You may find yourself in a multi-offer situation when

buying a property. It’s important to understand what

this means for you so that you can make an informed decision about what offer to make.

First and foremost the sales agent will let you know that there is more than one buyer interested in buying the property and willing to put in an offer. The agent will ask you to sign a form acknowledging that you have been advised of this.

This form will usually include the following acknowledgments:

• You have made your highest and best offer in writing;

• Your offer and any other offer will be presented to the client at the same time;

• The client/vendor may accept or reject any offer at the client’s sole discretion;

• The client may counter offer/negotiate with only ONE of the offers received at any one time at the sole discretion of the client;

• The price, terms and conditions of your offer will remain completely confidential to you and the sales person preparing your agreement;

• Your offer will be sealed in an envelope when signed and will only be opened in the presence of the client or the client’s duly appointed agent, along with all other offers.

Each prospective buyer will be asked to make a signed written offer (you should have your offer checked by your solicitor). This will be sealed in an envelope and presented to the vendor at the same time as all the other offers.

If the listing salesperson has an interested buyer who has submitted an offer, the manager or duly appointed nominee will present all the offers to the vendor to assure you that there is no hint of favouritism. The vendor will weigh up which offer, if any, they want to accept. They may ask the agent to negotiate further with this buyer.

If negotiations are unsuccessful, a second offer may be introduced and the first party’s negotiations must stop. The multi-offer rules will apply again. There might be another chance for you to re-negotiate or there might not be. This is solely up to the vendors.

No, confidentiality is essential. The details of your offer are not made known to other salespeople or buyers.

In a multi-offer situation, if you really want a property, you should offer the most you would be happy to pay for the property.

Assume the competition is just as keen to own it and remember you may not have the opportunity to negotiate further with the vendor. Offer your best offer the first time around to avoid disappointment.
