Alle bijlagen, waaronder registratierapport deel A en deel B, vormen een onlosmakelijk
onderdeel van dit besluit.
1.1 Samenstelling, vorm en verpakking
De toelating geldt uitsluitend voor het middel in de samenstelling, vorm en de verpakking als
waarvoor de toelating is verleend.
1.2 Gebruik
Het middel mag slechts worden gebruikt volgens het wettelijk gebruiksvoorschrift, letterlijk en
zonder enige aanvulling, zoals opgenomen in deel A van het registratierapport, Appendix I.
1.3 Classificatie en etikettering
Mede gelet op de onder “wettelijke grondslag” vermelde wetsartikelen, dienen alle volgende
aanduidingen en vermeldingen conform de geldende regelgeving op of bij de verpakking te
worden vermeld:

1.4 Aflever- en opgebruiktermijn (respijtperiode)
Het nieuwe gebruiksvoorschrift en de nieuwe etikettering dienen bij de eerstvolgende aanmaak
op de verpakking te worden aangebracht. De te hanteren w-coderingen en aflever- en
opgebruiktermijnen voor oude verpakkingen staan vermeld onder “toelatingsinformatie” in
bijlage I.

3. BEOORDELINGEN 3.1 Fysische en chemische eigenschappen
De aard en de hoeveelheid van de werkzame stoffen en de in humaan-toxicologisch en
ecotoxicologisch opzicht belangrijke onzuiverheden in de werkzame stof en de hulpstoffen zijn
bepaald. De identiteit van het middel is vastgesteld. De fysische en chemische eigenschappen van het
middel zijn vastgesteld en voor juist gebruik en adequate opslag van het middel aanvaardbaar
geacht.
3.2 Analysemethoden
De geleverde analysemethoden voldoen aan de vereisten om de residuen te kunnen bepalen die
vanuit humaan-toxicologisch en ecotoxicologisch oogpunt van belang zijn, volgend uit geoorloofd
gebruik.
3.3 Risico voor de mens
Van het middel wordt voor de toegelaten toepassingen volgens de voorschriften geen
onaanvaardbaar risico voor de mens verwacht.
3.4 Risico voor het milieu
Van het middel wordt voor de toegelaten toepassingen volgens de voorschriften geen
onaanvaardbaar risico voor het milieu verwacht.
3.5 Werkzaamheid
Van het middel wordt voor de toegelaten toepassingen volgens de voorschriften verwacht dat het
werkzaam is.

Het Ctgb heeft niet de mogelijkheid van het elektronisch indienen van een bezwaarschrift
opengesteld.

PART A – Risk Management
This document describes the acceptable use conditions required for the mutual recognition of the uses in
fruiting vegetables of Solanaceae and Cucurbitaceae with edible peel of NeemAzal-T/S containing
Azadirachtin in The Netherlands. This evaluation is required subsequent to the inclusion of Azadirachtin
on Annex 1.
The risk assessment conclusions are based on the information, data and assessments provided in
Registration Report, Part B Sections 1-7 and Part C and where appropriate the addendum for The
Netherlands. The information, data and assessments provided in Registration Report, Parts B includes
assessment of further data or information as required at national registration by the EU review. It also
includes assessment of data and information relating to NeemAzal-T/S where that data has not been
considered in the EU review. Otherwise assessments for the safe use of NeemAzal-T/S have been made
using endpoints agreed in the EU review of Azadirachtin
This document describes the specific conditions of use and labelling required for The Netherlands for the
registration of NeemAzal-T/S
Appendix 1 of this document provides a copy of the proposed product label for The Netherlands.
Appendix 2 of this document contains copies of the letters of access to the protected data / third party data
that was needed for evaluation of the formulation.
Appendix 3 of this document provides a list of data in support of the evaluation.
1 Details of the application
1.1 Application background
This application was submitted by Nufarm B.V., Rivium Quadrant 75-7, LC2909 Capelle a/d IJssel
The application was for approval of NeemAzal-T/S, an EC formulation containing 10 g/L Azadirachtin A
for use as an insecticide in fruiting vegetables of Solanaceae and Cucurbitaceae with edible peel
(including seed production).
1.2 Annex I inclusion
Azadirachtin was included in Annex I of Directive 91/414/EEC on 01.06.2011 according to Commission
Implementing Directive 2011/44/EC of 13 April 2011 (OJ L100/43, 14.4.2011).
Following entry into force of Regulation (EC) No 1107/2009, having repealed Directive 91/414/EEC,
Azadirachtin has been confirmed to be approved under Regulation (EC) No 1107/2009 by Commission
Implementing Regulation (EU) No 540/2011 – Commission Implementing Regulation (EU) No 540/2011
(OJ L 153/1, 11.06.2011).
The Annex I inclusion directive for Azadirachtin (2011/44/EC) as well as Commission Implementing
Regulation (EC) No. 540/2011 provide specific provisions under Part B which need to be considered by
the application in the preparation of their submission and by the Member States prior to granting an
authorisation:

For the implementation of the uniform principles as referred to in Article 29(6) of Regulation (EC) No
1107/2009, the conclusions of the review report on azadirachtin, and in particular Appendices I and II
thereof, as finalised in the Standing Committee on the Food Chain and Animal Health on 11 March 2011
shall be taken into account.
In this overall assessment Member States shall pay particular attention to:
• the dietary exposure of consumers in view of future revisions of Maximum Residue
Levels;
• the protection of non-target arthropods and aquatic organisms. Risk mitigation measures
shall be applied where appropriate.
The Member States concerned shall request the submission of confirmatory information as regards:
• the relationship between azadirachtin A and the rest of the active components in the
neem seeds extract with respect to amount, biological activity and persistence, in order
to confirm the lead active compound approach with regard to azadirachtin A and to
confirm specification of the technical material, residue definition and groundwater risk
assessment.
The Member States concerned shall ensure that the applicant submits such information to the
Commission by 31 December 2013.
The confirmatory data will be submitted to the RMS and Commission by end of December 2013. The
other concerns have been addressed within the current submission.
1.3 Regulatory approach
To obtain approval the product NeemAzal-T/S must meet the conditions of Annex I inclusion and be
supported by dossiers satisfying the requirements of Annex II and Annex III, with an assessment to
Uniform Principles, using Annex I agreed endpoints.
This application was submitted in order to allow the first approval of these uses in The Netherlands in
accordance with the above.

3 Risk management
3.1 Reasoned statement of the overall conclusions taken in accordance with the
Uniform Principles
3.1.1 Physical and chemical properties (Part B, Section 1, Points 2 and 4)
The physical and chemical properties are already evaluated by the Ctgb for the current authorization in
the Netherlands (12455 N). No additional studies have been provided and therefore it is found to be
acceptable. The extension in-use concentrations (0.3% – 0.5%) are within the in-use concentrations (0.2%
- 1.5%) of the current authorisation and therefore the technical properties are fully covered.
3.1.2 Methods of analysis (Part B, Section 2, Point 5)
Since NeemAzal-T/S is already approved and this application concerns an application for the mutual
recognition of new uses, we refer to the original assessment. The new uses are on Solanaceae and
Cucurbitaceae with edible peel (including seed production), which are matrices with high water content
and are covered by the original authorisation.

3.1.3.2 Operator Exposure (Part B, Section 3, Point 7.3)
Operator exposure was assessed against the AOEL agreed in the EU review for azadirachtin (0.1 mg/kg
bw/day) and the dermal absorption values used were 10% for both the concentrate and the spray dilution.
Operator exposure was modelled using the NL greenhouse model.
According to the model calculations, it can be concluded that the risk for the operator using NeemAzal-
T/S on fruiting vegetables of Solanaceae and Cucurbitaceae with edible peel is acceptable without the use
of personal protective equipment (exposure is 9% of the AOEL).
3.1.3.3 Bystander Exposure (Part B, Section 3, Point 7.4)
Regarding indoor use in fruiting vegetables of solanaceae and cucurbits with edible peel, no bystander
should be present in the glasshouse. Therefore bystander exposure is not relevant for this use.
For residents living near greenhouses, the exposure is estimated using the lee side turbulence model.
Based on worst case assumptions, the exposure is not exceeding the reference value.
3.1.3.4 Worker Exposure (Part B, Section 3, Point 7.5)
Worker exposure was modelled using EUROPOEM II/Dutch model. It is concluded that there is no
unacceptable risk anticipated for the worker wearing adequate work clothing (but no PPE), when re-
entering crops treated with NeemAzal-T/S (exposure is 4% of the AOEL).

3.1.4 Residues and Consumer Exposure (Part B, Section 4, Point 8)
Please, refer to the Core assessment.
3.1.5 Environmental fate and behaviour (Part B, Section 5, Point 9)
No new studies on environmental fate and behaviour are presented for Azadirachtin A with this
submission; all data were reviewed in the EU review for Azadirachtin A. Appropriate endpoints from the
EU review were used to calculate PECs for the product NeemAzal-T/S, the lead component, i.e.
Azadirachtin A, and for its metabolite, i.e. Azadirachtin H* in soil, surface water, ground water and air
(as required) for the intended use patterns.
In case of endpoints not available or not corresponding to current requirements new endpoints had to be
used. This is the case for degradation and adsorption data for the metabolite Azadirachtin H*. New
studies (not stated in the EFSA Journal 2011) were performed after Annex I inclusion. For the metabolite
Azadirachtin H* the resulting geometric mean DT50lab of 12.3 considering 3 soils, and the Koc of 48.8
(arithmetic mean, n=3) was used for calculations. As Freundlich exponent, the arithmetic mean of 0.979
(n=3) was used for calculations.
Additionally, where the review report did not clearly indicate the endpoint value used in risk assessments
for the different compartments, reference was made to the respective DAR and/or addendum to identify
this endpoint.
3.1.5.1 Predicted Environmental Concentration in Soil (PECsoil) (Part B, Section 5, Points
9.4 and 9.5) The PEC of Azadirachtin A in soil has been assessed following FOCUS guidance and approaches, the
FOCUS groundwater interception values and the DT50 values established in the EU review. The critical
uses following GAP table are characterised by a maximum recommended use rate of 3.75 L product/ha
(corresponding to 0.0375 kg Azadirachtin A/ha) twelve times per growing season in floriculture -
greenhouse (BBCH 15 to 69). The maximum initial predicted environmental concentration in soil
(PECSoil) was calculated to be 0.230 mg Azadirachtin A/kg dry soil following use in floriculture -
greenhouse, which is acceptable according to the uniform principles. The establishment of plateau
concentrations is not regarded as relevant considering Azadirachtin A is not persistent in soil. The DT50
value used for initial PECSoil calculations is 25.0 days for Azadirachtin A (maximum value from
laboratory data, n = 6).
Azadirachtin H* is a metabolite of Azadirachtin A in soil. Hence, soil non-target organisms may be
exposed to Azadirachtin H*. Azadirachtin H* is very similar in structure to Azadirachtin A and a
structural analogue of the other active components of the extract NeemAzal. For this reason it is highly
unlikely that Azadirachtin H* acts in a different mode than Azadirachtin A or the other components. In
consequence toxicity is likely to be similar and the risk of Azadirachtin H* to soil non-target organisms
can be evaluated on the basis of available toxicity endpoints for the extract NeemAzal. Therefore, the
exposure to Azadirachtin H*can be covered by the risk assessment for Azadirachtin A and no calculations
were performed for the metabolite. This is especially true when comparing substance characteristics
relevant for fate and behavior in the terrestrial compartment: Parent as well as metabolite show low to
moderate persistence in soil and similar adsorption behavior suggesting a comparable bioavailability.
Hence, predicted environmental concentrations in soil calculated for Azadirachtin A could also be used to
assess the potential risk of Azadirachtin H*and furthermore represent a worst case situation regarding soil
concentrations since the max occurrence of Azadirachtin H*in soil was determined to be only 63% of
initial Azadirachtin A amounts
The results for PECSoil for Azadirachtin A were used for the ecotoxicological risk assessment.

The PEC of Azadirachtin A and its metabolite Azadirachtin H* in ground water has been assessed with
GEM 3.3.2 model and the Koc values established in the EU review or agreed in the assessment based on
new data provided.
The model(s) predicts that Azadirachtin A and its metabolites will not be found in ground water at
concentrations greater than 0.01 μg/L. Based on the assessment, the use of Azadirachtin A is not expected
to lead to leaching into groundwater at levels that would be unacceptable when applied according to the
recommended use pattern.
Monitoring data ground water
There are no data available regarding the presence of the substance Azadirachtin A in groundwater.
Regarding the presence of metabolite Azadirachtin H* no monitoring data are available.
3.1.5.3 Predicted Environmental Concentration in Surface Water (PECSW) (Part B, Section
5, Points 9.7 and 9.8)
The PEC of Azadirachin A in surface water (PECsw and PECsed) has been assessed with GEM 3.3.2 for
both soilless and soilbound cultivation of fruiting vegetables of Solanaceae and Cucurbitaceae with
edible peel.
For soilless cultivation, the maximum PECsw of Azadirachin A for courgette, cucumber, aubergine and
tomato is 0.1679 µg/L; the maximum PECsw of Azadirachin A for sweet pepper is 0.2409 µg/L.
For soil bound calculation, the maximum PECsw of Azadirachin A is 0.2444 µg/L (gherkin used as a
surrogate crop).
The results for PEC surface water for the active substance and its metabolites were used for the eco-
toxicological risk assessment.
Monitoring data surface water
In 2014, version 3 of the Pesticide Atlas was launched, which includes a statistical correlation analysis
between concentrations, threshold exceedance and land use, which may indicate probable relationships. In
this version also the correlation analysis of land use with the environmental quality standards (EQS) of
the Water Framework Directive (WFD) is included. Data from the Pesticide Atlas are used to evaluate
potential exceedances of the authorisation threshold and environmental quality standards (MKN in Dutch,
data source http://www.rivm.nl/rvs/Normen). These environmental quality standards consist either of the
harmonised WFD thresholds derived according to the Fraunhofer methodology (AA-EQS and MACEQS)
or of an MPC value (which is usually derived on the basis of outdated guidance). When EQS values
according to the Water Framework Directive are available, the MPC value is not used further in the
analysis of monitoring data for the purpose of the registration. For examination against the drinking water
criterion, another database (VEWIN) is used, since the drinking water criterion is only examined at
drinking water abstraction points. For the assessment of the proposed applications regarding the drinking
water criterion, see next section.
Azadirachtin A
There are no data available in the Pesticide Atlas regarding the presence of the substance azadirachtin A
in surface water.

Drinking water criterion
Article 2.10b of the Plant Protection Products and Biocides Regulations (RGB) describes the use of the
90th percentile. It follows from the decision of the Court of Appeal on Trade and Industry of 19 August
2005 (Awb 04/37 (General Administrative Law Act)) that when considering an application, the Ctgb
should, on the basis of the scientific and technical knowledge and taking into account the data submitted
with the application, also judge the application according to the drinking water criterion ‘surface water
intended for drinking water production’.
The assessment methodology followed is developed by the WG implementation drinking water criterion
and outlined in Alterra report 16359. Substances are categorised as new substances on the Dutch market
(less than 3 years authorisation) or existing substances on the Dutch market (authorised for more than 3
years).
- For new substances, a preregistration calculation is performed.
- For existing substances, the assessment is based on monitoring data of VEWIN (drinking water
board).
- If for an existing substance based on monitoring data no problems are expected by VEWIN, Ctgb
follows this VEWIN assessment.
- If for an existing substance based on monitoring data a potential problem is identified by
VEWIN, Ctgb assesses whether the 90th percentile of the monitoring data meet the drinking water
criterion at each individual drinking water abstraction point.
The active substance azadirachtin has been on the Dutch market for > 3 years (authorised since 20-05-
2003). This period is sufficiently large to consider the market share to be established. From the general
scientific knowledge collected by the Ctgb about the product and its active substance, the Ctgb concludes
that there are in this case no concrete indications for concern about the consequences of this product for
surface water from which drinking water is produced, when used in compliance with the directions for
use. The Ctgb does under this approach expect no exceeding of the drinking water criterion. The
standards for surface water destined for the production of drinking water as laid down in the RGB are
met.
3.1.5.4 Predicted Environmental Concentration in Air (PECAir) (Part B, Section 5, Point
9.9) Based on its physical properties it is not expected that Azadirachtin A shows significant volatility. At
20°C, the vapour pressure of Azadirachtin A amounts to 3.6 × 10-13 and the Henry’s law constant was
calculated to be 10-14 -10-19 Pa m3 mol-1. Considering these data, it can be concluded that the volatility of
Azadirachtin A is insignificant and an accumulation in air can be excluded. Thus, significant long-range
transport and accumulation in the stratosphere is considered unlikely.
Therefore, following GAP application of NeemAzal-T/S, Azadirachtin A is not expected to be transported
into or accumulate in the vapour phase in any relevant amounts.
3.1.6 Ecotoxicology (Part B, Section 6, Point 10)
3.1.6.1 Effects on Terrestrial Vertebrates (Part B, Section 6, Points 10.1 and 10.3)
The TER values, calculated for recommended scenarios, all exceed the trigger values of 10 for acute risk
and 5 for long-term risk, thus indicating no unacceptable risk to birds from the proposed use.

The risk assessment for fish-eating and earthworm-eating birds as well as the risk for biomagnification
can be excluded, since Azadirachtin A has a low log POW of 0.99 and thus no risk of secondary
poisoning is expected.
3.1.6.2 Effects on Aquatic Species (Part B, Section 6, Point 10.2)
The risk for aquatic organisms is acceptable for the use in courgette, cucumber, aubergine, tomato and
sweet pepper in soilless cultivation with 95% reduction of the fraction discharged.
3.1.6.3 Effects on Bees and Other Arthropod Species (Part B, Section 6, Points 10.4 and
10.5)
Bees
All the hazard quotients are considerably less than 50, indicating that the active ingredient(s) poses a low
risk to bees.
Given that azadirachtin acts as an IGR, the effects on brood development must be considered.
For the proposed use in greenhouses a restriction for all uses should be included in the instructions for
use:
To protect bees and other pollinating insects do not apply to crop plants when in flower. Do not use
where bees are actively foraging. Do not apply when flowering weeds are present. Remove weeds before
flowering. Application to flowering plants in greenhouses is allowed when no bees are actively foraging

For glasshouse uses effect to non-target arthropods is not relevant. No assessment was performed.
However, IPM should be taken into consideration for the use in greenhouses.
The effects on beneficials are more than 30% in first tier tests and more than 25% effects in higher tier
tests. Therefore, the following restriction sentence is necessary:

For glasshouse uses, management practice includes regular sterilisation of the soil, which prevents the
formation of a natural soil organism community within glasshouses. Exposure to natural soils is not
expected. Therefore no risk assessment is performed for soil organisms.

It concerns a label extension of NeemAzal-T/S (12455N) through a mutual recognition of an
authorisation in Germany.
Please refer to the Core assessment of Germany.
The product is authorized in Germany for the use in fruiting vegetables of Solanaceae and Cucurbitaceae
with edible peel. Climatological and environmental circumstances relevant for the aspect efficacy in the
claimed uses in The Netherlands are comparable to those in Germany. The cultivation method in fruiting
vegetables of Solanaceae and Cucurbitaceae with edible peel is similar in both countries and there are no
country-specific situations for the use of NeemAzal-T/S as an insecticide in the claimed uses.
For the evaluation of the aspect ‘Efficacy’ we refer to the evaluation of the member state of the original
authorisation from Germany.
Adverse effects
On the German label a warning sentence is written: Young plants may display slight phytotoxic effects on
their leaves (e.g. crinkling, curling). Therefore on the Dutch label the following sentence is added:
Bij de opkweek van vruchtgroenten kan geringe gewasschade (bv. krullen van het blad) optreden.
Possible development of resistance or cross-resistance
Besides its activity as an insect growth regulator (IGR), NeemAzal-T/S has several other modes of
action e.g. repellent activity and disruption of breathing through the (soft) exoskeleton of some
insects. Moreover, several forms of the azadirachtin (A,B,D,F,H or I; see Introduction) make up the
active substance. The risk on resistance development is therefore regarded as low.
A resistance management sentence is not necessary.

3.2 Conclusions The assessment conducted for NeemAzal-T/S was in accordance with the Uniform Principles and
demonstrates an acceptable risk to human health and the environment. An authorisation can therefore be
granted for the new uses.

conditions and restrictions associated with the authorisation

3.4 Legal instructions
As on 1st January 2018 an amendment of the Activity Decree came into force, some of the restriction
sentences that have been included on the Legal Instruction will become unnecessary or
change. Therefore the following restriction sentences will be included on the Legal Instructions:
