(a) Is it true that Services Department is preparing a list of Peons for promotion;

Yes Sir, Services Department is preparing an eligibility list of Group-C employees having the Grade Pay of Rs.1800/- (erstwhile Group-D) working in various departments of Govt. of NCT of Delhi, as per provisions contained in the DASS Rules, for promotion to the post of Grade-IV (DASS).

(b) If yes, then how many posts of Grade-IV (DASS) are lying vacant with Services Department; and

There are 2166 posts of Grade-IV (DASS) lying vacant with Services Department for further posting to various departments of GNCT of Delhi.

(c) Out of these vacant posts how many posts will be filled up by direct recruitment and how many will be filled up by promotion and till when, proposal thereof?

From above-mentioned vacant posts, 2028 posts of Grade-IV (DASS) are to be filled up by direct recruitment and 138 posts by promotion. Requisitions for filling up the vacant posts under direct recruitment quota have been sent to DSSSB from time to time. The process of filling up the posts falling under promotion quota will be initiated immediately after finalization of the eligibility list.

a) whether it is a fact that non-functional scale is being granted to

the Grade-I Stenographers and Grade-I DASS officials on completion of four years of service subsequent

to the approval of the Hon’ble Lt. Governor obtained in this regard despite objection raised by the

Ministry of Home Affairs;

a) In view of the letter from Ministry of Home Affairs, raising objection about

grant of Non-functional scale to Grade-I (DASS) and Grade-I Stenographers, matter was considered in a Committee

of Officers under the Chairmanship of Chief Secretary, Delhi, which observed that grant of Scale was a conscious

decision of Govt. of NCT of Delhi and accordingly government’s earlier decision on grant of scale is reiterated

to the MHA after approval of LG, Delhi.

b) if so, whether it is also a fact that as

per rules the power for creation of new Group A, B, C & D posts under Plan and Non-Plan side rests with

the Hon’ble Lt. Governor/Delhi government within the delegation of financial powers;

b) As per Govt. of India, Ministry of Home

Affairs, letter No.U/14011/134/96-Delhi-II dated 01.01.1997 the Lt. Governor, Delhi has been delegated full

powers for creation of Group-A, B, C and D posts under Plan and Non-Plan sides under the Government of NCT of

Delhi subject to the condition that the balance from Current revenues continues to remain positive.

c) whether it is also a fact that matter pertaining to obtaining of approval

from the Ministry of Home Affairs by the Services Department to bring the pay scales and service

conditions of Stenographer Cadre of Delhi Government at par with the Central Secretariat Stenographers

Cadre is lying pending;

c) Yes Sir.

d) if so whether Delhi Government/ Hon’ble Lt. Governor is competent to

remove anomalies in salaries and to effect parity in the service

conditions;

As the matter has been referred to Ministry of Home Affairs, Govt. of India

regarding restructuring of Stenographic Cadre in Delhi Government, Ministry of Home Affairs has to take the decision.

e) if so, the time by which the anomalies in salary of Stenographer

Cadre and other service conditions will be removed by obtaining approval from Hon’ble Lt. Governor;

a) 810 posts of Grade-I (DASS) in Government of NCT of Delhi.

b) Whether it is a fact that Seniority List of Grade-II employees of Delhi Administration has not been prepared after 2006;

c) Whether it is also a fact that due to non-availability of seniority list officials of this grade have not been promoted?

c) No Sir, all the eligible Grade-II (DASS) officials have been promoted to the post of Grade-I (DASS).

d) Whether it is also a fact that if the post are lying vacant, adhoc-promotions can be given by relaxation in the rules, as per the Judgement of the Court, and

d) Yes Sir, the provisions laid down in DoPT’s O.M. No.28036/8/87-Estt. (D) dated 30.03.1988 stipulate as under:- 4(iii)(b) only those officers who fulfill the eligibility conditions prescribed in the recruitment rules should be considered for adhoc appointment. If, however, there are no eligible officers, necessary relaxation should be obtained from the Competent Authority in exceptional circumstances.

e) The time by which seniority list will be made and promotion be granted to Grade-II officials?

e) Finalization of seniority list is in process. Thereafter promotion to Grade-I will be taken up.

As per Notification dated 06.08.2003 read with Notification dated 13.08.2010 issued by Ministry of Home Affairs, Govt. of India, following officers are the feeder category for promotion in DANICS:-

a) Grade-I (DASS); b) Hindi Officer; c) Punjabi Officer; d) Urdu Officer; e) P.A. to Dy. Commissioner, Delhi; f) Reporter of Legislative Assembly; and g) Press Officer

b) whether it is a fact that out of these officers in feeder category, the non-functional scale (Grade Pay 5400/-); has been granted to some category of officers; the number of sanctioned posts in such categories and the authority competent to grant the non-functional scale to these categories of officers;

Yes Sir. Among the feeder category, Grade-I (DASS) Cadre were considered for grant of Non-Functional-Scale of Rs.8000-275-13500 with the approval of Lt. Governor, Delhi, in view of duties performed by them vis-à-vis employees in Central Government and stagnation in the Cadre. There are 1548 sanctioned posts of Grade-I (DASS) in Govt. of NCT of Delhi.

c) the remaining officers in the feeder cadre to whom the non-functional scale (Grade Pay Rs,.5400/-) has not been given so far; the number of sanctioned posts of such officers and the authority competent to grant the non-functional scale to these officers;

Remaining officers in feeder category who are not granted non-functional scale (Grade Pay Rs.5400/-) are as below:-

a) Hindi Officer- 2 posts; b) Punjabi Officer- 1 post; c) Urdu Officer-1 post;

d) P.A. to Dy. Commissioner, Delhi – Nil; e) Reporter of Legislative Assembly- 10 posts;

and f) Press Officer-1 post

d) whether the Government is considering to grant non-functional scale (Grade Pay 5400/-) to these officers of the feeder cadre?

In terms of duties of officers in these categories, no equivalence is made out with Section Officers in Govt. of India.

(a) Is it true that one stenographer, working in Sanjay Gandhi Memorial Hospital, who is working there from year 1987 to 1998 and 2008 till date in the hospital;

Yes Sir.

(b) Is it true that in year 2012 even after transfer to Directorate of Health Services, Education, DLAS and many other departments the official got his transfer orders cancelled and is still working in Sanjay Gandhi Memorial Hospital;

Yes Sir.

(c) If yes, what is the reason thereof;

The transfer orders of the official have been cancelled on medical and sympathetic grounds.

(d) Other than this, how many employees are there who are transferred repeatedly to hospitals; and

As per record, there are 28 employees (stenographic cadre and DASS Cadre) who are repeatedly posted in hospitals.

(e) and give details of the employees who got such transfers in last 5 years.
