Enclosed is a copy of an amendment to the Memorandum of Understanding dated September 7, 1998 that I delivered to Ed Kagehiro. Also enclosed is a copy of a letter from Alan Murakami ofNHLC in response to my request for his comments and recommendations relative to said agreement.

My last coversation with Mr. Kagehiro in early December was that he had reviewed the draft and was going to provide me with a written reponse. He never responded and I understand that he has since retired from the department.

I would like arrange a meeting with you to discuss the draft agreement. I can be reached at my office quring the day at # If you are not be able to arrange a meeting soon, please respond in writing. It is important to me that we finalize an agreement as soon as possible.

MEMORANDUM OF UNDEltSTANDING

THIS MEMORANDUM made as ofthe day of --------' 1998, by and between the DEPARTME-:--N-T:-0-F-· W-A-TE_R_ SUPPLY OF TilE COUNTY OF MAUl, whose post office address is P. 0. Box 1109, Wailuku, Maui, Hawaii 96793, hereinafier called DWS, and GERALD P. HOKOANA, whose residence and mailing address is 1980 Hana Highway, Haiku, Maui, Hawaii 96708, hereinafier called HOKOANA.

WHEREAS, the DWS has applied for a pump installation permit with the Commission on Water Resource Management, and intends to withdraw water from basal water source in the Paia Aquifer on a regular basis; and

WHEREAS, HOKOANA is seeking a commitment from DWS that if his water source (Well No. 5620-02) and/or the existing EMI Spring/Tunnel adjoining his property is/are adversely affected due to IJWS's pumping of its new Hamakuapoko Wells (Well Nos. 5420-02 & 5320-0 I), then IJWS shall immediately cease pumping of said wells.

WHEREAS, DWS acknowledges that aside from the existing HC&S Maliko Pump II Well (Well No. 5520-0 I), there arc no other known wells withdrawing water from the Pnia Aquifer. Also, thnt there has been no apparent impact on the HOKOANA well since its commencement of operation in 1980 despite a significant withdrawal capacity of the HC&S well of6.7mgd.

WHEREAS, DWS feels that HOKOANA will not be adversely affected by the use of the Hamakuapoko Wells because of the 2.1 mile separation between the two wells and the pumping rate ofDWS's wells; and

WHEREAS, it is not possible to determine with any reasonable accuracy the effect of the pumping of the Hamakunpoko Wells without it being put in operation; and

NOW THEREFORE, DWS hereby establish with HOKOANA the following understanding;

I. DWS will monitor HOKOANA's well for chloride ion levels and water level below the intake of HOKOANA's well; and

2. HOKOANA grants DWS right of entry to install a well depth monitoring device and to take periodic depth measurements and water samples for chloride testing, provided that it is determined by HOKOANA in his sole judgment that the device will not cause damage to the well or interfere with its operation, and that request for entry be made and given reasonable notice by DWS prior to entry and for the specific purpose of monitoring depth and chloride testing, with copies of all monitoring data and test results for HOKOANA's records be made; and

3. HOKOANA and DWS understand that should the chloride ion level rise above 150 mgiL or should the water level drop below the current intake of the pump to the extent that water can not be drawn on a continuous basis under normal operating conditions, then DWS shall immediately cease pumping of the Hamakuapoko Wells. Pumping shall not resume until the source of the problem has been determined and corrected and chloride and water levels are returned to conditions existing prior to commencement of pumping ofthe Hamakuapoko Wells.

4. HOKOANA and DWS agree that this Memorandum of Understanding shall remain in effect for as long as DWS continues pumping of the Hamakuapoko Wells and shall inure to any subsequent owner of the HOKOANA property.

Dear Mr. Hokoana:

I've reviewed your proposed draft Memorandum of Understanding with the County of Maui Dept. of Water Supply. It omits the mention of monitoring for "organic contaminants" as Bill Meyer recommended earlier. The EPA and the State Dept of Health has a Jist of these contaminants that appear to be a standard list of regulated contaminants in this category. I urge that your agreement include reference to this Jist, so the monitoring is more comprehensive than that currently outlined in your draft agreement. The appropriate language might be (additions underlined; deletions bracketed):

1. DWS will sample and monitor Hokoana's well for chloride ion levels [and] water level below the intrak of HOKOANA's WP-11, and organic contaminants as listed in the Quality Assurance Project Plan for the SDWA Monitoring Program of the state Department of Health. which implements the National Primary Drinking Water regulations. pursuant the Safe Drinking Water Act of 1974 (attached as Exhibit "1 "), as follows:

lh For chloride ions and well water levels. at least monthly for the first year, then every three months thereafter. If chloride ion levels exceed 150 mg/1. in the future. monitoring shall be conducted monthly.

2. Thank you for providing us a copy of the draft Memorandum of Understanding (MOU) between you and the Maui Department of Water Supply concerning use and monitoring of the captioned wells.

We recommend the following amendments:

1. Specify the Maliko-Hokoana Well (Well No. 5620-02) as the subject of item #2.

2. The monitoring device we believe you want installed at the subject well is for reading water levels, not well depth.

3. You should specify who maintains and reports to the Commission on Water Resource Management (Commission) the records of monitoring. The Commission requires monthly recording and at least annual reporting.

We note that you have specified 150 mg/1 chlorides as an action point, which is well below the EPA guideline of 250 mg/1 for potability. And while there was earlier discussion in your correspondence concerning contaminants, we concur that it does not appear relevant for the MOU.

While we are pleased to be notified of this agreement and are happy to provide these comments, the agreement is not enforceable by the Commission. Should there be problems in the future, the Commission will consider the facts at that time.

Dear Tim:

I am investigating an inquiry from Gerald Hokoana, who is challenging that installation of a pump in the County of Maui Department of Water Supply well at Maliko Gulch, because of potential interference with his domestic well and spring source down slope. Besides his drinking water, Mr. Hokoana relies on this groundwater to supply water he uses to irrigate traditional taro patches he maintains on his property.

Mr. Hokoana wrote the Commission to ask that a condition be imposed on the pump installation permit which would require the county to stop pumping should there be a deleterious effect on his ability to obtain water from his well. I am writing to determine what action, if any, the Commission staff intends to take to address Mr. Hokoana's concern. Please advise.

Thank you for your letter of April 4, 1998, indicating further difficulty in getting a response from the Maui Department of Water Supply (MOWS) regarding potential impacts of the captioned wells with your Maliko-Hokoana Well (Well No. 5620-02), and requesting special conditions upon any approval of the captioned wells. We are still trying to work with MOWS toward an agreeable solution to your situation.

For your information, we faxed a copy of your January 28, 1998 letter to the MOWS, requesting their response to us, but have not received any written response to date.

Regarding your requested special conditions for final approval of permanent pump installation permits for Hlimlikuapoko Wells 1 & 2 (Well Nos. 5420-02 & 5320-01), your requested condition #1 is already a standard condition for all pump installation permits (see Standard Condition #4 for Pump Installation Permits, attached).

Your requested special condition #2 is your own responsibility as a well owner, as descnbed in Administrative Rules §13-168-7(b):

"The owner or operator of any well ... shall file a report of total water usage on a regular monthly basis to the commission on forms provided IJy the commission ... The reports may include other use­related information such as type of use, salinity, and water level, as may be deemed appropriate and reasonable lly the commission. •

Our purpose in sending you a copy of the water use report form was to enable you to monitor your situation as the responsible well owner. It is not clear that the Commission on Water Resource Management (Commission) has the authority to impose this responsibility upon another party who is not the well owner. However, should negative impacts from the Hamlikuapoko Wells manifest themselves at other well sites, including your well, and the cause is clearly linked to MOWS wells, the Commission has the authority to order a cutback in the pumpage of the MOWS wells.

As noted in our October 8, 1997 leTter to you, pumpage from the Pa'ia Aquifer System is below 70% of sustainable yield, the trigger which would mandate a public hearing for the Hamakuapoko Wells Pump Installation Permits. In the meantime, it is critical that you record and report to us the relevant pumpage information from your well to establish a baseline record.

We will continue to press MDWS for a wriTten response to your concerns prior to final approval of the permanent Pump Installation Permits and keep you informed of any such response. Our understanding is that the captioned project's Supplemental EIS must be cleared by the court as adequate before it can be reviewed and officially accepted. The Commission will not act upon the permanent pump installation permit until the SEIS is accepted.

On January 23, 1997, the Commission delegated authority to approve pump installation permits to the Chairperson in cases where total pumpage from an aquifer is less than 70% of the sustainable yield. The Paia aquifer system is far below 70%, and if no other legal conflicts are apparent, we could approve the application at that time without going before the Commission.

Your well is registered in our database, and we are assigning it the State Well Number 5620-02. The file includes water quality sampling results, as well as staff's field report with photos. We therefore have some data against which to measure any changes that occur as a result of the proposed Harnakuapoko Wells or other activities. For even greater protection, and as required by Administrative Rules § 13-168-7(a), data should be gathered monthly and reported annually by you to the Commission to establish a historical record for your well. Please use the enclosed standard Water Use Report form.

One of the requirements before proceeding with the pump installation permit was to test the well for impact on other wells, streams, and to test water quality. The tests show no likely effect on other wells or streams. However, excessive levels of lead were found in the well, and the Director has indicated that unless a solution to that problem is found, they would not install permanent pumps.

Thank you for your letter of July 23, 1997, regarding the current pumpage and pump capacity of the HC&S Well located in Maliko.

I have been in contact with Tom Nance whose engineering firm has been retained by the Department of Water Supply to do testing of the Hamakuapoko Wells and monitoring of water sources in the Maliko area. The information you provided on HC&S Well No. 5520-01 has pretty much been confirmed by Mr. Nance. He also took samples from our well which test results indicated that it provided good potable water. Mr. Nance's opinion is that the HC&S Well and Hamakuapoko Wells are drawing from the same aquifer. Further, that our well is probably not drawing from the same source as we have not experienced any significant change in salinity or water level during periods when the HC&S pump is in operation. Despite the opinions of Mr. Nance and Mr. William Meyer of USGS, I am still not totally convinced that we would not be adversely affected by the Hamakuapoko Wells.

I sent a letter to Mr. Ed Kagehiro on May 8, 1997 requesting a meeting to discuss my concerns. On June 23, 1997, I sent a similar letter to the Director, David Craddick. To date, I have not received any response to my letters. It appears that in hiring Mr. Nance, the Department of Water Supply is continuing in its efforts to bring the Hamakuapoko Wells on line. What I don't understand is why they have not communicated with me. Especially after I have repeatedly told them that I have no objection to the development of the wells and only request assurances in writing that the department will provide water should a problem arise.

Therefore, I would like to request that the commission inform me of any hearing for pump installation permit whether permanent or on an emergency basis so I may be able

We received your letter of June 23, 1997, inquiring about any information on current pumpage or pump capacity at the captioned station.

According to our water use declarations files, there is only one very small user ( 1-hp pump) for domestic and irrigation purposes. Formerly, water use was being reported by HC & S; this reporting stopped in September 1995. We are trying to get current pumpage information from HC & S.

Concerning technical and regulatory matters, our records indicare that Well No. 5520-01 is a tunnel in Maliko Gulch, drilled in 1898, outfitted with a pump with the capacity of 6.7 mgd. Actual draft was about 4.6 mgd of brackish water. Withdrawal capacil)· in a tunnel is limited by the amount that flows naturally from the tunnel. If HC & S wishes to increase the tunnel or pump capacity, they would need a permit from the Commission on Warer Resource Management.

A review of our records show that Hawaiian Commercial & Sugar Co. (HC&S) has not reported any water use since July 1995. Owners and operators of wells must record and report their water use on a monthly basis under Hawaii Administrative Rules (HAR) §13-168-7:

§13-168-7 Report of water use. (a) The owner or operator of any well or stream diversion works from which water is being used shall provide and maintain an approved meter or other appropriate device or means for measuring and reporting total water usage on a monthly (calendar or work schedule) basis. If a well or stream diversion works is one of a battery of interconnected water sources, a centralized measuring device or facility may be approved by the commission.

(b) The owner or operator of any well or stream diversion works or battery of such water sources shall file a report of total water usage on a regular monthly (calendar or work schedule) basis to the commission on forms approved by the commission and provided by the department on or before the end of the month following the month for which water usage is to be reported. The reports may include other use-related information such as type of use, salinity, and water level as may be deemed appropriate and reasonable by the commission.

(c) At the discretion of the commission, requirements for measuring and reporting monthly water usage may be lessened, modified, or exempted for owners or operators of small, individual wells or stream diversion works. The lessening, modification, or exemption of such requirements shall be approved, disapproved, or otherwise decided by the commission on a case-by-case basis. [Eff. We ask that you bring our records up to date by sending us your water use records since July 1995 and that you begin monthly reporting. Failure to comply with these rules may result in penalties or fines under HAR §13-167-10:

(b) Any person who violates any provision of this title or any permit condition or limitation established pursuant to this title or who negligently or willfully fails to or refuses to comply with any final order of the commission may be subject to a fine imposed by the commission. Such fine shall not exceed $1,000 per violation. For a continuing offense, each day during which the offense is committed is a separate violation.

Attached please find a copy of letter dated 5/17/97 received from Mr. William Meyer of the U.S. Geological Survey, Water Resources Division. Regarding his reference of HC&S Pump 11 (Well #5520-01), do you have information on current pumpage of this well? If not, do you have technical information available that you could provide, such as size and pumping capacity of the existing pump? Also, would HC&S be required to submit a new or revised pump installation permit for commission approval to increase pumpage?

Our well has been in use since 1980 when we first moved to the property. In my opinion, any adverse affects due to pumpage by HC&S Pump 11 would have manifested ikself by now. At periodic times over these past few years, I have allowed DWS to monitor chloride levels of my well. Thus I do have data on chloride levels presumably while HC&S Pump 11 has been in use. DWS also conducted a complete test on the water quality of which a copy has been provided to me.

Your assistance in providing me with the above information would be greatly appreciated.

However, at this point the magnitude of the possible effect is subject to question. Salinity in your well is much more subject to pumpage at Well #5520-01 (HC&S Pump 11 ), located mauka of your property in Maliko Gulch. Evaluation of the proposed DWS pumpage on your well could possibly be made by examining the historic pumpage at Well #5520-01. Otherwise, we would suggest that a program be instituted to monitor the chloride concentration (as a measure of salinity) of water in your well. This program should be initiated before the DWS wells start pumping, and samples should be collected at periodic intervals under consistent conditions. This should allow you to document any changes in the salinity of your well that are concurrent with the onset of pumpage in the DWS wells.

We feel it is unlikely that pumpage from the wells will affect your spring. However, the fact that pesticides have been found in the spring suggest thai it is affected by local agricultural recharge. Given that pesticides have been found in the past and that it is used as for drinking supply, it would be prudent to sample the spring and your well for organic contaminants.

The Commission approved a pump installation permit for testing purposes only; the pump may not be used for production. The Commission will not act upon the application for a permanent pump until the Supplemental EIS has been accepted. The CWRM's final decision on the permanent pump installation will be based on the information available in the SEIS and data submitted to the CWRM. The County has scheduled completion of the SEIS in late January 1998, with review and acceptance by late February. Once that is complete, they may request a permit for permanent pump installation for municipal use. At this point, the County has not requested emergency use of these wells.

Box 621, Honolulu, Hl96809, shall be notified, in writing, at least two (2) weeks before any work covered by this permit commences and staff shall be allowed to inspect installation activities in accordance with § 13-168-15, Hawaii Administrative Rules.

2. The pump installation permit shall be for installation of a pump capacity- gpm capacity, or less, pump in the well.

3. The permittee shall provide and maintain an approved meter or other appropriate means for measuring and reporting withdrawals and water levels, and appropriate devices or means for measuring chlorides and temperature. These data shall be measured monthly and reported to the Commission on a monthly/an annual choose reporting period- basis, on forms provided by the Chairperson (attached).

4. The proposed use shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to pump water from a well shall not constitute a determination of correlative water rights. The permittee is notified and by this provision understands that the quantity of water taken from the well could be reduced by the Commission in the future. This permit is not a commitment that the pump capacity permitted here or even some lesser amount is guaranteed in the future.

5. The permittee shall complete and submit as-built drawings and Part II - (Permanent) Pump Installation Report of the Well Completion Report (attached) to the Chairperson within sixty (60) days after completion of work.

6. The permittee shall comply with all applicable laws, rules, and ordinances, and non-compliance may be grounds for revocation of this permit.

7. The pump installation permit application is incorporated into this permit by reference and is subject to the Hawaii Well Construction & Pump Installation Standards (1/23/97).

8. The permit may be revoked if work is not started within six (6) months after the date of approval or if work is suspended or abandoned for six (6) months, unless otherwise specified. The work proposed in the pump installation permit application sl1all be completed within two (2) years from the date of permit approval, unless otherwise specified. The permit may be extended by the Chairperson upon a showing of good cause and good-faith performance. A request to extend the permit shall be submitted to the Chairperson no later than three (3) months prior to the date the permit expires. If the commencement date is not met, the Commission may revoke the permit after giving the permittee notice of the proposed action and an opportun1ty to be heard.

9. If the well is not to be used it must be properly capped. If the well is to be abandoned then the permittee must apply for a well abandonment permit in accordance with § 13-168-12(1) prior to any well sealing or plugging work.

10. Special conditions in the attached cover transmittal letter are incorporated herein by reference.

Pursuant to your letter dated December 21, 1989, the following is submitted as additional information which you requested:

1. As indicated in my declaration of water use, my well system provides water for approximately 1/2 acre planted with various fruit trees. I also have about 1/2 acre that is in pasture which I have had to water by sprinkler system during occasional drought periods.

2. There is no county water service available to my property or nearby. Domestic use includes drinking water for single household with four people. I have a purification system of two prefilters, reverse osmosis module, and a charcoal filter to improve the quality of the water for drinking.

3. There are no other persons or households sharing my well system.
