  • ENERGY SAVINGS SCHEME (ELECTRICITY LOAD EXEMPTIONS) ORDER 2020

    Under the

    ELECTRICITY SUPPLY ACT 1995

    I, Matt Kean MP, Minister for Energy and Environment, in pursuance of clauses 22(1)(b) and 25(2) of Schedule 4A of the Electricity Supply Act 1995 (the Act) and being satisfied that each electricity load to which this Order applies is used in c01mection with an industry or activity that is both emissions

    intensive and trade exposed and that the exemptions are generally consistent with the objects of Pait 1

    of Schedule 4A of the Act, make the following Order.

  • 2 Commencement

    This Order commences on 1 January 2021 and is required to be published in the NSW Government

    Gazette.

    3 Exemptions

    (1) Any electricity load used in c01mection with a specified activity set out in Column 1 of Schedule

    1, at the corresponding location specified in Column 2 of Schedule 1, is either fully or partially exempt from the Energy Savings Scheme in Schedule 4A of the Act as specified i.n Column 3 of

    Schedule l.

    (2) For pa1tial exemptions, the exempt proportion of each electricity load is specified in Colmm1 4 of

    Schedule 1 (expressed as a percentage).

    4 Allowances

    In applying an exemption granted by this Order, a scheme participant may deduct from the total value of its liable acquisitions an allowance of 5% of the exempt propo1tion (specified in Colunm 4 of Schedule 1) for electricity losses occurring between the purchase of the electricity by the scheme

    participant and its use by an end user.

    5 Rules

    The Scheme Regulator is authorised to make rules with respect to the exemptions granted by this Order (including rules relating to the assessment of deductions under Division 5 of Pait 1 of Schedule

    4A of the Act). For these purposes, the Energy Savings Scheme - Scheme Regulator Exemptions Rule No. 1 of 2016, unless revoked, is deemed to be a rule made by the Scheme Regulator with respect to

    the exemptions granted by this Order.

    6 Revocation

    The order made under section 119 of the Act dated 10 December 20 19 and published in NSW Government Gazette No 173 of 13 December 2019, pages 5647 - 5651, is revoked. In accordance with clause 25(3) of Schedule 4A of the Act this revocation will take effect on 1 January 2021.

    ELECTRICITY SUPPLY ACT 1995

    I, Matt Kean MP, Minister for Energy and Environment, in pursuance of clause 78(2A) of Schedule

    4A of the Electricity Supply Act 1995 and being satisfied that small retailers generally are, or will be,

    unable to meet the individual energy savings target for the year 2020 because of an emergency affecting the State or pa1i of the State, make the following Order.

    Explanatory note

    The object of this Order is to reduce, by 100%, the individual savings targets for all small retailers in

    respect of the year 2020:

    This Order is made under clause 78(2A) of Schedule 4A of the Electricity Supply Act 1995.

    ENERGY SAVINGS SCHEME (SMALL RETAILER) ORDER 2020

    under the

    ELECTRICITY SUPPLY ACT 1995

    1 Name of Order

    This Order is the Energy Savings Scheme (Small Retailer) Order 2020.

    2 Commencement

    This Order commences on the day it is published in the NSW Government Gazette.

    3 Interpretation

    (1) In this Order-small retailer has the same meaning as in clause 78 of Schedule 4A to the Act. the Act means the Electricity Supply Act 1995.

    Note. The Electricity Supply Act 1995 and the Interpretation Act 1987 contain definitions and other provisions that affect the interpretation and application of this Order.

    (2) Words and expressions in this Order have the same meanings as in Schedule 4A to the Act.

  • 4 Application of Order

    Th.is Order applies in respect of a small retailer in the year 2020.

    5 Individual energy savings targets for small retailers

    The individual energy savings target in the year 2020 of a small retailer to whom this Order

    applies is reduced by 100%.
