(As per Rule 19(3) of Karnataka Biologica Diversity Rules 2005)
I . Introduction The Government of India passed the Biological Diversity Act 2002 No. 18 of 2003, (5th February, 2003) The Act provides for conservation of biological diversity, sustainable use of its components and fair and equitable sharing of the benefits arising out of the use of biological resources, knowledge and for matters connected therewith or incidental thereto. II. Constitution of the Board including changes therein.
As per the Act each State is supposed to establish state Biodiversity Board under section 22 of the Act. Accordingly the Govt. of Karnataka has established the Board Vide G.O.No. FEE 125 ENV 2003 dated: 19-06-2003 and it has started functioning from 1st August 2003.
The Board shall be a body corporate by the name aforesaid, having perpetual succession and a common seal, with power to acquire, hold and dispose of property, both movable and immovable, and to contract, and shall by the said name sue and he sued.
a. A Chairperson who shall be an eminent person having adequate knowledge and experience in the conservation and sustainable use of biological diversity and in matters relating to equitable sharing of benefits, to be appointed by the State Government;
b. Not more than five ex officio members to be appointed by the State Government to represent the concerned Departments of the State Government;
c. Not more than five members to be appointed from amongst experts in matters relating to conservation of biological diversity, sustainable use of biological resources and equitable sharing of benefits arising out of the use of biological resources.

III Constitution of the Committees by Board and meeting of the committees constituted by it.
During the year 2009-10 the board has not constituted any committee.
Functions of the Board:
The functions of the Board as per section 23 of Act are :
a. advise the State Government, subject to any guidelines issued by the Central Government, on matters relating to the conservation of biodiversity, sustainable use of its components and equitable sharing of the benefits arising out of the utilization of biological resources;
b. regulate by granting of approvals or otherwise requests for commercial utilization or bio-survey and bio-utilization of any biological resource by Indians;
c. perform such other functions as may be necessary to carry out the provisions of the Biological Diversity Act, 2002 or as may be prescribed by the State Government.

Powers of the Board:
1. lay down the procedure and guidelines to govern the activities provided under sections 23 of the Act.
2. advise the State Government on any matter concerning conservation of bio-diversity, sustainable use of its components and fair and equitable sharing of benefits arising out of the use of biological resource and knowledge;
3. provide technical assistance and guidance to the department of the State Government and Biodiversity Management Committee.
4. regulate by granting of approvals or otherwise requests for commercial utilization or bio-survey and bio-utilization of any biological resource by Indian nationals.
5. facilitate updating and implementation of State Bio-diversity Strategy and Action Plan.
6. commission studies and sponsor investigations and research. 7. engage consultants, for a specific period, not exceeding three years, for providing
technical assistance to the Board in the effective discharge of its functions. 8. Provided that if it is necessary and expedient to engage any consultant beyond the
period of three years, the Board shall seek prior approval of the State Government for such an engagement.
9. collect, compile and publish technical and statistical data, manuals, codes or guides relating to conservation of bio-diversity, sustainable use of its components and fair and equitable sharing of benefits arising out of the use of biological resource and knowledge;
10. organize through mass media a comprehensive programme regarding conservation of biological diversity, sustainable use of its components and fair and equitable sharing of benefits arising out of the use of biological resource and knowledge.
11. plan and organize training of personnel engaged or likely to be engaged in programmes for the conservation of bio-diversity and sustainable use of its components;
12. take steps to build up database and to create information and documentation system for biological resources and associated traditional knowledge through biodiversity registers and electronics data bases, to ensure effective management, promotion and sustainable uses.
13. give direction to the local bodies/Biodiversity Management Committees in writing for effective implementation of the Act, and to facilitate their meaningful participation in all measures relating to conservation, sustainable use, and equitable benefit-sharing.
14. report to the State Government about the functioning of the Board and implementation of the Act and the rules made there under.
15. recommend, prescribe, modify, collection fee of biological resources from time to time.
16. to devise methods to ensure protection of rights including intellectual property rights over biological resources and associated knowledge including systems of maintaining confidentiality of such information as appropriate, including the protection of the information recorded in people’s Biodiversity Registers.

17. Sanction grants-in-aid and grants to Bio-diversity Management Committees for specific purposes.
18. undertake physical inspection of any area in connection with the implementation of the Act.
19. ensure that biodiversity and biodiversity-dependent livelihoods are integrated into all sectors of planning and management, and at all levels of planning from local to state, to enable such sectors and administrative levels to contribute effectively for conservation and sustainable use.
20. Prepare the annual Budget of the Board incorporating its own receipts as also the devolution from the State and Central Government provided that the allocation by the Central Government shall be operated in accordance with the budget provisions approved by the Central Government.
21. Board shall have full powers for granting administrative and technical sanctions to all the estimates; it may however delegate such administrative and technical sanction powers to the Member Secretary of the Board as may be deemed necessary.
22. Recommend creation of posts to State Government, for effective discharge of the functions by the Board and to create such posts, provided that no such post whether permanent/temporary or of any nature, would be created without prior approval of the State Government.
23. Perform such other functions, as may be necessary to carry out the provisions of the Act or as may be prescribed by the State Government from time to time.

IV Meeting of the Karnataka Biodiversity Board During 2009-10 the Board has met on date given below and conducted deleberations:

V. Activities taken up by the Karnataka Biodiversity Board during the year as per Section 23 of the act. The Board has undertaken following activities. a. Formation of Biodiversity Management Committees (BMCs) b. Awareness training on Biodiversity and related issues to BMC’s, villagers,
government servants, colleges, university students & teachers, general public. c. Preparation of PBR through BMC’s with the guidance from NGOs, Forest
Departments and Universities and Colleges etc.,

d. Preparation of proposal for declaration of some areas as heritage site under Biodiversity act.
e. Research Projects. 1. Formation of Biodiversity Management Committees (BMCs): The Biological Diversity Act says that:
a) Every local body shall constitute a Biodiversity Management Committee within its area for the purpose of promoting conservation, sustainable use and documetnation of biological diversity including preservation of habitats, conservation of land races, folk varieties and cultivars, domesticated stocks and breeds of animals and microorganisms and chroniling of knowledge relating to biological diversity.
b) The National Biodiversity Authority and the State Biodiversity Boards shall consult the Biodiversity Management Committees while taking any decision relating to the use of biological resources and knowledge associated with such resources occurring within the territorial jurisdiction of the Biodiversity Management Committee,
c) The Biodiversity Management Committees may levy charges by way of collection fees from any person for accessing or collecting any biological resource for commercial purposes from areas falling within its territorial jurisdiction.
d) The main function of the Biodiversity management Committee is to prepare Poepl’es Biodiversity Register in consultation with local people. The Register shall contain comprehensive information on avaialblity and knowledge of local biological resources, their medicinal or any other use or any other traitional knowledge associated with them.
e) The other functions of the Biodiversity Managmetn Committee are to advise on any matter refered to it by the State Biodiversity Board or Authrotiy for granting approval, to maintain data about the local vaids and practitioners using the biological resources.
f) The People’s Biodiversity Registers shall be maintained and validated by the Biodiversity Management Committees.
g) The Committee shall also maintain a Register giving information about the details of the access of the collection fee imposed and details of the benefits dervied and the mode of their sharing. The Board has formed Biodiversity Management Committees at District, Taluka and Gramapanchayath level so far as detailed below.

2. Biodiversity Awareness Training Programme: The Karnataka Biodiversity Board has taken up the training programme on creation of Awareness in respect of Biodiversity and its related issues including Traditional Knowledge Biodiversity documentation and Management Plan.
The Training module covers the following:
1. Biodiversity and its importance. 2. Components of Biodiversity and its types. 3. Status of Biodiversity 4. Stakeholders in Biodiversity 5. CBD and Biodiversity Act and Rules 6. Functions of National Biodiversity Authority (NBA) Karnatka Biodiversity
Board (KBB) and Biodiversity Management Committees (BMCs) and other departments in nation to Biodivesity.
7. Biodiversity Hotspots and declaration of Biodiversity Heritage Site. 8. Community Traditional knowledge related to crop, Animals and health care of
humans and livestock.

3. People’s Bidiversity Register (PBRs)
As per Biological Diversity Act Biodiversity Management Registers are to be prepared. The Register shall contain comprehensive information on availability, knowledge of local biological resources, their medicinal or any other use and traditional knowledge associated with them. People’s Biodiversity Registers were taken up in varios districts at Gramapanchayath level as suggested by the National Biodiversity Authority and direction of Secretary, Environment of Forests, Government of India while addressing the State Biodiversity Boards at Ooty meeting to review the working of State Biodiversity Boards. People’s Biodiversity Registers is a panchayat level register that documents local biodiversity and the local community’s knowledge on biodiversity including its conservation and traditional uses.
The PBR will serve the following objectives:
1. Community regulation of access to biological resources related to sustainable harvests.
2. Promoting knowledge based sustainable management of agriculture, livestock, fish, forest and public health so as to enhance the quality of life of the community members.

3. Opportunities to generate funds through the imposition of collection fees for access to biological resources.
4. Conserving valuable Resources. 5. Value addition to biological resources. 6. Recording of biodiversity related knowledge, coupled with opportunities to
generate funds through imposition of collection fees for access to local knowledge. 7. Sharing the benefits of commercial application of local knowledge. 8. Help people access information of significance in management of their crops and
livestock, availability of seeds of various traditional crop cultivars, and special properties of these cultivars.
9. Help people share their special knowledge of uses and management of biological resources, access to information on technologies of relevance for better management of biodiversity resources, provide information on prevalent prices and quantities of that species to help estimate the level of commercial demand for the species.
10. Help continuation of traditional practices of conservation and sustainable use of biodiversity by facilitating their recognition and incorporation in the Biodiversity Management plans of local Biodiversity Management Committees.
11. Help empower women and other weaker sections of communities intimately linked to biodiversity by involving them in the process of documentation and development of the Biodiversity Management Plans of local Biodiversity Management Committees.
12. Help preserve the biodiversity related knowledge of people for the posterity through its codification and recording.
13. Help people publicize the nature of their special knowledge without disclosing full details, thereby opening avenues for arriving at contractual agreement with commercial enterprises interested in access to such knowledge.
14. Help local communities claim rewards in national conservation programmes.
The Forest Department, Universities, Colleges & NGOs have been involved as Nodal agency to guide and give technical expertise to Biodiversity Management Committies in PBR documentation.

Project on Integrated Ecological carrying capacity study of Uttara Kannada district, Karnataka The Karnataka Biodiversity Board has sponsored a study of Uttara Kannada district in the first phase to the Centre for Ecological Sciences, (Indian Institute of Science), Bangalore at a cost of Rs. 40.00 lakhs and duration 2 year. The other district will cover in Western Ghat in a phased manner.

9. Survey of Bio-industries and Utilisation of Bio Resources: The National Biodiversity Authority has funded a project for Survey of Bio-industries utilizing of Bio-resources. An amount of Rs. 3.00 lakhs has been released by National Biodiversity Authority. Action has been initiated to collect the information of Bio-resources from Bio-industries with the involvement of Karnataka Indian Medicine Manufacture’s Association (Regd) and Karnataka Unani Medical Associaton. The information is being collected as per the format supplied by the National Biodiversity Authority, Chennai. The work is going on. 10. In-situ Conservation of Biodiversity in Dry Zone of Karnataka Action has been initiated to identify and demarcate an area of 100 – 200 ha depending upon availability in the core forest area of 13 dry districts and In-situ conserve the species which are on the decline in the forests of districts namely Bangalore (R) Bagalkot, Bellary, Bidar, Bijapur, Chamrajanagar, Chitradurga, Gulbarga, Kolar, Koppal, Mandya, Raichur & Tumkur. The Deputy Conservator of Forests (Territorial) are implementing this project. The area is given full protection. There will be no harvest in these areas. The activities such as fire protection, sowing of indigenous Spp, soil and water conservation will be taken up. Inventorisation and documentation of Biodiversity will be done under the supervision and guidance of the Center for sustainable development. This way the change in Biodiversity will be monitored and reason for changes will be identified so that remedial measures can be planned.

11. News Letter:
Karnataka Biodiversity Board has started a News letter by giving details of important information and articals from various sources on various components of Biodiversity. The Ist quarterlly New letter was released in programme attended by various dignatories including Chairman, National Biodiversity Authority, Government of India. So far 4 issues have been released. 12 The Karnataka Biodiversity Board has published the following during the year 2009-10

VI . Prosecutions launched and convictions secured.
Action is being taken to control the uncotrolled and irregular harvest of Bioresources. The information is being collected from firms using Bioresources regarding quantity of Bioresources being harvested and sources/villages from where harvested. The legal action is being considered against the defaulters so as to stream the harvest of Bioresources on sustainable harvest principle.
