dismissal and other disputes with an employerEmployees who have been fired often need advice from a qualified lawyer – urgently. A lawyer who is well versed in employment questions will be able to determine whether a dismissal is justified, either on grounds of redundancy or because of employee misconduct.

Members of YTY can turn to their union for help in negotiating. When necessary a lawyer from YTY will negotiate with a representative of the employer or the employer’s federation with a view to reaching some amicable settlement.

liability and legal aid insuranceIf negotiations are inconclusive, then you may claim compensation for the costs of any legal proceedings that are required for settling an employment dispute from the union’s liability and legal aid insurance scheme. To be eligible for compensation, the claimant must have been a member of YTY for at least six months when the insured accident occurred or the civil dispute arose. If union membership has continued for less than two years, then the underlying grounds for any civil or criminal

action must also have arisen during the membership period. These waiting periods do not apply when membership has been transferred to YTY directly from another trade union. Be sure to contact YTY if any dispute occurs. Further details of insurance claims are shown on the members’ website.

employment contractA written employment contract specifies many things that might seem obvious to the parties, but the document should always be prepared with care and shown to a YTY legal advisor for checking where necessary.

Unemployment benefit and fund membership

The IAET unemployment fund insures YTY members, providing earnings-related benefit in the event of loss of work or lay-off. YTY also assists members at times of sudden and radical change, and engages in continual collective bargaining on their behalf.

If you lose your job or become laid off, the unemployment fund will pay you earnings related unemployment allowance, if both the membership condition and the employment condition are fulfilled. The membership condition means that you have to have been a member of the fund for at least 8 months before

becoming unemployed. The employment condition means that you have been in paid, social insurance-covered employment, for 34 calendar weeks during the 28 months immediately preceding unemployment. If you are an entrepreneur, or you or your family members own shares of the company you work for this could effect to your rights to unemployment benefits.

Insurance benefits

Leisure time accident insurance

The insurance coverage applies to accidents that occur during leisure time, unless covered by law. The insurance does not include a daily allowance. More details about the insurance policy are provided in the insurance terms and conditions. Unlike under the general terms and conditions, the beneficiaries of accident insurances taken out by YTY are always the insured person’s relatives.

the sums insured under the accident insurance:• medical expenses arising from an accident: 2 805 euros (no deductible)• compensation for permanent disability: 11 783 euros• compensation payable upon death: 5 738 euros.

Traveller’s insurance

The cover is valid for no longer than 45 days from the onset of an individual domestic or international journey during leisure time. Children under 20 years of age travelling with

the YtY membership fee includes the following insurance:• leisure time accident insurance (trade union insurance)• leisure time traveller’s insurance (trade union insurance)• legal expenses and liability insurance covering employment disputes

All members of YTY are covered under the leisure time accident and traveller’s insurance policies provided by If P&C Insurance Company Ltd, included in the membership fee. The insurance cover is tied to the YTY membership. If a member resigns or the membership is terminated by the trade union, the insurance cover expires with immediate effect. The insurance covers those members who live in Finland permanently for more than six months of the year, have permanent residence status in Finland, and who are within the scope of the Finnish Sickness Insurance Act. The valid insurance policy can be maintained through YTY until the end of the year during which the member reaches the age of 68.

The insurance number is 201-2054942. Your YTY membership card also acts as an insurance card. We advise you to store it in your wallet.

More detailed information on insurancepolicies is available via If ’s service number +358 10 19 19 19, Monday to Fridayfrom 8 am to 8 pm.

a parent who is insured are covered by the parent’s insurance, but only by one insurance policy at a time. The insurance provides the children with the same cover as the member. In addition, the compensation payable upon death arising from an accident is 2 000 euros, and the compensation for permanent disability arising from an accident is 10 000 euros. The insurance cover includes an exclusion concerning sports activities, in compliance with the insurance terms and conditions. The exclusion cannot be removed.

Expenses arising from sickness during a journey are compensated up to a maximum period of 90 days from the appointment with a doctor, and medical expenses arising from an accident are compensated up to three years from the occurrence of the accident. The medical expenses covered by the insurance are listed in the terms and conditions.

If a sickness existing prior to the journey unexpectedly worsens during the journey, only medical expenses arising from treatment in the nature of first aid provided at the travel destination will be compensated for a maximum period of one week. Further details about the exclusions are provided in the insurance terms and conditions.

Traveller’s insurance also covers expenses arising from the cancellation or curtailment of a journey and from being late for a journey. The insured is entitled to compensation for an interrupted journey on the basis of being admitted to hospital for treatment of sickness during a journey, for example. The cancellation

or curtailment of a journey or being late for a journey must result from a compelling reason, as listed in the insurance terms and conditions.

Legal expenses insurance

The legal expenses and liability insurance is primarily designed to provide support in disputes arising from the termination of an employment relationship. Applying the insurance cover requires that YTY’s legal adviser first reviews the dispute case, analyses the legal situation, and finds out if settling the matter is possible. Quite commonly, a reasonable solution to the matter is found at this stage.

However, if the dispute cannot be resolved through negotiations or otherwise, and the member’s claim for compensation is justified, YTY will make its decision about supporting the legal expenses claim on the basis of the legal adviser’s report.

The insurance cover will take effect once the insured person has been a member of YTY for six months. In other words, when an insured event occurs, the prerequisite for the event to be compensated under the insurance is that the insured person has been a member of YTY for at least six months. However, no waiting period is applied if the member has transferred their membership directly to YTY from another trade union. Furthermore, if the YTY membership has lasted less than two years at the time of the origin of the dispute, the event on which the dispute is based must also have occurred during the validity of the membership.

Federation of Professional andManagerial Staff (YTN)

As AKAVA’s collective bargaining organisation for the private sector, YTN is responsible for activities relating to negotiations and contracts for AKAVA’s field members in commercial, service and industrial sectors.

One of YTN’s prime objectives is to improve the earnings level and conditions of employment of professional and managerial employees by, among other approaches, strengthening contractual activities.

YTN’s main objectives

• Strengthening contract activities in all contracting sectors• Identifying the personnel group of managerial and professional staff in all labour legislation• Ensuring equal representation of personnel representatives

• Improving the operational framework for personnel representatives (use of time, access to information, authority to act)• Comprehensive coverage of the application of Finland’s Working Hours Act and payments for working hours under the provisions of the Act• Obtaining payment for work-related leisure-time travel• Ensuring practical implementation of Finland’s Act on Cooperation Within Undertakings• Promoting the use of working-hour banks• Enhancing official monitoring of enforce- ment of Finland’s Working Hours Act• Safeguarding the earnings level of managerial and professional staff• Developing occupational safety and health• Pursuing equitable tax policy, equality in unemployment benefits and social security, and improved employment protection

Lobbying

One important function of YTY is to promote and oversee the common interests of its members at work and in society more generally. YTY shares this collective lobbying function with the Confederation of Unions for Professional and Managerial Staff in Finland – Akava and with the Federation of Professional and Managerial Staff – YTN, which lobbies for private sector employees belonging to Akava-affiliated unions.

Work on behalf of individual members involves providing employment advice, legal services, and various advisory materials. Members may also approach YTY for advice on salary standards, or consult the YTY legal department for technical assistance with aspects such as employment contracts, non-disclosure and restraint of trade agreements.

Activities at the workplace

Enterprise staff association

Many companies have a local staff association operating at unit, enterprise or Group level. The role of such an association includes defending the employment-related interests of their members. Enterprise staff associations have a registered independent legal identity, meaning that they may enter into binding local agreements and collective agreements on behalf of their members. We recommend membership of any YTN-affiliated enterprise staff association operating at your workplace.

Staff representatives

Staff representatives include the elected representatives of senior salaried employees, shop stewards and other representatives elected to positions of trust, staff liaison officers, and representatives elected under the Employment Contracts Act. The elected representatives of senior salaried employees may belong to any YTN-affiliated trade union, including YTY, but will represent all senior salaried employees working in the represented staff group regardless of trade union membership. A staff liaison officer also serves as a link between YTY and its members and affiliated staff associations at the workplace.
