Mark is an active participant in TAHU (Texas Association of Health Underwriters) and AAHU (Austin Association of Health Underwriters) Mark is the current 2 nd Vice President on the TAHU Executive Committee for the 2011-2012 year. Mark is the President Elect of TAHU and will become President July of this year In 2004 Mark was honored with the TAHU Ken Martin Excellence in Communication and Journal- ism Award. In addition, in 2010 Mark was honored with the AAHU Shirley Hutzler Award. Mark has written education courses on a variety of subjects including Health Care Reform, Small Business Tax Credit Strategies, Senate Bill 80 qualified small business plans, Consumer Driven Health Plans, Self Funded plans, Healthy Texas, and Single Payer systems. He has conducted these courses to chapters across Texas as well as the TAHU state convention. Mark is also active with Health Alliance for Austin Musicians (HAAM) as a member of the HAAM Benefit Day committee and was a past Man of the Year candidate for the Leukemia and Lymphoma Society and a current board member. Mark is a graduate of The University of Texas at Austin, graduating with a B.A. in both Economics and Philosophy in 1993. Mark Bellman, RHU, SGS

United Healthcare Mark joined UnitedHealthcare as the Central Texas (San Antonio, Austin, and Waco) Vice President for Small Group Business (2-99) in February 2006. As of June 2012, Bellman assumed the role of Vice President of Small Business Sales and Account Management for the South Texas, adding Houston, Corpus Christi and the Rio Grande Valley to his territory. Prior to UHC, he worked with Humana for over four years in sales (Austin, Texas) and management (Tampa & Orlando, Florida) capacities with an emphasis on CDH plans. I hope this article finds our members recuperating

from the Christmas and New Year’s holidays and ready

and eager to get the new year started with a bang. I am

sure that a lot of you have already put together your business plan for

2013. If not, I urge you to actually write down a business plan and keep

it where you can see it on a daily basis. I don’t know about you, but for

me it is a case of “out of sight, out of mind”. Let’s have a year where

we can be proactive in our businesses and not reactive. I understand that

regardless of whether you are a broker, carrier representative, or third

party administrator, you are trying to figure out where you and your

business are going to fit into the Affordable Care Act and all of the

changes to our businesses that will need to take place as the new health-

care law is implemented.

I believe that is why we need each other and our members’ involve-

ment in HAHU, TAHU, and NAHU so that we can stay informed as to

what is going on both locally and

nationally that affects our ability to help our clients and continue to be

compensated for the work that we do for them. We travel to Austin on

the 22nd of this month to visit with our state legislators and express our

views on what the role of the insurance professional should be as they

implement the new health care law changes. I urge each of you to con-

sider taking the time to make the trip to Day at the Capitol, as we need

as many voices as we can muster so that we can make sure that our

views are heard.

In closing, I would like to ask each of you to be sure to contact any

of our board members with ideas that you may have for future luncheons

and events that will bring value to our members and clients.

Owner Only Exemption

from PBGC Coverage By

All defined benefit plans (including cash balance plans) are

covered by the PBGC unless the plan qualifies for a statutory

exemption from PBGC coverage. There is an exemption for

plans that cover only substantial owners. If a defined benefit

plan covers even one employee who is not a substantial owner, then the plan does not

qualify for this exemption.

In order to be a substantial owner, an individual must meet one of the following

requirements:

• Own 100% of an unincorporated trade or business

• Own directly or indirectly 10% or more of the capital interest in a partnership

• Own directly or indirectly 10% or more of the profit interest in a partnership

• Own more than 10% of the voting stock of a corporation

• Own stock representing more than 10% of a corporation’s value

In determining stock ownership, the ownership attribution rules used for determining controlled groups

apply. Under the controlled group ownership attribution rules, an owner’s spouse is treated as owning the stock

of the owner. Thus, the owner only exemption applies if all participants are substantial owners or spouses of

substantial owners. However, the child of a substantial owner is not generally attributed ownership, so if defined

benefit plan covers a substantial owner and his child, the plan is not exempt from PBGC coverage.

There are somDe other rules that are similar, but different for owners in the qualified plan arena. These

differences might lead to different reporting or testing requirements, but they do not necessarily change whether a

PBGC coverage exemption applies. First, certain owner-only plans are either exempt from filing a Form 5500 or

may file a Form 5500-EZ in lieu of the longer Form 5500-SF or Form 5500. A plan may file a Form 5500-EZ

instead of a Form 5500-SF/Form 5500 if the following requirements are met:

• The plan covers the 100% owner of an incorporated or incorporated business, or the plan covers only the

partners of a business partnership.

• The plan may additionally cover the spouse of an owner or partners.

• The plan may not cover any other employees.

Thus, to file a Form 5500-EZ, unlike the PBGC substantial owner exemption, there is no requirement that

each partner own more than 10% of the employer for a plan to be eligible to file a Form 5500-EZ in lieu of the

Form 5500-SF or Form 5500. Thus, not all plans that are eligible to file the Form 5500-EZ are exempt from

PBGC coverage..

Second, a 5% or more owner of an employer is considered a Highly Compensated Employee (HCE) for

nondiscrimination testing. The threshold for being an HCE and being a substantial owner are different. So, a

defined benefit plan that covers all HCEs is not necessarily exempt from PBGC coverage.

Third, when a PBGC covered plan terminates without enough assets to pay all benefits, the PBGC will

allow a majority owner to waive a portion of his benefit so that other participants will receive their entire

benefit. To be a majority owner, the participant must own 50% or more of the employer. The substantial owner

standard used to determine whether a plan is PBGC- covered is different from the majority owner standard used to

determine whether an owner in a PBGC-covered plan may waive his benefit.

Day at the Capitol by

On January 22nd members of TAHU, NAIFA and TALHI will meet in

Austin and have the opportunity to visit with legislators to discuss issues

affecting their clients. There have been over 300 bills pre filed before the start of this Legislative Session.

There are dozens of newly elected representatives who need to be educated, on the vital role of agents

and brokers. We will begin the day bright and early with a full breakfast buffet. Once breakfast is over,

we will load onto buses for meetings with legislators. After our morning meetings, we will then travel

back to the hotel for our lunch meeting. Attorney General Greg Abbott is the scheduled lunch speaker.

He led the way as Texas joined with several other states to challenge the constitutionality of the Patient

Protection and Affordable Care Act.

The deadline has passed for states to notify HHS if they are going to set up their own Health

Insurance Exchange. Governor Perry sent Secretary Kathleen Sebelius a letter on November 20th stating

Texas will not set up an Exchange. In the letter the Governor said, “This is a federally mandated

exchange with rules dictated by Washington.” Also in the letter, he added, ”It would not be fiscally

responsible to put hard working Texans on the hook for an unknown amount of money to operate a

system under which the rules have not even been written.”

Thank you, Governor Perry, for not subscribing to the same belief of some of the members of

Congress in Washington, who feel that they must pass Legislation just so we know what is in it! I am

thankful we have a Governor who strongly believes in states’ rights, especially where it comes to

regulation of insurance. As we start a new legislative year, it is essential we become involved in

promoting our industry. This Day at the Capitol is an excellent opportunity to have our voices heard.
