I refer to your application pursuant to the Freedom of Information Act 1991 (the Act) received by the

Department for Environment and VVater (DEVV) on 10 July 2018, seeking access to:

"A list of all Freedom of Information requests received from the Liberal Opposition between 17 March 2014 and 16 March 2018."

On 13 July 2018, Mr Andrew Love of your office confirmed that the scope of this request is intended

to identify all Freedom of Information applications that have been submitted by Liberal Members of Parliament within the timeframe, including any appl ications that were withdrawn, deemed refused

or transferred to other agencies.

Mr Love also confirmed that information identifying individua l and business names that wou ld otherwise require third-party consu ltation prior to release, cou ld be excluded from any discovered

documents.

As the agency did not determine the application with in 30 days of receiving it, by the operation of

section 19(2)(b) of the FOI Act, the agency is taken to have determined the application by refusing access.

However, section 19(2a) of the FOI Act, provides that an agency may give access to a document on an application after the period within which it was required to deal with the application (and any such

determination is to be taken to have been made under this Act).

DETERMINATION

Searches of the Department's records have found that there are five (5) documents held by this

agency with in the scope of your request and these are listed in the attached schedule.

As a DEW Accredited FOI Officer, I have determined to grant you full access to three (3) documents and partial access to two (2) documents. In accordance with Mr Love's confirmation on 13 July 2018,

information identifying individual and business names has been marked as 'out of scope' of your request.

I wish to also advise you that the information within these documents contains details of some Freedom of Information applications which have been withdrawn, transferred to other agencies or

deemed refused in accordance with the Freedom of Information Act 1991 .
