While some organiza- tions supported the decision some have questioned the same saying the order violates the fundamental rights of the peo- ple. Criticizing the State Government for grossly failing to live up to the expectations of the people, Harsh Dev Singh Chairman, JKNPP and former Minister condemned the ruling alliance for issuing absurd orders to divert the attention of the public from its mal- gover- nance, and misrule. He was referring to the recent ‘Guest Control Order’ issued by the Food Civil Supplies and Consumer Affairs Department, (FCS&CAD) which he said defied all logic and rationale besides being violative of fun- damental rights of citizens. Addressing the media, Harsh Dev ridiculed the issuance of Order No 39-FCS &CA of 2017 to be implemented with effect from April, 1 this year as absurd, whimsical and freakish. He said that the order had put a capping on the number of guests to be invited in the weddings, on the number of vegetarian and non –vegetarian dishes cooked at marriage functions besides complete ban on sending dry fruits, sweets with invitation cards by any person to relatives, friends and guests. He further said that the deviant order also banned the use of amplifiers, loud speakers, profuse lighting and fire crackers in all such social and private functions. Terming the recently issued Guest Control Order as farcical and ludicrous, Singh said that the State Government seemed to have lost its political acumen and the maverick regime had now started poking its nose into private life of the citizens. He said that the coalition of diamet- rically opposite poles had gone berserk by outlandishly interfer- ing in the rituals and customs of the varied communities which only showcased that the present government had lost its track and become mentally bankrupt. Criticizing the Government decision senior VHP leader, Dr Rama Kant Dubey said that the order was issued in haste as the Government was supposed to consult the socio-political lead- ers heads of various religious and social bodies and ascertain their views about the same. He said the order was issued in haste and it will meet the same fate which earlier order issued by the Government met. He said though religious and social organizations are opposed to lavish spending in social functions like marriages but at the same time the Government has no right to curb the fundamental rights of the people. He said the socio-religious organisations working for the welfare of society are fully aware of social evils prevalent in society and had they been taken on bard before issuing the order they could have guided the Government in a better way. However All Biradri/ Sabha Coordination Committee termed the decision of the Government as a result of their protracted struggle in this regard. However the Committee in a handout issued here today said before taking the decision the Biradaris should have also been taken into confidence. Committee organizer Vinod Gupta said no doubt the order will prove a milestone in ending the lavish spending in the mar- riage but he stressed that the decision should become a part of Legislation in the State. All India Backward Classes Union (AIBCU) while welcom- ing the decision said the Government should implement the same in letter and spirit so that the poor people can heave a sigh of relief. Besides the Union in its meeting held under the chairmanship of Abdul Majid Malik demanded that a com- plete check be maintained on banquet halls whose manage- ment is charging very high fares from the people. The meeting was attended by Prof Kali Dass and M R Bangotra also. Haq for making constituencies nodal points of development Excelsior Correspondent KULGAM, Feb 23: Minister for Rural Development and Panchayati Raj, Abdul Haq, today pitched for making constituencies as nodal points of development and plan execution. He also urged public representatives to serve as prime movers of development by properly monitoring the develop- mental activities. The Minister stated this while chairing District Development Board meeting of Kulgam district to discuss and approve the annual district plan today. MP Nazir Ahmad Laway, MLAs Muhammad Yousuf Tarigami, Abdul Majid Bhat, Mohammad Amin Bhat, Abdul Majid Padder, DDC Kulgam, heads of concerned departments, district and sectoral officers, besides other concerned attended the meeting. On the occasion, DDC Showkat Aijaz Bhat briefed the Minister about progress made in the implementation of previous DDB decisions. It was given out that against availability of Rs 68.29 crore, an expenditure of Rs 45.13 crore has been made by mid-February 2017. Abdul Haq impressed the offi- cials of Horticulture Department to develop high density orchards in the district by providing the root-stock to the orchardists. Besides, he enjoined them to pro- vide grafted walnut plants for upper Devsar and DH Pora belts. The Minister said that the Government is committed to pro- vide funds to only those projects which have been technically approved and vetted by the Departments. He directed the officers to pri- oritise those schemes and projects which are near completion but linger on due to meagre funding so that they can be physically and financially completed. The Chairman exhorted the officers to take the development on mission mode basis so that its fruition is cherished by the gener- al public. On the occasion legislators sought the realignment in 33 KV Yaripora receiving station with Kulgam grid station. They also highlighted the need of augment- ing strength of doctors and para- medics, besides completion of pending work of different PHCs in the district. Sham inaugurates ‘Vision-J&K’ Excelsior Correspondent JAMMU, Feb 23: Minister for PHE, Irrigation & Flood Control Sham Lal Choudhary today inaugurated three-day workshop 'Vision J&K' at Talab Tillo. Member Parliament Shamsher Singh Manhas, MLA Khour Dr Krishan Lal Bhagat and other officers of various departments were present on the occasion. The objective of organizing the workshop is to create aware- ness among the youth about employment opportunities in Government and private enter- prises. While addressing the gather- ing, the Minister said the State Government has launched many schemes for providing employ- ment opportunities to the youth in and outside the State. Events like these help educate and cre- ate awareness among masses especially youth about various avenues open for them to explore and exceed in, he added. As many as 30 Government organizations and many private companies displayed their stalls at the exhibition including Indian Space Research Organization (ISRO), Steel Authority of India, Indian Railways, CSIR, DBT, MOES, TDB, NATMO, Rural Electrification Corporation, National Skill Development Corporation, NTPC, Spices Board, Coffee Board, NRDC, JAKEDA, PowerGrid, KVIC and Cashew Board. Excelsior Correspondent JAMMU, Feb 23: In a much publicized Udhampur terror attack case, Division Bench of State High Court comprising Justice Mohammad Yaqoob Mir and Justice Janak Raj Kotwal today directed trial court to strictly follow the provisions of Section 17 of the NIA Act and Section 44 of the Unlawful Activities (Prevention) Act. The direction was passed in an appeal filed against the order dated December 9, 2016 whereby trial court had opined that the state- ments of the protected witnesses are to be recorded in the absence of the court but in the presence of respective counsels. After hearing Advocate Rahul Bharti with Advocate Satinder Gupta, who filed revision against the order of trial court, Division Bench observed, “special court if so desires for reasons to be record- ed in writing may hold the pro- ceedings in-camera. Sub-Section (2) provides that on an application of a witness or by the Public Prosecutor or court on its own motion if satisfied that the life of such witness is in danger then for reasons to be recorded in writing shall take such measures as it may deems fit for keeping the identity and address of such witness secret”. “The proceedings so far as recorded by the trial court from time to time do not indicate any- where that it has recorded any rea- son as was required to be done in terms of Section 17 of the NIA Act or under Section 44 of the Unlawful Activities (Prevention) Act”, the DB said, adding “Special Judge has not recorded any reason for holding the proceedings in- camera nor it is anywhere men- tioned that any application was made by any witness or by PP or the court on its own motion was satisfied that life of such witnesses (protected witnesses) is in danger”. The DB further observed, “order dated 09.12.2016 passed by the Special Judge rejecting the application of the accused is an interlocutory order, therefore under Section 21 of the NIA Act, appeal or revision cannot lie and counsel for the appellants while confronted with the legal position would con- tend that the order in effect is final, appeal can be maintained but we are not persuaded to accept the submission”. “But at the same time, while noticing that Special Judge has not followed the procedure as envisaged under Section 17 of the NIA Act or under Section 44 of the Unlawful Activities (Prevention) Act regarding holding of trial in- camera or taking measures for keeping the identity and address of protected witnesses secret and for avoiding miscarriage of justice and for fair trial to the accused, we are inclined to invoke powers under Section 561-A CrPC and to set- aside the order impugned which we do”, the DB said. “To avoid any protraction in the trial proceedings, the file shall be sent back to the trial court forth- with along with copy of this order so as to enable the Special Judge to fix the schedule for production and examination of the witnesses”, the DB said, adding “the trial court shall strictly follow the provisions of Section 17 of the NIA Act and Section 44 of the Unlawful Activities (Prevention) Act”. Speaking on the occasion, Haji Anayat Ali appreciated the efforts of Chief Minister Mehbooba Mufti to promote Kargil as an independent tourist destination. ADKUF expresses concern over ration problem Excelsior Correspondent JAMMU, Feb 23: All Displaced Kashmiri United Forum (ADKUF) in a meeting today held under the chairman- ship of DN Kissu expressed grave concern over the ration problem deliberately cropped up by the Food Civil Supplies & Consumer Affairs Department (FCS&CAD). Addressing the meeting Kissu said that the Department has failed to address the problem for the past six months period. Following strike of ration deal- ers, a number of APL ration cards most of them of senior citizens, in the list issued by the Department , have gone missing and are denied ration. The dis- placed community has to run from one office to another in search of some relief. He lam- basted the concerned for being insensitive and unconcerned about the problem. Surprisingly non migrants are being taken care of promptly particularly in Valley, he added. P L Sudeshi president of the Forum while welcoming Central Government's proposal for reha- bilitating Pandits in Valley said, that aspirations of Pandits will be met only after rehabilitating at single place, entire community is united on this issue. Professor GL Koul appealed Central and the State Government that the Pandits be declared internally displaced minority community according to the set national and interna- tional parameters on the issue. P N Raina general secretary said that the Forum vehemently opposes settling of Rohingyas refuges and demanded a thor- ough probe to investigate, expose and punish those supporting their illegal settlement in the State. He further said that it is embarrass- ing that Aadhar and ration cards have been arranged for them whereas ration is denied to the genuine State subjects. He added that the resolution passed by the State Assembly with hidden rider is nothing more than hoodwink- ing Central Government. Fresh migrant registration is a bigger conspiracy to change demo- graphic status of Jammu now after Kashmir. Meanwhile president Samajwadi Party (SP) Migrant Cell Inder Ji Labroo accused the Government of its failure in making arrangements on Mahashivratri at Jagti camp and alleged neither walnuts nor other essential items were made avail- able to camp inmates and all claims in this regard were hol- low. HC directive to DSEK Excelsior Correspondent SRINAGAR, Feb 23: The State High Court today directed the Director School Education Kashmir (DSEK) to comply with the directions of Court and provide all facilities to the educational insti- tutions in the Valley. The direction to DSEK fol- lowed after the Court came across with various insufficiencies indicat- ed in the report filed by the DSEK. Court during the perusal of status report observed that in various schools electricity, fire extinguish- ers and LED bulbs have not been provided. Besides these shortfalls, Court also came across other deficiencies in the status report. As such court asked the Amicus who has been provided the copy of status report to verify whatever has been stated in the report. "In the meantime, Director School Education is required to comply with the directions of this court and make up the shortfalls within a period of four weeks", directed the Division Bench of Justice Ramalingam Sudhakar and Justice Ali Mohammad Magrey while hearing a suo moto cog- nizance taken by the Chief Justice of the State about burning down of educational institutions in the Valley in last year uprising. Court ordered the matter be listed for fur- ther hearing on March 20. Court in its directions, besides protection of educational institu- tions from further damage had also directed the authorities to take immediate measures for rebuilding those schools which have been burnt down or damaged by the offenders during last year unrest. It may be mentioned here that about 39 schools were burnt down and torched during the unrest and about 47 persons were apprehend- ed by the police involving in the offence. Court also emphasized on the people of the State to ensure at their level that the educational institu- tions in their areas are protected with the observation that like water and air, education is also an essen- tial component of human life and for moral, spiritual and material development of a human being, education is of utmost importance Court has reiterated that it (court) in these proceedings has shown its deep concern about the burning down of the educational institutions in various parts of the Kashmir valley and in order to ensure that educational institutions are protected from being vandal- ized or damaged or burnt down, issued directions from time to time. DB directives to trial court in Udhampur terror attack case PK discusses socio-political scenario in J&K Excelsior Correspondent JAMMU, Feb 23: Panun Kashmir (PK) in its office bear- ers meeting here today discussed the socio-political scenario pre- vailing in the State. The meeting was held under the chairmanship of Ashwani Kumar Chrungoo, president, P K. It besides others was attended by Prof. M.L.Raina, chairman, Political Affairs Committee (PAC), Virender Raina, national spokesperson, Upinder Kaul, Kamal Bagati, Vijay Qazi and Sameer Bhat. Ashwani Kumar Chrungoo, president, PK in his address said that the struggle in exile of the Kashmiri Pandit community has reached a very crucial stage because of the fact that the gen- erational transition is taking place. The new generation of the community and the diaspora are effectively linked due to the modern technology and has evolved a better outlook to meet the challenges of the present times. The ideological thrust that the struggle in exile has created over the last three decades has started bearing its fruits. In this context, it is important that the issues pertaining to our geo- political concerns in the Valley of Kashmir, the day to day sub- sistence and economic rehabili- tation issues and the existential and civilizational identity con- cerns are addressed comprehen- sively. Chrungoo said that is why the "Comprehensive Political Agenda" has been launched with the active involvement of the energetic and meaningful youth activists of the community. While Margdarshan 1991 phi- losophy remains the main guid- ing principal, the declaration and the demand made in the Homeland Resolution also assumes more significance than ever before, he added. He said P K is committed to take the struggle in exile to the new level with effective strategy and speed. Virender Raina, national spokesperson-PK criticized the separatist-fundamentalist ele- ments in Kashmir for continuing to act as the surrogates of Pakistan and at the same time enjoying the largesse of the Indian State. Their several state- ments and actions further expose their intolerant life pattern towards the minorities of the Kashmir Valley. After genocide, ethnic cleansing and the mass exodus of the community in the Valley, these anti-Indian forces have left no stone unturned to disallow any space for the minorities in Kashmir. He said in all cases they have been refusing any kind of Kashmiri Pandit resettlement in Kashmir Valley. It needs to be said emphatically that the Kashmiri Pandits have a rightful claim on the territory of Kashmir as the indigenous peo- ple of the Valley and they are party to all negotiations on Kashmir. One killed in road mishap Excelsior Correspondent SAMBA, Feb 23: One pedestrian was killed on spot when he was trying to cross the road near 17 Miles on Jammu- Pathankot National Highway and hit by super fast bus bearing registration number JK02BD- 6177 which was on its way from Kathua to Jammu this evening. Vijaypur Police reached the spot and sent the dead body to Government Community Health Centre Ramgarh for legal formalities. The deceased was identified as Surinder Yadav, 32, son of Ram Raj Yadav of Bilria district Azamgarh U.P. Vijaypur police has regis- tered the case in this connection for further investigation.

“The proceedings so far asrecorded by the trial court fromtime to time do not indicate any-where that it has recorded any rea-son as was required to be done interms of Section 17 of the NIAActor under Section 44 of theUnlawful Activities (Prevention)Act”, the DB said, adding “SpecialJudge has not recorded any reason

for holding the proceedings in-camera nor it is anywhere men-tioned that any application wasmade by any witness or by PP orthe court on its own motion wassatisfied that life of such witnesses(protected witnesses) is in danger”.

The DB further observed,“order dated 09.12.2016 passed bythe Special Judge rejecting theapplication of the accused is aninterlocutory order, therefore underSection 21 of the NIA Act, appealor revision cannot lie and counselfor the appellants while confrontedwith the legal position would con-tend that the order in effect is final,appeal can be maintained but weare not persuaded to accept thesubmission”.

“But at the same time, whilenoticing that Special Judge hasnot followed the procedure asenvisaged under Section 17 of theNIAAct or under Section 44 of theUnlawful Activities (Prevention)Act regarding holding of trial in-camera or taking measures forkeeping the identity and address ofprotected witnesses secret and foravoiding miscarriage of justice andfor fair trial to the accused, we areinclined to invoke powers underSection 561-A CrPC and to set-aside the order impugned whichwe do”, the DB said.

“To avoid any protraction inthe trial proceedings, the file shallbe sent back to the trial court forth-with along with copy of this orderso as to enable the Special Judge tofix the schedule for production andexamination of the witnesses”, theDB said, adding “the trial courtshall strictly follow the provisionsof Section 17 of the NIA Act andSection 44 of the UnlawfulActivities (Prevention) Act”.

ADKUF expresses concern over ration problem

JAMMU, Feb 23: AllDisplaced Kashmiri UnitedForum (ADKUF) in a meetingtoday held under the chairman-ship of DN Kissu expressed graveconcern over the ration problemdeliberately cropped up by theFood Civil Supplies & ConsumerAffairs Department (FCS&CAD).

Addressing the meeting Kissusaid that the Department hasfailed to address the problem forthe past six months period.Following strike of ration deal-ers, a number of APL ration cardsmost of them of senior citizens,in the list issued by theDepartment , have gone missingand are denied ration. The dis-placed community has to runfrom one office to another insearch of some relief. He lam-basted the concerned for beinginsensitive and unconcernedabout the problem. Surprisinglynon migrants are being taken careof promptly particularly inValley, he added.

HC directive to DSEKExcelsior Correspondent

SRINAGAR, Feb 23: The StateHigh Court today directed theDirector School EducationKashmir (DSEK) to comply withthe directions of Court and provideall facilities to the educational insti-tutions in the Valley.

The direction to DSEK fol-lowed after the Court came acrosswith various insufficiencies indicat-ed in the report filed by the DSEK.Court during the perusal of statusreport observed that in variousschools electricity, fire extinguish-ers and LED bulbs have not beenprovided.

Besides these shortfalls, Courtalso came across other deficienciesin the status report. As such courtasked the Amicus who has beenprovided the copy of status report toverify whatever has been stated inthe report.

"In the meantime, DirectorSchool Education is required tocomply with the directions of thiscourt and make up the shortfallswithin a period of four weeks",directed the Division Bench ofJustice Ramalingam Sudhakar andJustice Ali Mohammad Magreywhile hearing a suo moto cog-nizance taken by the Chief Justiceof the State about burning down ofeducational institutions in the

Valley in last year uprising. Courtordered the matter be listed for fur-ther hearing on March 20.

Court in its directions, besidesprotection of educational institu-tions from further damage had alsodirected the authorities to takeimmediate measures for rebuildingthose schools which have beenburnt down or damaged by theoffenders during last year unrest.

It may be mentioned here thatabout 39 schools were burnt downand torched during the unrest andabout 47 persons were apprehend-ed by the police involving in theoffence.

Court also emphasized on thepeople of the State to ensure at theirlevel that the educational institu-tions in their areas are protectedwith the observation that like waterand air, education is also an essen-tial component of human life andfor moral, spiritual and materialdevelopment of a human being,education is of utmost importance

Court has reiterated that it(court) in these proceedings hasshown its deep concern about theburning down of the educationalinstitutions in various parts of theKashmir valley and in order toensure that educational institutionsare protected from being vandal-ized or damaged or burnt down,issued directions from time to time.

The ideological thrust that

the struggle in exile has createdover the last three decades hasstarted bearing its fruits. In thiscontext, it is important that theissues pertaining to our geo-political concerns in the Valleyof Kashmir, the day to day sub-sistence and economic rehabili-tation issues and the existentialand civilizational identity con-cerns are addressed comprehen-sively.

Chrungoo said that is whythe "Comprehensive PoliticalAgenda" has been launched withthe active involvement of theenergetic and meaningful youthactivists of the community.While Margdarshan 1991 phi-losophy remains the main guid-ing principal, the declarationand the demand made in theHomeland Resolution alsoassumes more significance thanever before, he added.

He said P K is committed totake the struggle in exile to thenew level with effective strategyand speed.

Virender Raina, nationalspokesperson-PK criticized theseparatist-fundamentalist ele-ments in Kashmir for continuingto act as the surrogates ofPakistan and at the same timeenjoying the largesse of theIndian State. Their several state-ments and actions further exposetheir intolerant life patterntowards the minorities of theKashmir Valley. After genocide,ethnic cleansing and the massexodus of the community in theValley, these anti-Indian forceshave left no stone unturned todisallow any space for theminorities in Kashmir.

He said in all cases they havebeen refusing any kind ofKashmiri Pandit resettlement inKashmir Valley. It needs to besaid emphatically that theKashmiri Pandits have a rightfulclaim on the territory ofKashmir as the indigenous peo-ple of the Valley and they areparty to all negotiations onKashmir.

One killed inroad mishap

Vijaypur Police reached thespot and sent the dead body toGovernment CommunityHealth Centre Ramgarh forlegal formalities. The deceasedwas identified as SurinderYadav, 32, son of Ram RajYadav of Bilria districtAzamgarh U.P.

Vijaypur police has regis-tered the case in this connectionfor further investigation.
