NOTE: The Technical bids for E- Tender No. 74/Restructuring-workstations/AM15
dated 11.12.2014 for Modular Workstations for Office floated by the Office of Additional DGFT,
Mumbai on 11TH
December, 2014 received through eprocure.gov.in were opened on 5TH
of
January, 2015. Total 3 bids were received for technical evaluation. Out of the 3 bids submitted,
only 1 bidder fulfilled the technical criteria whereas others did not submit all the mandatory
documents. The earlier tender dated 11th
December, 2014 is, therefore, cancelled due to non
fulfilment of minimum criteria for technically qualified bids. A fresh tender is again being
floated.
All the details are mentioned in the Tender document below.
The Additional DGFT, Mumbai invites Bids through the E-Tendering process ( www.eprocure.gov.in)
under two-bid system (Technical & Commercial) from authorized dealers/contractors, firms engaged
in interior work designing, fabrication/construction of workstations(including installation thereof)
herein after referred as ‘The Vendor’ and having a minimum of three years experience in this field.
The details are as under:-
I. TENDER PROCESS
1. The present Tender is for online submission through e-procurement portal for submission of
Technical Bid and Commercial Bid along with copies of necessary documents for construction of
modular workstations (for part 2nd floor and for 4 other floors - 49 per floor and 6 workstations per floor
for officers - 3rd floor to 6th floor “D” wing) as per the proposed plan provided in Annexure-1 in office of
Additional DGFT Office, Mumbai. The Technical bids may be submitted in the pro-forma prescribed
in Annexure-7 and the Commercial Bid may be submitted as per Performa prescribed in Annexure-8,
9 &10 complete in all respects. The same is required to be submitted through online on official e-
procurement website www.eprocure.gov.in. The last date for online submission of bids shall be 10 AM
on 27.01.2015. The Technical and Commercial Bids are required to be uploaded separately by
27.01.2015 in Electronic format only. Bids in Physical format shall not be accepted. The validity
of Tender would be up to 31.12.2015. However, the work order may be given for the entire work i.e.,
for the 2nd floor and for 4 other floors OR for a part thereof.
2. Earnest Money Deposit- As a part of the Technical Bid, EMD of Rs.2,00,000/- (Rupees Two Lakh
only) in the form of Demand Draft/Banker’s cheque of scheduled Bank drawn in favour of The
Additional DGFT, Mumbai be submitted in form of a scanned copy of the same in the online
submission of the Technical Bid. Hard copy of the said DD/Banker’s cheque should be submitted
manually to the Infrastructure Cell at 1st floor in this office before 10 am on 27.01.2015. Technical
bids without Earnest Money Deposit will be rejected. The NSIC/SSI registered bidders are exempted
from submission of EMD.
3. Submission Documents: The bidder shall submit bids electronically as per formats given in
Annexure-7, 8, 9 & 10 along with application form duly filled and signed as per Annexure-6. The
bidder should submit bids through online along with scanned copy of all the required documents
including the DD/Banker’s cheque of EMD. The Technical bids shall be scrutinized by the Technical
Evaluation Committee of this Department and Commercial Bids of only those who qualify in the
Technical Bid will be opened. Technical Bids will be opened on 27.01.2015 at 10.30 AM by the
Technical Evaluation Committee in the presence of bidders in the Conference Hall at 2nd
floor “B”

020.
The Commercial bids of technically qualified bidders only will be opened by the Commercial
Evaluation Committee on 28.01.2015 at 10:00 AM at the same venue stated above in presence of the
technically qualified bidders.
4. Incomplete bid documents shall be rejected. Late submission of bids shall not be accepted.
5. Bidders may inspect the site, if necessary, before submission of their tender.
II. PRE-QUALIFICATION CONDITIONS
The bidders fulfilling the following criteria are eligible to bid for tender.
1. The bidder (vendor) must have a turnover of not less than Rs. 50 lakhs in each of the last three
financial years. For this purpose last three financial years would be considered as the one which
ended on 31.3.2014.
2. The Vendor should have valid Permanent Account Number (PAN), Sales Tax, and Shop
Establishment registration and should be able to produce the copy/ documentary evidence of
the same.
3. The bidder shall have experience of minimum 3 years in the similar field with execution of
minimum one project of Rs. 50 lakhs along with Government / Semi-Govt /Government
undertaking/PSUs/ Banks/MNCs. The documentary evidence for each of the above should be
enclosed along with self attested performance letter.
4. The Bidder should have their registered office in Mumbai proof of which should be submitted.
5. The bidder should be PF, ESIC registered.
Vendor Prequalification: Only those firms which qualify Vendor Prequalification will qualify for
Technical qualification.
Note:- The electronic bid should include scanned copy of all the necessary documentary evidence in
support of all the conditions mentioned.
III. STANDARD TERMS AND CONDITIONS
In context of this document following definitions will apply:
(a) Purchaser: - The Purchaser is the DGFT acting through the authority issuing the purchase order. This
term is synonymous to Buyer.
(b) Vendor: - The vendor is the party to whom tender enquiry has been sent. The party may or may not
respond to the tender enquiry.
1. Rate and prices: The Bidders shall quote their rates for the proposed modular workstations in the
Performa for the Commercial bids. The rate quoted shall be exclusive of all taxes. The applicable taxes
shall be shown separately in percentage and amount. The prices quoted shall be written in figures and
words as well. The lowest quoted bidder (L-1) shall be chosen on the basis of total bid price received.
In case the lowest successful bidder (L1) fails to perform after the award of the Tender, the work shall
be awarded to L2 and EMD of L1 shall be forfeited.
2. Payment terms:
As per current practices, no advance payment is permissible. However, to ensure cash flow,
commensurate with progress of the project and the deliverables, stage payment may be made
@50% of the invoice.
95% payment of the total payment due will be made after the Contractor completes the entire work
of installing modular workstations and submits the final bill. This would be, however subject to the
completion certificate given in the said respect by this office.
5% payment will be retained and released only after 6 months of the final payment.
3. Tender Validity: The tender shall be valid for a period of one year from the date of finalization and the
quantity may increase or decrease as decided by the Purchaser. The effective date of Contract will be the
date on which the work order is issued. However, the work order may be given for the entire work i.e.,
for the 2nd
floor and for 4 other floors or for a part thereof.
4. Contract:
The contract shall be awarded by way of issuance of purchase order/“acceptance of tender”. The acceptance
may be communicated to the Vendor by fax or registered/speed post. The Vendor is required to
acknowledge receipt of the acceptance within 3 working days. However, non-acknowledgement on the part
of the Vendor does not affect the “acceptance of tender” or the conclusion of contract.
All communications by the Purchaser to the Vendor will be deemed to have been made by e-mail, fax, or
registered/speed post to the number or address furnished by the Vendor. The purchaser shall not be liable
for any obligation, monetary or otherwise, that has not been expressly stated in the contract.
5. SPECIFICATIONS
The specifications governing the project are provided as an enclosure in Annexure-3, 4 & 5. A quote
received against this tender shall be deemed to commit the Vendor to those specifications.
6. COMMERCIAL BID
When quoting the price in Commercial Bid, all components of the price such as the basic price and
different type’s taxes and charges shall be listed separately. If and where there are no taxes, they shall be
explained clearly. The proposed cost by the vendor shall include Supply and installation of modular
workstations and wooden partitions for cabins including furniture.
7. Time Frame:-
Work order of each floor will be given separately. The vendor should ensure the completion of the work
within 45 days (excluding holidays) from the date of the work order. A penalty of Rs.5000/-per day will be
imposed if the completion of project goes beyond a period of 45 days from the date of the work order.
8. Performance Security: An amount equivalent to 5% of the total value of the contract awarded shall
be withheld from the payment which is due to the successful bidder on completion of work, for a
period of one year from the date of supply and installation.
Tender document and all other enclosures appended to it as a token of having read and understood the
Terms and Conditions contained therein and submit the same along with the Technical bid. The bidder
would fill up the information in the Annexures enclosed at the end of this document in clear and
legible terms. Wherever required, copies of the supporting document in respect of the details
mentioned in the annexure should be enclosed.
The bids received shall be rejected if it is not complete in any aspect.
The tender documents are not transferable.
NOTE – If L1 is unable to complete this project in 4 weeks, OR if L1 fails to successfully carry out the
work, then L2 will be requested to match L1 rates and carry out the work and so on.
IV SCOPE OF WORK
The scope of work of this tender is to construct modular workstations (for 4 floors - 49 per floor- and 6
workstations per floor for officers 3rd floor to 6th floor “D” wing and part 2nd floor ) as per the proposed
plan in office of Additional DGFT Office, Mumbai. This would be required to be done as per the
proposed area plan attached at Annexure-1 & 2a, 2b&2c & 2d. Therefore the scope of work will
include the Supply and construction of modular workstations and wooden partitions for cabins including
furniture. The Technical specification of each of the items and bill of material is given in format
attached as Annexure-3, 4 & 5.
However, the work order may be given for the entire work i.e., for the 2nd
floor and for 4 other floors
or for a part thereof.
V. ITEM SPECIFICATIONS:
Item specifications as per proposed plan are given in Annexure- Annexure-3, 4 & 5.
Submission of Bids by itself does not confer any right or entitlement to do the job. The competent
authority reserves the right to accept “the tender either in full or part”. It Further reserves right to
cancel tender at any time without assigning any reasons whatsoever.
