8. Contextualizao12. CONTEXT

O Estatuto da Cidade, Lei n 10.257/01, estabeleceu as bases para a promoo da poltica urbana emtodo o pas, fortalecendo o Plano Diretor como principal instrumento para o desenvolvimento urbanomunicipal. As diretrizes estabelecidas no Estatuto mudaram a concepo de planejamento urbano atento praticada nos municpios, exigindo que o exerccio do planejamento passasse a enfrentar osproblemas urbanos, em especial a precariedade urbana e a irregularidade fundiria. The City Statute,Law n. 10,257/2001, has established the foundation for the promotion of urban policy throughout thecountry, strengthening the Master Plan as the main instrument for the municipal urban development. Theguidelines set out in the Statute changed the conception of urban planning so far committed in themunicipalities, requiring the exercise of planning to deal with urban problems, particularly urbanprecariousness and irregular urban land.

A Secretaria Nacional de Programas Urbanos (SNPU), em conjunto com o Conselho das Cidades, temdesenvolvido diversas atividades de apoio elaborao dos Planos Diretores e de mobilizao e

sensibilizao da sociedade: realizou a campanha nacional Planos Diretores Participativos: Cidade deTodos; distribuiu material de apoio em todo o territrio nacional; concedeu assistncia tcnica a mais de400 municpios; elaborou resolues do Conselho das Cidades sobre o processo de elaborao e ocontedo dos Planos Diretores; celebrou convnios com Estados e entidades; instituiu a Rede Nacionalde Avaliao de Planos Diretores Participativos; entre outras aes. The National Secretariat for UrbanPrograms (SNPU), together with the Council of Cities, has developed various activities to support thedevelopment of Master Plans and to mobilize and sensitize the society, held a national campaign"Participatory Master Plans: City of All" ; distributed material support across the country, gave technicalassistance to more than 400 municipalities; drafted resolutions of the Council of Cities on the process ofelaboration and contents of Master Plans; celebrated covenants with States and entities, established theNational Network of Assessment of Participatory Master Plans, among other actions.

Com a misso de apoiar o planejamento urbano nos municpios e consolidar uma poltica nacional deampliao do acesso a terra urbanizada, a SNPU tem concentrado seus esforos no apoio e fomento aosmunicpios na implementao dos instrumentos do Estatuto da Cidade. O intuito fazer com que osPlanos Diretores e a legislao que o complemente consigam definir reas na cidade destinadas produo de habitao de interesse social de modo a garantir uma soluo habitacional que viabilize apermanncia da populao de baixa renda em reas ento irregulares e precrias, mas aptas urbanizao. With a mission to support urban planning in municipalities and consolidate a national policyto increase access to urban land, the SNPU has concentrated its efforts in supporting and fostering themunicipalities in implementing the instruments of the City Statute. The aim is to make the Master Plansand its complementary legislation able to define areas in the city for the production of social housing inorder to ensure a housing solution that allows low-income population to remain in areas so far irregularand precarious, but suitable for urbanization.

Nesse sentido, tendo em vista a constante promoo da implementao do Estatuto da Cidade, apresente proposta visa fomentar a implementao dos instrumentos voltados a promover o acesso terraurbanizada e bem localizada aos segmentos historicamente excludos do direito moradia. Odesenvolvimento dos trabalhos ser feito a partir de metodologia construda entre o Ministrio dasCidades, consultores e gestores municipais. In this way, regarding the constant promotion ofimplementation of the City Statute, the proposal aims to enhance the fomentation of instruments directedto providing access to urbanized and well located land to the historically excluded segments of the right to

housing. The development of the work will take part under the methodology built by the Ministry of Cities,consultants and municipal managers.

O produto final ser uma publicao de orientao aos gestores e sociedade sobre a implementao deinstrumentos do Estatuto da Cidade, em especial os instrumentos de ampliao do acesso terraurbanizada e aqueles relacionados interface entre o planejamento urbano e a poltica municipal dehabitao de interesse social.The final product will be a publication of guidance to government managersand society on the implementation of instruments of the City Statute, in particular the tools for increasingaccess to urbanized land and those related to the interface between urban planning and the municipalsocial housing policy.

Espera-se, assim, que o material possibilite uma melhor apropriao do contedo e das idias doEstatuto da Cidade para que gestores pblicos e sociedade, juntos, tenham melhores condies de tomaras decises sobre o futuro das cidades e tenham melhor conhecimento sobre o potencial dos

instrumentos do Estatuto na construo de cidades mais justas e para a superao do quadro dedesigualdade social que abrange grande parte do pas.It is expected, therefore, that the material allowsgreater appropriation of the content and ideas of the City Statute, so that public officials and society,together, have better conditions to decide about the future of cities and have deeper knowledge about thepotential the instruments of the Statute in the construction of fairer cities and to overcome the context ofsocial inequality spread in a great part of the country.

Este projeto faz parte de uma estratgia mais ampla, em que se pretende, por um lado, adaptar as aesda Secretaria Nacional de Programas Urbanos no apoio aos municpios na regulamentao eimplementao dos instrumentos, de modo a propiciar o efetivo fortalecimento institucional para umplanejamento urbano mais qualificado. Isto , pretende-se avanar no apoio voltado ao efetivocumprimento da funo social da propriedade e, para tanto, espera-se explorar experincias piloto de

regulamentao dos instrumentos, bem como a construo de indicadores. Por outro lado, espera-seconferir diretrizes no mbito nacional que orientem os municpios acerca da implementao dosinstrumentos, fazendo com que o prximo ciclo decenal de elaborao de planos diretores (ps 2011)seja pautado nessas orientaes gerais.

This project is part of a wider strategy, which aims, first, to adapt the actions held by the NationalSecretariat for Urban Programs to support the municipalities in the regulation and implementation oftheseinstruments, in order to promote an effective institutional strengthening for a more qualified urbanplanning. This is intended in orderto advance in the support directed to the effective accomplishment ofthe social function of property and, to achieve this, it is expected to explore piloting experiences onregulatory instruments as well as on the construction of indicators. On the other hand, is expected to giveguidelines at the national level that guide the municipalities on the implementation of the instruments, sothat the next cycle of ten-year development master plans (after 2011) is guided by these generalorientations.

sentido de promover o acesso terra urbanizada e regularizada e garantir a equidade nas aes dedesenvolvimento urbano.

To e xpand and disseminate knowledge about the implementation of legal u rbanis m instruments, inorder to promote access to urbanized and regularized land, and ensure fairness in the actions ofurban development.

Construir orientaes e diretrizes gerais para o planejamento e gesto de reas de expanso urbanae de vazios em reas urbanas consolidadas mediante incorporao dos princpios da funo socialda propriedade e da cidade.

To b uild orientations and guidelines for planning and managing urban expansion areas and v acantareas (hollows) in urban consolidated areas by the incorporation of the principles of the socialfunctions of the property and ofthe city.

Consolidar o guia sobre implementao dos instrumentos do Estatuto da Cidade voltados para oacesso terra urbanizada por meio de publicaes a serem distribudas em todo o territrio nacional.

To consolidate the guide about the implementation of the instruments of the City Statute focused onaccess to urban land through publications to be distributed throughout the country.

14. 14. Metodologia e seqncia das atividadesMethodology and sequence of activities

a) Seleo de instrumentosSelection of the instruments

A SNPU definir quais instrumentos do Estatuto da Cidade sero trabalhados. A seleo se pautar nosresultados da pesquisa da Rede Nacional de Avaliao de Planos Diretores Participativos, na anlise dodficit habitacional brasileiro, na anlise dos resultados dos programas habitacionais do governo federal,entre outros insumos. The SNPU will define which instruments of the City Statute will be worked. Theselection will be driven in the results of the National Assessment of Participatory Master Plans research, inthe analysis of the Brazilian housing deficit, in the analysis of the results of housing programs of thefederal government, among other inputs.

b) Elaboration of technical studies on the selected instruments, with descriptions of theinstruments, assessment of implementation experiences carried out by localgovernments, mapping of the implementation process and description of difficultiesand challenges

Por se tratar de um trabalho de proposio de subsdios para constituio de metodologias paraimplementao dos instrumentos do Estatuto da Cidade, espera-se intensa interao entre osespecialistas contratados, servidores da SNPU (tendo em vista a oportunidade para a qualificaodestes), e servidores e gestores de prefeituras municipais convidadas com experincias exitosas naaplicao dos instrumentos do Estatuto da Cidade nos objetivos acima apresentados.

Because it is a work of proposing subsidies for establishment of methodologies for implementation of theinstruments of the City Statute, it is expected intense interaction between the experts hired, the SNPUservers (regarding the opportunity ofqualification), and servers and managers of invited municipalgovernments with successful experiences in applying the tools of the City Statute in the goals outlinedabove.

d) Oficinas de trabalho

Sero realizadas 2 oficinas de trabalho, envolvendo os tcnicos da SNPU, osconsultores do projeto e tcnicos de prefeituras convidados. A primeira oficina, no incio doprojeto, objetiva avaliar a seleo prvia dos instrumentos e definir os pontos principaisdos estudos tcnicos a serem elaborados pelos consultores. A segunda oficina serrealizada para discusso dos estudos tcnicos e elaborao de diretrizes para o guia deimplementao dos instrumentos.c) Workshops

Two workshops will be held, involving the technicians ofSNPU, the project consultants and themunicipal technicians invited. The first workshop, at the beginning of the project, aims to evaluatethe previous selection of instruments and to define the main points of the technical studies to be

prepared by consultants. The second workshop will be held to discuss the technical studies and theelaboration of guidelines forthe implementation of the instruments guide.

O contedo final da publicao ser revisado por profissional especialista em lngua portuguesa, comconhecimento e experincia na lngua portuguesa e em revises tcnicas. Os servios incluem revisoortogrfica e formatao dos textos de modo que a publicao apresente uma leitura clara, simples,interessante e homognea.

The final content of the publication will be reviewed by a professional specialist in portuguese, withknowledge and experience in the Portuguese language and technical reviews. Services includeproofreading and formatting text so that the publication shows a clear, simple, interesting andhomogeneous reading.

Consiste na etapa de desenvolvimento do projeto grfico para a publicao. O objetivo oferecer umproduto de boa qualidade tcnica contemplando os aspectos visuais, de impresso e de reproduo, bemcomo de resistncia com relao ao manuseio ao longo do tempo.

It consists in the stage of graphic design development for publication. The goal is to offer a product ofgood technical quality regarding visual, printing and reproduction aspects as well as resistance withrespect to handling over time.

Espera-se consolidar orientaes e diretrizes gerais no mbito nacional sobre a implementao deinstrumentos do Estatuto da Cidade.Expected to strengthen orientations and guidelines at the nationallevel on the implementation of instruments of the City Statute.

Em relao difuso, espera-se que o guia seja distribudo a pelo menos 300 municpios brasileiros, comfoco nas equipes tcnicas e nos gestores municipais. O guia tambm ser distribudo a profissionais erepresentantes da sociedade que estejam envolvidos com a poltica urbana.

Regarding dissemination, it is expected that the guide is distributed to at least 300 Brazilian municipalities,with a focus on technical teams and municipal managers. The guide will also be distributed toprofessionals and representatives of civil society involved in urban policy.

A difuso do guia ser realizada por meio de distribuio direta aos municpios, na realizao deatividades de capacitao promovidas pelo Ministrio das Cidades e conforme solicitao das Prefeituras.O monitoramento ser realizado por meio do controle da entrega do guia, tendo como indicadores os

municpios que receberam o guia e os municpios que receberam o guia e tomaram a iniciativa deregulamentar os instrumentos. Neste ltimo caso, o monitoramento ser realizado pelo envio aoMinistrio das Cidades da experincia ou da regulamentao realizada pelo municpio. As experinciasenviadas comporo um banco de experincias de implementao ou regulamentao dos instrumentosdo Estatuto da Cidade, tomando por base a orientao estabelecida no guia.The spread of the guide willbe done through direct distribution to municipalities, in carrying out training activities promoted by theMinistry of Cities and upon the request of the municipalities prefectures. The monitoring will be

accomplished by controlling the delivery of the guide, using as indicators the municipalities that receivedthe guide and the municipalities that received the guide and took the initiative to regulate the instruments.In the last case, the monitoring will be accomplished by sending to the Ministry of Cities report of theexperience or the regulations made by the municipality. The experiences sent will compose a bank ofexperiences in the implementation of instruments and regulations of the City Statute, based on theguidance set out in the guide.

It is also expected to articulate a project of international technical cooperation to support pilotingexperiences of application of the instruments, so that the orientations and guidelines are materialized inlocal experiences.

The guide will be an instrument and a foundation for support orientation to be carried out by the Ministry ofCities in the activities of the National Urban Programs.

Tambm de espera estruturar o banco de experincias a partir dos recursos tcnicos, humanos efinanceiros da Secretaria Nacional de Programas Urbanos, no contexto do Departamento dePlanejamento Urbano.

It is also expected to structure the bank of experiences from the technical, human and financial resourcesof the National Secretariat for Urban Programs, in the Department of City Planning.

Por fim, os recursos para assistncia tcnica para capacitao, regulamentao e implementao deinstrumentos do Estatuto da Cidade sero oriunda das aes e programas da Secretaria Nacional deProgramas Urbanos.

O Ministrio das Cidades, por meio da Secretaria Nacional de Programas Urbanos, com base na suamisso de promover a ampliao do acesso terra urbanizada, tem desenvolvido diversas atividadesvoltadas ao apoio aos municpios na promoo da regularizao fundiria e na implementao dosPlanos Diretores e instrumentos do Estatuto da Cidade. Por demandas advindas da sociedade, dosgovernos estaduais, dos municpios e do Conselho das Cidades, o Ministrio das Cidades tem buscado aampliao das atividades de capacitao de modo a preparar os agentes envolvidos na implementaoda poltica urbana. No caso da SNPU, uma das linhas de capacitao envolve a implementao deinstrumentos do Estatuto da Cidade.

The Ministry of Cities, through the National Secretariat for Urban Programs, based on its mission topromote the expansion of access to urban land, has developed various activities aimed at supportingmunicipalities in the regularization of land tenure and the implementation of Master Plans and instrumentsof the City Statute. For claims arising from society, state governments, municipalities and the Council ofCities, the Ministry of Cities has looked for the expansion of training activities in order to prepare the

agents involved in the implementation of urban policy. Regarding SNPU, one of the areas of traininginvolves the implementation of instruments of the City Statute.

O presente projeto se insere no conjunto de atividades em desenvolvimento pela SNPU, contribuindopara delinear orientaes e diretrizes para que os municpios implementem os instrumentos do Estatutoda Cidade voltados ampliao do acesso terra urbanizada. Este projeto disponibilizar importantessubsdios para que as aes da SNPU sejam ajustadas de modo a ampliarem o escopo de apoio aosmunicpios.

This project is inserted in the range of activities being undertaken by SNPU, helping to draw uporientations and guidelines for municipalities to implement the instruments of the City Statute aimed atexpanding access to urbanized land. This project will provide important subsidies so that the actions ofSNPU are adjusted in order to magnify the scope of support to municipalities.

Os resultados obtidos serviro para direcionar as aes da Secretaria Nacional de Programas Urbanosno apoio aos municpios para a implementao das suas polticas urbanas.. Oportunamente, a partir domonitoramento da implementao do projeto, ser possvel, em conjunto com o Conselho das Cidades,elaborar resolues com diretrizes especficas para cada instrumento. Tambm se espera apoiar aaplicao dos instrumentos nos municpios por meio de experincias piloto, de modo a concretizar asorientaes e diretrizes gerais construdas no guia.

The obtained results will serve to direct the actions of the National Urban Programs in supportingmunicipalities for the implementation of theirurban policies. In due course, it will be possible, based on themonitoring of the project implementation and in conjunction with the Council of Cities, to developresolutions with specific guidelines for each instrument. It is also expected to support the implementationof the instruments in the municipalities through pilot experiments in order to implement the orientationsand guidelines built in the guide.
