PART-III

INSTRUCTIONS FOR TENDERERS/BIDDERS

1. Tender should be addressed to the Principal Government Higher Secondary

School Maneri Payan (Swabi). 2. Tender shall be valid up-to 90 days from the date of opening of tenders.

3. Prices should be quoted item wise and Brand wise separately.

4. The bidder can quote rates for maximum 03 brands of each item.

5. Conditional/Incomplete bids will not be entertained.

6. Bidders should have office or Shop facilities, failing which their offer will not be

considered.

7. The bidders shall submit on Judicial Stamp Paper that bidder has not been blacklisted

by any Government/Semi-Government/Autonomous organizations.

8. Rates should be quoted in Pak Rupees per item on the basis of F.O.R. Government

Higher Secondary School Maneri Payan (Swabi). 9. Any bid received by the Purchaser after the deadline for submission of bids shall be

declared late, rejected, and returned unopened to the Bidder.

10. Bid security @ 2% of total value of bid in favour of Principal Government Higher

Secondary School Maneri Payan (Swabi) in the shape of Pay Order / Bank Draft

or CDR issued by any scheduled bank should be attached with the Bid. The bidder

should affix the seal/stamp of bidder on the back of the Pay Order/Bank Draft/CDR.

11. The Bid Security of unsuccessful Bidders will be returned as promptly as possible

upon the successful Bidder's furnishing of the Performance Security and signing of

contract agreement.

12. The bidders will be bound to present and demonstrate the samples of items before the

Purchase Committee at the premises of Government Higher Secondary School

Maneri Payan (Swabi) as and when asked for.

13. The successful bidder shall execute a separate agreement on Judicial Stamp Paper of

Rs.100/- with the Principal Government Higher Secondary School Maneri Payan

(Swabi) of the value of supply order within 15 (fifteen) days of the acceptance of

tender.

14. Any increase or decrease in the agreed quantity shall be acceptable to the successful

bidder as per requirement of the Procuring Entity at the same agreed rates and terms

including freight and other charges.

15. The Purchase Committee reserves the right to purchase all or few items or reject the

tender if the bidder fails to fulfill any clause of the tender agreement.

16. Delivery Schedule: The successful bidder/supplier shall supply the required items

within 20 days after issue of supply order.

17. Penalty @ 0.5% per day of the contract value will be charged after expiry of

delivery period up to the maximum of 30 days, failing which supply order will be

treated as cancelled and 10% performance security / guarantee shall be forfeited.

18. Scope of Supply: The successful bidder shall supply science equipment/items, of

the specifications given in the tender documents / contract agreement. Any item

found substandard or below specification will be rejected and the supplier will

replace the items within 15 days without any additional cost. The bidder shall also be

responsible for installation and calibration if required.

19. Mode of Payment: Payment will be made within 30 working days on the

satisfactory receipt of complete order and after satisfactory inspection report of all

items by the inspection committee.

20. In case the offer is withdrawn, amended or revised by the tenderer during the validity

period of the offer, the entire amount of earnest money shall be forfeited.

21. The entire amount of earnest money shall be forfeited if the successful bidder fails to

sign the Contract Agreement within the specified period.

22. Performance security @ 10% shall be deposited by the successful bidder within

two weeks after signing acceptance of the bid and before signing of the contract

agreement which shall be discharged by the Purchaser and returned to the successful

bidder/supplier after satisfactory completion of the supply.

23. Any violation of the agreement by the successful bidder will entitle the purchaser to

forfeit the whole or part of the performance security amount to make up losses to the

Procuring Entity.

24. All taxes & duties levied by the Govt. from time to time shall be deducted as per

rules.

25. Sales Tax Challan (in original) if applicable shall be submitted along with bill.

26. Any erasing, cutting, crossing and over writing in the offer shall in no case be

accepted. All pages of the tender form and enclosures must be duly filled and signed

by the bidder.

27. In case of failure in supply of any item as per agreed time schedule the Purchaser

reserves the right to purchase the same at successful bidder’s/supplier’s risk & cost

including legal course of action, (if any). Penalty will also be imposed on the

successful bidder.

28. The decision of the Purchase Committee regarding acceptance/rejection of the tender

shall be binding on the tenderer/bidder.

29. Firms should quote their rates inclusive of all Government taxes/duties.

30. In case of any dispute or interpretation with regard to any matter connected with or

arising out of this agreement, the matter shall be referred to the Deputy

Commissioner Swabi as sole arbitrator, wherein eventually his award shall be final.

This Agreement is executed at Mansabdar District (Swabi) on ----------------------

called the Purchaser) and M/S. ------------------------------------------ (hereinafter called the

supplier) which shall include their successors/assignees on either part on the following terms

and conditions:
