liability incurred in respect of claims (including claims by servants of the Company or of the hirer) for loss of or damage to property or for personal injury (including injury resulting in death) which may be made against the Company or any of its servants arising out of or in connection with the use of the vehicle/equipment other than claims which are properly attributable to wilful misconduct or gross negligence on the part of a servant of the Company;

c) to indemnify the Company in respect of any loss of or damage to the property for which the Company is responsible which may arise out of or in connection with the use of the vehicle/equipment and which is properly attributable to the wilful misconduct or negligence of any servant of the hirer;

d) to pay charges as set out by the company from time to time.

81. The charges for the hire of attachment equipment are exclusive of the cost of the prime mover and labour except in the case of the Sicard where the rate includes the cost of an attendant.

82. The charges for the hire of the Runway De-Icing Unit and Aircraft De-Icing Unit do not include the cost of de-icing fluid which will be charged per gallon or part thereof.

83. Special rates may be applied for equipment hire during non-standard handling events.

Conditions of Hire of Labour

84. Labour can be hired from the Company on receipt of an application on the appropriate hire form or by telephone from regular users on the understanding that the hire form will be signed on completion of the hire.

85. The hirer on signing the labour hire form; or requesting the hire, accepts these conditions of the hire for the Company’s servants.

86. The hire of labour does not include charges for vehicles or equipment. The period of the hire will be based on the time the employee is unavailable for his normal duties on behalf of the Company.

87. There are two bands of charges as follows:

a) Craftsman, General Hand and Security Guard. The minimum period of hire will be 15 minutes per employee; thereafter the charge will be in increments of 15 minutes or part thereof.

b) Systems Engineers and Electronic/Air Traffic Engineers. The minimum period of hire will be 1 hour per employee; thereafter the charge will be in increments of 30 minutes or part thereof.

88. The use of the labour is subject to its being available on the Airport and not being required for the purposes of the Company, the decision as to whether it is so available being at the discretion of the Chief Executive.

89. The period during which any labour can be hired shall be at the discretion of the Chief Executive.

90. In consideration of permission relating to the hire being granted, the hirer undertakes and agrees:

a) to make no claim against the Company or any of its servants in respect of loss or damage to property or in respect of personal injury (including injury resulting in death) which may arise out of or in connection with the use of labour other than claims which are properly attributable to wilful misconduct or gross negligence on the part of the company;

b) to indemnify the Company and all its servants against all legal liability incurred in respect of claims (including claims by servants of the Company or of the hirer) for loss of or damage to property or for the personal injury (including injury resulting in death) which may be made against the Company or any of its servants arising out of or in connection with the use of the labour other than claims which are properly attributable to the wilful misconduct or gross negligence on the part of a servant of the Company.

c) to indemnify the Company in respect of loss of or damage to the property of the Company or property for which the Company is responsible which may arise out of or in connection with the use of the labour and which is properly attributable to the wilful misconduct or negligence of any servant or hirer;

d) to pay charges set out by the Company from time to time.
