    Act No. 2 2009 – An Act to constitute the Barangaroo Delivery Authority; to specify its functions; and to provide for other matters related to the development, use and management of Barangaroo. [Barangaroo Delivery Authority Bill].

    Act No. 3 2009 – An Act to amend the Children and Young Persons (Care and Protection) Act 1998 and related legislation with respect to the employment of children. [Children and Young Persons (Care and Protection) Amendment (Children’s Employment) Bill].

    Act No. 4 2009 – An Act to amend the Crimes (Appeal and Review) Act 2001 to make further provision with respect to appeals and applications for annulments; and for other purposes. [Crimes (Appeal and Review) Amendment Bill].

    THE Environment Protection Authority (EPA) declares the following land to be a remediation site under the Contaminated Land Management Act 1997 (“the Act”):

    1. Land to which this declaration applies ("the site")The site, comprising Lots 575, 576, 587, and 588 in DP

    14716, is located at 20 Carvers Road, Oyster Bay in the local government area of Sutherland Shire Council.

    2. Nature of contamination affecting the site:The EPA has found that the site is contaminated with the

    following substances (“the contaminants”):• Total Petroleum Hydrocarbons (TPH)• Benzene, Toluene, Ethyl benzene and Xylenes

    (BTEX)

    3. Nature of harm that the contaminants may cause:The EPA has considered the matters in s.9 of the Act and

    has determined that the contamination at the site warrants regulation under the Act for the following reasons:

    • High concentrations of contaminants, including TPH and BTEX, in groundwater exceed human health and ecological guideline criteria;

    • Petroleum hydrocarbons, including benzene, have migrated off-site, beneath adjacent properties;

    • Exposure to this contamination can cause adverse health effects;

    • Exposure to the contamination may occur if contaminated groundwater is extracted, excavations are carried out in the affected area or from inhaling chemicals volatilising from groundwater.

    THE Environment Protection Authority “EPA” declares the following land to be a Remediation Site under the Contaminated Land Management Act 1997 (“the Act”):

    1. Land to which this declaration applies ("the site")The site is a former Shell fuel depot located at Adelaided

    Street, Moree NSW 2400 in the Local Government Area of Moree Plains Shire Council and comprises:

    • Lot 1 in Deposited Plan 316750; • Lot A in Deposited Plan 410632; and • Lot 1 in Deposited Plan 16225.

    2. Nature of contamination affecting the site:The EPA believes that the site is contaminated with the

    following substances (“the contaminants”): • Petroleum hydrocarbons including benzene, toluene,

    ethyl benzene and xylenes.

    3. Nature of harm that the contaminants may causeThe EPA has considered the matters in s.9 of the Act and

    has determined that the contamination at the site warrants regulation under the Act for the following reasons:

    • The groundwater at the site is contaminated with separate phase hydrocarbons and dissolved phase hydrocarbons at concentrations exceeding relevant guideline values;

    • The hydrocarbon contaminat ion includes benzene;

    • The hydrocarbon contaminated groundwater has migrated off-site towards adjoining residential area and there is potential for the contaminated groundwater to continue to migrate off-site if left unchecked; and

    • There are potential exposure pathways to the contamination through the extraction and benefi cial uses of groundwater in the vicinity of the site, and

    workers may be accidentally exposed to vapours that may accumulate in excavations and service utilities.

    THE NSW Food Authority advises of convictions under the Food Act 2003 relating to offences in the handling, storage and sale of food made against John Thomas Harvey, at the business addresses of “Mayfi eld”, Coppabella Road Rosewood, NSW 2652. The defendant was charged with two offences under section 104 (2) of the Food Act 2003 of carrying on a business, namely an abattoir, and carrying on a business activity, namely a meat processing plant, both without a licence. The total penalty imposed under the Act was $400 plus court and legal costs of $793. This notice is made after the statutory time for appeal has elapsed.
