/ The Danish AgriFish Agency / Hobby Varieties and Conservation Varieties in DK2

General aim:• protecting plant genetic resources by ensuring in situ conservation and the sustainable use of plant

genetic resources

• landraces and varieties which have been traditionally grown in particular localities and regions and are

threatened by genetic erosion (conservation varieties) should be grown and marketed

• even where they do not comply with the general requirements as regards the acceptance of varieties and

the marketing of seed.

• the particular interest of preserving these varieties lies in the fact that they are especially well adapted to

particular local conditions.

How is it handled in Denmark?

• Implemented in Danish regulations since 2009

• Denmark regarded as one region

• Fees for testing of variety and control of seed production

• Restrictions as regards seed production of conservation varieties

• First application spring 2015 ”Kornby Øland”

• First variety, ”Kornby Øland”, approved spring 2016

• No official trade of seed yet

• No hobby varieties registered.

Facilitate a dialogue with NGO’s, organic producers, seed breeders and seed trade

Two main challenges:

• How to meet the need for trade of conservation varieties?

- Fees and quantitative restrictions seen as impediments

• How to exchange/trade seed for non-commercial use?

- Restrictions in EU directives and Danish regulations?

Way forward:

• EU directives aimed at commercial exploitation

• Seed for non-commercial use is considered exempted

• Nordic common region for conservation varieties

• Exchange of seed in a closed circuit, eg. conservationvarieties

• Communication and instructions on the way forward

What is meant by the term ”Aimed at commercial exploitation”?

For the purpose of agricultural and horticultural production = commercial production:

• The EU directives on the marketing of seeds have suspension in the EU 's agricultural policy, which has the following aims:

• The Lisbon Treaty , Article 39 - to increase agricultural productivity, - to ensure a fair standard of living for the agricultural community, - to stabilize markets, - to ensure security of supply, and - to ensure reasonable prices for consumers.

• We consider therefore that the directives are aimed at the marketing of seeds with a view to a commercial use in agricultural and horticultural production. This is also mentioned in the preamble of the directives.

This includes hobby varieties and conservation varieties for commercial use.

What is exempted according to the Danish practice?

/ The Danish AgriFish Agency / Hobby Varieties and Conservation Varieties in DK8

- Exchange and trade of seeds for non-commercial use, i.e. seed which is not used for agricultural and horticultural production:

- Exchange and trade of seed considered for non-commercial use

- private use (hobby gardeners), - test and trials (small amounts) and - gene banks

This includes also hobby varieties for non-commercial use.

- Species not included in the directives

- Varieties for other purpose, eg. rape seed as babyleaves

- Exchange of seed in a closed circuit
