Healthcare Association LiabilityOver the years there has been an increasing number of Association & Not For Profit Organisations set up to meet the needs of the Community. But despite their good intentions, many of these Organisations and their Officers have found themselves at risk of expensive litigation arising from the provision of their services to their members or the public.With the increased cost and frequency of litigation and frequent changes to legislation; Organisations, Associations and their Officers cannot afford to operate without theprotection of a suitable insurance program.

A Healthcare Professionals’ Association Liability – Not for Profit policy is designed to protect both the assets of the Association or Organisation and their Officers.

EMPLOYEESAlleging discrimination, harassment, wrongful dismissal or discipline, breach of employment contract, defamation and committing internal fraud (Fidelity).

COMPETITORSClaims brought against a Director for misleading & deceptive conduct (Trade Practices Act)

What Are The Risks?

Risk Management – ensure that your Organisation has in place mechanisms to assess risk and risk tolerances. This should form part of a Risk Management Plan. A Risk Management Plan should be reviewed annually and align with the Organisation’s culture and strategy.

Data Management and Privacy – your organisation should review its process and procedures in this area to ensure that they are compliant with the recent changes to privacy legislation. The fallout and risk surrounding inappropriate access to data and client privacy is now very significant.

Compliance – Many NFP’s provide or deliver healthcare services to the community that are subject to accreditation or legislation. Changes to legislation should to be monitored regularly and frequently to ensure that your Organisation remains compliant. Non-compliance may see the Organisation impacted by fines and penalties or breach of contract actions.

Volunteers – Does your Organisation ensure that health, safety and other workplace obligations to volunteers are met? Are your volunteers appropriately trained? Are your volunteers appropriately qualified (eg. licensed to work with minors)?

GOVERNMENT AUTHORITIES & LEGISLATIONDirectors and Officers may be personally liable for breaches of hundreds of statutes (eg. ATO, ASIC, Trade Practices Commission)

CREDITORSAllegations a Director allowed the company to trade whilst knowing it could not pay its debts

Fraud – NFP’s experience high levels of internal fraud, sadly many instances of fraud are not discovered until the Organisation has been severely impacted. Ensure that dual controls are in placeregarding the transfer of money, reconciliations and expenditure.
