There are many different types of land ownership

in New Zealand.It is important to understand the basics on each type so that you can make an informed decision on how each type affects your rights and the asset value of your property you intend to purchase.• Freehold (fee simple)• Leasehold• Crosslease• Licence to occupyFreehold (fee simple)Freehold is also known as fee simple and is the largest type of ownership of land in New Zealand. Freehold land is land over which the Crown has granted a freehold interest in property. Freehold gives the owner of the land exclusive rights in terms of use and possession of the land, for example:

• the right to hold (part of their estate)

• the right to sell • the right to gift • the right to dispose of through their

will • the right to subdivide the land into

smaller lots (subject to permission

from the local authority/local council).

Freehold ownership is not limited by time (ownership is forever). If the owner dies, the land is be passed on to their legal heirs through their written will.

LeaseholdA leasehold tenure is where the land owner and the building owner are two different identities. The building owner (leaseholder) pays ground rent to the landowner and in return has exclusive possession for a fixed period, which is often 21 years and perpetually renewable. The leasehold interest is registered on the title. There are numerous parcels of New Zealand land that are leasehold: either leased directly from the Crown, Maori, or from local territorial authorities, port authorities, trusts, companies and individuals.

The leasehold will include certain conditions or requirements.

A perpetually renewable lease also called a Glasgow lease, is commonly found in older residential leasehold arrangements. The ground rent is usually renegotiated at a renewal date. A leasehold in perpetuity is usually for a term of 999 years. An annual ground rent is paid. A cross lease is an example.

CrossleaseA crosslease is a method of multiple ownership that grants each tenant in common:

• an undivided share in the land, and • exclusive possession of their flat/

dwelling by leasing the building from the tenants in common for a defined time (usually 999 years)

Each flat/dwelling has its own title. This title is called a composite title because both the share in the land and the lease of the flat/dwelling are shown on the same title. Covenants on the titles designate areas to be set aside for the exclusive use of individual dwellings/flats (eg parking spaces associated with specific flats).

A flats' plan is a plan attached to the crosslease title which shows the outline of the buildings (footprint) and outlines the exclusive use areas. It also shows any common area (often the driveway) which is able to be used by all owners.

There are usually limits on crosslease titles, restricting the owner’s right to tenant or sub-lease their flat, or alter or make additions to their flat, without the consent of all the other owners.

The owners can sell their property independently of each other.

Licence to occupyAn occupation licence is a personal right only. You do not own the property, but you have a contractual right to occupy that particular dwelling. That right is secured on your behalf. Unlike normal property ownership, you are not usually able to mortgage the property or register any other interests such as a caveat against the certificate of title. You cannot sell or transfer the right to occupy. Unlike a usual residential property purchase, you are usually not entitled to any capital gain from the re-sale of the property after termination.

The full purchase price (sometimes referred to as a capital payment) usually includes a membership or amenities fee of approximately 25 to 30 per cent of the full purchase price.

This fee amortises (or depreciates) over three or four years on a pro-rata basis. For example, if the period specified is three years and you leave the village within three years, a portion of this will be refunded. If you leave after three years, it will have fully depreciated and the amount you will receive back upon termination of the occupation licence or agreement will be the full purchase price you paid less the membership or amenities fee (usually 25 to 30 per cent).

Create cottage garden colour with

Canterbury bellsI often use the term cottage garden when describing the type of garden a particular flower might best suit. I actually use the term so often it’s easy to forget that others – particularly those new to gardening – might not know what I mean by it.

So, I thought I’d start off this article by explaining that ‘cottage garden’ typically implies an informal garden with dense and messy plantings (a mixture of floral and edible) that are often fragrant.

For those wanting to create this type of effect look for mixed bundles of cottage garden seedlings. These usually includes a mix of seasonal flowers like antirrhinums (snap dragons), carnations, love-in-the-mist and pansies, which combine together to create a lovely cottage garden feel.

Another plant I like to grow when trying to create this type of whimsical feel in a garden, is Canterbury bells. This biennial (they flower for two seasons and die down

in between) grows to around 80cm high and produce beautiful, as the name suggests, bell-shaped violet, purple and pink flowers.

It’s perfect for planting around fences or borders and with delphiniums, hollyhocks and snapdragons because of the height it grows to.

A fence or border will help support it as it grows taller. Otherwise you can simply stake it if needed. Canterbury bells also grow well with

roses (another cottage garden flower) because it likes the same sunny conditions.

Pick up some Canterbury bell seedlings from your local supermarket or garden centre. Alternatively, you may even be able to buy them online and have them delivered direct to your door.

When you’ve picked the perfect spot to plant, dig in a little compost and a well-balanced fertiliser. This will help give your seedlings the right nutrition for a good kick-start.

Then plant your seedlings around 20cm apart from each other and spread some mulch and pea straw around. Lastly, watch out for slugs – they can be fans of these pretty flowers.

Because they grow quite tall, Canterbury bells take a while to mature. You should see them start to flower in around early summer or Christmas time. And if you don’t see them flower when you expect to, keep waiting – they will get there.
