Federal Laws - Access

Section 504 of the Rehabilitation Act, one of the first civil rights laws offering protection for people with disabilities, was originally passed in 1973.

The Americans with Disabilities Act, 1990, was followed by the 2008 ADA Amendments Act (Title II)

ESSA Amendment to ESEA Sec. 1111(b)(1)(E)

Alternate Academic Achievement Standards (AAAS)

AAAS must: be aligned with the State’s academic content

standards promote access to the general education curriculum reflect professional judgment as to highest possible

achievement enable a student who meets the standards to be on

track to pursue postsecondary education or competitive integrated employment

ESSA Amendment to ESEA Sec. 1111(b)(2)(D)

Alternate Assessment (AA) Guidelines

Requires States to: Provide training in accommodation use Incorporate universal design for learning Base IEP team decision on State’s AA Identification Guidelines Inform parents:

o that their child’s academic achievement will be measuredbased on AAAS

o how participation in the alternate assessment may delay or otherwise affect completing requirements for a regular high school diploma

ESSA Amendment to ESEA Sec. 1111(b)(2)(D)

1% Threshold on Alternate Test Participation

Limits the number of students who may take an alternate assessment to no more than 1.0 percent of the total number of all students in the State who are assessed in a given subject.

States, however, cannot place a limit on AA participation at a district (or school) level.

Requires states to publicly post district data, districts to submit justification for overage, and states to provide oversight.

Subgroup data-ELL Disproportionality Concern

Currently there appears to be a sub-group disproportionality concern for our ELL students

HIDOE will be monitoring this as the alternate identification rate the ELL students as a whole across the State is more than 2X the expected rate.
