INTERPRETATION AND APPLICATION DÉFINITIONS ET CHAMP D’APPLICATION

Interpretation Définitions

1 In this Act,

“animal” means

(a) alpacas, cattle, donkeys, geese, goats, horses, llamas, mules, sheep, and swine,

(b) game farm animals as defined in the Game Farm Regulations made under the Wildlife Act, and

(c) any other animal set out in the regulations; « animal »

“construction” includes the constructing of access roads, driveways, curbs, ditches, sidewalks, storm sewers, illumination devices and traffic control devices, grading, gravelling, and paving; « travaux de construction »

“enforcement officer” means

(a) a member of the Royal Canadian Mounted Police, or

(b) a person or a member of a class of persons appointed by the Minister as an enforcement officer under section 3.1; « agent d’application de la loi »

“ferry” means a vessel used for the passage of vehicles as a part of a highway if operated by or for the Government of Yukon; « traversier »

“final agreement” means a land claim final agreement entered into by a Yukon First Nation, the Government of Canada and the Government of Yukon that is approved and has the force of law under An Act Approving Yukon Land Claim Final Agreements; « entente définitive »

“former Act” means the Highways Act, being chapter H-1.1 of the Statutes of Yukon, 1975 (second session) and chapter 82 of the Revised Statutes of Yukon, 1986; « ancienne loi »

“highway” means land and improvements, as more particularly described in sections 1.1 and 1.2,

(a) used as a public highway, road or street for the passage of cars, trucks and other vehicles,

(b) surveyed for use as a public highway, road or street, or

(c) declared to be a highway under paragraph 7(1)(d); « route »

“municipality” means a municipality as defined in the Municipal Act; « municipalité »

“officer” means any member of the public service employed in the administration of this Act and includes any member of the Royal Canadian Mounted Police. « fonctionnaire »

“public improvement” includes earth embankments, grade construction, earth or gravel pits, structures, ditches, drains, survey markers, dams, reservoirs, or other works required in connection with highway construction or maintenance; « amélioration publique »

“restricted use highway” means a highway prescribed for use for one or more restricted purposes; « route à usage restreint »

“right-of-way” means

(a) in the case of a highway which is shown on a plan of survey filed in the Yukon Land Titles Office, the area of land within the boundaries of the highway as shown on the plan of survey,

(b) in the case of a highway on

settlement land to which a specified access right applies, the area of land within the boundaries of the right-of-way specified in Appendix A of the relevant final agreement,

(c) in the case of a highway for which the Commissioner in Executive Council has prescribed a right-of-way or road allowance, the area of land as prescribed, and

(d) in every other case, the area of land within 30 metres of the centre line of the travelled surface of the highway; « emprise »

“self-government agreement” means an agreement for the self-government of a Yukon First Nation that has been ratified by the Government of the Yukon and implemented by an Act of the Legislature or of Parliament the purpose of which is to implement that agreement; « entente sur l'autonomie gouvernementale »

“settlement land” has the same meaning as in a final agreement; « terres visées par le règlement »

“specified access right” has the same meaning as in Appendix A of a final agreement; « droit d’accès spécifié »

“traffic control device” means any sign, signal, marking, or device placed or erected for the purpose of regulating, warning, or guiding traffic; « dispositif de signalisation »

“travelled surface” means that portion of a highway over which cars and trucks typically and actually pass including shoulders but not including pullout areas, rest areas or weigh stations; « chaussée »

“unmaintained highway” means a highway that has not, at the time in question, been designated under subsection 18(1) by the Commissioner in Executive Council; « route non entretenue »

1.1 A highway consists of 1.1 Une route comprend :

(a) the right-of-way for the highway, including but not limited to the travelled surface;

(b) any bridge, trestle, tunnel, ferry, ferry landing, pier, culvert, drainage facility or other improvement incidental to use of the land for the passage of vehicles; and

Application and exceptions Champs d’application

1.2(1) For greater certainty, the following are highways for the purposes of this Act

(a) an ice road or winter road if constructed by or for the Government of Yukon;

(b) a road on settlement land if a specified access right applies to the road under Appendix A of the relevant final agreement;

(c) a temporary highway referred to in section 10; and

(2) The following are not highways for the purposes of this Act

(a) a trail or route used primarily for purposes other than the passage of cars and trucks, except to the extent that the trail or route is within the right-of-way for a highway;

(b) a road or access route on settlement land if no specified access right is applicable to it under Appendix A of the relevant final agreement;

(c) a forest resources road as defined in the Forest Resources Regulation made under the Forest Resources Act;

(d) an area that was a highway but has been closed as a highway under section 13; and

Agreements Accords

2 The Minister may make agreements with the Government of Canada, a government of a province, or any person for the purposes of this Act. S.Y. 2002, c.108, s.2

3 The Minister may delegate the power or authority vested in the Minister under this Act to any officer subject to any conditions considered appropriate by the Minister. S.Y. 2002, c.108, s.3

Appointment of enforcement officers Nomination d’un agent d’application de la loi

3.1 The Minister may, by order, appoint persons or classes of persons as enforcement officers with responsibility for enforcing one or more of the provisions of this Act or the regulations. S.Y. 2013, c.11, s.5

4 All highways and all property acquired for highway purposes are subject to the jurisdiction, management, and control of the Minister. S.Y. 2002, c.108, s.4

Transfer of highway to municipality Compétence à l'égard des routes dévolue à une municipalité

5(1) The Commissioner in Executive Council shall transfer the jurisdiction over any highway or part thereof in the limits of a municipality, other than a highway or part thereof excepted by order, to that municipality subject to any conditions that the Commissioner in Executive Council considers appropriate.

(2) When a highway or part of a highway is transferred to a municipality pursuant to subsection (1),

(a) it vests in and is under the management and control of the municipality on and after the day set by the Commissioner in Executive Council;

(b) it is for all purposes subject to the jurisdiction of the municipality under the Municipal Act;

(c) any agreements made or permits granted by the Minister, the Government of the Yukon, or the Government of Canada in relation thereto shall continue in force as though made or granted by the municipality; and

(d) all rights, privileges, and benefits

Municipal responsibility for works Responsabilité de la municipalité

6(1) A municipality in which a highway subject to the jurisdiction, management, and control of the Minister is situated is responsible for maintaining and repairing any sidewalks, poles, sewers, waterworks, or other municipal works of a like nature constructed on, over, or under the highway by or under the authority of the municipality.

(2) When constructing a sidewalk, improvement, or service on, over, or under a highway subject to the jurisdiction, management, and control of the Minister, a municipality shall conform to any requirements or conditions established by the Minister.

(3) A municipality is liable for any damages arising as a result of the works or structures set out in subsection (1) to the same extent and in a like manner as if jurisdiction over and control and management of the highway was vested in it. S.Y. 2002, c.108, s.6

CONSTRUCTION AND MAINTENANCE CONSTRUCTION ET ENTRETIEN

Establishing and altering highways Création et modification des routes

7(1) The Minister may

(a) make highways;

(b) vary and alter existing highways;

(c) maintain highways or public improvements; and

(d) declare a highway by notice in the Yukon Gazette setting forth its direction and extent.

(2) No person shall survey, construct, or maintain a highway or public improvement except as authorized by permit from the Minister.

(3) The Commissioner in Executive Council may by order name a highway or change the name of a highway. S.Y. 2002, c.108, s.7

Removing fences and constructing ditches

Enlèvement de clôtures

8(1) If the Minister considers it necessary in the course of constructing or maintaining a highway to remove a wall or fence on land adjoining the highway or to construct a ditch or drain on land adjoining the highway, the Minister may enter onto the adjoining land and remove the wall or fence or construct the ditch or drain.

8(1) Le ministre peut, s'il le juge nécessaire pour la construction ou l'entretien d'une route, pénétrer sur un bien-fonds adjacent à la route pour y enlever un mur ou une clôture, y construire un fossé ou un drain.

(2) If a wall or fence has been removed under subsection (1), the Minister shall ensure that the removed wall or fence is replaced as soon as practicable.

11(1) The Minister shall pay to a person having an estate or interest as registered owner or life tenant in any land affected by any action taken under sections 8, 9, or 10 compensation for the use of the land and for damages in an amount agreed on by the Minister and the person having the estate or interest in the land.

(2) If the Minister and the person with the estate or interest in the land are unable to agree on the amount of compensation to be paid by the Minister within 30 days after the Minister's action under section 8, 9, or 10 was taken, any party to the dispute may refer the dispute to an arbitrator under the Arbitration Act and the decision of the arbitrator on the reference shall be final and binding.

18(1) The Minister has a duty to maintain highways designated by the Commissioner in Executive Council.

(2) If a court convicts a person of an offence under subsection (1), the court may also order the convicted person to immediately remove any obstruction, material, device, structure, work, substance, remains or thing deposited by the person on the highway.

(b) respecting restrictions on the design, class, gross axle weight, or gross vehicle weight of vehicles that may be operated on a highway or class of highways.

(2) No person shall allow any animal owned by the person or under the person's care to be on a prescribed highway unless the animal is in a person's control.

(b) the livestock control officer in possession of the animal shall sell it at public auction after posting, for at least 10 days in at least three public places in the pound district, conspicuous notices of the time and place of the auctioning of the animal.

Compensation for loss from closure of access

36(1) Subject to subsections (2) to (4), when a means of access was maintained in accordance with this Part at the time it is closed under section 35, the Government of the Yukon shall compensate each person owning an estate or interest in the adjacent land as registered owner or life tenant for the loss resulting to them for the closing of the means of access.

(a) by sale, lease, or other disposition to the owner of the land of which the closed highway originally formed part, if any, or to the owner of the land adjoining the closed highway; or

(b) by sale, lease, or other disposition to the Government of Canada or to the municipality in whose boundaries the closed highway is located.

Penalties Sanctions

42(1) A person who is convicted of an offence under section 24 is liable to a fine of up to $100,000, to imprisonment for a term not exceeding one year, or to both.

43(1) The owner of a motor vehicle that is involved in any contravention of this Act or regulations is guilty of an offence unless the owner proves to the satisfaction of the judge that at the time of the offence the motor vehicle was not being driven or was not parked or left by them or by any other person with their consent, express or implied.

44(1) The Commissioner in Executive Council may make regulations

(a) designating highways the Minister is required to maintain and prescribing maintenance standards for these highways;

(b) designating any highway or part thereof as a primary, secondary, rural, or restricted use highway;

(c) prescribing standards for primary, secondary, rural, restricted use or other class of highway;

(d) prescribing conditions for the use of restricted use highways;

(e) respecting

(i) the issuing of permits under this

(i) respecting the operation of ferries and prescribing tolls for the use of ferries;

(j) providing for and compelling the weighing of vehicles and the furnishing of satisfactory evidence of their weight, for the removal from any vehicle of a load or any portion of a load if it is found that the weight is in excess of that prescribed in the regulations, and the redistribution of the load;

(k) prescribing a right-of-way for any highway or class of highways;

(l) prescribing highways or parts thereof on which animals shall not be unattended;

(m) prescribing time periods a vehicle may be left on a highway or class of highways before being deemed abandoned;

(n) respecting the powers and duties of officers;

(n.1) defining any word or expression
